2 PRESIDENT S MESSAGE HOHOHO!! It's that time of year again! On Saturday December 1st we will meet at The Fraternal Order of Eagles, 190 S Nova Rd, Ormond Beach at 12pm and kick stands up at 1pm to ride together to the Daytona Re-Hab Center on 3rd St. in Daytona Beach. I think it's our chapters 25th year handing out gifts and seeing these residents smile that are going through tough times and need the extra help. They will be outside waiting to greet us upon arrival. There is a State Abate meeting in Naples on the 8th of this month and as always, if anyone is interested in going, the chapter will pay for your lodging and gas. Contact me asap and I will forward the details. It would be a nice little weekend getaway with the wife or girlfriend..or both! Next Chapter meeting is December 6th. No stats of Biketoberfest accidents yet. Next month state meeting December 8 th in Naples. December 1 st is the run to the Daytona Rehab. VP: Alfy Reported he will have more information at next meeting. Alfy was able to meet up with some of the politicians running for office. Treasurer: John- gave Treasury report. John has gun tickets for sale $5.00 per ticket. 7 Legislative Report November 22, 2018 John Banta Election results have indicated that a slim majority is happy with the status quo. As ABATE members, you were able to make a very informed decision. In Volusia County 1615 voters voted for Darcy Richardson for Governor and Nancy Argentziano for Vice Governor. Barbara Girtman took the County Council seat from Pat Paterson to Some of her votes were ABATE votes. The Volusia County State representatives are now all Republican: District 24 Paul Renner; District 25 Tom Leek; District 26 Elizabeth Fetterhoff; District 27 David Santiago. Office assignments are not yet finalized. Committee hearings start Dec 11-13, Jan 7-11, 22-25; Feb 4-8, 11-15, Session starts during Bike Week. Here are the issues that will affect motorcyclists. This is why we need a lobbyist. Texting While Driving a Primary Offense Motorcyclist see distracted drivers all the time. Last Session Reps. Leek &Santiago became co-sponsors; Sen. Perry was a sponsor for the Senate bill. Sen. Rob Bradley, as chairman of Appropriations was able to kill the Senate bill. He said it was over profiling concerns but he was not a co-sponsor the racial profiling bill. It passed the House but died in the Senate. Bicycle and Pedestrian Safety The previous session Senate bill would also provide safety to all vulnerable road users stopped on the side of the road. The House bill was changed to exclude motorcycles by House Transportation committee chairman Brad Drake. House bill passed 2 committees but died on the House floor. The Senate bill was never heard in the first committee, Transportation. ABATE of Florida supported this bill but our chapter was wary about bills creating new additional penalties. Motorcycle Safety and Education In July 2018 there were registered motorcycles in Florida, down from 2017(35184 in Volusia County). Those owners paid $2.50 to be used for motorcycle safety and awareness. That fee was originally asked for by motorcyclists to fund the Florida Motorcycle Riders Training Program. That program has evolved over the years. The subsidies for the riders beginning course have stopped and the funds are being used at the discretion of DHSMV with the remaining being transferred to the DHSMV general fund. Of note is that Kansas still has a similar program but instead of the safety schools applying for the rebates the individual students apply for a $50 reimbursement. For several years ABATE of Florida was able to use a portion of the funds for their Motorcycle Safety and Awareness program while the DHSMV did nothing. The DHSMV is now starting to use these funds wisely, specifically the Ridesmart program. ABATE will probably seek to try get some funding now that Scott is no longer Governor. Rep. Santiago is a supporter for us. The House bill to secure some funding was never heard in second committee and there was no Senate companion bill. Law Enforcement Practices (Racial Profiling) Last session bills were never heard in the first committees. These bills define and prohibit racial profiling. It would be nice to get these bills amended in committee to included motorcyclists but they just do not move. Politicians talk about profiling in the texting bills but the subject of racial profiling goes nowhere. Motorcyclists, especially those having organization insignia have also been subjected to profiling. Motorcycle and Moped Riders Last session, the Senate bill would of required a helmet for all persons, under 21 years of age, riding a moped or motorcycle under 50cc. Currently everyone under 21 has to wear a helmet for motorcycles over 50cc. Last session the House bill died in first committee; Senate bill died in 2nd committee, Appropriation Subcommittee. While the staff reports do not give any accident statistics to justify this change, apparently there are presently some challenges in compliance and enforcement. I guess we need to make it easier? The University of Florida ( who does make significant campaign contributions) is behind this, citing concern over their students. However there were no statistics on the number of UF students or anyone else under 21 who were hurt riding under 50cc motorcycles or mopeds. The Crash Report for 2017 has not been released. Last session our lobbyist got a promise
8 from a sponsor that this bill would not get amended to include those over 21. Amendments need the approval of the sponsor. Under 21 you get thrown under the bus. Motor Vehicle Insurance Last session bills tried to repeal Florida No- Fault Insurance Law. These bills would also create a PD and BI insurance requirement for motorcycle registration, although motorcyclist have always had to provide proof of financial responsibility after an accident. The Senate could not agree with the House bill over the issue of medical payment requirements. I have NOTHING that would support a motorcyclist exemption for the liability or medical payment insurance requirement. If you have assets it would be wise to spend about $100/year for $100,000 liability insurance. Those that ride without a helmet have our health insurance satisfying the current medical payment requirement. Will we have to purchase additional insurance? This is a complicated issue. I do not have faith that our legislators will be able to come up with something we will like WASHINGTON, DC Consider subscribing to the AMA or MRF Alerts. The AMA and MRF websites do have automated letters that will go to your congressman. The MRF letter can be tweaked before you send it. Congress is basically running out the clock, with little happening. We will have to wait till the next Congress. The MRF is gearing up to make sure provisions such as no funding for Motorcycle only checkpoints, NHSTA lobbying ban, continuation of Motorcycle Advisory Council get included in the next highway bill in Here are the bills that will be re-filed in 2019 Self Driving Cars: S.1885 AV Start Act. American Vision for Safer Transportation though Advancement of Revolutionary Technologies Act A bill to support the development of highly automated vehicle safety technologies, and for other purposes. The MRF is reviewing this bill to make sure motorcycles are recognized. EPA: S.203: HR.350 Recognizing the Protection of Motorsports Act of 2017 (RPM Act). These bills ensure that transforming motor vehicles, including motorcycles, into race cars or racing bikes used exclusively in competition does not violate the Clean Air Act. ETHANOL: E15, E30 and E85 will damage your motorcycle. The EPA is pushing E15 although my owners manual for my 2012 car says only use E10. Running E15 will burn up your engine, if it is not designed for it. HR1314 Renewable Fuel Standard Elimination Act Rep. Goodlatte 37 co-sponsors. Eliminates Renewable Fuel Standard in the Clean Air Act that sets progressive minimum volumes of renewable fuel to be on the marketplace. This is the best bill. It will not go anywhere since President Trump has publically called for increased E15 ethanol production. HR5855 Consumer Protection and Fuel Transparency Act of 2018 Rep. Austin Scott (R-GA) 7 co-sponsors. To require the Administrator of the Environmental Protection Agency to revise labeling requirements for fuel pumps that dispense E15, and for other purpose. Doc's buddy Rep. Lois Frankel (D-FL) is a co-sponsor. PROFILING : H.Res.318. Promoting awareness of motorcycle profiling and encouraging collaboration and communication with the motorcycle community and law enforcement officials to prevent instances of profiling. Sponsored by Rep Walberg. Note the registration numbers in the resolution ( , 2015). S.Res.154 is almost identical to H.Res.318 and is sponsored by Sen. Johnson. 7 cosponsors among them Sen. Jeanne Shaheen D-NH, Sen. Lisa Murkowski R-AK.
