3 PRESIDENT S MESSAGE Another Biketoberfest in the books and according to the Florida Highway Patrol there weren't any fatalities to report. Last year there were 3. I was seeing light crowds in the beginning of the week and then bam..everyone showed up at once! You couldn't have asked for better weather and I hope everyone had a great time. I sure did. Also, we had a few chapter members attend the Abate State Autumn Bikefest in Avon Park on the first weekend of October, and we'll try to get a report from Frank at the meeting. I heard that it was a success financially and I'm looking forward to next year's party. Thank you to everyone for coming to last months meeting and hoping to see you this month too. Our VP Alfy was at the State meeting in Hillsboro County and I'm sure he has a lot to tell. We'll see if he stayed for the "Spooks and Scoots" party that was afterward. So come on out, find out the latest and greatest and support your chapter!! Also..don't forget..the snowbirds are back in town, so be careful out there!! Look twice! Happy Thanksgiving to all!! Geno President Daytona Beach Chapter It looks like the weather has finally broke, less rain and much better temps to get out and put some miles on. The ride over to the State meeting was great, took all back roads home from Dade City and really enjoyed the ride and scenery. Biketoberfest looked to be fairly busy this year and we made it through without and fatalities, hopefully this trend will continue. I would like to thank the Eagles for the use of there facility for our meeting and hope to see everyone out for the next one on Thursday November 5th. Everyone stay safe out there!!! Fraternal Order of Eagles, Ormond Beach, FL By: Frank Molinario President (Geno) Sgt. at Arms Grog called meeting to order at 7:36 p.m. (19 riders in attendance). Group recited the Pledge of Allegiance and a moment of silence was observed. Geno talked about Biketoberfest coming up and reminded everyone of the state party coming up on October 17 th. Vice President (Alfy) Alfy chose to wait for his report until after everyone else gave an update. Secretary (Frankie) Secretary report accepted as written. Frankie gave an update on what was happening in Waco and encouraged everyone to read the articles coming out from different sources. Most of the newer articles depict what occurred as a massacre or a military-style execution on the part of the Waco PD rather than what was originally reported as gang-violence. PR raffle tickets being sold for state (drawings: $7K, $2K and $1K) during bike week. Drawing to be held on Saturday. Treasure Treasury report given by John Banta. Sergeant at Arms (Grog) no report given. Membership Steve reported out on membership and stated he would be out for Nov. meeting. Safety (Mike) People coming in for Biketoberfest. Watch out for others that may have had too much to drink. Take keys away if possible. Legislative (John) reported out on House appropriations bill and all updates to current legislation. Products (Frank) Verbal presentation of our products. Geno suggested putting pictures of items in the newsletter. Discussion about having clothing and other items available during meetings. Old Business Alfy discussed current by-laws and not moving forward with the proposed changed. Instead, suggested that we enforce our by-laws as written. Told everyone he was riding out Sat. morning at 10am if anyone wanted to join him. New Business Bobby brought up a nationwide motorcycle profiling survey that was introduced and requested we post it on the ABATE website. Roller (Sons of God) asked for participation in the blanket drive they are hosting in Nov. Also, the ARM toy run was discussed and will be held in Dec. Good of the Order Mongols MC announced official win with the Federal Gov. regarding their patch. Lisa Ling with CNN will give a special report called this is life on the Mongols Nation on Oct. 7 th at 9 p.m. EST. Meeting Adjourned Closing prayer bymagic Man (Soldiers for Jesus). He sends news reports of legislative activities on a myriad of topics, not necessarily those that ABATE is involved in. Consider signing in to the MRF or AMA alerts. Sometimes issues do move quickly. Sometimes the alerts actually give the bill numbers. TALLAHASSEE The 2016 session is early this year, for the Senate January 12 to March 11, The ABATE rights rally is scheduled for February. Bills are being filed NOW. Nov 20, 2015 is the Senate deadline for submitting requests for drafts of general bills and joint resolutions, including requests for companion bills. Abate of Florida is preparing for the 2016 session. The DHSMV 2014 Traffic Crash Facts are out. Fatality/Accident Ratio; Helmeted Riders.041; No Helmet.049; No Helmet & Non-DOT Helmet & Unknown.046 Enhanced Penalties for those who injure or kill vulnerable road users. I printed this in Dec Richard Mathew (Hathew) Shea, 27 Deland, hit John Corbin, 64 Deland, from behind when Corbin slowed at for an intersection. Corbin died 3 days later. Shea had 15 citations between 2006 and He had been charged with careless driving which is a fine. His judge is Robert Saunders Jr. Pled Guilty Paid $189 on Dec. 11, (2014). Fine ; Delinquency Fee 16.00; D-6 Affidavit 7.00 Listed on the citation: Injury to another Yes; Serious Bodily NO; Fatality NO WHAT S UP WITH THIS? Someone is dead and this slips thru the cracks? Crummy follow up FHP. It is a $1000 fine for popping a wheelie. We have dead bodies & damaged vehicles but crummy drivers are walking out of court with just a ticket under $200, IF THAT. Last session bills for vulnerable road users passed all committees, passed the Senate, House bill was replaced by the Senate s bill. The bill died because the House went home early. So much for Let s Get to Work. The following are bills that have been filed fir session These are not ABATE bills but rather bills ABATE is supporting. While these bills have language specifically for bicyclists, it benefits motorcyclist too, primarily to try to force automobile drivers to be more aware of vulnerable road users. Last session, our lobbyist, Doc Reichenbach, did have input on a well written Senate bill that had some teeth. Unfortunately that bill fell by the wayside to the meeker bicycle bills. HB253 Highway Safety Passidomo Provides criminal penalties for certain noncriminal traffic infractions that cause serious bodily injury or death to person; revises provisions relating to operation of bicycles; revises provisions relating to passing of vehicle; revises provisions relating to careless driving; provides penalties for specified infractions contributing to bodily injury of vulnerable user; requires hearing for specified offenses; directs law enforcement officer issuing citation for specified violations to note certain information on citation Line654 2 nd accidents causing bodily injury or death, within 5 years, would become a misdemeanor 1 st degree. 3 months license suspension. Nothing surprises me anymore about Florida drivers. Are there are individuals who have killed people in separate accidents? Line 688 Those passing vulnerable road users, including motorcycles, have to be 3 away or further Line 706

6 If a violation of this section ( Passing Vehicles) contributed to the bodily injury of a vulnerable user of a public roadway, the law enforcement officer issuing the citation for the violation shall note such information on the citation. They are suppose to do this now Line 753 (3) This section does not apply to a person who safely and 753 briefly drives to the left of the center of the roadway or pavement striping only to the extent necessary to: (a) Avoid When an obstruction; exists making it necessary to drive to the left of the center of the highway, nor (b) Turn To the driver of a vehicle turning left into or from an alley, private road, or driveway; or (c) Comply with the requirements regarding a safe distance 760 to pass a vulnerable road user, as required by s (2). To comply with the 3 rule, motorists can pass in a no passing zone. THIS NEEDS SOME WORK. WILL WE HAVE CARS PASS MOTORCYCLES WHEN WE LEAST EXPECT IT? Line 821 If a violation of this section ( Turning at Intersections) contributed to the bodily injury of a vulnerable user of a public roadway, the law enforcement officer issuing the citation for the violation shall note such information on the citation. They are suppose to do this now Line 837 If a violation of this section ( Careless Driving) contributed to the bodily injury of a vulnerable user of a public roadway, the law enforcement officer issuing the citation for the violation shall note such information on the citation. They are suppose to do this now Line Infractions contributing to bodily injury of a vulnerable user of a public roadway. In addition to any other 889 penalty imposed for a violation under s , s , or s , if the violation contributed to the bodily injury of a vulnerable user of a public roadway as defined in s , the law enforcement officer issuing the citation for 893 the infraction shall note such information on the citation and the designated official may impose a fine of not more than $2,500. Increases the fine for serious bodily injury from $500 to $2500 at the judge s discretion, may versus shall. THIS IS IT, THIS IS WHAT ABATE OF FLORIDA IS GOING TO CONCENTRATE THEIR EFFORTS FOR. Line 912 (6) Any infraction of s , s , or s which contributes to bodily injury of a vulnerable user of a public roadway as defined in s If an infraction listed in this subsection contributes to the bodily injury of a vulnerable user of a public roadway, the law enforcement officer issuing the citation for the infraction shall note such information on the citation Here it is again, Law enforcement is suppose to do this now SB332 Traffic Safety Altman Prohibiting passing and turning in front of a vulnerable user in an unsafe manner; providing penalties; providing fines and penalties for specified infractions contributing to bodily injury of a vulnerable user; requiring a hearing for specified offenses, etc. Line Infractions contributing to bodily injury of a vulnerable user of a public roadway. In addition to any other penalty imposed for a violation under s , s , or s , if the violation contributed to the bodily injury of a vulnerable user of a public roadway as defined in s , the designated official shall impose a fine of not more than $2,000. Funding for ABATE s Motorcycle Safety and Awareness Program. This has been vetoed, removed and vetoed the last 3 years. The DHSMV is actually using the same $2.50 per registration fee for their Ride Smart Program (

7 There are other issues that Daytona Beach chapter is concerned about: draconian laws, equal access and profiling. Profiling This is from the Motorcycle Rights Foundation Agenda It is in their latest agenda MRF will oppose any motorcycling, motorcycle, or motorcyclist-based discriminatory legislation or rules proposed by the U.S. Congress or by a federal agency MRF to oppose any motorcyclist profiling legislation or rules this upcoming congressional session From Bobby C: Below you will find a link to the National Motorcycle Profiling Survey. It would be great to see Florida ABATE members embrace this survey and get max participation. The intent of this survey is to get enough safety, profiling, and discrimination information for not only Florida, but the entire Nation by the New Year to help our lobbyist wage an effective campaign with relevant current data and statistics. From the opening page of the survey: What is the intent of this survey & why should I take it? First and foremost, we want to thank you for participating in the National Motorcycling Profiling Survey (FY 2016), your feedback is an important step in identifying the issues and trends that impact the motorcycling community. The data collected in this survey will help motorcyclist rights advocates throughout the country gather information that is needed to build an effective argument in the request for legislative relief in protecting all aspects of your motorcycling lifestyle. Moreover, this survey will provide quantifiable up-to-date data from a national perspective, as well as a state and local perspective. This information will help identify the geographical areas that have a higher propensity of motorcycle profiling and discriminatory acts directed towards bikers. This survey will also help identify the core issues and support legislative relief efforts on a state and national level. We would also like to identify the biker friendly areas and share this information with the communities so they can look into the best practices and what is working, and help build a better social environment for all. This survey will take about 15 minutes to complete. HOWEVER, it will provide a lifetime of benefits. In its entirety, this survey will run no less than 12 months with quarterly updates published through the sponsors' websites, the first quarterly update will be released around 1 January We are seeking cosponsors for the FY2, FY3, and FY4 quarterly update releases. If you or your organization is interested in cosponsoring this survey, please contact David "Double D" Devereaux at: doubled@motorcycleprofilingproject.com or Bobby "C" Colella at: bfcbobby386@gmail.com WASHINGTON DC It always comes back to helmets From the MRF alert, Oct. 18, PUSH FOR HELMET LAWS Right now, the push for motorcycle helmet laws is stronger than ever. Its bigger than a handful of the usual government agencies pushing for mandatory helmet laws, It is that of course too, but there is another factor at work as well. And its a very natural thing to happen, the desire to protect children. Many skate parks, bmx parks, horse rides, go carting, etc all now require helmets for youngsters, and we are ok with that. So long as that the continues the likely hood of keeping states helmet law free gets slimmer. But it certainly is coming from agencies and departments all over the country, and its getting nasty. Recently at the State Motorcycle Administrators annual conference the Vice President of Government Relations for the Governors Highway Safety Association, Erik Strickland, touted the benefits of an Obama backed transportation plan that would have given the federal Department of Transportation back the ability to lobby state legislatures about implementing helmet laws. Then in the next breath, he referred to the language in the transportation currently working its way through Congress, and is likely to pass soon, Specifically he called the language to stiffen the lobby ban to the whole of the federal government, state governments and local governments, A real pain in the ass. That bill also contains language that would commission a study to determine the best practices to avoid motorcycle crash in the first place. Saving lives instantly. Is that also a real pain in the ass Erik Strickland? Thats your governors direct pipeline for ideas for state law. In recent publication by the Insurance Institute for Highway Safety they had a two page article about the actions that the National Highway Traffic Safety Administration has taken to enforce helmet laws by law enforcement officers. The proposed rule by the safety agency would effectively give law enforcement the ability to

8 H.R. 21 U.S. Rep. Jim Sensenbrenner (R-Wis.) This bill would repeal the U.S. Environmental Protection Agency s waiver decision related to E15 fuel and the authority of the agency to grant further decisions in the matter, until the EPA seeks an independent scientific analysis of the effects of gasoline containing up to 15 percent ethanol. BLACKBOX PRIVACY H.R.2526 Black Box Privacy Protection Act Amends the Automobile Information Disclosure Act to require manufacturers of new automobiles to disclose on the information label affixed to the window of the automobile: (1) the presence and location of an event data recorder (commonly referred to as a "black box"), (2) the type of information recorded and how such information is recorded, and (3) that the recording may be used in a law enforcement proceeding. NON-MOTORCYCLES CURRENTLY CLASSIFIED AS MOTORCYCLES S685 Autocycle Safety Act HR 2892 Autocycle Safety Act This bill defines "autocycle" as a motor vehicle with three wheels, a fully enclosed occupant compartment, and a steering wheel, which is subject to applicable federal motor vehicle safety standards. Specified interim automotive and motorcycle safety standards apply to autocycles until at most three years after enactment of this Act, by which time the Department of Transportation shall issue appropriate final rules, interpretations, and test procedures. Automotive fuel standards also apply to autocyles. OTHER H.R.1102 Police Accountability Act of 2015 Rep. Henry Johnson D GA Introduced Feb. 2015, 12 Democrat Co-sponsors. Amends the federal criminal code to require a state or local law enforcement officer in a public agency which receives federal funding under the Edward Byrne Memorial Justice Assistance Grant Program, who engages in conduct in the line of duty that would constitute murder or manslaughter if it were to occur in the special maritime and territorial jurisdiction of the United States, to be punished as provided for that offense under federal law. This bill would make any police shootings come under federal scrutiny. Then again, do you trust the federal government? They are the ones that classify which clubs are gangs. LOCALLY The Chapter has discussed lobbyists. Here is some past stuff I have printed: If you re not at the table, you re probably on the menu Rep. Dwayne Taylor This is why ABATE of Florida has a full time lobbyist, Doc Reichenbach, whose only client is us. In 2011, Harley had four lobbyists in Florida; all who work for Floridian Partners, LLC. Each represents many interests: Jorge Chamizo 23; Charles Dudley 27; Scott Ross 8; Elizabeth Webster 14. Lobbyist or their firms are required to list their compensation from the individual interests they represent. The compensation is reported in a range for each quarter. For 2011, Harley paid Floridian Partners $10000 to $29999; $10000 to $29999; $10000 to 29999; $1-to $9999. So Harley paid $30001 to $ And that is just Harley, what about all the other interests. Harley Davidson was marketing a motorcycle with vertical plates. The Floridian Partners lobbyists were responsible for the ludicrous transponder requirement for those who wish to have vertical license plates. In 2012, Doc Riechenbach was able to get the statue changed in a massive DHSMV bill. There is another lobbyist group, Peeples, who judging from the compensation listing, did work for the off road trail riders for cheap. Apparently personally tied to this segment of motorcyclists. That is how it works. Lobbyists get contracted for a single objective. We have had other lobbyist before. We had a lady named Sandy, who did not think about other legislation than might affect us. We had another fellow whose objective was to get Sunday helmet free riding so that statistics could be compiled. A bill got filed that went nowhere. The other fellow reported to a chapter president instead of the State president. None of these lobbyists made reports to the State delegation. We also had Bones, an ABATE member and motorcyclist. Our current Lobbyist, Doc Reichenbach, who we pay $50000/year, covers ALL legislation. Having a lobbyist is not a sure fire way of a group reaching their goals. There has to be grassroots contact with legislators.

9 pull over, ticket, or worse, any motorcyclists wearing a helmet that the officer felt did not meet the new appropriate standards with a visual test on the road. So, should this rule become final, and that is almost a certainty at this point, any helmet that appears, to a traffic cop, to be less than one inch in the thickness can pull you over for further inspection. Of course the Insurance Institute publication just echoed the same un truths that all of the other safety groups march out. It is interesting and troubling that the agencies that are charged with making things safer, most who don't ride motorcycles, do not care to listen to the very people they are trying to protect. Bureaucracy at its best. Then, in the Wall Street Journal this week was an article where groups of bicyclists are opposing mandatory bicycle helmet laws. They say mandatory helmet laws, particularly for adults, make cycling less convenient and seem less safe, thus hindering the larger public-health gains of more people riding bikes. They think that more bicycles on the street will result in greater degree of visibility in numbers and therefore reduce injuries and fatalities. Cycling advocates are quick to say they re not anti-helmet. Instead, they re opposed to helmet laws and their unintended consequences. Sound familiar? Make strange bedfellows. For all is not lost. We need to stay engaged and active. We, the guardians of motorcycling, must do what those before us and those before them have done. A fight is brewing and we need to be ready. The forward force to pass mandatory helmet laws is swelling. We need to push back with a tidal wave. HIGHWAY APPROBRIATION H.R. 22 Developing a Reliable and Innovative Vision for the Economy Act or DRIVE Act This bill passed the House in January. It then passed the Senate in July. In the engrossed amended Senate version, which is for six years, is the language to end federal funding of motorcycle-only roadside checkpoints is in the bill. But this bill now goes back to the House, which has funding issues with what the Senate finally passed. The specific language reads: SEC SHORT TITLE. This part may be cited as the ``Stop Motorcycle Checkpoint Funding Act''. SEC GRANT RESTRICTION. Notwithstanding section 153 of title 23, United States Code, the Secretary may not provide a grant or any funds to a State, county, town, township, Indian tribe, municipality, or other local government that may be used for any program (1) to check helmet usage; or (2) to create checkpoints that specifically target motorcycle operators or motorcycle passengers. SO, the House is working on another bill So far in that bill, funding is denied for motorcycle only checkpoints and the NHSTA lobbying ban is tighten further to include state and local legislative bodies. CHECKPOINTS This is being addressed in the Highway bills H.R Stop Motorcycle Checkpoint Funding Act: Rep. Sensenbrenner S.127 Senators Shaheen (D-NH) and Ron Johnson (R-WI). ETHANOL Excessive ethanol will damage your engine. The EPA has backed off on forcing E15 on us, only because of the marketability. ABATE supported the bill, that passed, that now allows non-ethanol to be sold at regular Florida gas stations. While the chapter finds this issue boring, I scramble with different types of additives to minimize working on my carburetor. Some of us still ride older bikes..
