Representations from the Public Council received a letter from John Dean of 6281 Hwy 27 North, objecting to the rezoning for environmental, noise, safety and property value reasons. 41 Agenda Item # 4.2 OFFICE OF ADMINISTRATION Date: February 21, 2011 Memo to: From: Subject: Mayor and Council Kevin Crook, CAO Election Bylaw Amendment PURPOSE/ISSUE To discuss the merits of the different options for voter registration. BACKGROUND Council directed that administration prepare a report on the merits of different options for voter registration, following a report read at the meeting of February Provincial Voters List This list is made available by the province and is based on the most recent list of eligible provincial voters. Advance registration to add to the list is also permitted, but would be closed off 52 days before voting day. I would not recommend this for use in Fort St. James because the provincial list does not take into account municipal boundaries, and so makes determination of residency more difficult. 2. Create Our Own Voters List The municipality can take the provincial list as a base, and modify it to include or exclude voters based on their residency or other reasons. The list can also be modified by voluntary registration up to 52 days before the election. This can be fairly demanding of staff time and voter engagement. This would not be an accurate way of measuring population, as only 30 to 60 per cent of eligible people will register, and not every resident is eligible to vote. 3. Voting Day Registration Only This is the municipality s current practice. In my opinion, it is the easiest method for both the public and for staff. Both of the other options require some or all voters to come to the office to pre-register to vote, and then to come back again to vote on voting day. It is also the most accurate way to allow currently eligible voters to vote, as there is no cut off of registration 52 days before the election as there is with the above options. (Voters are only required to have lived in Fort St. James for 30 days prior to registration). RECOMMENDATION THAT Council receive this report and not amend the elections bylaw. 43 Agenda Item # 4.2 DISTRICT OF FORT ST. JAMES BYLAW NO. 771, 2002 A Bylaw to provide for the determination of various procedures for the conduct of local government elections and other voting. Under the Local Government Act, the Council may, by bylaw, determine various procedures and requirements to be applied in the conduct of local government elections and other voting. Council wishes to establish various procedures and requirements under that authority. The Council of the District of Fort St. James, in open meeting assembled, enacts as follows: 1. Voting Day Registration Only (a) (b) As authorized under section 54 of the Local Government Act, at each election or other voting, electors who wish to vote at such elections or other voting are required to register at the time of voting. Registration as an elector under paragraph (a) is effective only for the election or other voting for which the voting is being conducted at the time. 2. Mail Ballot Voting As authorized under Section 100 of the Local Government Act, for the purpose of enabling an elector who is unable to vote at another voting opportunity due to physical disability, illness or injury, voting shall be permitted by mail ballot. 3. Required Advance Voting Opportunity For the purpose of enabling an elector who is unable to vote on the regular polling day, advance polls shall be held at the District Office 10 days and 3 days before general voting day between the hours of 8:00 am and 8:00 pm. 4. Determination of Results in Case of a Recount As authorized under Section 141 of the Local Government Act, if at the completion of a judicial recount the results of an election cannot be declared because there is an equality of valid votes for 2 or more candidates the results will be determined by lot in accordance with Section 141 of the Local Government Act. "District of Fort St. James Election Bylaw No. 702, 1999" is hereby repealed. 7. This bylaw may be cited for all purposes as the "District of Fort St. James Elections Bylaw No. 771, 2002".
