Purpose To hold a public meeting to consider an application for an amendment to Zoning By-law Number PL. Re: Hermson Britton Clarkson (MHBC) Planning Limited on behalf of Best Homes Ltd. Part of Lots 14 & 15, Concession 5 (Thorah) Township of Brock File Nos: RA S-B The purpose of this public meeting is to obtain public input in respect of an application for approval of a draft plan of subdivision to permit a residential plan of subdivision consisting of 252 units, park, Stormwater and walkway blocks. In addition, an application to amend the Zoning By-law to rezone the property from the Development (D) Zone category to a Residential Type No. 1 Exception (R1-Exception), Residential Type No. 2 Exception (R2 Exception), Residential Type No. 3 (R3-Exception), Mixed Use Corridor Exception (MUC-Exception), Open Space Exception Number Two (OS-2), and Recreation (RE) Zone categories to implement the plan of subdivision. 6 Purpose RE: Hermson Britton Clarkson (MHBC) Planning Limited on behalf of Best Homes Ltd Part of Lots 14 & 15, Concession 5 (Thorah) Township of Brock File Nos: RA S-B The purpose of this public meeting is to obtain public input in respect of an application for approval of a draft plan of subdivision to permit a residential plan of subdivision consisting of 252 units, park, Stormwater, and walkway blocks. In addition, an application to amend the Zoning By-law to rezone the property from the Development (D) Zone category to a Residential Type No. 1 Exception (R1- Exception), Residential Type No. 2 Exception (R2 Exception), Residential Type No. 3 (R3-Exception), Mixed Use Corridor Exception (MUC-Exception), Open Space Exception Number Two (OS-2), and Recreation (RE) Zone categories to implement the plan of subdivision. 2. There will be no decision made on behalf of the Township of Brock in respect of the proposed amendments at this meeting. 3. Subdivision Application a) You may submit to the Clerk any written comments with respect to the plan of subdivision tonight. Thereafter, you must forward written submissions directly to the Region of Durham Planning Department to the address shown on the Notice you received in the mail with a copy to the Township of Brock. b) If a person or public body that files an appeal of a decision of the Region of Durham, as the approval authority, in respect of the proposed plan of subdivision, does not make oral submissions at the public meeting, or make written submissions to the Region of Durham Planning Department before the proposed This document is available in alternate formats upon request. 7 plan of subdivision is approved or refused, the person or public body is NOT entitled to appeal the decision of the Region of Durham to the Local Planning Appeal Tribunal. Further, the person or public body may NOT be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion the of the Tribunal, there are reasonable grounds to do so. c) If you wish to be notified of the decision of the Region of Durham Planning Department in respect of this proposed plan of subdivision, you MUST MAKE A WRITTEN REQUEST to the Region of Durham Planning Department. 4. Zoning Application a) Persons who wish to be notified of further meetings of the Planning Committee and/or Council dealing with this amendment to the Zoning By-law must request to be notified in writing. Persons who wish to be notified of the decision of the rezoning application, if approved by Council, must submit a written request. Notification forms are available from staff in attendance. b) If a person or public body does not make oral submissions at the public meeting or make written submissions to the Township of Brock before the by-law is enacted (if approved), the person or public body is NOT entitled to appeal the decision of the Council of the Township of Brock to the Local Planning Appeal Tribunal. Further, the person or public body may NOT be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so. c) In the event that the actual by-law is enacted by Council, it will be circulated in the formal manner under the provisions of the Planning Act and at that time, if Page 2 of 3
8 objections are received, a hearing will be held before the Local Planning Appeal Tribunal, at which time the objectors will be informed of a hearing date. 7. Call upon the Applicant / Agent to outline the proposal for the benefit of those in attendance. 8. Open the meeting to the public to receive input and request the name of the individual(s) speaking to the application. 9. Inquire of those present if anyone has any further input to make at this time. If not, request a motion to officially close the public meeting in respect of the subject application. Page 3 of 3
