It took many votes and a lot of discussion but hopefully it is done now. There is a lot of talk about motorcycle checkpoints and profiling of bikers by law enforcement coming out and with the increased number of accidents and deaths we need to stay on top of this. As the elections are coming up this fall I would encourage everyone to do their research and check out your candidates, encourage them to come to our meetings and get involved. Talked about the State Party on October 9th, 2016 in place of Spooks at Hillsboro. VP: Alfy Going to State Meeting June 11 in Sebring. Voting the same as we did before the last State Meeting. 7 Legislative Report June 17, 2016 John Banta Out of date as soon as I write it Go on to the ABATE of Florida Website Click on the Legislative Information Center and subscribe to list. Ideally you would get the latest legislative news and press releases. Contact the State Legislative Trustee, Darrin Brooks, to get on his list for alerts when bills are in committee. At that time we can contact legislators outside our district. He sends news reports of legislative activities on a myriad of topics, not necessarily those that ABATE is involved in. Consider signing in to the MRF or AMA alerts. Sometimes issues do move quickly. Sometimes the alerts actually give the bill numbers. There are many interesting bills that affect us; however, I try to report only on motorcycling and our life style. At the local level we see a move to make all special events sanitized and turned into family events. Law enforcement supports the federal view that all patch holders are criminals and terrorists and profiling and denial of equal access are necessary tools. Body cameras are needed, but the Sheriff Dept has procrastinated. Recently the County Council approved (without any one making a comment) the $500,000 settlement for the death of that Deltona kid that occured during a search warrant. Good luck collecting it. It has to be approved by the State Legislators. One session they just refuse to hear any relief bills. After coming out of a recession, legislators in Tallahassee thought it was okay to walk off the job and go home two sessions ago. So much for let s get to work. Nationally, federal agencies like NHSTA and EPA try to make rules that affect us. Elections Qualifying ends in June. August 30 will be the primaries. People are jumping in and out and the list changes. There will be important elections for even non-partisans to vote (Sheriff, County Council). You have 30 days to change to a party affiliation. That means before July 30. Consider switching to Republican, it is a crowded field. Be aware that some of those running do not support all our issues. ABATE of Florida cannot endorse candidates. We can report on the voting record and their views on the issues that affect motorcyclists. Democrat Headquarters 457 S. Ridgewood Ave, Daytona Beach. This is a doctor s office at Loomis Republican Headquarters 999 3rd St Holly Hill at Nova Rd SR44; 661 Beville Rd. Daytona Beach Sheriff.This is not a political party office, but local party officials are identifying who they support Wendell Bradford (DEM), Dave Brannon (REP), Mike Chitwood, Eric Dietrick, Jim Gullum, Brett Kennan. Brannon and Dietrick are currently with the Volusia County Sheriffs Dept. Chitwood believes all patch holders are criminal but has been pro active with body cameras and has trained his officers in diffusing situations in order to try to take suspects to jail instead of shooting them and personnel to go home to their families. County Chairman Jason Davis, Greg Gimbert, Ed Kelley, Tom Laputka. Davis thought the electronic signs saying No Colors on a public highway was okay at the Deland Bike Fest. Greg Gimbert is a member of Sons of the Beaches. Former Chapter President Mac Burns introduced founder Jim Ward as a kindred sprit to those in ABATE. I still go to the beach and access is important. Gimbert was also active in getting more access to ATVs on State lands, a principle the AMA adheres to. Laputka also wants no more restrictions on beach driving. Kelley is open to restrictions and was behind the move to shutdown the clubhouse on US1. County Council District 2 Willie Kimmons, Billie Wheeler County Council District 4 Linda Bourquin-McIntyre, Roy Johnson, Heather Post, Al Smith County Judge Group 9 Robert Sanders, unopposed Group 3 Heather Caeners, Shirley Green, Marla Rawnsley Both Judge Sanders and Judge Green have withheld adjudications thus circumventing the $500/$1000 fine for those who cause an accident resulting in an injury or death of a motorcyclist.
8 US Senator The list is long. At the meeting we spoke about Lopez-Cantera s legislation concerning vertical plates and Ron DeSantis concern about federal bureaucracies. Perhaps Rubio will jump in and Cantera dropping out. US Representative District 6 Adam Barringer REP, Fred Costello, REP, GG Galloway REP, James Jusick REP, Jason Kendall DEM, William McCullough DEM, Patrick Mooney REP, George Pappas DEM, Brandon Patty REP, David Santiago REP, Dwayne Taylor DEM Rep. Costello was receptive to our DHSMV statistics that show little differences to those in an accident and weather they wore helmets or not. He also supported the law that would allow non-ethanol gas to be sold at any gas station. I d o not know much about Rep. Santiago. I heard Pappas on the Big John Forum. I am impressed with his goals of issues that face the average citizen, but do not know at this time on his stand on helmet laws or federal bureaucracies. State Senator District 7 Curtis Ceballos DEM. Travis Hutson REP I gave Hutson my best white papers concerning mandatory helmet laws and while he stated they were compelling, I could not get a position from him. State Senator District 14 Richard Dembinsky NPA, Dorothy Hukill REP State Representative District 24 Adam Morley DEM, Paul Renner REP State Representative District 25 Noel Bickford DEM, Tom Leek REP State Representative District 26 Michael Cantu REP, Patrick Henry DEM, Steve Miller DEM Steve Miller was Jimmy Charles campaign manager. State Representative District 27 ZenaidaDenizac REP, Randi Doan NPA,Robert Mann DEM, William McBride REP STATE TO STUDY END OF 'NO-FAULT' AUTO INSURANCE The state plans to undertake a study that would determine what would happen if Florida's no-fault auto insurance program is scrapped. According to a request for proposals posted by the Office of Insurance Regulation, the study is expected to find "the potential impact to Floridians if the personal injury protection coverage requirements were repealed and replaced with varying levels of bodily injury coverage, or if the current requirements to purchase auto insurance were completely repealed." The no-fault system is commonly referred to as "PIP," which is shorthand for personal-injury protection coverage. The objective of the study, which was first reported by The Palm Beach Post, is also to determine the effect of a 2012 law intended to reduce fraud in the no-fault system. An actuarial consulting firm is expected to be awarded the contract for the study on May 27, with the study expected to cost up to $125,000. A draft of the study's findings is expected to be completed by Aug. 26, with a final report presented to Gov. Rick Scott, the Senate president and House speaker on Sept. 2. Under the decades-old no-fault system, motorists are required to carry personal-injury protection coverage that includes $10,000 in medical benefits. Washington DC There is a lame duck session after the elections. Recess is in August. Nothing will happen till after elections End Motorcycle Profiling Act of 2016 We do not have sponsors yet. Maryland is now the second state to pass a motorcyclist antiprofiling law (May, 2016). Washington State passed related legislation in H.R. 5180, the Food and Fuel Consumer Protection Act of 2016 today. The American Motorcyclist Association supports this bill. The bipartisan legislation would cap mandated ethanol content in the nation s fuel supply at 9.7 percent and institute a provision that automatically reverts the U.S. Environmental Protection Agency s annual Renewable Volume Obligations to the previous year s percentage if the EPA misses its Nov. 30
9 deadline. And, finally, the bill would ensure commercially available cellulosic and advanced ethanol has a place under the 9.7 percent cap. In other words, the bill would stop the federal government from forcing E15 fuel (15 percent ethanol by volume) into the market. Capping the ethanol mandate helps ensure the availability of safe fuels like E10 and a continuing place in the market for ethanolfree gasoline (E0) for older motorcycles. This is important, because the last RVO rule issued by the EPA decreased the E0 supply to just 130 million gallons from 9.2 billion gallons in 2016, despite the fact that the demand for E0 doubled. The practical effect of the EPA s action is more unsafe E15 (15 percent ethanol by volume), less E10 and virtually no E0 for older and vintage machines. The urgency of EPA action to address misfueling is supported by a recent study from the Outdoor Power Equipment Institute. The study indicates only five percent of consumers are aware that E15 is prohibited for use in certain engines and that 60 percent of consumers assume that any gas sold at a pump must be safe for all of their engines. Ethanol Bills Thrive in Washington (from MRF May 20, 2016) Last week saw the introduction of yet another legislative proposal addressing the use of ethanol blends in fuel. Introduced by Congressman Bill Flores from Texas, the proposal would institute a cap on the ethanol content in fuel. Presumably the bill would stop what many are concerned about; an uncomfortable creep towards a higher content of ethanol in gasoline which could have the effect of voiding many motorcycle warranties. The bill introduced last week marks the 16th bill concerning ethanol in the 114th Congress alone, and the issue remains as controversial as ever. Rather than pick a side, the MRF position on ethanol seeks to achieve a federal policy that emphasizes research on ethanol blends. Encouraging new research, specifically targeted towards engines in motorcycles and the effects on internal combustion, could help to alleviate the concerns of motorcycle riders as well as motorcycle manufacturers. From MRF June 10. The U.S. Environmental Protection Agency (EPA) held a public hearing in Kansas City, MO concerning ethanol mandates. Stakeholders from both PRO and ANTI ethanol standpoints testified at the hearing which went on for several hours and incredibly, afforded over 120 people the opportunity to voice their opinion. Speaking out over concerns on fuel containing higher blends of ethanol (E15, etc.) was the MRF s own Amy Allmon who was also present as a part of the Freedom of Road Riders. Amy did a fantastic job communicating the MRF position encouraging the EPA to conduct new research specifically targeted towards motorcycle engines as well as the effects on internal combustion. She also cited concern over the lack of communication to consumers about the possible side effects of mis-fueling and possible effects on motorcycle warranties. H.R and S Recognizing the Protection of Motorsports Act of 2016 (RPM Act). This legislation would ensure that converting any motor vehicle (including street motorcycles) into a competition-only vehicle remains legal. This proposed legislation became necessary after the U.S. Environmental Protection Agency, under the guise of maintaining emissions as outlined by the Clean Air Act, announced plans to regulate the conversion of street motorcycles and other motor vehicles into race vehicles. This attempt is reminiscent of the EPA's efforts back in 2003 to regulate motorcycling through another unrelated proposed regulation aimed at heavy equipment, steam engines and diesel engines that would have prohibited owners from changing anything on their motorcycles except for paint color or chrome. Through the Color and Chrome initiative, the MRF was successful in separating motorcycles from the EPA s regulations and created exemptions to protect the custom and aftermarket industries and our lifestyle. On April 15, 2016, the EPA announced that, under pressure from Congress, it would drop the language from its proposed regulations; nevertheless, it shows the clear intent of the EPA to attempt to overstep its bounds, as outlined by the Clean Air Act, in an effort to strip motorcyclists of the rights to modify their motorcycles as they see fit. The MRF urges its members to contact their U.S. Representative and Senator and ask them to support H.R. 4715/S. 2659, the Recognizing the Protection of Motorsports Act of 2016, so that the EPA makes no further attempts to erode motorcyclists rights.
