1 The Corporation of the Township of North Kawartha Minutes Regular Meeting held on May 3, 2016 at the North Kawartha Council Chambers 280 Burleigh Street, Apsley, ON Regular Session Members Present: Mayor Richard B. Disclosure of Pecuniary Interest The Mayor reminded members of Council of their obligation to declare any pecuniary interest they may have. None. Adoption of the Agenda Moved by - Councillor Amyotte

Adoption of Minutes: Regular Minutes That the minutes of the regular meeting of Council held on April 18, 2016 be adopted, as presented. Deputations/Presentations Presentation of Long Standing Service Award Mayor Woodcock presented Nicole Cannon-Haycock, Receptionist / Secretary for the Township with a certificate in recognition of five years of dedicated service to North Kawartha. Nicole was commended for her accomplishments. Warden Jones and Gary King J. Murray Jones, County Warden and Gary King, Chief Administrative Officer attended the meeting to present the 2015 Accomplishments and 2016 Projects, Priorities and Budget. There was an opportunity for questions from Council with respect to the County Official Plan and Growth Plan. Special Meetings of Council for Visioning Moved by - Councillor Amyotte Seconded by - Councillor O'Shea That Special Meetings of Council be scheduled, for the purpose of Visioning Sessions, to be held at Wilson Park Community Centre, on Friday, May 6, 2016 and Tuesday, May 31, 2016 from 9:30 a.m. to approximately, 12:30 p.m. HST on Land Fees for Applications to Purchase Municipal Shoreline / Unopened Road Allowances Seconded by - Councillor Amyotte That by-laws be adopted at the end of the meeting to amend the fee collected for the

3 Regular Meeting Page 3 of 10 purchase of municipal unopened and shoreline road allowances within the Township. Parks and Recreation Fees and Rates Review That notice be given that Council will consider a fee revision and increase for Parks and Recreation rental rates and Fitness Centre fees listed in By-Law at the regular meeting scheduled for June 7, New Recycling Initiative Seconded by - Deputy Mayor Hutton That the Township of North Kawartha does not enter into a recycling program with Terracycle for coffee and tea dics/capsules such as Tassimo and/or Keurig. County of Peterborough Report No report. Crowe Valley Conservation Authority Report That the Crowe Valley Conservation Authority Report from Councillor O Shea be received as presented. Reports from Boards and Committees North Kawartha Library Board That Council receives the North Kawartha Library Board minutes for the meeting held on April 26, Public Hearing Zoning By-Law Amendments

4 Regular Meeting Page 4 of 10 Moved by Deputy Mayor Hutton Seconded by Councillor O'Shea That Council go into public hearing for the proposed zoning by-law amendment applications. Application #ZA (Lean) Travis Toms identified the lands and the purpose and effect and provided photographs for viewing. There were questions from Council for clarification. Lew Lean, applicant, was present to speak in favour of the application and utilized a drawing to explain the application and identify the challenges on the property. He advised Council of the efforts that have been made to move the building back as far as possible from the lake. No one was present to oppose the application Moved by Deputy Mayor Hutton That Council approves Zone Amendment Application #ZA (Lean), as circulated. Application #ZA (Trachsler) Travis Toms identified the lands and the purpose and effect and provided photographs for viewing. There were questions from Council for clarification. John, Caroline and Paul Trachsler were present in support of the application. John Trachsler provided an explanation for the amendment advising that they would like to have a recreational building in compliance with the building code. No one was present to speak against the application Moved by Councillor O'Shea Seconded by - Councillor Amyotte That Council approves Zone Amendment Application #ZA (Trachsler), as circulated. Application #ZA (Porter) Travis Toms identified the lands and the purpose and effect and advised that Crowe Valley Conservation Authority has no concerns with the application. Terry Post, representing the owner, was present to speak in support and advised that within

5 Regular Meeting Page 5 of 10 two years the owner will apply for a building permit to build a home. No one was present to speak in opposition Moved by Councillor Amyotte Seconded by - Deputy Mayor Hutton That Council approve Zone Amendment Application #ZA (Porter), as circulated. Application #ZA (Watts) Travis Toms advised that the application was deferred from a meeting in January, 2016 for the owner to reconsider the configuration, setbacks and site plan control. Kevin M. Duguay has been engaged by the owners and has reported in support of the application and responded to the concerns identified at the January meeting. Mr. Toms identified the lands and the purpose and effect and advised that at this time no further comments have been received. Council asked about the potential for visual impact and questioned the relevancy of the various policy sections that are included in the Planning Report prepared by Mr. Duguay. Kevin Duguay explained that he has relied on surveys, staff reports and a site visit as part of his preparation. It is his professional opinion that the policies referenced in the Report are relevant and that the application has merit and represents good planning. He presented his report. Mr. Watts indicated that he is agreeable to moving the Bunkie back beyond the cottage. Mr. Toms confirmed that the Bunkie is being moved back much farther but will be visible from the lake. Mr. Toms indicated that based upon advice from the County this development is not significant enough to trigger an Environmental Impact Study. No comments have been received from the Park. Drew Ridpath, Architectural Design, explained that the reason for the walkout basement is to raise the floor level to the existing driveway level. A drawing of the front elevation of the building was provided to Council for viewing. Lee Minty was present in support of the application and advised that the development will improve upon the property and present an opportunity for the Lake. Jim Whelan was present to support the application and referenced page 632 of the Official Plan to support that the structure legally exists and can be replaced in accordance with the provisions of the Official Plan and Zoning By-law. Ambrose Moran provided his own drawing to Council and advised that he has no problem with locating the building at the 30 ft. setback. If approved, the building will end up closer to

6 Regular Meeting Page 6 of 10 the lake than the drawing indicates as he thinks the drawing shows the building at a 30 ft. setback. As the building was built on public lands, he feels it does not have a legal nonconforming status. The owner is entitled to build on the footprint but he thinks the 30 ft. setback has to be maintained. Jim Whelan spoke in support commenting that there are 280 cottages on Anstruther Lake and the water quality is AA. The amendment is site specific. Cottages on the lake were built on the 66 ft. allowance and became legal non-conforming. Mr. Jenkins confirmed that the drawings are copy write drawings and people can t change them on their own. He confirmed that the setback is accurate, where shown and is taken from a computer drawing done by Elliot and Parr Moved by Councillor Amyotte That Council approve Zone Amendment Application #ZA (Watts), as circulated. Recorded vote: Councillor Amyotte Yes, Councillor O Shea Yes, Counciilor Miszuk - Yes, Deputy Mayor Hutton No, Mayor Woodcock No Out of Public Hearing Moved by Deputy Mayor Hutton Seconded by Councillor Amyotte That the public hearing be closed. Recess Mayor Woodcock called for a recess at 11:16 a.m. Council reconvened at 11:25 a.m. Presentation from County of Peterborough Moved by - Councillor Amyotte Seconded by - Councillor O'Shea That Council receives the presentation from the County Warden and Chief Administrative Officer. Township of South Frontenac Renewable Procurement Initiatives That Council supports the resolution from the Township of South Frontenac with respect to large Renewable Procurement Initiatives. Declaration of Pecuniary Interest Councillor Amyotte stated: I declare a pecuniary interest on correspondence item C6 i) as we build docks. Councillor Amyotte did not participate in discussion. Township of Douro-Dummer Notice of Open House Concerning a Proposed Zoning By-Law Amendment for In-Water Boathouses Seconded by - Councillor O'Shea That Council authorizes mileage for Deputy Mayor Hutton to attend the Douro-Dummer Open House scheduled for May 5, 2016 in Warsaw.
