1 CITY OF ORILLIA COUNCIL MINUTES MINUTES OF THE REGULAR MEETING OF COUNCIL, MONDAY, JULY 18, 2005 AT 10:05 P.M. FOLLOWING THE COUNCIL COMMITTEE MEETING Present: Absent: Mayor R. File: C12-EDC (Motion) a) Report - Economic Development Committee Moved by Lauer, seconded by Spears, that Report Number of the Committee of the Whole Council, now before Council, be adopted. Carried Moved by Morano, seconded by Smith, that Report Number of the Council Committee, now before Council, be adopted with the exception of Clause 14., which shall be introduced separately. Carried Moved by Morano, seconded by Smith, that Clause 14. of Report Number of the Council Committee, now before Council, be adopted. Carried Moved by Spears, seconded by Downey, that as recommended in a report dated July 12, 2005, from Mayor Stevens, the request set out in a letter dated April 28, 2005 by Fayne Bullen (151 and 153 Cedar Island Road) for the former Canadian Pacific Railway corridor to be opened and assumed from Cedar Island Road east along Mr. Bullen's lot line adjacent to the corridor by the City of Orillia as a public road, be deferred until Council has had further discussion concerning the waterfront area and related draft Waterfront Framework Plan. LOST Moved by Smith, seconded by Morano, that as recommended in a report dated July 11, 2005 from the Economic Development Committee, Council authorize the appointment of one executive member from the Orillia District Chamber of Commerce to sit on the Economic Development Committee for a period ending December 2006; AND THAT the Economic Development Committee, as part of its mandate, review the effectiveness of this additional position and report its findings to the newly elected Council in the fall of Carried. Carried Moved by Downey, seconded by Garland, that the following by-laws be now introduced and read a first, second and third time today: A By-law to amend Chapter 457 of the City of Orillia Municipal Code User Fees - Public Works - Solid Waste Management A By-law to provide for the levying of an annual tax payable upon a university, college, public hospital and a facility under the Development Services Act for the year Amendment Number 167 to Traffic and Parking Regulation By-law Number , as amended

6 A By-law to authorize the execution of an Agreement with Cansult Tatham Transportation Consultants - Environmental Assessment and Engineering Design - Coldwater Road Reconstruction A By-law to authorize the execution of an Agreement with KMK Consultants - Engineering Design and Contract Administration - Wells Nos. 1 & Moved by Smith, seconded by Morano, that By-law Number , a by-law to confirm the proceedings of Council at its meeting held on July 18, 2005, be now introduced and read a first, second and third time today. Carried. By-laws read a first, second and third time and passed Moved by Lauer, seconded by Spears, that Council authorize the repair of railings at the Scout Valley Lookout tower; AND THAT funding at an upset limit of $500 be appropriated from Operating Contingency for this work. 7 CITY OF ORILLIA TO: The Mayor and Members of Council FROM: Committee of the Whole Council DATE: July 18, 2005 SUBJECT: Report Number (From meeting of July 18, 2005) Your Committee is pleased to report as follows: 1. THAT as recommended in a report dated July 12, 2005 from the Director of Real Estate, the City renew its General Insurance Portfolio coverage with Jardine Lloyd Thompson Canada Ltd. for a one-year term commencing September 1, 2005; AND THAT the current $10,000 per claim deductible levels for Comprehensive General Liability and Property Damage claims be raised to $15,000 per claim in order to preserve the same rates charged in T. Lauer, Chair.

8 CITY OF ORILLIA TO: The Mayor and Members of Council FROM: Council Committee DATE: July 18, 2005 SUBJECT: Report Number (From meeting of July 18, 2005) Your Committee is pleased to report and recommend as follows: 1. THAT as recommended in a report dated June 28, 2005 from the Trails for Life Committee, the City of Orillia supports trail development and the acquisition of rail corridors for trail use but the City of Orillia has a concern with the continued burden that Section 20 of the Line Fences Act places on municipalities attempting to develop abandoned railways into usable trails; AND THAT a copy of this resolution be forwarded to the following: Ministry of Tourism and Recreation Ministry of Municipal Affairs and Housing Association of Municipalities of Ontario 2. THAT the report dated June 21, 2005 from the Housing Committee regarding changes in the Tenant Protection Act, be received as informational. 3. THAT the report dated July 5, 2005 from the Environmental Advisory Committee regarding Asian Long-Horned Beetle Educational Programs, be adopted and implemented. 4. THAT as recommended in a report dated July 11, 2005 from the Manager of Property and Purchasing regarding the Opera House Window Replacement Program, Clause 11. of Council Committee Report be adopted. 5. THAT further to the report dated July 8, 2005 from the Director of Culture and Heritage, the City agrees in principle to the proposal to take possession of the Regan House and to relocate it; AND THAT the Director of Culture and Heritage be directed to work with the Municipal Heritage Committee to: a) establish and recommend to Council a relocation plan and budget which will include the hiring of an accredited restoration architect or heritage consultant to supervise the project, including removal, reconstruction if required, relocation and on-going maintenance of the house; b) negotiate an agreement for execution by the Mayor and Clerk and the owner of the Regan House for the removal of the house from the property at 149 Westmount Drive, including filling the remaining basement to grade; c) recommend the designation of the house when it is relocated, as a building of architectural and/or historical significance pursuant to the Ontario Heritage Act d) establish and recommend to Council an end-use plan for the building, including budget.

THAT as recommended in a report dated July 5, 2005 from the Public Works Department and the Director of Real Estate, the City retain the property on the west side of the Veterans' Park parking area adjacent to the Legion east property line; AND THAT "No Parking Anytime" signs be re-installed on the west side of the Veterans' Park parking area to comply with By-law Number THAT as recommended in a report dated June 24, 2005 from the Public Works Department, the existing "No Parking 7:00 a.m. to 6:00 p.m." on the west side of Park Street between Johnson Street and Fitton's Road be repealed from August 1, 2005 through to April 1, 2006 to allow Champlain Manor staff to park on Park Street during the day, due to limited parking spaces available on-site, during the construction of an addition to the Champlain Manor. 8. THAT as recommended in a report dated July 8, 2005 from the Public Works Department, no action be taken at this time regarding a request for a left turn prohibition and additional signing at Peter Street and Coldwater Street. 9. THAT the report dated June 21, 2005 from the Director of Public Works regarding environmental issues and fencing at 95 Barrie Road, be received as informational. 10. THAT the report dated July 11, 2005 from the Director of Public Works and the Director of Parks and Recreation regarding access between Colborne Street and Veterans' Park, be received as informational. 11. THAT as recommended in a report dated July 13, 2005 from the Director of Parks and Recreation, the "No Parking" times in the Dr. Seymour Conservatory parking lot of Couchiching Beach Park, be changed from "No Parking 1:00 a.m. to 7:00 a.m." to "No Parking 10:00 p.m. to 7:00 a.m.", on a trial basis, to commence as soon as possible and conclude October 1, 2006; AND THAT increased supervision and enforcement be requested from the police relative to the noise by-law and illegal parking. 12. THAT the report dated June 22, 2005 from the Director of Parks and Recreation and the Director of Planning and Development regarding topsoil requirements for subdivisions, be received as informational; AND THAT staff further investigate the City's current practices and potential municipal best practices THAT as recommended in a report dated July 13, 2005 from the Director of Parks and Recreation, Council approve the proposal from Doug Roe, in his letter dated

10 June 24, 2005 regarding Kitchener Park parking and Tudhope Park Fill removal; AND THAT staff be authorized to draft the appropriate agreement in relationship to parking and fill removal. 14. THAT the report dated July 7, 2005 from the City Treasurer regarding New Path Foundation and property taxes at 359 West Street North, be received as informational. 15. THAT as recommended in a report dated June 29, 2005 from the Public Works Department, Cansult Tatham Transportation Consultants be retained to carry out Environmental Assessment and engineering design for the reconstruction of Coldwater Road from Westmount Drive to approximately 150 metres east of Rynard Drive for a proposed cost of $62,450, plus G.S.T. 16. THAT as recommended in a report dated July 13, 2005 from the Public Works Department, KMK Consultants be retained to carry out Engineering Design and Contract Administration of the Well No.'s 1 and 2 treatment system for the proposed cost of $133,760, plus G.S.T.; AND THAT a budget allocation of $150,000 be made for this work as a pre-approval of the 2006 budget; AND THAT a budget request for well rehabilitation and construction of the treatment system be made as part of the 2006 budget process. 17. THAT the report dated July 13, 2005 from the Manager of Special Projects regarding MURF Additional Site Characterization Studies, be received as informational. 18. THAT the report dated June 28, 2005 from the City Manager regarding O.P.P. complement increases, be received as informational. G. Morano, Chair.
