2 PRESIDENT S MESSAGE Well it's February already and you know what that means.. VALENTINES DAY! Just kidding..only a month till the 78th anniversary of the Daytona Bikeweek!! This year it's March 8th thru the 17th. I'm hoping it's a little warmer than its been the last couple weeks. I was out on the bike a few times for breakfast and it was only in the high 30s making me wonder if I need a new bike with a heated seat and grips..naaaa..after 40 yrs I still don't have a radio! Ok, if you weren't at the last chapter meeting to hear, the State meeting is this month on Saturday, February 9th at 2pm in Ocala. Everyone is welcome to attend and we will be riding there, weather permitting leaving the Iron Horse at 11:30am. Lunch will be provided by the Forest Chapter! Also, an early reminder..abate of Florida's 22nd annual "Freedom Rights Rally" in Tallahassee is getting closer. The dates are April the 13th thru the 15th with the state meeting on the 14th at 2pm. There will be a few of us going. Some for just the meeting on Sunday and some for Monday also. If you are interested and want to go or know more, contact me or see the flyer on the Abateflorida.com website under events. There is also momentum gaining on the antiprofiling front at the national level. Our next State meeting is in Ocala on Feb 9th, we should get some good info to bring back and share with everyone. Doug Dameron was from Flint, Michigan that has lived here in Florida for 25 years. Doug has been a Life Member of our chapter for 24 years. Each year when we go to the Daytona Beach Rehab, Doug has always been there with his floppy santa hat that lights up and always enjoyed handing our Christmas presents to the residents. Doug will be surely be missed!

7 Legislative Report January, 2019 John Banta Read this because I do not go into details at the chapter meeting. Committee hearings start Dec 11-13, Jan 7-11, 22-25; Feb 4-8, 11-15, Session starts during Bike Week, March 5. I am now tracking bills. Some of them will be part of ABATE of Florida legislative agenda. Our chapter is not excited about more enhanced penalties and the mandatory minimum sentences being handed out. However, I have witness terrible driving on A1A in Ormond Beach. People do not slow down, they speed up. Monday April 15 is the ride to the Tallahassee to lobby our state legislators. There is a way they do business in Tallahassee and, in the past, deviating from that does not yield results. Hand Held Cell Phone Use Texting is the worst but these bills make a primary offense of all handheld usage. HB45, Rep Slosberg D Use of Wireless Communications Devices While Driving: Revises short title & legislative intent; prohibits operation of motor vehicle while holding or touching wireless communications device; provides exceptions; requires law enforcement officer to record certain information on citation; requires law enforcement agencies to provide such information to DHSMV; requires report to Governor & Legislature; removes requirement that enforcement be accomplished only as secondary action. This bill is for handheld devices and includes profiling provisions. These provisions are the same as originally for the bill making non-use of seatbelts a primary event. SB79, Sen. Simpson R Use of Wireless Communications Devices While Driving: Creating the "Florida Ban on Wireless Communications Devices While Driving Law"; prohibiting a person from operating a motor vehicle while listening or talking on a wireless communications device for the purpose of voice interpersonal communication; deleting a provision requiring that enforcement of this section be accomplished only as a secondary action. This covers handheld devices but the bill should of been written like HB45. Vulnerable Road Users HB71, Rep. McClain SB 158, longtime ABATE supporter Sen. Baxley. Traffic Offenses: Provides criminal penalties for person who commits moving violation that causes serious bodily injury to or death of vulnerable road user; requires person to pay specified fine, serve minimum period of house arrest, & attend driver improvement course; requires court to revoke person's driver license for minimum specified period; defines "vulnerable road user". These bills are identical. HB71 has been assigned to Transportation and Infrastructures Subcommittee, Chairman nemesis Brad Drake; Criminal Justice Subcommittee with David Santiago; State Affairs with Brad Drake. Sponsor Rep. McClain sits on all committees. Our lobbyist, Doc Reichenbach has done a good job. SB158 has been assigned to Infrastructure and Security committee, Appropriation subcommittee on Civil and Criminal Justice and Approbations. Sen. Travis Hutson sits on the1st and 3rd committee. (3) A person who commits a moving violation that causes the death of a vulnerable road user commits a misdemeanor of the first degree, punishable as provided in s or s , and, upon conviction, shall pay a fine of not less than $5,000, serve a minimum of 180 days of house arrest, and attend a department-approved driver improvement course relating to the rights of vulnerable road users relative to vehicles on the roadway as provided in s (2). The court shall also revoke the person's driver license for at least 1 year. Motorcycle Safety and Education Funding HB2001, Rep. Stan McClainAbate of Florida, Inc. Motorcycle Safety Awareness Program: Provides an appropriation for the Abate of Florida, Inc. Motorcycle Safety Awareness Program Section 2. For fiscal year the nonrecurring sum of $300,000 from the Highway Safety Operating Trust Fund is appropriated to the Department of Highway Safety and Motor Vehicles to fund the Abate of Florida, Inc. Motorcycle Safety Awareness Program as described in Appropriations Project Request 2. State Vice President Darrin says start talking to your Legislators about HB 2001 and the importance that ABATE of Florida, Inc. can do with the money to increase motorcycle awareness and decrease motorcyclists deaths. Let them know that unlike other groups getting money from the State, the money we are requesting is OUR money that only Motorcyclist have paid in. And most importantly, 100% of the money is spent on safety awareness for the public. There are stringent reporting guidelines which ABATE of Florida complied with when we did get a portion of the safety money.

8 Motorcycle and Moped Riders Under 21 to wear a helmet No bill has been filed yet. Last year University of Florida pushed a bill. ABATE did not oppose this bill although those, who support mandatory helmets for all, have called this a victory. Currently those under 21 do not have to wear a helmet for mopeds and under 50cc motorcycles. Previously there were no statistics given. The 2017 DHSMV Florida Crash Statistic are out. 515 motorcyclist and 37 passenger fatalities. There are no separate categories for Autocycles. I always look for the Fatality per accident ratios between helmeted (DOT compliant) and un-helmeted motorcyclists. They are 5.37% (264/49120 and 5.95% 9230/3867). There are other helmet and unknown categories. Less than a percentage point difference. That helmet does not do what some people think it does. In 2017, there were 20 ATV fatalities and 20 Moped fatuities. They are grouped together in the helmet use and injury table, which is stupid. There were 6 helmeted (DOT compliant) and 32 no helmet fatalities. Street Racing SB116 Rep. Linda Stewart, Democrat from Orange County. Motor Vehicle Racing. Increasing the criminal penalty for a third or subsequent violation related to motor vehicle racing, by any participant, within a specified period after the date of a prior violation that resulted in a conviction. The change is from 1st degree misdemeanor to 3rd degree felony. (3)(c) Any person who commits a third or subsequent violation of subsection (2) within 5 years after the date of a prior violation that resulted in a conviction for a violation of subsection (2) commits a felony of first degree, punishable as provided in s , or s Still Watching for: Law Enforcement Practices (Racial Profiling) ; Liability Insurance to register a motorcycle if they change no-fault. WASHINGTON, DC Consider subscribing to the AMA or MRF Alerts. The AMA and MRF websites do have automated letters that will go to your congressman. The MRF letter can be tweaked before you send it. Congress is basically running out the clock, with little happening. We will have to wait till the next Congress. The MRF is gearing up to make sure provisions such as no funding for Motorcycle only checkpoints, NHSTA lobbying ban, continuation of Motorcycle Advisory Council get included in the next highway bill in The Motorcycle Riders Foundation (MRF) is proud to announce that The Motorcycle Profiling Resolution (S. Res. 154), sponsored by Sen. Johnson, passed the U.S. Senate with unanimous consent on Tuesday evening, December 11, Russell Radke, MRF Sustaining Member Motorcycle Club Representative, said, We are now one step closer to ending the attacks on our civil liberties from unconstitutional motorcyclist profiling. MRF President Kirk Hardtail Willard said upon learning of the adoption of the resolution, Passage of Senate Resolution 154 has been the Motorcycle Riders Foundation s number one legislative initiative in this current Congress. This act today by the Senate is very important, as it recognizes that the profiling of motorcyclists because of our mode of transportation or choice of attire is unacceptable. I am waiting for suggestions from the national motorcyclist organizations on how to use this resolution. Higher Ethanol use will be expanded and we hope to get better warnings at the gas pump.
