ADOPTION OF MINUTES Moved by Councillor Sweeney, seconded by Councillor Wiebe, that the minutes of the Executive Committee meeting of Council held July 31, 1995, be adopted. E CARRIED. 3. REPORTS 5.1 DEVELOPMENT.1 Argo Land Corporation, and block Downes Road (south side) Development Permit Application - File No.: /D95-17 Report No from the Senior Planner (J. Malcolm) introduced an application from P. Letkeman and P.L. Construction Ltd. for a development permit to allow site clearing and grading of the northwest 5 ha of the property for a 53-unit bare land strata development. The site comprises two distinct land units: a 5 ha area in the northwest corner, which is gently sloping and suitable for development, and which was cleared approximately a year ago, and the remaining 22.9 ha, which is traversed by Downes Creek and its tributaries and has been almost entirely designated as a Fisheries no-disturbance area. The only developable portion of the land is the 5 ha in the northwest corner. As this permit is for environmental purposes, a Council Hearing is not required. The rezoning and proposed variances were discussed at the Executive Committee meeting on July 31, Moved by Councillor Wiebe, seconded by Councillor Ross, that Development Permit No be approved for issuance, subject to provision of financial security in the amount of $62,000 and an inspection fee of $3,100. E CARRIED..2 Filuk Holdings Ltd., Marla Enterprises Ltd., Messrs. Wiebe, and B.C. Ltd., 2034 and 2076 Townline Road - Rezoning Application - File No.: R95-11 Report No from the Assistant Planner (A. Campeau) presented an application from Filuk Holdings Ltd., Marla Enterprises Ltd., Messrs. Wiebe, and B.C. Ltd. Rezoning of 2034 and 2076 Townline Road from Agricultural One Zone (A-I) to General Industrial Zone (M-3), to allow for the establishment of an industrial complex consisting of three warehouse buildings with large truck access and dock loading capacity, is proposed.

Moved by Councillor Sweeney, seconded by Councillor Wiebe, that: (1) staff prepare an amendment to District of Matsqui Zoning By-law No to rezone property covered under application R95-11 to General Industrial Zone (M-3) when development issues and issues of funding for items not budgeted for by the municipality, as set out in the report, have been resolved; and (2) the Mayor and City Clerk be authorized to execute all documentation relating to the matter. E CARRIED..3 M. Rempel, V. Anthony, and D. Schellenberg, 3143 Clearbrook Road - Land Use Contract - File No.: /R95-23 The Deputy Approving Officer presented his Report No , concerning an application from M. Rempel, V. Anthony, and D. Schellenberg to amend Land Use Contract No. 200 to permit subdivision of 3143 Clearbrook Road into two single-family residential lots. Two changes to the Land Use Contract would be required. The first would increase the number of lots specified in Schedules "B" and "G" from 88 to 89, and the second would amend the plan of subdivision of the parent property shown in Schedule "G" to reflect the proposed subdivision of the subject property into two lots. Both would be substantially larger than most properties in the original subdivision. Moved by Councillor Sweeney, seconded by Councillor Boyes, that: (1) staff prepare and present a by-law to amend Land Use Contract No. 200 to permit an additional singlefamily lot when development issues and issues of funding for items not budgeted for by the municipality have been resolved, namely a 2.2 m road dedication along Clearbrook Road; and (2) the Mayor and City clerk be authorized to execute all documentation relating to the matter. E CARRIED.

4 August 14, 1995, at 3:00 p.m. in the Matsqui Centennial Auditorium Page B.C. Ltd., 1367 Ross Road - Rezoning Application - File No.: R94-30 Report No from the Assistant Planner (S. Thomson) addressed an application from B.C. Ltd. to rezone the rear 3 ha of 1367 Ross Road from Agricultural One Zone (A-I) to Agricultural and Resource Processing Zone (A-4) to permit the location of an asphalt plant. The Agricultural Land Commission has approved the use of the site on a temporary basis, provided that the plant is removed and the site rehabilitated to an appropriate agricultural standard when the on-site sand and gravel resource has been exhausted. Since not more than 15% of material may be imported for processing, the time frame of the plant's operation is necessarily finite. Imported material for processing is to be brought in via Bradner Road, an access agreed jointly by the owner and users in the area. Moved by Councillor Wiebe, seconded by Councillor Boyes, that: (a) staff prepare and present an amendment to Matsqui Zoning By-law No to rezone the property covered under application R94-30 to Agricultural and Resource Processing Zone (A-4) when development issues and issues of funding for items not budgeted for by the municipality have been resolved, namely execution of a Section 215 covenant to prohibit Ross Road access to the subject site; and (b) the Mayor and City Clerk be authorized to execute all documentation relating to this matter. E CARRIED..5 L. Carron, Downes Road - Development Variance Permit Application File No.: D95-18 Report No from the Assistant Planner presented an application from L. Carron for approval for an addition to a single-wide mobile home which is an approved second dwelling. Former District of Matsqui Council supported this application, which was forwarded to the Agricultural Land Commission in December The Commission recently approved the proposed 85 m 2 addition. However, before the applicant may apply for a building permit, a development variance permit is required to relax Matsqui Zoning By-law, 1985, which allows only a single-wide mobile home as an Accessory Family Residential Use.

5 August 14, 1995, at 3:00 p.m. in the Matsqui Centennial Auditorium Page 5 Moved by Councillor Wiebe, seconded by Councillor Ross, that Application D95-18 be approved in principle and forwarded to an upcoming Council hearing; and that the Mayor and City Clerk be authorized to execute all documentation relating to the matter. E CARRIED.. 6 First National Properties Subdivision (Westview Properties), McKinley Drive File No.: S93-65 Report No from the Director of Development Services spoke to correspondence and a petition dated August 3, 1995 from K. and S. Penner and the residents of Westview Properties. The concern expressed was that three new homes in the subdivision had been constructed with duroid shingle roofs, while the Design Controls enforced on original Westview residents specified cedar shakes or tiles only. R. Danziger advised that the park referred to in the Penners' letter is in the City's five-year program for development. L. Collins, representing First National Properties, was present at the meeting, and affirmed that First National is aware that the use of duroid shingles has upset existing property owners. The shingles were authorized because the product has improved considerably, and is now considered by the construction industry to be a better and more durable product than the cedar shakes currently available. However, because of the conflict, she advised that all future homes in the subdivision will be required to conform to the initial standards, and no more houses will be constructed using duroid shingles. In discussion, it was felt that decisions involving agreements between developers and purchasers should be left in private hands. Moved by Councillor Warawa, seconded by Councillor Sweeney, that correspondence dated August 3, 1995 from K. and S. Penner be received, and that the Penners be informed of the decision of First National concerning roofing material as well as the fact that the park is in the municipality's five-year capital works program. 6 August 14, 1995, at 3:00 p.m. in the Matsqui Centennial Auditorium Page 6.7 Secondary Suite Survey Proposals - File No.: Report No from the Director of Development Services recommended selection of a consultant to conduct a public opinion study on the issue of secondary suites. The report outlined two alternative sample approaches, one from Waugh Research, and the other from CV Marketing. R. Danziger suggested that, if Council approved the recommendation, an initial meeting with the consultant be scheduled for August 28, 1995 to discuss the nature of the questions to be asked. Discussion centred around the value of conducting such a survey. It was emphasized that the survey is just part of the process of first, finding out what the public wants, then initiating action on the results. Moved by Councillor Warawa, seconded by Councillor Peary, that the proposal of Waugh Research to carry out a stratified random survey of residents of the City of Abbotsford to measure public opinion on the issue of secondary suites be accepted, with the cost not to exceed $2, plus G.S.T. E CARRIED. Opposed: Councillors Boyes and Wiebe 5.2 ENGINEERING None. 5.3 ADMINISTRATION.1 Canadian Association of Municipal Administrators Conference, June 6 to 9, 1995, Metropolitan Toronto - File No.: /CAMA In a report dated July 27, 1995, the City Manager summarized her participation in the 23rd Annual CAMA Conference in Toronto, held June 6 to 9, She emphasized that these sessions are valuable learning experiences, and felt that this year's conference offered several ideas which were worth pursuing.

E CARRIED. 5.4 FINANCE.1 Investment Report to June 30, File No.: The Treasurer presented his Investment Report dated July 31, He noted that the City has realized a return to June 30, 1995 of 8.3% in Bond Funds, 7.81 % in Money Market Funds, for a combined yield of 8.14%. Moved by Councillor Peary, seconded by Councillor Sweeney, that the Investment Report dated July 31, 1995 be received. E CARRIED..2 Fraser Valley Regional Library Funding Formula - File No.: Correspondence dated July 18, 1995 from the Fraser Valley Regional Library, attached to Report No from the Director of Finance, requested input on the formula to be used in the 1996 budget process. In his report, D. Bottrill recommended no change to the present funding formula for apportioning the cost of Fraser Valley Regional Library services. Moved by Councillor Boyes, seconded by Councillor Wiebe, that the funding formula for apportioning the cost of library services remain in its present form. E CARRIED.

8 August 14, 1995, at 3:00 p.m. in the Matsqui Centennial Auditorium Page 8.3 Internal Trade Agreement - File No.: Report No from the Purchasing Manager provided further information concerning "Procedures for Procurement" regulations proposed for inclusion under Chapter Five of the Internal Trade Agreement. The report suggested that certain sections of Chapter Five of the Internal Trade Agreement will place additional and unnecessary demands on municipalities without any measurable benefit. Particular areas of concern included low tendering thresholds, costly advertising, loss of strategic alliances such as cooperative purchasing, a costly electronic bidding system, cumbersome bid protest process, and additional reporting requirements. Moved by Councillor Wiebe, seconded by Councillor Sweeney, that Report No be received. A number of Councillors felt strongly that a motion to receive was not adequate, but that a decision was required. The motion was then put and DEFEATED. Opposed: Councillors Lee, Ross, Peary, and Warawa 5.5 FIRE Moved by Councillor Warawa, seconded by Councillor Peary, that Council support the position taken by the Federation of Canadian Municipalities, that Chapter Five of the Internal Trade Agreement should not apply to municipal governments. E CARRIED..1 Learn Not to Burn Champion - File No.: Report No from the Fire Chief advised that Public Fire Education Coordinator Charlene Jordan and the City of Abbotsford Fire Department have been chosen "1995 Learn Not to Burn" Champion by the National Fire Protection Association. L. Haagen gave a brief outline of the program, and C. Jordan exhibited the crystal apple award she had received. Congratulations were proffered, from Council and the entire community.

9 August 14, 1995, at 3:00 p.m. in the Matsqui Centennial Auditorium Page 9.2 Fire Department Quarterly Incident Report - File No.: Report No from the Fire Chief provided the Fire Department's quarterly incident report, covering emergency incidents and fire prevention activities. Moved by Councillor Warawa, seconded by Councillor Wiebe, that Report No be received. E CARRIED.. 3 Fire Chiefs' Association of B.C. - Annual Conference - File No.: Report No from the Fire Chief provided information on the hosting of the 64th annual conference of the Fire Chiefs' Association of B.C. by the City of Abbotsford Fire Department. L. Haagen advised that the conference was highly successful, and thanked those involved. Moved by Councillor Peary, seconded by Councillor Sweeney, that Report No concerning the 64th annual conference of the Fire Chiefs' Association of B.C. be received. E CARRIED..4 Fire Department Annual Report File No.: Moved by Councillor Wiebe, seconded by Councillor Warawa, that the 1994 Annual Report of the Abbotsford Matsqui Fire Department be received. E CARRIED. 6. NEW BUSINESS.1 Regional Transportation Conference, March 22 and 23, File No.: Correspondence dated July 7, 1995 from the University of British Columbia School of Community and Regional Planning requested participation in its Regional Transportation Conference to be held March 22 and 23, 1996, and offered a number of forms that support could take.

10 00068a August 14, 1995, at 3:00 p.m. in the Matsqui Centennial Auditorium Page 10 Moved by Councillor Wiebe, seconded by Councillor Ross, that the correspondence from the University of B.C. requesting participation in its Regional Transportation Conference March 22 and 23, 1996 be received. In discussion, a number of Councillors emphasized the importance of providing input into transportation issues, and of receiving cooperation from the Greater Vancouver Regional District on issues which affect the Fraser Valley. Representation at the Conference was recommended. The motion was then put and E CARRIED..2 Noise By-law - File No.: Correspondence dated August 9, 1995 from K. Pincott enclosed a copy of the Noise Control By-law from West Vancouver, and recommended that the City of Abbotsford proceed along similar lines. In addition, correspondence received August 2, 1995 from G. and G. Ruggles recommended changes in the hours of operation to 7:00 a.m. to 7:00 p.m. Monday to Friday, and 8:00 a.m. to 5:00 p.m. Saturday and Sunday. While some Council members felt the specific nature of the West Vancouver By-law made it easier to control, others felt it made control more difficult. Generally, the observation was made that the most effective and amicable way of controlling noise was individual cooperation rather than government intervention in neighbourhood disputes. Moved by Councillor Boyes, seconded by Councillor Wiebe, that the correspondence from K. Pincott and G. and G. Ruggles be received. E CARRIED.

11 August 14, 1995, at 3:00 p.m. in the Matsqui Centennial Auditorium Page Ground Water Protection - File No.: Moved by Councillor Boyes, seconded by Councillor Ross, that ground water protection be placed on the agenda for a future Executive Committee, and that K. Chipperfield of the Sustainable Poultry Farming Group be invited to present another proposal to remove manure in order to protect the aquifer. It was pointed out that the Sustainable Poultry Farming Group had already made a presentation and that a second one would not be in order. Options included a different proposal which would involve no cost to the municipality, and directing the presentation to the farmers themselves. The motion was then put and DEFEATED. Opposed: Councillors Lee, Sweeney, Warawa, and Wiebe Moved by Councillor Boyes, seconded by Councillor Warawa, that staff be directed to prepare a report on ground water conservation for a future Executive Committee, and that the Sustainable Poultry Farming Group not be invited to make another presentation. E CARRIED. Opposed: Councillors Sweeney and Wiebe.4 AgriFair and Airshow - Fund-raising Moved by Councillor Boyes, seconded by Councillor Wiebe, that the AgriPair and Airshow committees be invited to meet with Council at a date to be specified, to discuss fundraising ideas. E CARRIED.
