14 Morrisburg Waterfront Committee - Minutes for December 16, 2015 Minutes of Waterfront Committee Meeting Dec 16th, 2015 Present: Brian Veinotte, Marc St Pierre, Keith Robinson, Mike Thompson, Jean-Louis Tanguay, Evonne Delegarde Absent: Carmelo Scaini Order of business: 1. Minutes of November 25 th meeting modified as per Jean-Louis request and approved. Submitted to Brenda Brunt for posting on South Dundas website. 2. Brian welcomed our newest member, Andy Lee. 3. During the review of our committee responsibilities Jean-Louis asked if something could be done about a by-law from the village of Morrisburg (by-law 1776) regarding motorized equipment on the parkland. It was stressed that this is not the responsibility of our committee; it should be brought to the attention of township council or staff. Evonne indicated she would pursue this further on Jean-Louis behalf. 4. There was a discussion regarding the benefits of relocation of the ball diamond. Jean- Louis tabled documents from the Ministry of Culture and Recreation regarding standards for the building new ball diamonds. He emphasized that proper guidelines had to be followed. Evonne stated that township staff were aware of guidelines and would follow these guidelines. As an alternative to immediately constructing a new lighted ball diamond as per Phase I Concept Plan, the existing ball diamond near the Sir J. Morris Walk could be utilized with minor upgrades. A round-table discussion followed and various recommendations were proposed. Andy questioned the need for a new ball diamond since the Williamsburg Park appeared to be the hub for baseball, Riverside Heights had a ball park, and Iroquois had just recently removed their ball diamond. Cost estimates for the relocation and building of the new ball diamond were reviewed and it was felt that an engineering cost study should be done. Ultimately it was decided that before proceeding with this engineering cost study, Andy and Ben Macpherson should get statistics on usage of the existing Morrisburg ball parks. 5. Brian gave an update of the pathway lighting. Shannon Geraghty informed Brian that the lights are back-ordered and expected delivery is February 2016 however the Page 14 of 28

15 Morrisburg Waterfront Committee - Minutes for December 16, 2015 concrete bases would be going in soon and would be ready for the lights to be mounted when they arrived. Brian also indicated that we have $48,000 approved for engineering costs and a request for 2016 budget approval of another $48,000 was being submitted. Brian tabled information on the use of brick engraving as a means of fund raising. All agreed that this was an excellent idea and would be pursued in the near future. 6. Brian and Marc will be working on the submission to council to match dollar for dollar the $25,000 contribution from the Morrisburg Lions Club. 7. Jean-Louis reported that Wendy Graham was willing to give an overview of the Waterfront project at some point in the future. Since we are focused on year end submissions it was decided to defer this to a later date. 8. Members also requested that information about the Committee and our Concept Plan should be easier to find on the South Dundas website. Mayor Delegarde promised to look after that request. 9. It was decided that all future meeting would be held on the third Wednesday of each month at 7:00 pm 10. This Zoning By-law Amendment is needed to fulfill a condition of approval of the aforementioned consent application wherein both the severed and retained lot does not conform to the minimum lot area of 3,035 metres squared. The zoning is being changed from Residential Waterfront (RW) to Residential Waterfront Special Exception 14 (RW-14) to reduce the required minimum lot area to 1,850 square metres. This Zoning By-law Amendment is not related to any Minor Variance, Official Plan Amendment or Plan of Subdivision. 22 07-Zoning Amendment County Road 4/Lakeshore Drive MUNICIPALITY OF SOUTH DUNDAS Planning & Enforcement Department Report Explanatory Note To: From: Mayor & Council Donald JW Lewis, Manager of Planning & Enforcement Date: February 2, 2016 Subject: 07-Zoning Amendment County Road 4-Lakeshore Drive Recommendation: That By-Law No , being a By-law to amend By Law No , be read and passed in open Council, signed and sealed. Background: The Municipality has received a request to amend the current zoning from "Residential waterfront (RW)" subject to a Consent application which resulted in the property being divided into two equally sized lots. The purpose of this Zoning By-Law amendment is to fulfill one of our Municipal conditions wherein both the severed and retained lot does not conform to the minimum lot area of 3055 metres squared. Since the property is undersized, the landowner was requested to provide a Hydrogeological Study and Terrain Evaluation Analysis be prepared by a Professional Consulting Engineer with disciplines in Geotechnical, Environmental and Hydrogeology. The purpose is to ensure that the existing infrastructure (septic system, potable well water, etc.) will serve the existing and proposed single detached dwellings. The Zoning is being changed from Residential Waterfront (RW) to Residential Waterfront Special Exception 14 (RW-14). Please refer to key map depicting area affected. Page 22 of 28

23 07-Zoning Amendment County Road 4/Lakeshore Drive THE CORPORATION OF THE MUNICIPALITY OF SOUTH DUNDAS BY-LAW NO A By-law to amend By-Law No WHEREAS By-law No regulates the use of land and the use and erection of buildings and structures; AND WHEREAS the Municipality of South Dundas deems it advisable to amend By-Law No as hereinafter set forth; NOW THEREFORE the Council of the Corporation of the Municipality of South Dundas enacts as follows: 1. The area affected by this By-law is indicated by the shaded tone on Schedule A attached hereto and forming part of this By-law. 2. By-Law No is hereby amended as follows: i) Schedule 9 of By-Law No is hereby amended in accordance with Schedule A attached hereto; ii) The area shown on Schedule A to this By-law shall henceforth be zoned Residential Waterfront Special Exception 14 (RW-14). 3. Section 5.8 (3) is hereby amended by inserting the following after RW- 13: RW-14 (Pt. Lot 6, Concession 1, Part 1, 2, 3, 4 and 5 on Plan 8R- 2589) Matilda. Notwithstanding the provisions of Section 5.8 (2) (b) to the contrary, for the lands zoned RW-14, the minimum lot area shall be 1,850 square metres. 4. 25 08-Interim Tax Rate MUNICIPALITY OF SOUTH DUNDAS Treasury Department Report Explanatory Note To: From: Mayor & Council Shannon Geraghty, CAO/Treasurer Date: February 2, 2016 Subject: 08-Interm Tax Rate Recommendation: That By-Law No , being a By-law to authorize an interim tax levy for 2016, be read and passed in open Council, signed and sealed. Background: A By-law under Section 317 (1) of the Municipal Act is required to be passed in the year that the amounts are to be levied. The interim tax rates are calculated in order to meet the financial obligations of the municipality until the final 2016 budget and taxes are set. Due to the phase in assessments the interim tax rates are calculated using notional tax rates which is comprised of using the 2015 approved budget amount against the 2016 Assessments. These rates along with the 2015b Counties and Education rates are calculated at 50% for an interim tax rate for each property class. The interim tax bill is an estimate to raise approximately 50% of property taxes. When the budget for the Municipality of South Dundas has been approved and the final tax rates calculated, along with the Counties and Province of Ontario Education rates, the final tax bills will be issued. The amount of this interim bill will be deducted from the final tax bill for each property. Page 25 of 28

26 THE CORPORATION OF THE MUNICIPALITY OF SOUTH DUNDAS BY-LAW NO A BY-LAW to authorize an interim tax levy for the year Interim Tax Rate WHEREAS the Municipal Act, 2001, provides that a local municipality, before the adoption of the estimates for the year, may pass a by-law levying amounts on the assessment of property in the local municipality rateable for local municipality purposes; AND WHEREAS the Council of the Municipality of South Dundas deems it necessary to levy an interim tax rate to meet the financial obligations of the municipality until the final 2016 budget and tax levies are set; NOW THEREFORE the Council of the Corporation of the Municipality of South Dundas enacts as follows: 1. That the Treasurer is hereby authorized to bill and collect the tax levies set at 50% of the 2015 tax rates using the 2016 assessment roll. 2. The calculation used in this By-Law may exceed 50% of the 2015 taxes for each assessed property due to the phase-in of new assessment totals for all classes. 3. In the event that a property owner has exceeded the 50% compared to their total taxes from 2015 the owner may pay up to the maximum and the remaining balance will be transferred to the final bill without any penalty. 4. The interim levy will be the amount produced by applying 50% of the estimated notional tax rate for the class to the assessment value as per the last revised assessment rolls. The estimated notional rate for the class is the rate at which the 2015 level of taxes would be raised for the class when applied to the total assessment value for that class as per the last revised assessment rolls. 5. That the said interim tax levies shall become due and payable on the 31 st day of March, That all taxes on the interim levy, which are in default on the first day of the month following, a penalty of 1.25% shall be added, and thereafter a penalty of 1.25% per month will be added on the first working day of each and every month the default continues, until December 31, Notwithstanding Section 4, owners enrolled and in good standing in the preauthorized payment plan, no discount shall be allowed on prepayments and no penalty shall be charged on current levies. WHEREAS the Municipal Act, 2001, as amended, provides that the powers of the Corporation of the Municipality of South Dundas, shall be exercised by By-law; AND WHEREAS in many cases, action which is taken or authorized to be taken by the Municipality of South Dundas does not lend itself to the passage of an individual By-law; NOW THEREFORE the Council of the Corporation of the Municipality of South Dundas hereby enacts as follows: 1. THAT the Minutes of the meetings held on January 12 and 19, 2016 and In Camera Meetings on January 12 and 19, 2016 of the Municipality of South Dundas, be and the same are hereby adopted. 2. THAT the actions of the Municipality of South Dundas, at its meeting held on February 2, 2016, in respect of which recommendations contained in the reports of the committees considered at each meeting and in respect of each motion, resolution and other action taken by the Municipality of South Dundas at its meeting are, except where the prior approval of the Ontario Municipal Board or other authority is required by law, hereby adopted, ratified and confirmed as if all such proceedings were expressly embodied in this By-law. 3. THAT where no individual By-law has been or is passed with respect to the taking of any action authorized in or by the above-mentioned minutes or with respect to the exercise of any powers by the Municipality of South Dundas in the above-mentioned minutes, then this By-law shall be deemed for all purposes to be the By-law required for approving and authorizing and taking of any action authorized therein and thereby or required for the exercise of any powers therein by the Municipality of South Dundas. 4. THAT the Mayor and Members of Council of the Municipality of South Dundas are hereby authorized and directed to do all things necessary to give effect to the said action of the Municipality of South Dundas to obtain approvals where required and accept otherwise provided, the Mayor or Clerk are hereby directed to execute all documents necessary on behalf of the Municipality of South Dundas.
