1 District of Metchosin Minutes Council Meeting Closed Portion 6 P.M. July 15, 2013 at 7 P.M. Following the Parks Committee Council Chamber Metchosin Municipal Hall Present: Regrets: Mayor Ranns in the Chair; Councillors Milne, Mitchell and Tremblay. Also present were J. Martignago, Chief Administrative Officer, and T. Van Swieten, Recording Secretary Councillor Gramigna Closed Portion, Exclusion of the Public Moved and Seconded by Councillors Milne and Mitchell that the public be excluded under section 90 of the Community Charter in order to consider: (b) personal information about an identifiable individual who is being considered for a municipal award or honour, or who has offered to provide a gift to the municipality on condition of anonymity; (f) law enforcement, if the council considers that disclosure could reasonably be expected to harm the conduct of an investigation under or enforcement of an enactment. The closed portion of the meeting was adjourned at 6:50p.m. The open portion of the meeting was called to order at7:20p.m. 1. Agenda, Additions and Approval Moved and Seconded by Councillors Tremblay and Milne to approve the agenda with the addition of receipt of Finance & Environment Committee meeting of June 3, 2013, Highways Committee meeting of May 13, 2013 and Parks Committee meeting of June 17, 2013, and Environmental Advisory Committee meeting of May 28, Presentations a) Royal Roads University Agricultural Survey Dan Spinner, Chief Executive Officer, West Shore Chamber of Commerce introduced Lisa Makar and Jeff Townsend, both MBA students and researchers at Royal Roads University, and gave a brief description of the project they are planning Metchosin. Ms. Makar and Mr. Townsend spoke to Council about their research projects: A feasible study of integrative options to increase the long term viability of independent community farms The Metchosin Farm Study Can farmland near urban centers continue to resist the increasing pressures from nearby developing communities. Moved and Seconded by Councillors Mitchell and Milne to approve the agricultural survey by

2 District of Metchosin July 15, 2013 Royal Roads University students, Ms. Makar and Mr. Twonsend and provide support as necessary. 3. Public Participation Gail Dalzell, property owner, commented on the statutory appointment of the Fire Chief as Acting/Chief Administrative Officer. Ms. Dalzell also stated no wild fire interface is mentioned in the Tree Management Amendment Bylaw and questioned inconsistencies with the bylaw. Ms. Dalzell also stated she felt the $10,000 fine in the bylaw was too high. Brent Donaldson, resident, stated that the Tree Management Bylaw should have more public input and awareness before the bylaw gets changed. Tom Cole, resident, commented that the public should be notified before the Tree Management Bylaw gets changed. Mr. Cole stated that there is no old growth left on Southern Vancouver Island. Wendy Ramsay, resident, stated she was very disappointed staff did not call her to tell her the Tree Management Bylaw was on the agenda, as was promised. Ms. Ramsay asked how many Council members objected to the fines in the Tree Management Bylaw. Ms. Ramsay stated that fines are necessary to keep ordinance and if there had been stiffer fines, past tree cutting offences could have been prevented. Ms. Ramsay agrees there should be more public awareness of the changes to this bylaw. Ms. Ramsay appreciates the informative mail outs that the District sends out. Ms. Ramsay commented on other forms of penalties for tree cutting offences. Ken Farquharson, resident, speaking on behalf of APRM, feels that the concept that was introduced in the early drafts of the Tree Management Bylaw are forest management plans for larger lots were valuable for this community and there could be a lot of merit in encouraging the larger land owners to move towards a suburban woodland approach and is disappointed that this is not written in the bylaw at this time. Gail Dalzell, property owner stated before a change like this is made in the Tree Management Bylaw, notices should go out to residents, and feels the fines are ridiculous. Tom Cole, resident asked if he could still remove ten trees per acre per year that is in the Tree Cutting Bylaw. Doug Stevenson, resident supports the changes and fines to the Tree Management Bylaw and questioned if the wording of how the trees are taken down will be addressed. 4. Adoption of Minutes Moved and Seconded by Councillors Milne and Mitchell that Council approve the minutes of the Council meeting held on June 17, 2013 and the minutes of the Special Council meeting held June 28, 2013.

3 District of Metchosin July 15, Receipt of Minutes Moved and Seconded by Councillors Tremblay and Milne that Council receive the minutes of the Parks Committee meeting held on June 17, Moved and Seconded by Councillors Milne and Mitchell that Council receive the minutes of the Finance and Environment Committee meeting held on June 3, Moved and Seconded by Councillors Mitchell and Tremblay that Council receive the minutes of the Highways Committee meeting held on May 13, Moved and Seconded by Councillors Mitchell and Tremblay that Council receive the minutes of the Environmental Advisory Committee meeting held on May 28, Business Arising a) Parks Committee Recommendations, July 7, 2013 District of Metchosin Subdivision Servicing Amendment Bylaw No. 600 Moved and Seconded by Councillors Tremblay and Mitchell recommend that Council refer the Subdivision Servicing Amendment Bylaw No. 600 back to staff to bring forward further amendments. SU Subdivision Policy, Roadside Trails and Utilities Moved and Seconded by Councillors Tremblay and Mitchell that Council defer SU Subdivision Policy, Roadside Trails and Utilities to the next Council meeting. b) 2013 Roads Resurfacing Program Brookview and Malloch Moved and seconded by Councillors Mitchell and Milne that Council accept the low bid tender received from O.K. Industries Ltd. dba Island Asphalt Company in the amount of $72, Mayors Report Mayor Ranns spoke on the statutory appointments, introducing Tammie Van Swieten as the new Deputy Corporate Officer, taking over for Lisa Urlacher. Mayor Ranns thanked Joe Martignago for his years of services to the District, and explained his employment with the District now being once a week to help with Public Works and provide advice to the new Chief Administrative Officer, Lisa Urlacher.

4 District of Metchosin July 15, Reports for Action a) Annual General Meeting 2013 Annual Report Staff presentation Sam Weller provided information as to the following: Where the money comes from What does Metchosin own What does Metchosin owe others Municipal taxes per house Debt per capita Reserves per capital Public Input Gail Dalzell, property owner questioned Council s 30% raise and why expenses for each Council member seem to be imbalanced. Tom Cole, resident questioned per diem expenses when Council members attend conferences and meetings. Mr. Cole also thanked Sam Weller for a well put together presentation. b) Statutory Appointments Moved and Seconded by Councillors Milne and Mitchell that Council appoint Lisa Urlacher as Interim Chief Administrative Officer (CAO) and Chief Financial Officer of the District of Metchosin and rescind the appointment of Joe Martignago as CAO, Deputy Corporate Officer and Financial Officer effective July 22, And that Council appoint Tammie Van Swieten as Deputy Corporate Officer and Allison Swanson as Deputy Financial Officer. And that Council appoint Stephanie Dunlop as Acting Chief Administrative Officer and rescind Lisa Urlacher as Acting Chief Administrative Officer. And that Council appoint Lisa Urlacher to replace Joe Martignago as bank signing authority for the District of Metchosin effective July 22, And that Council rescind the appointment of Joe Martignago as ICBC signing authority. c) Agreements to Dedicate Land Kangaroo Road Construction Moved and Seconded by Councillors Mitchell and Milne that Council authorize the Mayor and Chief Administrative Officer to execute the agreements as presented: Catherine Rose Hay Norman Russell Norby Lisa Carolyn Gee Eric Bruce McDowall Eileen Margaret Withaar 9. 5 District of Metchosin July 15, 2013 a) Public Communications Monthly Report, May 2013 b) Building Permit Monthly Report, May 2013 c) RCMP Monthly Policing Report May 2013 Moved and Seconded by Councillors Milne and Mitchell that Council receive the Public Communications Monthly Report, June 2013 and the Building Permit Monthly Report, June 2013, and the RCMP Monthly Policing Report, May Bylaws a) Tree Management Amendment Bylaw, No. 597 Consider Amendment and 3 rd reading Council discussed the fines being a deterrent for tree cutting offenses and gives staff leeway for enforcement. Moved and Seconded by Councillors Milne and Tremblay that Council amend Tree Management Amendment Bylaw, No 597, Section 24. Penalty (2) by replacing the period with a comma at the end of the sentence and adding with a maximum of $100,000 per offence. Moved and Seconded by Councillors Milne and Tremblay that Council give third reading to Tree Management Amendment Bylaw, No 597. b) Ticket Information Authorization Amendment Bylaw, No. 601 Consider 3 rd reading Moved and Seconded by Councillors Milne and Mitchell that Council give third reading to Ticket Information Authorization Amendment Bylaw, No Correspondence 12.
