Proposed Pesticide Use Control Bylaw No. 4377, 2004, Amendment Bylaw No. 4966, 2018 and Good Neighbour Bylaw No. 4380, 2004, Amendment Bylaw No. 4965, 2018 (File: ) Bylaws are passed by a simple majority affirmative vote unless otherwise noted. Presentation to be provided. THAT 1. Proposed Pesticide Use Control Bylaw No. 4377, 2004, Amendment Bylaw No. 4966, 2018 be read a first, second and third time; and 2. Proposed Good Neighbour Bylaw No. 4380, 2004, Amendment Bylaw No. 4965, 2018 be read a first, second and third time. 7. Banking Resolution for Royal Bank of Canada (File: ) THAT 1. As described in the report dated January 8, 2018 regarding banking resolution, the Royal Bank of Canada ( Royal Bank ) be and is appointed banker for The Corporation of the District of West Vancouver ( District ); and 2. Any two of the Mayor, Chief Administrative Officer, Director, Financial Services, Financial Controller, Manager, Financial Planning, or Manager, Financial Accounting & Reporting are authorized on behalf of the District, from time to time: (a) to withdraw or order transfers of funds from the District s accounts by any means including the making, drawing, accepting, endorsing or signing of cheques, promissory notes, bills of exchange, other orders for the payment of money or other instruments or the giving of other instructions; (b) to sign any agreements or other documents or instruments with or in favour of Royal Bank relating to products or services provided by Royal Bank to the District; (c) to do, or to authorize any person or persons to do, any one or more of the following: i. to receive from Royal Bank any cash or any securities, instruments or other property of the District held by Royal Bank, whether for safekeeping or as security, or to give instructions to Royal Bank for the delivery or other transfer of any such cash, securities, instruments or other property to any person named in those instructions; ii. to deposit with or negotiate or transfer to Royal Bank, for the credit of the District, cash or any security, instrument or other property, and for those purposes to endorse (by rubber stamp or otherwise) the name of the District, or any other name under which the District carries on business, on any security or instrument; v2 A-4
5 iii. to instruct Royal Bank, by any means, to debit the accounts of third parties for deposit to the credit of the District; iv. to receive statements, instruments and other items (including paid cheques) and documents relating to the District s accounts with or any service of Royal Bank, and to settle and certify the District s accounts with Royal Bank; and (d) the Royal Bank is authorized and directed to honour, pay, and charge to the account of the District any and all cheques signed and completed using electronic cheque printing software and electronic signature reproduction of the signatures of the staff occupying the positions named above, and which are kept on file at the Royal Bank as signatures authorizing District transactions. 8. Notice of Motion regarding New Municipal Tax Classes (File: ) Notice of the proposed motion was given at the February 5, 2018 Council meeting. As notice of the proposed motion has been given, the motion may be considered at the February 19, 2018 meeting, after it has been moved and seconded. WHEREAS many municipalities in BC are facing a very significant and welldocumented housing affordability issue with property prices significantly higher than local residents ability to pay and in many cases the highest average housing prices in the country; AND WHEREAS currently, municipalities have only nine tax classes that can be used to set property taxes to achieve municipal goals: Class 1 - Residential; Class 2 - Utilities; Class 3 - Supportive Housing; Class 4 - Major Industry; Class 5 - Light Industry; Class 6 - Business Other; Class 7 - Managed Forest Land; Class 8 - Recreational Property, Non-Profit Organization; and Class 9 Farm; and while there have been minor amendments, the basic structure of this property tax class system has not been substantially amended since the 1980s; AND WHEREAS with the creation of new tax classes each municipality could set different tax rates for each class based on their individual needs and circumstances. As an example, different residential classes could be created to address vacant houses, non-resident ownership, etc.; THEREFORE BE IT RESOLVED THAT the provincial government amend the Community Charter to allow municipalities to create additional tax classes so they can each accomplish their own community goals v2 A-5
6 THAT Council s resolution regarding New Municipal Tax Classes be submitted to the Lower Mainland Local Government Association for consideration at its convention in May Heritage Protection in West Vancouver (File: HAC1.2018) (This item was formerly listed as Item 11.1) Presentation to be provided. THAT 1. A Heritage Advisory Committee be established as an advisory body to Council and the Director of Planning and Development Services; 2. The proposed Terms of Reference for the Committee be approved; 3. The properties identified in the District of West Vancouver Heritage Inventories be added to the District of West Vancouver Heritage Register, and that, 4. Proposed Building Bylaw No. 4400, 2004, Amendment Bylaw No. 4970, 2018 be read a first, second and third time Parcel Tax Roll Review Panel (File: ) THAT the March 29, 2018 sitting of the Parcel Tax Roll Review Panel be rescheduled to: March 22, 2018 at 9 a.m. in the Main Floor Conference Room South, Municipal Hall. BYLAWS Bylaws are passed by a simple majority affirmative vote unless otherwise noted. 9. Proposed Road Closure and Removal of Highway Dedication Bylaw No. 4957, 2017 at Rodgers Creek Lot 37 (File: ) The proposed bylaw received first reading at the December 11, 2017 Council meeting, and was revised and second and third reading at the January 22, 2018 Council meeting. Approval of the revised bylaw by the Ministry of Transportation and Infrastructure (required pursuant to section 41(3) of the Community Charter) was received on January 22, THAT proposed Road Closure and Removal of Highway Dedication Bylaw No. 4957, 2017 be adopted v2 A-6
7 10. New Business (File: ) If new business items are added to the agenda at the time of agenda approval, the new items will be added to this section. CONSENT AGENDA ITEMS Items listed in the Consent Agenda are considered for approval in one motion, unless a member of Council wishes to debate an item and requests that it be excluded. If an item is excluded from the Consent Agenda it will be considered as an agenda item. The rule of order establishing a Consent Agenda provides that consent agenda items may be considered in total and without debate or amendment. 11. Consent Agenda Items The following Consent Agenda items may be considered for approval in one motion, or considered separately, or items may be excluded for debate. Item 11.1 (Heritage Protection in West Vancouver) has been moved to Item 8.1. THAT 1. Item 11.2 regarding Economic Development Plan be excluded from the Consent Agenda for debate; and that 2.
