1 CITY OF ORILLIA COUNCIL MINUTES MINUTES OF THE REGULAR MEETING OF COUNCIL, MONDAY, SEPTEMBER 29, 2008 AT 8:06 P.M. FOLLOWING THE SPECIAL MEETING RE TAX APPEALS Present: Mayor R. Presentation Nature of Interest - Councillor Spears is a member of the Couchiching Golf and Country Club. Councillor Spears declined to discuss the matter or to vote on its disposition. Councillor Cipolla introduced Elizabeth Riley, CEO of Orillia Soldiers' Memorial Hospital. The Mayor was presented with a Dave Beckett numbered print as a token of appreciation for the City's support. The print was commissioned to celebrate the hospital s centennial anniversary. City of Owen Sound - re requesting endorsation of its resolution regarding the exemption of sales tax for Ontario Police Service purchases. File: C10-GEN (Motion) 2. City of Owen Sound - re requesting endorsation of its resolution regarding a full exemption of Provincial sales tax on goods and services be provided to all Ontario municipalities similar to the G.S.T. exemption. File: C10-GEN (Motion) 3. Town of Milton - re requesting endorsation of its resolution regarding a deposit/ return system on aluminum and plastic drink containers. File: C10-GEN (Motion) 4. Orillia Power Corporation - re correspondence to the Editor of the Packet and Times regarding electricity prices. File: C12-OPC (Motion) a) Letter dated September 17, 2008 to the Orillia Power Corporation. b) Letter dated September 23, 2008 from the Orillia Power Corporation.

File: A01-OADD (Motion) Moved by Fecht, seconded by Cipolla, that Council endorse the resolution of the City of Owen Sound regarding the exemption of sales tax for Ontario Police Service purchases; AND THAT copies of this resolution and the City of Owen Sound's resolution be forwarded to the following: Honourable Dalton McGuinty, Premier of Ontario Honourable Dwight Duncan, Minister of Finance Ontario Association of Chiefs of Police Garfield Dunlop, Simcoe North, M.P.P. That the following resolution be passed: "THAT, pursuant to the request of the Orillia District Chamber of Commerce, dated October 18, 2007, Centennial Drive be closed to vehicular traffic from the Couchiching Beach Park entrance to Front Street from 7:00 a.m. to 4:00 p.m. on Sunday, November 23, 2008 as well as the parking lot adjacent to Couchiching Beach Park (between Jarvis Street and Centennial Drive), to facilitate the marshaling of the Santa Claus Parade, provided that a six metre right-of-way is maintained to comply with fire and safety regulations; AND THAT the barriers be removed immediately following the parade;

5 AND THAT the Santa Claus Parade awards be presented at the Council Committee meeting on November 24, Public Works Department - re request for noise by-law exemption in connection with the Mississaga Street/Peter Street signalization construction. File:T06-GEN Recommendation: That the following resolution be passed: "THAT, further to a memo dated September 26, 2008 from the Public Works Department, Guild Electric be exempt from Chapter Noise, of the City of Orillia Municipal Code with respect to the reconstruction of the signalization at the intersection of Mississaga Street and Peter Street." Moved by Lauer, seconded by Fogarty, that Council adopt the recommendations as set out on the Consent Agenda for the Regular Meeting of Council on September 29, 2008, including Item No. 10. as set out in the Addendum, with the exception of the recommendation(s) with respect to Correspondence Item(s) 4., 8. and 8.a) which shall be introduced separately. Carried Moved by Spears, seconded by Fecht, that the recommendation with respect to Correspondence Item 4. on the Consent Agenda for the regular meeting of Council on September 29, 2008, read as follows: THAT the Council of the City of Orillia resolves: 1. To encourage Orillia residents: a) as restaurants and caterers in both private and City operations, to highlight the support for and availability of certified organic, freerange eggs on their menus; b) as consumers, to request the option of purchasing certified organic, free-range eggs at retail food outlets and restaurants and, where available, choose the certified organic, free-range option; c) as wholesalers, to highlight the preference for and availability of certified organic, free-range eggs in their food supply inventories; and d) as retailers, to highlight the preference for and availability of certified organic, free-range eggs in their food stores; 2. That the operators and caterers of City-run facilities be requested to use only certified organic, free-range or free-run whole (shell) eggs; and 3. That a letter be written to the Provincial Government, Federal Government and the Canadian Food Inspection Agency stating the Orillia Council opposes battery cage egg production based on the inherent cruelty of confining egg-laying hens in battery cages. 4. That a letter be written to the Association of Municipalities of Ontario requesting all members adopt a similar initiative. Carried.

Carried Moved by Evans, seconded by Cipolla, that the following by-laws be now introduced and read a first, second and third time today: A By-law to amend Chapter 170 of the City of Orillia Municipal Code - Municipal By-law Enforcement Officer A By-law to amend Chapter 719 of the City of Orillia Municipal Code - Lottery A By-law to amend Chapter 460 of the City of Orillia Municipal Code - User Fees - Farmers Market A By-law to amend Chapter 101 of the City of Orillia Municipal Code - Farmers Market Management Committee Amendment Number 13 to Traffic and Parking Regulation By-law Number , as amended A By-law for the purpose of appointing an Acting Clerk for the City of Orillia A By-law to authorize the execution of a transfer of blocks 123, 127, 131 and 132, Plan M843, in the City Of Orillia, Being One Foot Reserves To Charter Construction Limited (Stone Ridge Subdivision - Phase II) A By-law to exempt certain lands from taxation for Municipal purposes (Skylite Residential Inc.) Carried. Open Public Forum By-laws read a first, second and third time and passed. Ruth Lee Burnett re invitation to Council to attend the WIT (Women in Transition) Program on November 7, 8 and 9, Cathy McConnell re request for a wavier of the $150 appeal fee to the Ontario Municipal Board for 114 Davey Drive. 8 CITY OF ORILLIA TO: The Mayor and Members of Council FROM: Council Committee DATE: September 23, 2008 SUBJECT: Report Number (From meeting of September 22, 2008) Your Committee is pleased to report and recommend as follows: 1. THAT as recommended in a report dated September 16, 2008 from the Farmers' Market Management Committee, City Policy No Terms and Conditions, be repealed and replaced with the attached policy, being Appendix "A" to the report; AND THAT Chapter 460 of the City of Orillia Municipal Code - User Fees - Farmers' Market, be amended by deleting the Farmers' Market fees and inserting new fees, as set out in Appendix "B" to the report; AND THAT Chapter 101 of the City of Orillia Municipal Code - Farmers' Market Management Committee, be amended to allow the appointment of non-electors to the Committee, as set out in Appendix "C" to the report. 2. THAT the existing 50km/h maximum speed limit on Julia Crescent be changed to a 40km/h maximum speed limit. 3. THAT the report dated September 15, 2008 from the Public Works Department regarding a review of the 2008 BIA Sidewalk Restoration Program, be adopted and implemented. 4.
