Mayor Davidson called the meeting to order (7:31 p.m.). 1A AGENDA APPROVAL APPROVAL OF AGENDA (including Supplemental Items) THAT Council approves the agenda, and the following supplemental item for discussion under Section 2-1 Public Hearing, rather than Section 14: 14-1 Letter dated November 12, 2007, from G. Tamblyn, Box 2349, Smithers, opposing Zoning Amendment (Bylaw No. 1564). 2. PUBLIC HEARING 2-1 PUBLIC HEARING BYLAW 1564 Mayor Davidson opened the Public Hearing for Bylaw No Town of Smithers Zoning Bylaw No Amendment No at 7:32 p.m. Mayor Davidson stated that the proposed bylaw would rezone all R-2A properties to R-2 in the Willowvale neighbourhood and remove the R-2A zone from the Zoning Bylaw. The following letters relative to the public hearing were noted: a) dated November 6, 2007, from R. Milazzo and M. Stanistreet. b) Letter dated November 6, 2007, from C. Niven and O. Koldyk. c) Letter dated November 12, 2007, from G. Tamblyn (Supplemental item).

Mayor Davidson called a first time for submissions to Bylaw B. Sikkes, 1650 Kidd Road, requested an explanation of the difference between the R-2 and R-2A zones. Mayor Davidson added that there has been considerable misunderstanding. M. Allen, Director of Development Services, explained that both zones allow duplexes, but the R-2 zone also permits semi-detached dwellings, which allows a subdivision of a duplex by way of party wall agreement, on the lot line, and the owners can sell both halves of the duplex. Currently that is not allowed in the R-2A zone. Originally, the R-2A zone did not allow single-family dwellings, but that was added in B. Sikkes asked if fourplexes are permitted. M. Allen explained that they are, but the owner would have to consolidate lots to build townhouses. B. Sikkes asked if that means that there would be no more than two families on the present lots and M. Allen clarified that this is the case. Don Pederson, 8110 Kroeker Road, asked if it is permissible to sell duplexes individually by strata title for lots that are zoned R-2A and M. Allen confirmed that strata ownership is permitted in the R-2A zone. Mayor Davidson stated that the R-2A zone came about when Willowvale lots went on the market a few years ago and it has caused a lot of confusion. Essentially, the R2 zone has always allowed a duplex. The difference was that a person could own a duplex and live in one half and rent the other half. However, the R2 zone allows two separate properties separated by a party wall. He added that there are only a certain number of properties zoned R-2 in the Willowvale subdivision and they are located on Third Avenue. At the far end of Third Avenue close to Canadian Tire there is a small area that has been purchased by The Sparrows for a housing development for disabled persons. It is considered more a larger residence than it is a duplex, and it will be built on three lots across the road from Canadian Tire. Charlie Northrup, 1501 Sunnypoint Drive, expressed that the elimination of the R2-A zone is a good housekeeping move. He added, for clarification, that the area between Turner and Third and Turner Way is also R-2. A fair bit of the subdivision is R-2. Mayor Davidson called a second and third time for submissions to Bylaw No and, receiving none, closed the public hearing at 7:43 p.m.

Sargent reported on the Chief Administrative Officer roundtable regional forum she attended in Terrace and advised that Smithers will host a follow-up event on April 16, 2007, in conjunction with Minerals North. D. Sargent and other senior staff members attended a Municipal Law Seminar also held in Terrace that dealt with liability issues and conflicts of interest. A. Hillaby announced that Hockey Night in Smithers will take place on November 18, 2007, and acknowledged organizers C. Beebe and J. Laidlaw for their hard work. Money raised will go towards Affordable Recreation. Mayor Davidson will coach one of the merchants teams. Mayor Davidson gave an update on the status of the abattoir, adding that the project needs public support. Councillor Bucher reminded Council of the all-candidates forum being held November 14, 2007, at 7:00 p.m. in the Della Herman Theatre. PUBLIC QUESTION PERIOD Mayor Davidson welcomed Quinn Bender, reporter for The Interior News. Director J. Penninga, Rural Area A, Regional District of Bulkley-Nechako, confirmed that November 20, 2007, is the Town s grant-in-aid night. C. Northrup reported on the Real Estate Institute s climate change conference and the role of realtors to encourage local governments to adopt measures that would avoid risk development, i.e. not developing on flood plains, and measures that would decrease vehicle traffic, i.e. supporting higher density housing. Mr. Northrup will provide the Director of Development Services with a copy of a presentation made by the City of Langford. L. Benson elaborated on issues raised in W. J. Hope s letter regarding safety at intersections. He noted that individuals in wheelchairs face many challenges resulting from steep and icy curbs, potholes located along the edge of the road, and activation buttons that are difficult to reach. Mr. Benson is optimistic that solutions can be attained through consultation.
