Just got the flyer from the State office with the dates for the ABATE OF FLORIDA'S "FALL STATE BIKER BASH" located at the Peace River Camp grounds in Arcadia, Florida which is a few miles N/E of Port Charlotte. You will have time to plan this one way in advance as it isn't starting till October 7th and runs thru the 9th with live bands, a scavenger hunt and a swap meet just to name a few of the events. Check out the flyer at Abateflorida.com for all the info!i want to thank everyone that attended the last meeting in May and hoping to see everyone again for the final elections on June the 2nd at 7:30 pm. The way it looks..everyone on the board of directors/officers will stay same as last year. The members are still making plans for a fun run/party in August and I will update you all (y'all as spoke in southern) in the next newsletter. Our next state meeting is in Sebring on June 11th, I will be riding down and most likely back that night if anyone wants to come along just let me know, it looks like about 3 hours each way. Secretary: Kathy H. stated that last month s minutes were printed in the newsletter. Motion made to accept minutes as printed. Motion passed. Treasurer: John Banta read the treasury report regarding the Chapter finances for the month of December. Motion made to accept report as reported. Motion passed. Membership: Steve- 1 renewal. State has come up with incentive of recruiting Members. See Steve about the incentive. Products: We have products here at the Eagles. Legislative: See John s report in newsletter Newsletter: Kathy H Newsletter is on the website and printed copies for anyone that would like the newsletter hard copy. PR Communications: - Ken absent Safety: Mike Knezevich Mike brought in some State products and talked about hearing 2 counties in Florida with motorcycle check point and we need to watch for that. Mike talked to OB about having a party at OB s. We need to supply food. Mike is still working on this fun run. No charge but will take donations. New Business: John mentioned the fact that we never did anything for Mac after he passed. We voted that we are sending his spouse money as we do for anyone else that passes. 7 Legislative Report May 17, 2016 John Banta Out of date as soon as I write it Go on to the ABATE of Florida Website Click on the Legislative Information Center and subscribe to list. Ideally you would get the latest legislative news and press releases. Contact the State Legislative Trustee, Darrin Brooks, to get on his list for alerts when bills are in committee. At that time we can contact legislators outside our district. He sends news reports of legislative activities on a myriad of topics, not necessarily those that ABATE is involved in. Consider signing in to the MRF or AMA alerts. Sometimes issues do move quickly. Sometimes the alerts actually give the bill numbers. There are many interesting bills that affect us; however, I try to report only on motorcycling and our life style. Elections Qualifying ends in June. August 30 will be the primaries. People are jumping in and out and the list changes. There will be important elections for even non-partisans to vote (Sheriff, County Council). You have 30 days to change to a party affiliation. That means before July 30. Consider switching to Republican, it is a crowded field. Be aware that some of those running do not support all our issues. ABATE of Florida cannot endorse candidates. We can report on the voting record and their views on the issues that affect motorcyclists. From Darrin: JUSTICES GIVE GREEN LIGHT TO STOPS OVER LICENSE PLATES In a case that started with a dangling tag light, the Florida Supreme Court made clear Thursday that police officers have broad authority to pull over motorists whose license plates are not fully visible. Justices, in a 5-2 decision, rejected an appeal from Jermaine D. English, who was stopped by Orlando police because a tag light and wires were hanging down over the license plate on a vehicle he was driving. Evidence found during the stop led to English being charged with possession of cocaine, marijuana and paraphernalia. In seeking to suppress the evidence, an attorney for English contended that police did not have cause to stop the vehicle. But the Supreme Court upheld a 2014 decision by the 5th District Court of Appeal, which found that state law requires numbers and letters on license plates to be "plainly visible at all times." A major part of the dispute centered on whether the law applies only to license plates that have been defaced or covered in substances, such as grease, that would prevent them from being easily read --- or whether it also applies to situations such as bulbs and wires hanging down. "We conclude that the plain language of (the section of state law) is clear and unambiguous, and requires that a license plate be plainly visible and legible at all times without regard to whether the obscuring matter is on or external to the plate,'' said Thursday's ruling, written by Chief Justice Jorge Labarga and joined by justices R. Fred Lewis, Peggy Quince, Charles Canady and Ricky Polston. But Justice James E.C. Perry, in a dissent joined by Justice Barbara Pariente, wrote that the law was intended to prevent motorists from "physically altering or obscuring the license plate." "Under the majority's view, the licensing statute could lead to potentially outrageous results," Perry wrote. "For example, families and avid bikers who utilize rear bike racks will now be guilty of unlawful activity if any part of the bicycle or bicycle rack --- or the nylon straps which are used to secure the bike to the rack --- covers the license plate. The possibilities under which law enforcement may now detain drivers under this statute are limited only by the imagination, potentially placing in the hands of law enforcement unfettered discretion to enforce the statute." In going to the Supreme Court, English's attorney argued that the 2014 ruling by the 5th District Court of Appeal conflicted with an earlier decision by another appeals court. That decision, by the 2nd District Court of Appeal, found that police could not stop a vehicle because a trailer hitch blocked the view of a license plate, according to a brief filed last year by English's attorney. The Supreme Court majority, however, sided with the 5th District Court of Appeal and rejected the earlier ruling. "The plain language of (of the section of law) requires that a license plate be 'clear and distinct' and 'free from defacement, mutilation, grease, and other obscuring matter;' it does not suggest that matter external to the license plate may constitute a permissible obstruction under the statute,'' Labarga wrote.

8 Washington DC There is a lame duck session after the elections. End Motorcycle Profiling Act of 2016 We do not have sponsors yet. News from The AMA U.S. Reps. Bill Flores (R-Texas), Peter Welch (D-Vt.), Bob Goodlatte (R-Va.), Jim Costa (D-Calif.), Steve Womack (R-Ark.) and Cedric Richmond (D-La.) introduced H.R. 5180, the Food and Fuel Consumer Protection Act of 2016 today. The American Motorcyclist Association supports this bill. The bipartisan legislation would cap mandated ethanol content in the nation s fuel supply at 9.7 percent and institute a provision that automatically reverts the U.S. Environmental Protection Agency s annual Renewable Volume Obligations to the previous year s percentage if the EPA misses its Nov. 30 deadline. And, finally, the bill would ensure commercially available cellulosic and advanced ethanol has a place under the 9.7 percent cap. In other words, the bill would stop the federal government from forcing E15 fuel (15 percent ethanol by volume) into the market. Capping the ethanol mandate helps ensure the availability of safe fuels like E10 and a continuing place in the market for ethanol-free gasoline (E0) for older motorcycles. This is important, because the last RVO rule issued by the EPA decreased the E0 supply to just 130 million gallons from 9.2 billion gallons in 2016, despite the fact that the demand for E0 doubled. Tell your representative to support H.R From The MRF For Immediate Release April 21, 2016 Modified Motorcycles Potentially Under Attack Members of both Houses of Congress have introduced proposed legislation that would protect the rights of Americans to modify their vehicles for racing purposes. Dubbed the Recognizing the Protection of Motorsports Act of 2016 (RPM Act, H.R and S. 2659), this legislation would ensure that converting any motor vehicle (including street motorcycles) into a competition-only vehicle remains legal. This proposed legislation became necessary after the U.S. Environmental Protection Agency, under the guise of maintaining emissions as outlined by the Clean Air Act, announced plans to regulate the conversion of street motorcycles and other motor vehicles into race vehicles. This attempt is reminiscent of the EPA's efforts back in 2003 to regulate motorcycling through another unrelated proposed regulation aimed at heavy equipment, steam engines and diesel engines that would have prohibited owners from changing anything on their motorcycles except for paint color or chrome. Through the Color and Chrome initiative, the MRF was successful in separating motorcycles from the EPA s regulations and created exemptions to protect the custom and aftermarket industries and our lifestyle. On April 15, 2016, the EPA announced that, under pressure from Congress, it would drop the language from its proposed regulations; nevertheless, it shows the clear intent of the EPA to attempt to overstep its bounds, as outlined by the Clean Air Act, in an effort to strip motorcyclists of the rights to modify their motorcycles as they see fit. The MRF urges its members to contact their U.S. Representative and Senator and ask them to support H.R. 4715/S. 2659, the Recognizing the Protection of Motorsports Act of 2016, so that the EPA makes no further attempts to erode motorcyclists rights.
