4 Minutes - Ninetieth Meeting MINUTES NINETIETH MEETING OF THE FIFTH COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF SOUTH DUNDAS The Ninetieth Meeting of the Fifth Council of the Corporation of the Municipality of South Dundas was held in the Council Chambers at 1:00 p.m., Monday, January 20, Present: Mayor Byvelds Deputy Mayor Locke Councillors Delegarde, Graham, Mellan CAO McDonald Clerk Brunt Manager of Planning & Enforcement and By-Law Enforcement Officers The main intent of this special meeting was to discuss and review a draft Traffic By-law. CALL TO ORDER DECLARATION OF PECUNIARY INTEREST & THE GENERAL NATURE THEREOF Nil COUNCIL/DEPARTMENTAL/COMMITTEE REPORTS 1. Traffic By-Law Council reviewed the draft by-law and discussed areas of concern. Planning and Enforcement Manager Lewis will seek input from the BIA, Chamber of Commerce and the Iroquois Business Group. The draft by-law will also be placed on the website for public input. PUBLIC MEETINGS Resolution No Moved by Councillor Graham Seconded by Deputy Mayor Locke THAT the Public Meeting to consider four zoning by-law amendments be opened at 7:03 p.m Crowder Road The Manager of Planning & Enforcement explained that the farmland at West Part Lot 19, East Part Lot 20, Concession 2 of the former geographic Township of Williamsburg, located at Crowder Road is currently zoned Agriculture (A) and was subject to a consent application which resulted in the severance of a surplus dwelling from vacant farm parcel comprising the bulk of the property. The purpose of this Zoning By-law amendment is to fulfill a condition of approval of the aforementioned consent application wherein no new permanent residential uses are to be allowed on the vacant farm parcel. The applicants were not present and the Manager of Planning and Enforcement did not receive any verbal or written correspondence. Council did not have any concerns County Road 28 The Manager of Planning & Enforcement explained that the farmland at South Part Lots 23 and 24, Concession 3 of the former geographic Township of Williamsburg, located at County Road 28 is currently zoned Agriculture (A) and was subject to a consent application which resulted in the severance of a surplus dwelling from vacant farm parcel comprising the bulk of the property. The purpose of this Zoning By-law amendment is to fulfill a condition of approval of the aforementioned consent application wherein no new permanent residential uses are to be allowed on the vacant farm parcel. The zoning is being changed by rezoning the retained parcel from Agricultural (A) and Agricultural Special Exception 29 (A-29) to Agricultural Special Exception 8 (A-8). Council did not have any concerns Flagg Road The Manager of Planning & Enforcement explained that the land at Part Lot 6, Concession 1 of the former geographic Township of Matilda, located at 5589 Flagg Road is currently zoned Residential Waterfront (RW) and was subject to a consent application which resulted in the severance of a vacant parcel from the front half of the lot. The purpose of this Zoning By-law amendment is to fulfill a condition of approval of the aforementioned consent application wherein the retained parcel does not meet the minimum lot frontage required in the Residential Waterfront zone. The zoning is being changed on the retained parcel currently zoned Residential Waterfront (RW) by reducing the required minimum lot frontage of the RW Zone from 38 meters to 11 meters. The zoning on the severed parcel is not being changed; it will remain zoned as Residential Waterfront (RW). The applicants were not present and the Manager of Planning and Enforcement did not receive any verbal or written correspondence. Council had a few questions concerning driveways, frontage and M2 Zone across the road, but were satisfied with the information provided to them by the Manager of Planning and Enforcement Norgaard Road The Manager of Planning & Enforcement explained that the farmland at Part Lots 3 and 4, Concession 4 of the former geographic Township of Page 6 of 36

The purpose of this Zoning By-law amendment is to fulfill a condition of approval of the aforementioned consent application wherein no new permanent residential uses are to be allowed on the severed parcel. The zoning is being changed by rezoning the severed parcel from Agricultural (A) to Agricultural Special Exception 8 (A-8). The Manager of Planning and Enforcement did not receive any verbal or written correspondence. Council did not have any concerns. Miss Wright provided a presentation on the process for selection and the functions for her participation. Council wished Miss Wright the best of luck!! COUNCIL/DEPARTMENTAL/COMMITTEE REPORTS 1. Economic Development Officer Report EDO Iroquois Visitor Information Centre Service for 2014 Resolution No Moved by Deputy Mayor Locke Seconded by Councillor Graham THAT the Council of the Municipality of South Dundas receive Report EDT regarding the Iroquois Visitor Information Centre Service for 2014 and provide direction to Staff. 2. Treasurer A) United Counties of SD & G - installment dates Resolution No Moved by Councillor Graham Seconded by Deputy Mayor Locke THAT the Council of the Municipality of South Dundas support By-Law No of the United Counties of Stormont, Dundas & Glengarry to change the instalment dates for payment of annual general or special upper-tier levies. B) Report TR Municipal Finance Internship Program Resolution No Moved by Deputy Mayor Locke Seconded by Councillor Graham THAT the Council of the Municipality of South Dundas accept Report No. TR and authorize Staff to prepare an application to the Municipal Finance Internship Program for 2014, and further acknowledge that the Municipality of South Dundas is prepared to enter into a conditional grant agreement with MFOA governing the use of the grant as per the terms and conditions outlined in the Municipal Finance Internship Program grant application guidelines if the subject application is approved. AND THAT this application will be in partnership with the Township of North Dundas. C) Clerk Report CLK Holiday Closure Resolution No Moved by Councillor Mellan Seconded by Councillor Delegarde THAT the Council of the Municipality of South Dundas accept Report CLK and approve Option No. 2 regarding holiday closure. AND THAT a masonry veneer will be on the exterior finish. B) Report CAO South Dundas Community Playground Committee $ for $ Funding Request This report was deferred to a future meeting. Summary received and clarification on projects discussed. 2. County Road 1/Carman Road Deputy Mayor Locke requested Council s consideration to assume part of County Road 1/Carman Road from the Broken Second Road intersection to the St. Lawrence Seaway Management property, as a municipal roadway. Council requested the Manager of Public Works provide a report on the pros and cons of such an acquisition. BY-LAWS 1. 36 By-Law Enforcement Officer Appointment THE CORPORATION OF THE MUNICIPALITY OF SOUTH DUNDAS BY-LAW NO A BY-LAW to appoint a Municipal By-Law Enforcement Officer. WHEREAS the Police Services Act, R.S.O. 1990, Chapter P.15, Section 15(1) authorizes a municipal council to appoint persons to enforce the bylaws of the municipality; AND WHEREAS the Municipal Act, 2001, S.O. 2001, Part XIV Enforcement - governs the authority of municipalities to enforce by-laws; AND WHEREAS it is deemed expedient to appoint a By-law Enforcement Officer; NOW THEREFORE the Council of the Corporation of the Municipality of South Dundas enacts as follows: 1. That Brent A. Mattice be and is hereby appointed as a By-Law Enforcement Officer with the authority to enforce all by-laws in the Municipality of South Dundas. 2.
