2 PRESIDENT S MESSAGE Happy 36th Anniversary Daytona Beach Abate!! That's right, we are the oldest (and bestest) chapter in the great state of Florida!! We are celebrating at the State party and Fall Biker Bash at the "Peace River Campground" in Arcadia, Florida and everyone is welcome!! Dates are October 7th thru the 9th Food, beverages, bands, a scavenger hunt and a bike show along with the Iron Horse Rodeo..just to name a few of the activities. Luckily it was just a clogged AC drain line and I got it all cleaned up without any real damage but it took most of the day. I haven't had any free time lately so I don't have much to report on other than watch the heat out there, we have been having record setting months of heat for awhile now and there is no end in sight. Ideally you would get the latest legislative news and press releases. Contact the State Legislative Trustee, Darrin Brooks, to get on his list for alerts when bills are in committee. At that time we can contact legislators outside our district. He sends news reports of legislative activities on a myriad of topics, not necessarily those that ABATE is involved in. Consider signing in to the MRF or AMA alerts. Sometimes issues do move quickly. Sometimes the alerts actually give the bill numbers. Elections August 30 will be the primaries. Vote!!!. If I do not list more than one candidate from a political party, that is the choice on Nov. 8. There will be important elections for even non-partisans to vote (Sheriff, County Council, and Judges). July 30 was the last day to switch to a party affiliation. ABATE of Florida cannot endorse candidates (although our lobbyist can publish recommendations. We can report on the voting record and their views on the issues that affect motorcyclists. Democrat Headquarters 457 S. Ridgewood Ave, Daytona Beach. This is a doctor s office at Loomis Republican Headquarters 999 3rd St Holly Hilll 1710 SR44; 661 Beville Rd. Daytona Beach US Senate The field has gotten smaller since Rubio jumped in. Sheriff Primary This is not a political party office, but local party officials are identifying who they support Wendell Bradford (DEM), Dave Brannon (REP) (currently with the department), Mike Chitwood, Eric Dietrick (currently with the department), Jim Gullum (a fireman), Brett Kennan. Chitwood believes all patch holders are criminal but has been pro active with body cameras and has trained his officers in diffusing situations in order to try to take suspects to jail instead of shooting them and personnel to go home to their families (de-escalation). His call for his profession to be guardians not warriors is encouraging. County Chairman Primary Jason Davis, Greg Gimbert, Ed Kelley, Tom Laputka. Davis thought the electronic signs saying No Colors on a public highway was okay at the Deland Bike Fest. Kelley is open to beach restrictions and was behind the move to shutdown the clubhouse on US1. Greg Gimbert is a member of Sons of the Beaches. Gimbert was also active in getting more access to ATVs on State lands, a principle the AMA adheres to. Equal access for all. Laputka also wants no more restrictions on beach driving. County Council District 2 Primary Willie Kimmons, Billie Wheeler County Council District 4 Primary Linda Bourquin-McIntyre, Roy Johnson, Heather Post, Al Smith, Ronald Via Circuit Judge Group 4 Primary Chris France, Sebrina Slack, Stasia Warren Circuit Judge Group 10 Primary Malcom Anthony, Scott Dupont Circuit Judge Group 13 Primary Kathleen McNeilley, David Hood Hood lost his lawsuit to prevent McNeilley from running. You would think a judge would know the law. However, as State Representative, Hood did chip away at Florida s draconian drug laws. County Judge Group 3 Primary Heather Caeners, Shirley Green, Marla Rawnsley Both Judge Sanders and Judge Green have withheld adjudications thus circumventing the $500/$1000 fine for those who cause an accident resulting in an injury or death of a motorcyclist. Marla Rawnsley was impressive on the Big John forum. US Representative District 6 Primary
9 Fred Costello, REP, GG Galloway REP, Ron DeSantis REP Rep. Costello was receptive to our DHSMV statistics that show little differences to those in an accident and if they wore helmets or not. He also supported the law that would allow non-ethanol gas to be sold at any gas station. I heard Pappas on the Big John Forum. I am impressed with his goals of issues that face the average citizen, but do not know at this time on his stand on helmet laws or federal bureaucracies. Ron DeSantis could be using this office as a stepping stone, but he shares our concerns about the over reach of federal agencies. Jay McGovern DEM, William McCullough DEM, George Pappas DEM, Dwayne Taylor DEM McCullough believes only special people should have a concealed weapons permit. What did Taylor ever do, however in a Republican controlled House, what could he do? Pappas was impressive on the Big John forum. State Senator District 7 Election Day Curtis Ceballos DEM. Travis Hutson REP I gave Hutson my best white papers concerning mandatory helmet laws and while he stated they were compelling, I could not get a position from him. State Senator District 14 Election day Richard Dembinsky NPA, Dorothy Hukill REP. Hukill is in. State Representative District 24 Election Day Adam Morley DEM, Paul Renner REP State Representative District 25 Election Day Noel Bickford DEM, Tom Leek REP State Representative District 26 Primary Michael Cantu REP, Patrick Henry DEM, Steve Miller DEM Steve Miller was Jimmy Charles campaign manager. Nothing will happen till after elections End Motorcycle Profiling Act of 2016 From the MRF July 16 Legislation Introduced in Congress Addressing Motorcycle Profiling On Wednesday evening, Representatives Reid Ribble of Wisconsin and Tim Walberg of Michigan, jointly introduced a legislative measure that addresses concern over the profiling of motorcyclists. H.Res.831, formally titled, Promoting awareness of motorcycle profiling and encourage collaboration and communication with the motorcycle community and law enforcement officials to prevent instances of profiling is what is referred to as a simple resolution. If voted on and passed, it does not carry the force of law, but rather, expresses the sentiment of a chamber. The introduction of the measure itself is a first step towards addressing the issue of motorcycle profiling from a national perspective. Over the next several months, your MRF and our state partners, affiliates and members of the Anti-Profiling Action Group will need to secure additional co-sponsors for the resolution in hopes of a vote. Additionally, we will also need to work to get a similar bill introduced in the Senate chamber. Our work is certainly cut out for us, but we have cleared a major hurdle by getting the bill introduced. For those who are pursuing motorcycle anti-profiling laws in your own state legislatures, you should reference the activity in the U.S. House of Representatives as I trust it will serve helpful. You can view the bill by clicking on the link below: We ll be in touch with you in the coming weeks regarding next steps on the bill and how you can help. In the meantime, my sincerest thanks to everyone who aided in the effort to get H.Res.831 introduced. The activity this week is a direct result of the collaboration from the many motorcycling organizations that are in support anti-profiling language, including James Doc Reichenbach II, Chairman of the National Coalition of Motorcyclists (NCOM), Frank Ernst, Chairman of the NCOM Legislative Task Force, and David Double D Devereaux, representing the Council of Clubs. The AntiProfiling Action Group also includes the Committee Lead Russell Radke, MRF President Kirk Hardtail Willard, Committee Secretary Shelly Holcomb, MRF Board Rep Lenny Holcomb, and nationally known motorcyclists advocate Dick Slider Gilmore. It is truly representative of advocacy in action at a contentious time in Washington, DC. We should be proud of this first hurdle that we ve cleared.
10 H.R. 5180, the Food and Fuel Consumer Protection Act of 2016 The American Motorcyclist Association supports this bill. The bipartisan legislation would cap mandated ethanol content in the nation s fuel supply at 9.7 percent and institute a provision that automatically reverts the U.S. Environmental Protection Agency s annual Renewable Volume Obligations to the previous year s percentage if the EPA misses its Nov. 30 deadline. And, finally, the bill would ensure commercially available cellulosic and advanced ethanol has a place under the 9.7 percent cap. In other words, the bill would stop the federal government from forcing E15 fuel (15 percent ethanol by volume) into the market. Capping the ethanol mandate helps ensure the availability of safe fuels like E10 and a continuing place in the market for ethanol-free gasoline (E0) for older motorcycles. This is important, because the last RVO rule issued by the EPA decreased the E0 supply to just 130 million gallons from 9.2 billion gallons in 2016, despite the fact that the demand for E0 doubled. The practical effect of the EPA s action is more unsafe E15 (15 percent ethanol by volume), less E10 and virtually no E0 for older and vintage machines. The urgency of EPA action to address misfueling is supported by a recent study from the Outdoor Power Equipment Institute. The study indicates only five percent of consumers are aware that E15 is prohibited for use in certain engines and that 60 percent of consumers assume that any gas sold at a pump must be safe for all of their engines. Ethanol Bills Thrive in Washington The 2007 Renewable Fuel Standard of the Clean Air Act mandates higher blends of biofuel must be introduced; but technology and old Harley riders have not kept up to the higher blends of ethanol. Change the law, not likely. The MRF is involved to try to assure that lower blends and no blends will always be available. H.R and S Recognizing the Protection of Motorsports Act of 2016 (RPM Act) From the MRF July 8 Progress Made On RPM Act. Over the last several weeks, the MRF has become increasingly active in its new role as a member of the RPM Working Group and it appears that we ve made some progress on the issue. For those who participated in the Washington, DC lobby day back in May, (also known as Michael Boz Kerr Bikers Inside the Beltway) you know that one of our key issues that we advocated for was support and passage of the Recognizing the Protection of Motorsports Act or RPM Act. The RPM Act aims to correct a recent Environmental Protection Agency (EPA) regulation that would effectively ban any conversion of street automobiles or motorcycles into racing vehicles. As if this provision wasn t alarming enough, the language pertaining to race-modified street vehicles and motorcycles was buried in a 600+ page proposal having to do with cutting emissions from heavy - and medium-duty trucks pertaining to greenhouse gases! Though it was only one sentence, it would effectively outlaw part of the amateur car and motorcycle racing industry. As a solution, the RPM Act was introduced and we ve been working tirelessly to rally support. The bill recently enjoyed a big influx of co-sponsors that was directly related to your work during Bikers Inside the Beltway. Since then, the MRF has been collaborating with a Working Group which recently sent a letter to leadership in both the House and Senate asking for progress on the bill. Your MRF was a signatory on the letter along with Harley Davidson, the Motorcycle Industry Council, the American Motorcycle Association and others. This week we were informed that as a temporary fix, a Member of Congress from North Carolina had offered some immediate relief to address our concerns. Yesterday, Rep. McHenry (R-NC) offered an amendment to a bill that funds the EPA. The amendment would require a one-year suspension of EPA s authority to enforce the tampering prohibition against motor vehicle and motorcycle conversions. Though the solution is temporary, it buys the RPM Working Group more time to achieve a bigger and more permanent fix, ensuring the EPA doesn t continue its creep into regulating motorcycles. From the MRF July 15 Presidential Candidate Donald Trump Names Motorcyclist Governor Mike Pence as Running Mate. Speculation on who would be Republican presidential candidate Donald Trump s possible VicePresident pick grew to a fever pitch this week. All eyes were on Indiana when candidate Donald Trump made a pair of visits to the Hoosier state earlier in the week. The first was a standard fundraiser but the second event was a rally where inquiring minds waited for a possible announcement of Trump s VicePresidential pick. They were rewarded on Friday when it was announced via twitter that Governor Mike Pence would indeed round out the Republican presidential ticket. Speculation on Governor Pence as a running mate grew as rumors of a series of private meeting between the Governor and Trump persisted over the last several days. Perhaps one of the groups most excited about the announcement are motorcyclists from the state. During his tenure in office, Governor Pence has been a supporter of motorcycle rights, working directly with ABATE of Indiana (American Bikers Aimed Toward Education) and receiving a personalized basic rider training course arranged by the group s
11 Executive Director, Jay Jackson. I think Governor Pence saw the strong connection his predecessor, former Governor Mitch Daniels, had with the motorcycling community. He saw the value in engaging this group because they are politically active, passionate about their cause and most importantly, they show up to vote! Jackson stated. Governor Pence rides on a bike several times a year participating in the Ride with the Governor event which brings awareness to motorcycle safety in the Hoosier State and raises funds for the Indiana National Guard Relief Fund. He also has participated in other charity rides as well as served as an escort to bikers passing through the state on their way to the nation s capital for the Rolling Thunder motorcycle rally in Washington, D.C. First Lady Karen Pence has also started to show an interest in riding, indicating a desire to ride with her husband in upcoming events. Though what will ultimately happen in November with the Presidential Election is anybody s guess. National polls change almost daily sometimes showing Hillary Clinton in the lead and sometimes Donald Trump. Nonetheless, some motorcyclists from the state are excited about the possibility of a motorcycle rights supporter as Vice-President. Who knows? Jackson said, Maybe this time next year we ll hold the nation s first ever Ride with the Vice-President event. Other Stuff On June 16, the MRF sent out a release outlining the attacks on Michigan s 2012 Freedom of Choice on helmets. Opponents claimed a 23% increase in Fatalities from 2014 to This was cherry-picking. ABATE of Michigan has a statistician. We in Florida have me. CUTR tried the same thing in Florida. The real issue was that Michigan rider can get insurance without a motorcycle license endorsement. On June 16, the MRF sent out a release about the Supreme Court ruling on Utah vs. Strieff that weakens the 4 th Amendment and therefore calls for additional laws to end profiling. When someone is stopped without reasonable suspicion, any fruits from the stop can not be used in court. The court rules that if the stop discovers a minor warrant, then it is legitimized. As motorcyclists we do not want to be stopped arbitrarily. On June 30, the MRF reported on the US Dept. of Transportation awarding grants to Cities on plans detailing visions to reduce traffic using intelligent transportation systems technologies. None of the plans addressed motorcyclists. Waco May 17, bikers have filed suit over civil rights violations, unlawful arrest and due process violations Almost 200 people were arrest (with initial bonds of 1 million) and nine were killed. With the Black Lives Matters movement growing and the murder of policemen by unstable people, there are discussions on transparency. I will probably find out more in upcoming books by bikers, that were there, than the Texas justice system. Those guys there were discussing the same things we have discussed at our chapter meeting: Federal copyright confiscation of club insignia and profiling. The initial Waco police press release was baloney and further demonstrates the need for transparency.
