3 PRESIDENT S MESSAGE Bike week is over hope everyone had a safe one. It s now time to look ahead to the Abate fall festival, I hope we can get some volunteers from our chapter for this event. Elections for our chapter start at the April meeting. I hope to see you there. Ride safe and enjoy the ride! Frank-Cupcake President VICE PRESIDENT MESSAGE Bikeweek 2015 is over and I'm hearing from a few of the promoters that attendance was down 30 to 40 percent. Some say people up north couldn't get to their bikes for the snow others are blaming it on the 75th anniversary this year in Sturgis. Everyone thinks next year...daytona's 75th will be a BIG event..so get ready!! (I'm leavin town!!) Hoping to see everyone at the next meeting on Thursday, April 2nd at 7:30pm and as always..a big Thank You to the Fraternal Order of Eagles #3800 for hosting our meetings. Fraternal Order of Eagles, Ormond Beach, FL 3274 By: Bobby Colella President (Frank) Meeting called to order 7:30 PM and conducted the Pledge of Allegiance and moment of silence. Opened discussion on insurance for rallies and rides, as well as when we do have a ride that the number of participants must match the number of riders. Please ensure you use your full name, not your road name/nickname. In the future we will have a separate sign in area prior to staging for the rides. If participants are under the age of 18, their parents/guardians must sign. 10 minute time limit for all speakers has be re-introduced. Vice President (Geno) Announced the State meeting that ABATE will be transitioning from ABATE of Florida Inc. to ABATE of Florida Safety and Education (501c3). NCOM meeting is in May for those who want to attend. This year it will be held in Colorado Springs, CO. Secretary (Bobby C) Motion to accept February meeting minutes as published, motion accepted. Treasure (John) Read the financial report regarding the chapter finances for Feb. Motion made to accept report as stated. Motion passed. Ideally you would get the latest legislative news and press releases. Contact the State Legislative Trustee, Darrin Brooks, to get on his list. He sends news reports of legislative activities on a myriad of topics, not necessarily those that ABATE is involved in. If you are on these lists, you will get the latest alerts regarding bills when they are being heard in committee. At times you will be asked to contact committee members to provide a push to get them heard. Some things DO move quickly and a lot can happen in a month which could use input from our members. Rights Rally April 20. Tallahassee; Special election April 7, Senate District 6 Travis Hutson Republican (State Representative District 24), David Cox Democrat House District 24 Paul Renner Republican (NRA endorsed), Adam Morley Democrat ABATE of Florida supports enhanced penalties for those who injure or kill vulnerable road users. In 2005, our lobbyist, Doc Reichenbach, was successful in getting an amendment to a bill that changed the following statues so the word shall replaced may which means MUST Mandatory hearings for those who are involved in an accident with severe injury or death (5) the actual stiffer penalties for those under $500 for causing incapacitating injuries, $1000 for causing death. (The same year, Doc was able to get the apehanger law changed to shoulder height.) After the bill became law, it took a letter to the head 7 th circuit court judge to revise the memo dealing with sentencing guidelines, despite DHSMV sending memos to all circuit courts on new laws. Currently, if judges are aware that an injury or death occurred at all, they usually withhold adjudication if you have a lawyer. In Volusia County reckless driving charges never seem to be used. So now we need more laws. Our chapter would prefer backing off on enhanced penalties. However, the ABATE state delegation believes that since there is so much minimum mandatory laws, motorcyclists should get something for themselves. There needs to be something between a $122 ticket and vehicular manslaughter to get the attention of those with poor driving skills. In recent sessions, committee chairmen have sat on this bill. ABATE of Florida will seek State funding for our Motorcycle Safety and Awareness Program. These funds come from an additional fee paid only by motorcycle registrations under FS (1) (c). It was taken out of the budget last year and vetoed the year before. DHSMV Ridesmart program has been established so this will be a tough sell. TALLAHASSEE: These are the statues I check bills for: (3b) $10000 medical coverage requirements for helmetless riders (1) PD Financial Responsibility exemption for motorcycles routed to (3) (3) PIP No Fault exemption for motorcycles; Motor vehicle means any self-propelled vehicle with four or more wheels ENHANCED PENALTIES FOR THOSE WHO KILL OR INJURE VULNERABLE ROAD USERS CS/HB231 Transportation Passidomo; Revises provisions relating to the rights & safety of vulnerable users (includes motorcycles) of public rights-of-way; prohibits assault of bicycle riders; revises provisions for careless driving; provides penalties for specified infractions contributing to bodily injury of vulnerable users; requires traffic law & substance abuse education courses to include certain instruction; requires driver license examinations to include test of applicant's knowledge of certain traffic laws; requires driver education courses offered by school district to include certain information. HB 231 passed successfully out of its first committee (Highway & Water Safety Subcommittee)! Doc was there and was able to speak in support of the Bill very successfully. ABATE of Florida is supporting this bill. The penalties are weaker and I think the passing in a no passing zone needs work. Death $5000 fine, 180 days house arrest, revoke license 1 year THE YEARLY MASSIVE HIGHWAY AND TRANSPORTATION BILLS SB702, 704, which deal with cleanup of statues, are already in messages; CS/ SB1184 (references ), SB1186, SB1456, SB1554, HB7055, HB7071 RED LIGHT CAMERA HB7071 Traffic Control HB4025 Traffic Infraction Detectors: Repeals provisions relating to installation & use of traffic infraction detectors to enforce specified provisions when driver fails to stop at traffic signal. LIABILITY INSURANCE HB803 Motor Vehicle Liability Insurance Trujillo: Revises legislative intent with respect to financial responsibility for damages caused by operation of motor vehicle; increases financial responsibility limits with respect to bodily injury or death; revises required threshold limit for self-insurers; repeals Florida Motor Vehicle No-Fault Law; provides for termination of personal injury protection policies; requires maintaining minimum security requirements allowing person to respond to property damage & bodily injury by certain

7 date; requires insurer to notify insured about such changes by certain date; provides for applicability of suspensions for failure to maintain security; conforms provisions. HB819; HB805 Pub. Rec. /Bodily Injury Liability Insurance Policies; SB976; SB1266 Increase liability amounts if you are in an accident; SB1268 Pub. Rec. /Bodily Injury Liability Insurance Policies; SB1326 Transportation Network Companies CELL PHONES There are many bills files that expand the penalties for using cell phones. I am not including them in my published legislative report. Motorcyclists know texting is the worst form of distracted driving. Eating your French Fries after the drive thru window is also distracting. ABATE of Florida has no position on these bills. We finally got a texting statue last session. Public awareness is being raised with interstate message boards and TV commercials. But in the Florida tradition of criminalizing America, there are several bills increasing restrictions and fines. GUN DISCHARGE I will not be tracking these, but Darrin probably is. At issue is home gun ranges and there are bills to totally restrict this to letting local government decide. SPEED TRAPS HB421 Traffic Enforcement Agencies and Traffic Citations: Designates counties & municipalities as traffic enforcement agencies; prohibits establishing traffic citation quotas; requires county or municipality to submit report of its traffic citation revenue & its expenses for operating law enforcement agency during fiscal year to Legislative Auditing Committee. CS/SB264 Traffic Enforcement Agencies and Traffic Citations: Designating counties and municipalities as traffic enforcement agencies for purposes of the section and prohibiting them from establishing traffic citation quotas; requiring a county or municipality to submit a report of its traffic citation revenue and its expenses for operating a law enforcement agency during a fiscal year to the Legislative Auditing Committee under certain circumstances, etc. SENATE BACKS PLAN TO END SPEED TRAPS Pointing to a long-running controversy about a speed trap in the small North Florida town of Waldo, a Senate panel Wednesday approved a proposal to make clear that local police officers cannot have quotas for writing traffic tickets. Sen. Rob Bradley, a Fleming Island Republican who is sponsoring the bill (SB 264), said quotas have long been banned for state law-enforcement officers. But he said questions remained about whether the ban applied to local police. Along with clearing up that question, the bill would require cities or counties to publicly report if revenue from traffic tickets exceeds 50 percent of the costs of operating their law-enforcement agencies. Such disclosure could indicate whether local governments are relying on tickets to pay for police services. "I think the more information, the better,'' Bradley said before the Senate Transportation, Tourism and Economic Development Appropriations Subcommittee unanimously approved the bill. Waldo, along U.S. 301 near Gainesville, was accused for years of being a speed trap. The issue ultimately led to the town's police department being disbanded last year after officers said they had been placed under a ticket quota. The Florida Police Chiefs Association and the Florida Police Benevolent Association signaled support for the bill during Wednesday's meeting. Bradley's district includes Waldo, which now gets police services from the Alachua County Sheriff's Office. BODY CAMERAS. Daytona Beach Police Chief Chitwood likes body cameras; however is this a form of an unfunded mandate? The Feb legislative report has more details. SB248 Recording of Law Enforcement Activities Smith: Citing this act as the "Police and Citizen Protection Act"; requiring uniformed officers assigned primarily to patrol duties to be equipped with body cameras; exempting the recordings of such activities from specified provisions relating to the interception of wire, electronic, and oral communications, etc. HB57 Recording of Law Enforcement Activities Jones, S. and Williams, A. (CO-SPONSORS) Van Zant: Designates act "Police and Citizen Protection Act"; requires uniformed officers assigned to patrol duties to be equipped with body cameras; requires use of such cameras during specified activities; exempts recordings of such activities from specified provisions relating to interception of wire, electronic, & oral communications. (2) Every uniformed law enforcement officer in this state who is primarily assigned to patrol duties shall be equipped with a body camera while performing such duties. The camera

8 shall be used by the officer to record activities that take place during motor vehicle stops or other law enforcement actions taken during the course of his or her official duties. OTHER HB197 Tracking Devices or Applications: Prohibits use of tracking device or application to determine location or movement of person without person's consent; creates presumption that consent is revoked upon initiation of specified proceedings; provides exceptions. SB1186 Transportation Brandes: Providing that certain commercial sponsorship may be displayed on state greenway and trail facilities not included within the Shared-Use Nonmotorized Trail Network; requiring the governing body of any independent special district created to regulate the operation of public vehicles on public highways to consist of a certain number of members; authorizing a public transit provider to enter into agreements with a transportation network company for the provision of certain transit services, etc. Sometimes things will get tacked on to innocuous bills SB1162 Driver Licenses: Sachs: Decreasing the fee for the renewal or extension of a Class E driver license or a license restricted to motorcycle use; decreasing the replacement fee for a driver license; revising the allocation of such fee; providing that any veteran honorably discharged from the Armed Forces who has served at least 1 day during a wartime period and who is qualified to obtain a driver license under this chapter is exempt from all fees required by this section, etc. WASHINGTON DC CHECKPOINTS H.R Stop Motorcycle Checkpoint Funding Act: Rep. Sensenbrenner states I will be reintroducing H.R. 1861to protect motorcyclists rights and promote crash prevention as the most effective use of taxpayer money to save motorcyclists lives. Pulling law abiding motorcyclists off the road does not make anyone safer is a waste of taxpayer money and is law enforcement harassment at its worst, said Jeff Hennie, Vice President for Government Relations and Public Affairs for the MRF. ETHANOL H.R. 21 U.S. Rep. Jim Sensenbrenner (R-Wis.) This bill would repeal the U.S. Environmental Protection Agency s waiver decision related to E15 fuel and the authority of the agency to grant further decisions in the matter, until the EPA seeks an independent scientific analysis of the effects of gasoline containing up to 15 percent ethanol. From the MRF March 9, 2015 The WiFi Innovation Act of 2015 Congress wants more wi-fi available to the general public, and in order to do so, both the U.S. House and Senate have legislation to explore one possibility of getting you a new way to access a wireless signal. Congressmen Bob

9 Latta (R-OH) has introduced H.R. 861 and Senator Marco Rubio has introduced S 424, and both do the same thing. They order a test to see if a wi-fi signal can coexist with the incumbent licensee on the megahertz (MGh) band. Currently the most popular band for wi-fi is 2.4 and the incumbent licensee for the MGh is vehicles. The license was dedicated for use by vehicles in 1999 by the FCC, before wi-fi was even available for public use. The Motorcycle Riders Foundation (MRF) is tracking this issue because like all driver assist technology, we fear that this will reduce the amount time drivers spend watching the road. Technologies that take the actual operators out of the equation are always worrisome; this is no different. If operators become accustomed to not needing to pay attention for red lights and stop signs, we all know that will pose problem for motorcyclists, said Jeff Hennie Vice President of Government Relations and Public Affairs for the Motorcycle Riders Foundation. The MRF does not currently have a position on this issue. The distracted driving portion of this issue is completely separate from this legislation. This legislation simply conducts a technical test to see what's possible with modern technology. The distracted driving issue will always be part of the discussion as more and more technology is employed by vehicles. March 11, 2015 Congress looks at Vision Zero Vision Zero is the concept that it is possible to drop the fatalities within the road transportation community to zero and that it should be done at all cost. Vision Zero plans are lofty and admirable, but the approach is just not plausible. At the core of Vision Zeros philosophy, life and health can never be exchanged for other benefits within the society, rather than the more conventional comparison between costs and benefits, where a monetary value is placed on life and health, and then that value is used to decide how much money to spend on a road network towards the benefit of decreasing how much risk. The plan also places human life and health as a priority over mobility and other objectives of the traffic system. It also describes how we should build roads with no possibility of a side or frontal impact, and prohibition to use those roads on more vulnerable road users. Another part of plan is speed limits; should the plan be adopted in full American speed limits would plummet to 19 miles per hour in areas where there is contact between pedestrians and cars, and 43 mph for all other roads. The creators envisioned a slow moving, padded fantasyland right at home in a Disney movie, not the real world. Vision Zero began in Sweden in 1997 and has since been adopted in some part at least by Netherlands and United Kingdom. In the United States some major cities are also adopting the concept; so far New York, Portland, and San Francisco are all on board. A lawyer in Boston gives out a law school scholarship in the attempt to get the city to take look at considering the idea. Last week Congressman Earl Blumenauer (D-OR) introduced H.R. 1274, a bill that would make money available to local governments to develop and implement Vision Zero plans. A mandatory national helmet law would just be the jumping off point. Make no mistake that the full implementation of Vision Zero in America would eliminate motorcycling as its known now. Of course it is everyone s wish that no one would become injured or killed on our roads. Every life is precious and every American should do all in their power to reduce bloodshed on the roads. But simply slowing every vehicle and prohibiting other vulnerable vehicles from the traffic mix, all while padding the roadways and interior of vehicles and installing cameras everywhere to find the scofflaws, is the stuff of science fiction, not the real world. Vision Zero has a blind spot; it does not take into account any budget, financing or the effects on the economy by slowing traffic. Zero fatalities is always the goal, however when you have moving parts operated by human beings traffic safety will always have a component that will never be a control for: human behavior.
