2 PRESIDENT S MESSAGE June is here and that means hot and humid weather for the next few months. But hey..it also means the snowbirds flew north for the summer and less traffic and crowds everywhere! It also means our chapter elections will finally be over. We will be voting on these positions..president, Secretary, Sergeant of Arms and Safety Director. I want to thank everyone that attended last months meeting and I'm hoping to see everyone again for the final elections on June 7th at 7:30 pm. I also want to thank everyone on the board for their service and dedication over the past year. Without you and the work you all do ABATE would not exist (and we all might be wearing helmets again too!). Our next state meeting is in beautiful downtown Stuart, Florida on Saturday, June 9th so if you're into a nice ride south and want to meet the state officers and experience a state meeting, be sure not to miss it. Nominations tonight, we need to decide who we are voting for at the next State meeting VP: Alfy - Not much to say, been very busy this month. Talked to Senator Perry who is very biker friendly. Secretary: Report was in the newsletter and on the website. Treasurer: John gave Treasury report. 6 Legislative Report May 19, 2018 John Banta WASHINGTON, DC The Motorcycle Riders Foundation is our voice in Washington. Our chapter is now a sustaining member. Recent successes were prohibiting federal funding for motorcycle only check points and re-formation of the Motorcycle Advisory Council which seeks to make roads engineered better for motorcyclists. Here are our national issues: The Road to Zero Coalition, managed by the National Safety Council, has released it's report, A Road to Zero, a vision for achieving zero roadway deaths by The report stinks, it calls for mandatory helmet laws and fails to recognized all the input from motorcyclists, who were active participants. Bikers in America are being ignored. Motorcycles are a legitimated form of transportation, however we have been neglected by those formulating policies on autonomous vehicles. When the first horseless carriages were driving around, so were motorcycles. What about us? EPA: S.203: HR.350 Recognizing the Protection of Motorsports Act of 2017 (RPM Act). These bills ensure that transforming motor vehicles, including motorcycles, into race cars or racing bikes used exclusively in competition does not violate the Clean Air Act. The bill would clarify that the anti-tampering provisions applicable to motor vehicles do not apply to motorcycles used for competition in racing. The EPA says they have the authority to enforce any modifications (they call it tampering ) you might make to your bike s emissions system. Ron DeSantis is a co-sponsor, Sen. Rubio and Nelson are among the co-sponsors of the Senate bill. S cosponsors, HR cosponsors. Light weight feel good legislation, but we need to reel in our federal agencies. ETHANOL: HR1314 Renewable Fuel Standard Elimination Act Rep. Goodlatte. Eliminates Renewable Fuel Standard in the Clean Air Act that sets progressive minimum volumes of renewable fuel to be on the marketplace. This is the best bill. Rep. Ron DeSantis is a cosponsor. Caps blending to the current of 10%. You do not want to run E15 in your bike. The EPA is pushing E15 although my owners manual for my 2012 car says only use E10. Running E15 will burn up your engine, if it is not designed for it. PROFILING : Here is the link for the National profiling survey. H.Res.318. Promoting awareness of motorcycle profiling and encouraging collaboration and communication with the motorcycle community and law enforcement officials to prevent instances of profiling. Sponsored by Rep Walberg. Note the registration numbers in the resolution ( , 2015). S.Res.154 is almost identical to H.Res.318 and is sponsored by Sen. Johnson. 5 cosponsors among them Sen. Jeanne Shaheen D-NH, Sen. Lisa Murkowski R-AK. Last session in Tallahassee saw Sen. Rob Bradley, chairman of appropriations, killing the texting bill over privacy concerns and profiling. which were somewhat addressed in the bill. However he was not a co-sponsor on the racial profiling bill which had stronger language. Racial profiling means determining probable cause for and carrying out the detention, interdiction, or other disparate treatment of a person based solely on the person s race or ethnicity. ELECTIONS Governor: For Republicans it is between DeSantis and Putnam. Putnam has been a proven supporter for ABATE. Attorney General: Republicans House members Frank White and Jay Fant and former Hillsborough County Judge Ashley Moody all oppose the constitutional amendment to restore felons rights. Let's keep on crucifying people after they serve their sentence. We still have Jim Crow legislation.

7 Agriculture Commissioner: Republicans Grimsley, Caldwell and Troutman indicated they intend to build on the work of outgoing Agriculture Commissioner Adam Putnam, who is running for governor. Democrat Porter, meanwhile, contends Putnam has been more reactive than proactive. Judges: All circuit and county judges, except for Judge Dawn Fields, have retained their seats without a challenger. Her challenger is Steven Burk. Group 15 Circuit seat has candidates Linda Gaustad, Sebrina Slack and Ryan Will to fill an opening because of a judges retirement. Ryan Will is currently works for the State Attorney and has been reprimanded. We do have a few outstanding judges( my favorite is Belle Schumann, who also got the highest Volusia Bar Association rating) but there are also those that are part of the system that caters to the State Attorneys office. If you get arrested get a good attorney because most of the judges will not step out of the system for justice. Case in point: Dylan Braithwaite was charged with robbery with a weapon (baseball bat), kidnapping, aggravated battery and had bail set at $ (News Journal 5/5/2018). That is the same bail the judges set for having 15 Loratabs, trafficking. I know of ABATE members who were clobber by an automobile while riding. All had issues with pain medication, not all were able to beat it. US Senate: Scott vs. Nelson. Scott was no friend to ABATE US House of Representatives District 6: Democrats John Upchurch, Nancy Soderberg, Stephen Sevigny. Republicans John ward, Michael Waltz, Fred Costello. Fred was approachable while a State Representative. He supported the non ethanol gas bill and was sympathetic to my arguments of why that helmet does not do what the bureaucrats says it does. Florida State Representatives: Qualifying is still open. The texting bill will be back. They might finally change the no-fault insurance law but have no clue on what will happen to motorcyclists. The Center for Urban Transportation Research (CUTR) has acknowledge that time might be right for a mandatory motorcycle bill, since ABATE is comprised of older members. Last session saw bills that would put all riders under 21 in a helmet; mopeds and motorcycles under 50cc. No safety stats, just some statements on how law enforcement could be confused by the present laws. Volusia County Council: The developers are pouring in money. The candidates will not listen to you after the elections. Constitutional Amendments: The following are from the committee and are bundled. VICTIMS RIGHTS AND JUDGES (Amendment 6): It would establish a series of rights for crime victims, including the right to be notified of major developments in criminal cases and the right to be heard in legal proceedings. It would increase the mandatory retirement age for judges from 70 to 75. It would provide that judges or hearing officers should not necessarily defer to the interpretation of laws and rules by governmental agencies in legal proceedings. FIRST RESPONDERS AND HIGHER EDUCATION: (Amendment 7): It would require the payment of death benefits when law enforcement officers, paramedics, correctional officers and other first responders are killed while performing official duties. It also would apply to Florida National Guard and active-duty military members stationed in Florida. It would establish a governance system for the 28 state and community colleges. It would require a supermajority vote by university boards of trustees and the Board of Governors when raising student fees. PUBLIC SCHOOLS (Amendment 8): It would impose an eight-year term limit on school board members. It would allow an alternative process for approving public schools, including charter schools, rather than by local school boards. It would establish a requirement for the teaching of civic literacy in public schools. OIL DRILLING AND VAPING (Amendment 9): It would prohibit drilling for gas and oil in state coastal waters and ban vaping and the use of electronic cigarettes in workplaces.

8 GOVERNMENTAL STRUCTURE (Amendment 10): It would require all charter -county governments to have elected constitutional officers, including sheriffs. It would lead to the Legislature beginning its annual session in January in even-numbered years. It would create an Office of Domestic Security and Counterterrorism in the Department of Law Enforcement. It would revise the constitutional authority for the Department of Veterans Affairs. Sheriff Chitwood has asked everyone to vote yes. PROPERTY RIGHTS AND HIGH-SPEED RAIL (Amendment 11): It would remove language that prohibits aliens ineligible for citizenship from owning property. It would remove obsolete language that authorizes a high-speed rail system. It would revise language to make clear that the repeal of a criminal statute does not affect the prosecution of any crime committed before the repeal. ETHICS (Amendment 12): It would impose a six-year lobbying ban on former state elected officials, state agencies heads and local elected officials. It would also create a new ethics standard that would prohibit public officials from obtaining a disproportionate benefit from their actions while in office. GREYHOUND RACING (Amendment 13): It would ban greyhound racing at Florida tracks after Dec. 31, Traffic Safety Facts-Motorcycles 2016 Data The MRF Reports had an article about Traffic Safety Facts-Motorcycles 2016 Data, issued February The article pointed out that NHSTA has made a big deal about the 5.1 increase from 2015 to 2016, but fail to mention that from 2014 to 2015 the increase was 8.0%. In a separate report 2016 Fatal Motor Vehicle Crashes Overview, issued October 2017 it mentions in the first sentence the 5.6 increase in total vehicle fatalities from 2015 to 2016 is still less than the 8.4% increase from 2014 to A different slant altogether. Reports about motorcycles are always slanted about how helmets could make the numbers better but offer no proof. These people get paid a good buck to write these slanted reports. The MRF article did mention "when we look at the motorcycle fatality rate per registered motorcyclists between the jurisdictions that have mandatory helmet laws and those we don't, we see less than a 1% difference". The MRF article did not mention reports by name. I am not so sure so I looked it up myself. Motorcycles are registered, motorcyclists are licensed. Numbers are from the NHSTA website and you have to dig for them. We had a few rainy days so I rolled up my sleeves. These numbers use to be available in the yearly NHSTA Traffic Safety Facts-Motorcycles. They stopped after they realized motorcycle rights organizations were using them to change mandatory helmet laws. After all these years, it is still the same, of the 10 safest states, a majority allow freedom of choice, 7 out of 10 using 2015 data. Only three states allow minors freedom of choice with all the others ranging from 18 to 21 years old; listed by the Institute as 17 & 20.
