2 PRESIDENT S MESSAGE Bikeweek in Daytona always takes me back to the 70's and my first trip to Daytona in 1977 as a kid that was only 17 with an $ Panhead in the stripped out backseat of my 68 Chevelle SS (with the front end and a handful of tools in the trunk). Was even a couple years before I had tattoos or could grow a beard AND when I had a full head of hair..lol So here we are..times have changed and there are hundreds of thousands of people and bikes in our area..so like I say year after year.. HAVE FUN..DON'T DRINK (too much) AND RIDE..BE SAFE AND LOOK TWICE..EVEN THREE TIMES...IT MIGHT SAVE YOUR LIFE!! Thank you everyone that attended our last months meeting..we had a great turnout with 10 new members. We hope to see you again at this months meeting on Thursday March 7th which just so happens to be the first day of Bikeweek. Afterwards, we will be riding to Troys Pub on Nova Road to kick off Bikeweek and check out the band..everyone's welcome and yes..colors are ALLOWED!! We have lots to talk about as we have the latest and greatest info from the State meeting in Ocala a couple weeks ago. I was there along with our very own, statewide known Legislative officer, John Banta and world famous membership officer..steve Fritze. Don't forget next months ride to the Capital for the 22nd annual Freedom Rights Rally and State Meeting in Tallahassee April 14th and 15th!! As always, please check your bikes and your friends that may be done visiting and haven't been on them for awhile due to the weather up north... tires, oil, and/or loose parts can cause for a bad ride if not properly taken care of. Be careful out there as there will be the usual traffic issues and people not familiar with the area everywhere. If you haven't checked out the MPP video of the profiling going on in our area, go to the Motorcycle Profiling Project website at videos/ / I hope that this is a thing of the past but I don't think it will stop till we all stand together and push our legislators to do something about it. DAYTONA BEACH CHAPTER February 7, :30 PM Kathy Holland Steve called meeting to order at 7:30 PM followed by Pledge of Allegiance and moment of silence for lost brothers and sisters. President:. State meeting this weekend. Anyone can go to the state meeting. April 14-15th run to the Capital. State meeting is on Sunday then ride to the Capital on Monday. John brought up the fact that he asked to cancel the Capital run because the Senators make plans and are not there to see us until late afternoon. By the time we ride home, it s dark out. This is part of reason so many people stopped riding to the capital. VP: Alfy : Alfy says we need more of a show up of bikes to the Capital. Last year there were less than 100 people show up. Bobby C called Alfy to let him know the city police were harassing the patch holders during bike week. Bobby talked about his video of the police hassle of patch holders. Alfy is going to put it on the agenda to the State to talk to Legislators. Bobby wants a short term fix. Asked the Outlaws if they want to do something l before bike week. 7 Legislative Report February 18, 2019 John Banta Session starts during Bike Week, March 5. Ride to Capitol Monday April 15. NCOM Convention Orlando Florida May 10,11,12, 2019 Hand Held Cell Phone Use Texting is the worst, but these bills make a primary offense of all handheld usage. A press release on the Florida Atlantic University study states that states with bans on handheld devices have differences in motorcycle fatalities as much as 11% compared to states with no bans. The Jan/Feb Masterlink has a write up. Motorcyclists are at an elevated risk of being as victim of distracted drivers. HB45, Rep Slosberg D Use of Wireless Communications Devices While Driving: Revises short title & legislative intent; prohibits operation of motor vehicle while holding or touching wireless communications device; provides exceptions; requires law enforcement officer to record certain information on citation; requires law enforcement agencies to provide such information to DHSMV; requires report to Governor & Legislature; removes requirement that enforcement be accomplished only as secondary action. This bill is for handheld devices and includes profiling provisions. These provisions are the same as originally for the bill making non-use of seatbelts a primary event. SB79, Sen. Simpson R Use of Wireless Communications Devices While Driving: Creating the "Florida Ban on Wireless Communications Devices While Driving Law"; prohibiting a person from operating a motor vehicle while listening or talking on a wireless communications device for the purpose of voice interpersonal communication; deleting a provision requiring that enforcement of this section be accomplished only as a secondary action. This covers handheld devices, but the bill should have been written like HB45. Vulnerable Road Users HB71, Rep. McClain, co-sponsors Slosberg, Stevenson, Stone SB158, longtime ABATE supporter Sen. Baxley. Traffic Offenses: Provides criminal penalties for person who commits moving violation that causes serious bodily injury to or death of vulnerable road user; requires person to pay specified fine, serve minimum period of house arrest, & attend driver improvement course; requires court to revoke person's driver license for minimum specified period; defines "vulnerable road user". These bills are identical and they are for all vulnerable road users. HB71 has been assigned to Transportation and Infrastructures Subcommittee, Chairman nemesis Brad Drake; Criminal Justice Subcommittee with David Santiago; State Affairs with Brad Drake. Sponsor Rep. McClain sits on all committees. Our lobbyist, Doc Reichenbach has done a good job. SB158 has been assigned to Infrastructure and Security committee, Appropriation subcommittee on Civil and Criminal Justice and Approbations. Sen. Travis Hutson sits on the 1st and 3rd committee. Deltona- Daytona-Ormond Beach metro area ranks second in the nation for dangers places for pedestrians by Smart Growth America Dangerous by Design 2019 report. We need something between a $112 ticket for running a stop sig and vehicular manslaughter. (3) A person who commits a moving violation that causes the death of a vulnerable road user commits a misdemeanor of the first degree, punishable as provided in s or s , and, upon conviction, shall pay a fine of not less than $5,000, serve a minimum of 180 days of house arrest, and attend a department-approved driver improvement course relating to the rights of vulnerable road users relative to vehicles on the roadway as provided in s (2). The court shall also revoke the person's driver license for at least 1 year.

8 Vice President Darin has ed a sample letter. Here is what I sent. This bill talks about house arrest for killing someone not prison time. Previous attempts involved prison time and those bills went nowhere. It has been reported that there is talk in Tallahassee of easing the minimum mandatory prison sentences for non-violent crimes like First Step Act did on federal drug crimes. Good luck on that since law enforcement likes the enhanced penalties and the only solution that prosecutors and legislators have come up with on the opiod crisis is locking people up, certainly not paying for drug rehab. Hello Sen. Hutson, I am writing to ask you to please consider co-sponsoring SB158, sponsored by Sen. Baxley, titled "Traffic Offenses". SB158 helps protect the Vulnerable Road Users (VRU) by providing the judges more options when they sentence or fine someone found guilty of violating a traffic law that injures or kills a vulnerable road user. We need something between a moving violation and vehicular homicide. While I am tired of all the enhanced penalties and minimum mandatory sentences, as a motorcyclist, I want something for ME. The arrogance, aggressiveness and lack of attention of some drivers is just as bad on AIA, Ormond by the Sea as my daily commute on I4. Within the past 6 months I have been run off the road, while on my motorcycle, and my wife was hit from behind while stopped behind a driver making a left hand turn on A1A. This is the automated response when I sent through the Florida Senate website. I think I will send a letter next time: Thank you for your message. Because I receive such an overwhelming number of daily s, I send this automatic response to verify receipt of your correspondence. Senator Travis Hutson Florida Senate District 7 Motorcycle Safety and Education Funding HB2001, Rep. Stan McClain Abate of Florida, Inc. Motorcycle Safety Awareness Program: Provides an appropriation for the Abate of Florida, Inc. Motorcycle Safety Awareness Program Section 2. For fiscal year the nonrecurring sum of $300,000 from the Highway Safety Operating Trust Fund is appropriated to the Department of Highway Safety and Motor Vehicles to fund the Abate of Florida, Inc. Motorcycle Safety Awareness Program as described in Appropriations Project Request 2. This bill will allocate $ for ABATE's Motorcycle Safety & Awareness Program to reach out to the non-riding public. It has been assigned to Transportation and Tourism Approbations sub committee. Brad Drake sits on it; however, he did vote yes last year.

9 Local legislators are Tom Leek and Elizabeth Anne Fetterhoff. Approbations Committee has Paul Renner and Tom Leek. Last session, Rep. Santiago was a strong supporter in committee. In July 2018 there were registered motorcycles in Florida. Those owners paid $2.50 to be used for motorcycle safety and awareness. That fee was originally asked for by motorcyclists, particularly ABATE of Florida, to fund the Florida Motorcycle Riders Training Program. That program has evolved over the years. The subsidies for the riders beginning course have stopped and, after legislation in session 2008, the funds are used at the discretion of DHSMV with the remaining being transferred to the DHSMV general fund. For a while the DHSMV was not doing much with motorcyclists money. ABATE of Florida was able to get a $ disbursement in ; $ in , and $ in There were strict auditing procedures and ABATE used State of Florida approved vendors. DHSMV has finally developed the Ridesmart program, which uses several ABATE of Florida ideas. ABATE is only asking for a portion on available funding. Gov. Chris term was Jan to Jan. 2011, ABATE of Florida developed the Motorcycle Safety and Awareness Program to teach the non-riding public why motorcyclist do what they do on the rode and how to share the road. It includes a seminar, developed by Steve Avery, that ABATE has presented in schools. That seminar includes video's, testimonies and promotional items for the message of sharing the road. That seminar is now being used in at least four other states. ABATE of Florida did a study of accidents in Volusia county using data available from FDOT. We found out that while most motorcyclists have stories about tourist and elderly drivers, it was the 18 to 30 year old local drivers that were responsible for a majority of the car and motorcycle accidents. There was clearly a need to have a program that targets that age group. ABATE of Florida plans to buy safety promotional products, update the safety video and do more radio ads. Tell your legislators that unlike other groups getting money from the State, the money we are requesting is OUR money that only Motorcyclist have paid in. And most importantly, 100% of the money is spent on safety awareness for the public. This program is associated with ABATE of Florida Safety and Education Inc., a 501 C-3 corporation. Street Racing SB116 Sen. Linda Stewart, Democrat from Orange County. Motor Vehicle Racing. Increasing the criminal penalty for a third or subsequent violation related to motor vehicle racing, by any participant, (passengers, fag girls, etc.), within a specified period after the date of a prior violation that resulted in a conviction. The change is from 1st degree misdemeanor to 3rd degree felony. What happened in Orange County? ABATE of Florida has not taken a position on this. HB611 Rep. Amy Mecado, Democrat from Orange County (3)(c) Any person who commits a third or subsequent violation of subsection (2) within 5 years after the date of a prior violation that resulted in a conviction for a violation of subsection (2) commits a felony of first degree, punishable as provided in s , or s , Transportation Some of these bills are big but I track them since sometimes in committee something will be added that affects us. Red White and Blue Motorcycle license plate: The 20 % of the proceeds for Prevent Blindness is to be changed to Restore Vision. Purple Heart MC license plate: Our State President and Lobbyist Doc Reichenback, a purple heart recipient from Vietnam, gave input on this. Still Watching for: Law Enforcement Practices (Racial Profiling); Liability Insurance to register a motorcycle if they change no-fault; Motorcycle and Moped Riders Under 21 to wear a helmet; No bill has been filed yet. Last year University of Florida pushed a bill. ABATE did not oppose this bill although those, who support mandatory helmets for all, have called this a victory. Currently those under 21 do not have to wear a helmet for mopeds and under 50cc motorcycles. Previously there were no statistics given. Local From the Florida Statues: Powers, duties, and obligations. (3) Every sheriff shall 263 incorporate an antiracial or other antidiscriminatory profiling policy into the sheriff s policies and practices, utilizing the Florida Police Chiefs Association Model Policy as a guide. Antiprofiling policies shall include the elements of definitions, traffic stop procedures, community education and awareness efforts, and policies for the handling of complaints from the public. I track accidents to see how they end up in the courts. Judge Green was voted out. Judge Weston presided over the complicated case where the FHP bungled the investigation of an Edgewater cop who ran into a man, stopped at an intersection on his moped. Dead body, damage police car but no one caused an accident. Friday, 1/25/2018, Larry Lawson, 69, in a SUV, pulled in front of Clovis Madalozzo, 56, on a 2013 Honda on CR426 and Old Mims Rd., in Seminole County. His helmet did not save him. Madalozzo later dies.
