1 2012 ELECTORAL AREA O (LOWER NORTH THOMPSON) BY-ELECTION TO: Individuals Seeking Candidacy DATE: September 10, 2012 FROM: SUBJECT: Liz Cornwell, Chief Election Officer Candidate s Guide and Nomination Package Thank you for your interest in local government and the Thompson-Nicola Regional District. Due to the passing of Electoral Area O (Lower North Thompson) Director CruzelleMyram, a by-election must be held to fulfill the remainder of the three-year term for this position, officially beginning on Thursday, December 6, 2012, and ending in The purpose of this memo, as well as the Candidate s Guide and Nomination Package, is to provide you with information on local government, the nomination process, and key dates and procedures that must happen between now and the election, in accordance with the Local Government Act. Attached to this memo is a summary of key dates. It is the candidate s responsibility to adhere to and meet all required filing dates throughout the election process. The Thompson-Nicola Regional District Board of Directors is made up of twenty-five (25) Directors representing ten (10) electoral areas and the eleven (11) member municipalities within the regional district. Based on the allocation of population within the different electoral areas and member municipalities, there are five (5) Directors in total representing the City of Kamloops. Attached to this memo are a map outlining the electoral areas, member municipalities and communities within the TNRD; and a map of Electoral Area O (Lower North Thompson). As an electoral area director, you should be aware that carrying out your duties can be very time consuming. Typically, as an electoral area director you will be expected to attend annually (in addition to attending meetings in your electoral area): 22 board of directors regular meetings (normally held twice a month, on Thursdays, at 1:15 pm) 2 board workshops 2 hospital board meetings (at least) 2 meetings (at least) for each standing or select committee appointed to External committee meetings if appointed 1 out of town board meeting and volunteer recognition dinner Other meetings as they arise Who may hold elected office A person is qualified to be nominated to run for electoral area director if they meet the following requirements; are at least 18 years old on voting day; are a Canadian citizen; have lived in British Columbia for at least 6 months;
2 September 10, 2012 Page 2 of 3 Subject: 2012 By-Election Candidate s Guide and Nomination Package have not been disqualified by this Act or any other enactment from voting in an election or from being nominated for, being elected to or holding the office, or be otherwise disqualified by law. Who are disqualified from holding elected office The following persons are disqualified from being nominated for, being elected to or holding office as an electoral area director (not an exhaustive list): a person who is a judge of the Court of Appeal, Supreme Court or Provincial Court; a person who is disqualified under section 67 as an employee of the regional district, except as authorized under that section; a person who is disqualified under section 67 as an employee of a member municipality except as authorized under that section; a person convicted of an election office, such as vote buying, intimidation, obtaining ballots or voting when not entitled to do so; a person who is prohibited from holding elected office (including a person serving a sentence for an indictable offence); Nomination Period Nominations for electoral area director must be filed with the Chief Election Officer at the TNRD Administration Office (Kamloops) from 9:00 a.m., Tuesday, October 2, 2012 to 4:00 p.m., Friday, October 12, Nomination documents may be delivered by hand, mail, courier, to election@tnrd.ca, or other service delivery or facsimile. Originals for or facsimile filing must be received by the Chief Election Officer by 4:00 p.m. on Friday, October 19, If the original nomination documents are not received by the Chief Election Officer by the deadline, the person being nominated is deemed to have withdrawn from being a candidate for election. Remember, it is your responsibility to ensure all your nomination documents are submitted on time, complete and accurate. In accordance to Thompson-Nicola Regional District Election Procedure Bylaw No. 2056, as amended by Bylaw No. 2365: nomination documents will be available for public inspection on the Thompson-Nicola Regional District s website from time of filing until 30 days after the declaration of election results; and campaign financial disclosure statements (and supplementary statements) will be available for public inspection on the Thompson-Nicola Regional District s website from time of filing until 7 years after the local government election. Who May Nominate To run as a candidate for electoral area director, a person must be nominated by 2 people who are qualified to vote either as resident or non-resident property electors in the electoral area where you are seeking election.
3 September 10, 2012 Page 3 of 3 Subject: 2012 By-Election Candidate s Guide and Nomination Package A qualified elector is a person who meets ALL of the following qualifications on the day they register to vote: is age 18 or older, or will be on general voting day (November 17, 2012); is a Canadian citizen; has been a resident of British Columbia for at least six months immediately before the day the nomination paper is completed; has been a resident of the Electoral Area of the Thompson-Nicola Regional District for at least 30 days immediately before registration (for resident elector) OR the registered owner of real property in the Electoral Area of the Thompson-Nicola Regional District for at least 30 days immediately before registration (for non-resident property electors); has not been disqualified by law from voting. Nominees Nominees for electoral area director are not required to be residents or non-resident property owners in the electoral area for which they are being nominated. Withdrawing If you decide to withdraw from being a candidate, you must deliver a signed withdrawal statement to the Chief Election Officer no later than 4:00 p.m. on October 19, If you decide to withdraw after that date, you must deliver a signed withdrawal statement to the Chief Election Officer and receive the approval of the minister responsible for local government affairs.
