1 MINUTES REGULAR COUNCIL MEETING City of Cranbrook Minutes of the Regular Council Meeting held on Monday, May 26, 2014 at 4:00 p.m., in the Council Chamber, 40-10th Avenue South, Cranbrook, BC. Chernove, Airport Manager Media Mayor Stetski called the Regular Council Meeting to Order at 4:00 p.m. (1) CLOSED MEETING CLOSED MEETING THAT in accordance with Section 90 of the Community Charter the Regular Council Meeting of Monday, May 26, 2014, commencing at 4:00 p.m. is to be closed on the basis that the subject matters relate to Sections 90(1 )(a), 90(1 )(b), 90(1 )(c) and 90(1 )U), specifically personal information about an identifiable individual who holds or is being considered for a position as an officer, employee or agent of the municipality or another position appointed by the municipality; personal information about an identifiable individual May 26, 2014 (Regular)

2 who is being considered for a municipal award or honour; or who has offered to provide a gift to the municipality on condition of anonymity; labour relations or other employee relations; and information that is prohibited, or information that if it were presented in a document would be prohibited, from disclosure under section 21 of the Freedom of Information and Protection of Privacy Act; RECONVENE INVOCATION Mayor Stetski reconvened the Regular Council meeting in Council Chambers at 6:01 p.m. Grant McDowell, Cranbrook Alliance Church (2) ADOPTION OF AGENDA REGULAR MTG MAY 26/14 Mayor Stetski noted the following changes to the agenda: Item (9.2) Report Recommendation from Engineering Services re: Environment and Utilities Committee 15 Year Asset Management Plan Recommendation to be withdrawn from the agenda. Item (12.8) Correspondence from Lourdes Roxas-Butalid, President Filipino Canadian Association of the East Kootenay dated May 22, 2014 re: 116 th Philippine Independence Day Funding Request THAT the Agenda of the Regular Council Meeting of Monday, May 26,2014 be adopted as amended. 3 SPECIAL MEETING MAY 14/14 Moved by Councillor Warner and seconded THAT the Minutes of the Special Council Meeting of Wednesday, May 14, 2014 be adopted. RECESS Mayor Stetski recessed the meeting at 6: 03 p.m. (4) PUBLIC HEARING BYL #3797 City of Cranbrook Official Community Plan Amendment Bylaw No. 3797, 2014 See Public Hearing Minutes BYL#3798 City of Cranbrook Zoning Amendment Bylaw No. 3798, 2014 See Public Hearing Minutes BYL#3800 City of Cranbrook Zoning Amendment Bylaw No. 3800, 2014 See Public Hearing Minutes RECONVENE Mayor Stetski reconvened the meeting at 6: 09 p.m. (5) DELEGATIONS DELEGATIONS Moved by Councillor Warner and seconded THAT the Cranbrook Heritage Association be heard as a delegation regarding the Water & Electrical Building. Mayor Stetski welcomed the delegation to the meeting. Karen Crawford, President of Cranbrook Heritage Association, and Anna Majkowski, Member, provided Council with: An overview of the association's contributions to protecting Cranbrook' s heritage brief history of the small brick Water & Electrical Building 3 May26,2014(Regu~0

4 Fundraising effort for the stabilization of the Water & Electrical Building The representatives of the Cranbrook Heritage Association advised that they would have a sheer wall engineer's report to be given to the Mayor in the coming week. Further, the Association asked Council to rescind the demolition order placed on the Water & Electrical building, and to move a motion that will guarantee both the future of the stabilization effort and of the building itself. Members of Council had general questions and comments for the delegation. Councillor Warner indicated that he may bring forward a motion to rescind the demolition order at a subsequent meeting of Council. Mayor Stetski thanked the delegation for the presentation. (6) BYLAWS BYL #3795 Moved by Councillor Whetham and seconded THAT Council adopt "Multi-Use Recreation Trail Bylaw No. 3795, 2014"; and further, that Council direct Administration to proceed with enforcement of this bylaw on a complaint basis. BYL #3798 Moved by Councillor Davis and seconded THAT Council adopt "City of Cranbrook Zoning Amendment Bylaw No. 3798, 2014." BYL # THAT Council give third reading to "City of Cranbrook Zoning Amendment Bylaw No. 3800, 2014." BYL # THAT Council adopt "City of Cranbrook Zoning Amendment Bylaw No. 3800, 2014." (7) BUSINESS ARISING RDEK & REC SERVICES Moved by Councillor Whetham and seconded THAT Council receive the report recommendation from the Finances and Computer Services Department titled "Invitation to RDEK re: Recreation Services; and further, that Council direct staff to submit to the RDEK Board an invitation to meet with Mayor and Council to enter into discussions regarding establishing a joint Recreation Commission or Committee under Part 5, Division 4 of the Community Charter to oversee the goals and operations of the community's recreational services in order to best serve the interests of the residents of both the City of Cranbrook and Rural Area C. 5 May 26, 2014 (Regular)

6 (8) NEW BUSINESS UNAUDITED SCHEDULES THAT Council receive the Report Recommendation from the Finances and Computer Services Department titled " Unaudited Complementary Schedules"; and further, that Council receive and approve the unaudited complementary schedules produced in accordance with the Financial Information Act; And further, that the Mayor and Director of Finance and Computer Services be authorized to execute the "Statement of Financial Information Approval." COFFEE WITH THE MAYOR THAT Council receive the Report Recommendation titled "Coffee with the Mayor May 3, 2014" for information. Moved by Councillor Whetham and seconded BROWN BAG LUNCH APR 30/ THAT Council receive the Report Recommendation titled "Mayor's Brown Bag Lunch - April 30, 2014" for information. COMM. D.P BAKER LANE THAT Council approve an application for a Downtown Commercial Development Permit to enable renovations for an existing commercial building located on property legally described as Lots 29, 30, and Parcel A (see ) of Lot 31, Block 86, Plan 669, District Lot 5, Kootenay District (PIDs ; & respectively), consistent with the application and plans submitted. 6 May 26, 2014 (Regular)

7 (9) COMMITTEE RECOMMENDATIONS ENV. & UTIL COMM. APR 30/14 REC THAT Council receive the Report Recommendation from the Engineering Services Department titled "Environment and Utilities Committee Recommendations April 30, 2014 Meeting"; and further, that Council approve the following recommendations from the Environment and Utilities Committee: THAT the Environment and Utilities Committee invite a delegation from the Ministry of Forests, Lands, and Natural Resources Operations to come and speak to Council; THAT the delegation from the Ministry of Forests, Lands, and Natural Resources Operations be heard at a Special Council Meeting. Carried Unanimously (10) ADMINISTRATION UPDATES ADMIN UPDATES W. Staudt reviewed the Administration Updates dated May 26, 2014 regarding: 2 nd Street South Update; Airport First Quarter Report; Council Contingency; National Health and Fitness Day-June 7, 2014; Pitch In Week; Super Trustee Awards, and Library's 2013 Annual Report to the Community. T. Chernove, Managing Director, Elevate Airports Inc. presented a Tri-Annual Update PowerPoint to Council, which reviewed the following: Rebranding and new website; Online flight schedule; YXC Advantage; Passenger statistics update; Events at the airports. 8 THAT Council receive the Administration Updates dated May 26, (11) PETITIONS Nil (12) CORRESPONDENCE ACTION ITEMS CBK DANCE CONNECTION THAT Council receive the correspondence from Randy Tapp, Cranbrook Dance Connection received May 12, 2014 regarding Dancing in the Park 2014; and further, that Council approve a donation in the amount of $500 to the Cranbrook Dance Connection for the rental costs of the Rotary Bandstand for five Saturday evenings in August, including grants for performers for the series, source of funds Council Contingency. ACCESS AWARENESS DAY THAT Council receive the correspondence from Lorraine Copas, Executive Director, SPARC BC dated May 5, 2014; and further, that Mayor and Council proclaim the day of June as Access Awareness Day. 8 May26,2014(Regu~0

9 FILIPINO FUNDING REQUEST Moved by Councillor Davis and seconded THAT Council receive the correspondence from Lourdes Roxas-Butalid, President Filipino Canadian Association of the East Kootenay dated May 22, 2014 regarding the 11Sth Philippine Independence Day Funding Request; and further, that Council approve a donation in the amount of $ to the Filipino Canadian Association of the East Kootenay, source of funds Council Contingency. TRAIL UPDATE THAT Council receive the correspondence from Deborah Apps, President & CEO, Trans Canada Trail, received May 7, 2014 regarding Trans Canada Trail Progress Update, AND FURTHER, MED. MERIHUANA FACILITY CLASS. THAT Council receive the correspondence from Coralee Oakes, Ministry of Community Sport and Cultural Development, received May 13, 2014 regarding Medical Marihuana Production Facilities classification, AND FURTHER, MISS BC CONTRIBUTION THAT Council receive the correspondence from Christina Smith, Miss BC Program Director, Courage Productions Inc, received, May 14, 2014 regarding Miss BC Contribution Request. 9 May 26, 2014 (Regular)

10 (13) MAYOR AND COUNCILLORS - REPORTS & INQUIRIES MTGS/FUNCTIONS COUNCIL MBRS Mayor and Council advised of their attendance at various meetings and events including: Clean-up at Lake Koocanusa; City's Volunteer Dinner; Chamber of Commerce's events; Welcoming Committee for Prospective Doctor; St. Mary's Band Strategic Planning Celebration; Youth Arts Exhibition; Pride BBQ; Heavy Duty Project at Public Works; East Kootenay Performing Arts Festival; Southwest Canada Chamber Music Festival; Aspire Dance performance; Elizabeth Lake Turtle Day; Rotary Trail Connector meeting; Deer Translocation meeting; Creston Blossom Festival Parade; Collaboration of Service Clubs Workshop.
