Sargent, Chief Administrative Officer, recommending the appointment of one voting delegate and two alternate delegates to be registered with the Municipal Insurance Association of BC (MIABC) for the purpose of voting at the Annual General Meeting of Subscribers of the MIABC ( ) dated August 24, 2012, from the Office of the Premier, requesting Mayor Bachrach s confirmation to attend the BC Mayor s Caucus being held on Monday, September 17, 2012, in Vancouver, BC ( ) dated August 24, 2012, from TransCanada Yellowhead Highway Association, inviting the Town of Smithers to submit an application to host the 2014 Conference and background information ( ). Sargent, Chief Administrative Officer, recommending no items be made public from the Special (In-Camera) meeting of Council held July 24, 2012, was presented ( ). 5. PETITIONS AND DELEGATIONS None. 6. COUNCIL REPORTS 6.1. COUNCILLOR ADOMEIT ADOMEIT REPORT Councillor Adomeit advised he attended the following: a) Fall Fair Parade; and b) Camp Ganokwa graduation ceremonies. He advised Council of the upcoming 2013 Centennial Celebration public meeting being held on September 19, Council agreed to vary the agenda to bring forward Item #6.5.1 to this point in the meeting, as it was inadvertently placed under Councillor Northrup BV POOL The dated August 13, 2012, from C. Dohler, Bulkley Valley Regional Pool and Recreation Centre, presenting the following: a) Financial Statements for May and June 2012; and b) Annual General Meeting Reports and Minutes, were presented ( ). COUNCILLOR BANDSTRA BANDSTRA REPORT None COUNCILLOR BRIENESSE BRIENESSE REPORT None COUNCILLOR GOODACRE GOODACRE REPORT Councillor Goodacre advised he attended the following: a) Fall Fair Parade; b) Camp Ganokwa graduation; and c) 2013 Homecoming Fall Fair Booth COUNCILLOR NORTHRUP BV POOL See Councillor Adomeit s Report # RDBN Report dated August 16, 2012, from Councillor Northrup, providing an update on the Regional District of Bulkley Nechako's Board meeting that was held on August 16, 2012, was presented ( ) NORTHRUP REPORT Councillor Northrup advised he attended the following: a) 60th Wedding Anniversary for Slim and Mary Goodacre; b) Fall Fair Parade; and c) Fall Fair via Smithers Transit Bus COUNCILLOR WRAY WRAY REPORT Councillor Wray advised he attended the following: a) Fall Fair Parade; and b) coronation of the Smithers Rodeo Queen. He reminded Council of the upcoming 100th Anniversary of the Telkwa BBQ this weekend. Page 3 of 16

4 6.7. REPORT OF MAYOR BACHRACH MAYOR'S REPORT Mayor's Report dated August 28, 2012, was presented. Council directed Staff to request a report from the Northwest Regional Hospital District regarding the cost to the Smithers taxpayers in regard to the new Queen Charlotte City Hospital BC MAYORS' CAUCUS Bachrach/Bandstra THAT the agenda be varied to bring forward Item #14.2 to this point in the meeting. The dated August 24, 2012, from the Office of the Premier, requesting Mayor Bachrach s confirmation to attend the BC Mayor s Caucus being held on Monday, September 17, 2012, in Vancouver, BC, was presented ( ) Northrup/Adomeit THAT Council authorize Mayor Bachrach to attend the BC Mayor s Caucus being held on Monday, September 17, 2012, in Vancouver, BC; 7. STAFF REPORTS 7.1. STAFF (A) REPORTS AND THAT funding to come from the Council Contingency Budget CYCLING FRIENDLY COMMUNITY TASK FORCE Report ADM dated August 20, 2012, from S. Bassett, Director of Corporate Services, recommending appointment of five to seven individuals from the Summary of Applicants to form the Cycling Friendly Community Task Force, was presented. 5 CYCLING FRIENDLY COMMUNITY TASK FORCE CONTINUED Northrup/Adomeit THAT Council select five individuals to sit as members of the Cycling Friendly Community Task Force Goodacre/Brienesse THAT Motion # be amended, by replacing the number "five" with "seven". OPPOSED: COUNCILLORS ADOMEIT, BANDSTRA, AND NORTHRUP. The main motion, as amended, was voted on with the final wording being as follows: THAT Council select seven individuals to sit as members of the Cycling Friendly Community Task Force. OPPOSED: COUNCILLORS BANDSTRA AND NORTHRUP Goodacre/Brienesse THAT Council appoint Mayor Bachrach and Councillor Brienesse to be the Council Representatives on the Cycling Friendly Community Task Force. D. Sargent, Chief Administrative Officer, distributed to Council a "Scoring Card" that was prepared with all ten applicants, to assist Council with the selection of the seven Task Force members. She asked that each Council member score the applicants from 7 to 1 with the number 7 being ranked as their top applicant choice Northrup/Adomeit THAT the meeting be recessed for five minutes while Administration scores the ten applicants for the seven positions on the Cycling Friendly Community Task Force (8:35 p.m.). The meeting resumed (8:42 p.m.) and D. Sargent read aloud the results of Council s scoring, which are as follows: Barbara Barker, Theresa degroot, Ellen Hanson, Anne Havard, Peter Krause, Bob Mitchell, and Dave Turko. Page 5 of 16

6 CYCLING FRIENDLY COMMUNITY TASK FORCE CONTINUED Northrup/Brienesse THAT Council send a letter of thanks to all ten applicants who applied to be a member of the Cycling Friendly Community Task Force; AND THAT Council send an appointment letter to the seven selected individuals Goodacre/Wray THAT Council ratify the appointment of Barbara Barker, Theresa degroot, Ellen Hanson, Anne Havard, Peter Krause, Bob Mitchell, and Dave Turko, as members of the Cycling Friendly Community Task Force Goodacre/Brienesse THAT Council direct the Cycling Friendly Community Task Force to consult with the Measuring Up the North Committee INTERIOR HELICOPTERS LEASE Report ADM dated August 16, 2012, from S. Bassett, Director of Corporate Services, recommending the assignment of the Interior Helicopter's Lease with the Town of Smithers to "Coast to Coast Helicopters Inc.", was presented (Vault) Bandstra/Northrup THAT Council approve the assignment of the Interior Helicopter's Lease with the Town of Smithers to "Coast to Coast Helicopters Inc." COM2COM FORUM Report ADM dated August 20, 2012, from S. Bassett, Director of Corporate Services, providing objectives for the Community-to- Community Forum grant application, was presented ( ) Brienesse/Wray THAT Council select the following objectives for the Community-to- Community Forum grant application: c) Strengthening relationships and fostering future co-operative action by building stronger links between First Nation and local government elected officials and Staff; and d) Determining opportunities for future collaboration and joint action. Ford, Director of Finance, recommending approval of the Permissive Taxation Exemption request by the Bethesda Christian Association for the Sparrows Christian Housing Society property located at 3220 Third Avenue, was presented ( ) Goodacre/Bandstra THAT Council approve the Permissive Taxation Exemption request by the Bethesda Christian Association for the Sparrows Christian Housing Society property located at 3220 Third Avenue Bandstra/Goodacre THAT Motion # be deferred Bandstra/Goodacre THAT Motion # be amended, by adding the wording "until after Staff has prepared a Permissive Tax Exemptions Policy". Walker, Planner, recommending Council respond to the Regional District of Bulkley Nechako's referral as "Interests Unaffected by the Bylaw" for the proposed "Smithers Telkwa Rural Official Community Plan Amendment Bylaw No. 1645, 2012", "Regional District of Bulkley Nechako Rezoning Bylaw No. 1646, 2012", and "Regional District of Bulkley Nechako Rezoning Bylaw No. 1647, 2012", was presented ( ) Northrup/Bandstra THAT Council respond to the Regional District of Bulkley Nechako's referral as "Interests Unaffected by the Bylaw" for the proposed "Smithers Telkwa Rural Official Community Plan Amendment Bylaw No. 1645, 2012", "Regional District of Bulkley Nechako Rezoning Bylaw No. 1646, 2012", and "Regional District of Bulkley Nechako Rezoning Bylaw No. 1647, 2012". Blackburn, Airport Manager, providing information on the Airport Improvement Fee Contract, was presented ( ) CHARITABLE DONATIONS Report FIN dated August 17, 2012, from L. Ford, Director of Finance, providing information on Charitable Donations, was presented ( ) ST. JOSEPH'S SCHOOL - SHIPPING CONTAINER Report DEV dated August 16, 2012, from A. Walker, Planner, providing background information on the St. Joseph's School request to install a shipping container for storage, was presented ( ) Wray/Goodacre THAT Council vary the agenda to bring forward Item 9.3 to this point in the agenda. 9.3 The letter dated August 12, 2012, from R. McKenzie, St. Joseph's School, requesting permission to install a shipping container for storage on their land, was presented. Page 8 of 16

JOSEPH'S SCHOOL - SHIPPING CONTAINER CONTINUED Brienesse/Bandstra THAT a Committee of the Whole meeting be scheduled to deal with the issue of the use of shipping containers Goodacre/Brienesse THAT Administration send a letter to St. Joseph's School informing them that their request to install a shipping container for storage on their land does not fit into the current zoning of the property and that the use of shipping containers has been sent to a future Committee of the Whole meeting CHAMBER OF COMMERCE HVAC CONTRACT Report DEV dated August 13, 2012, from M. Allen, Director of Development Services, announcing the award of the Chamber of Commerce Heating and Ventilation Upgrades Contract to Alpine Plumbing and Heating for the amount of $6,625 excluding HST, was presented (533-20/ ) MAIN STREET REMEDIATION Report DEV dated August 20, 2012, from M. Allen, Director of Development Services, providing an update on the 1089 Main Street Remediation, was presented ( ) SOUNDING OF NOON SIREN Report FIR dated August 21, 2012, from K. Stecko, Fire Chief, providing background information on the sounding of the noon siren at both the Smithers Fire Department and the Smithers Regional Airport; and advising of the discontinuation of the siren except for during "Emergency Preparedness Week", was presented ( ) Northrup/ THAT the sounding of the noon siren at both the Smithers Fire Department and the Smithers Regional Airport be discontinued except for during "Emergency Preparedness Week". 10 SOUNDING OF NOON SIREN CONTINUED Goodacre/Adomeit THAT Council seek the Public's input on the practice of sounding the siren and until then continue to sound the noon hour siren at both the Fire Department and the Smithers Regional Airport. OPPOSED: COUNCILLORS ADOMEIT, DEFEATED. BANDSTRA, BRIENESSE, GOODACRE, NORTHRUP, WRAY, AND MAYOR BACHRACH Bandstra/Wray THAT Council continue the practice of sounding of the noon siren at both the Smithers Fire Department and the Smithers Regional Airport. OPPOSED: COUNCILLOR NORTHRUP. 8. BYLAWS BYLAW 1699 Adomeit/Wray THAT "Bylaw No Highway Naming" (Ambleside), be adopted. OPPOSED: COUNCILLOR BANDSTRA. 8.2 BYLAW 1700 Public Opportunity Mayor Bachrach opened the Public Opportunity to Speak for "Bylaw No Highway Closure and Dedication Removal (Portion of Sixteenth Avenue in Plan 9678, and the Un-named Road in Plan 9176-I, Section 30, Township 4, Range 5, Coast District)" [Ambleside] at 9:47 p.m. There were no written submissions received. Mayor Bachrach called three times for submissions from the gallery to "Bylaw No Highway Closure and Dedication Removal (Portion of Sixteenth Avenue in Plan 9678, and the Un-named Road in Plan 9176-I, Section 30, Township 4, Range 5, Coast District)" [Ambleside], and, hearing none, closed the Public Opportunity to Speak at 9:48 p.m Brienesse/Northrup THAT "Bylaw No Highway Closure and Dedication Removal (Portion of Sixteenth Avenue in Plan 9678, and the Un-named Road in Plan 9176-I, Section 30, Township 4, Range 5, Coast District)" [Ambleside], be adopted. McEvoy, Federal Electoral Boundaries Commission for British Columbia, requesting feedback on the new Federal Electoral Districts in British Columbia Map, was presented ( ). 9.2 PLANT SALE 2013 The letter dated August 9, 2012, from the Bulkley Valley Genealogical Society requesting the use of Goat Statue Park for the Annual Perennial Plant Sale being held May 25, 2013, was presented ( ) Brienesse/Wray THAT Council approve the Bulkley Valley Genealogical Society request to use the Goat Statue Park for the Annual Perennial Plant Sale being held May 25, ST. JOSEPH'S SCHOOL See Item BC HYDRO BEAUTIFICATION PROJECTS The letter dated August 7, 2012, from R. Robertson, BC Hydro, seeking submissions for the Electric Beautification Projects, was presented (400-30). 9.5 FARMERS' MARKET The letter dated August 14, 2012, from K. Hooker, Bulkley Valley Farmers' Market Association, requesting the removal of cement barriers at the Central Park building parking lot, was presented ( ) Brienesse/Goodacre THAT Council approve the Bulkley Valley Farmers' Market Association's request to remove the cement barriers at the Central Park building parking lot. OPPOSED: COUNCILLORS ADOMEIT, DEFEATED. BANDSTRA, BRIENESSE, GOODACRE, NORTHRUP, WRAY, AND MAYOR BACHRACH. Page 11 of 16

12 FARMERS' MARKET CONTINUED Adomeit/Northrup THAT Council direct the Director of Works and Operations to work with the Bulkley Valley Farmers' Market Association to rearrange the cement barriers at the Central Park building parking lot in a way that will be a benefit to the Farmers Market, while maintaining the safety of the area for all users. 9.6 FAIR GROUNDS ROAD Letter dated August 20, 2012, from L. Heer, Bulkley Valley Agricultural and Industrial Association, requesting a road at the Fair Grounds be named "Tomayer Trail" after Anita Tomayer; and if approved that Council unveil the road sign at the September 22, 2012, Volunteer BBQ, was presented ( ) Goodacre/Bandstra THAT Council approve naming the second road, running behind the office and outdoor arena, at the Fair Grounds to "Tomayer Trail" after Anita Tomayer. 9.7 COFI The invitation received August 21, 2012, from the Council of Forest Industries, inviting Mayor and Council to attend the 2012 Prince George Community Dinner being held on Thursday, September 20, 2012 in Prince George, was presented [ ]. 9.8 NATIONAL ENERGY STRATEGY The dated August 15, 2012, from L. Bleiler, Band Together BC, requesting Council's endorsement of Tides Canada's "Statement of Support for a National Energy Strategy", was presented ( ) Brienesse/Goodacre THAT Council send a letter of endorsement of Tides Canada's "Statement of Support for a National Energy Strategy". OTHER/NEW BUSINESS 15.1 Councillor Wray stated that the allocated crossing time for the pedestrian crosswalk signal at the corner of Main Street and Highway 16 is too fast for individuals with mobility issues or small children to cross in time Wray/Brienesse THAT Council send a letter to the Ministry of Transportation to request that the allocated pedestrian crosswalk signal times be increased at all Highway 16 crossings Councillor Northrup recognized the work of L. van Baal and the Staff in the Works and Operations Department for a great job of the community flower gardens and for keeping the community beautiful this summer season. Councillor Northrup requested a status update on the South Trunk Storm Sewer Project. D. Sargent replied that it is nearing substantial completion. Councillor Northrup brought to Council's attention the sink hole located at the new pavement patch work at Seventh and Morice. W. Taekema, Director of Works and Operations, replied that he is aware of the said sink hole and will be contacting BC Hydro to confirm if it is related to their project. 16. PUBLIC QUESTION PERIOD 16.1 B. Garner informed Council that the noon hour siren has been sounding since he moved to Smithers in K. Hooker thanked Council for working on a solution to the cement barriers at the Farmers' Market. K. Hooker asked if Council had considered installing a "Loading Area for Cargo Vehicles" in front of the Terminal Building at the Smithers Regional Airport. R. Blackburn, Airport Manager, replied that people are encouraged to unload cargo in the parking lot area to lower the risk of pedestrians crossing the road in front of the Terminal Building. NOTICE OF SPECIAL (IN-CAMERA) MEETING(S) OF COUNCIL PURSUANT TO SECTION 92 OF THE COMMUNITY CHARTER Bachrach/Brienesse THAT, pursuant to Section 92 of the Community Charter, Council gives notice and exercises its authority and excludes the media and the public, except for municipal staff, from the Special (In-Camera) meeting being held Tuesday, September 11, 2012, at 6:00 p.m., to deal with matters falling under Section 90, Subsection 1 and/or 2 of the Community Charter. 18.
