3 PRESIDENT S MESSAGE! October is here and the end of summer means..cooler weather and it's finally time for Abate of Florida's Autumn Bike Fest being held in Avon Park, Fl on the 2nd, 3rd and 4th. Camping and live bands all weekend plus much more. Be there or be square!! Did I mention the beer garden? Poker run too! Then...Biketoberfest 2015!! The official dates are 10/15 to 10/18 so be ready for tens of thousands of people and bikes (and trailers) heading to Volusia County. Please ride safe and don't forget to look twice or even three times, it might save your life! Thank you to everyone that attended our last meeting and hoping you can come out and support us this month too. We have a ton of Daytona Beach Chapter t-shirts, long and short sleeves available in grey or black so get one (or a few) and show your local Abate pride during Biketoberfest. No one else has them but us! See Frank at the meeting, he will have them on display. Hooded sweatshirts sizes 3 and 4xl are here also! We have the Avon Park Bike fest on Oct 2,3 & 4th, Spooks-n-Scoots is Oct 9,10 & 11th with the State meeting on the 10th in Hillsborough County and Biketoberfest this year is from Oct 15-18th so there is plenty to do and places to ride. I would like to congratulate the Mongol Nation on there win against the Government, keep up the good fight. Please stay safe out there, check your tires and do your maintenance. 4 Daytona Beach Chapter ABATE September 3, 2015 (7:30 P.M.) Fraternal Order of Eagles, Ormond Beach, FL By: Frank Molinario President (Geno) Sgt. At Arms Grog called meeting to order at 7:35 p.m. (20 riders in attendance). Group recited the Pledge of Allegiance and a moment of silence was observed. Geno then reminded everyone of the state party coming up in Avon Park and encouraged attendance. Vice President (Alfy) Alfy joined into discussion about Avon Park meeting. Discussion ensued regarding the campground and the cost ($20 for the weekend). Review of sent to board members by R. Simmons. Discussion around ABATE election process and campaigning for State positions. Doc willing to step aside for another person to fill one of the roles. Reminder that next state meeting is October 10th. Secretary (Frankie) Secretary report accepted as written. PR raffle tickets being sold for state (drawings: $7K, $2K and $1K) during bike week. Drawing to be held on Saturday. Treasure Treasury report given by John Banta. Sergeant at Arms (Grog) no report given. Membership Steve reported out on membership. Safety no safety representative present. Frankie talked about riding positions on the rode in two lanes of traffic going one direction. Legislative (John) reported that the senate passed the appropriations bill, but the house didn t like it and will write their own. Discussion to the group regarding biker profiling and filming interactions with the police. The use of MSO cameras suggested by Grizz of the Mongols. Discussion about possible anti-profiling bill. Products (Frank) Verbal presentation of our products. Discussion about having clothing and other items available during meetings. Old Business Bobby brought up the vote at a previous state meeting regarding membership dues being raised. Board members stated that it was discussed at the last meeting, but there doesn t seem to be any support for doing it. New Business Bobby brought up a current House bill for national oversight of police weaponry and training. House Bill HR1102. Return to campaigning discussion. Alfy suggested brining in candidates to talk to chapter during campaigns. Good of the Order Mongols MC thanked everyone for coming to the Dog Days Party. No news on court battle. Lisa Ling with CNN will give a special report called this is life on the Mongols Nation on Sept. 30th at 9 p.m. EST. Meeting Adjourned Closing prayer. Meeting adjourned.

Ideally you would get the latest legislative news and press releases. Contact the State Legislative Trustee, Darrin Brooks, to get on his list. He sends news reports of legislative activities on a myriad of topics, not necessarily those that ABATE is involved in. Consider signing in to the MRF or AMA alerts. Sometimes issues do move quickly. They do discuss issues in more depth. TALLAHASSEE The 2016 session is early this year, for the Senate January 12 to March 11, The ABATE rights rally is scheduled for February. Bills are being filed NOW. Nov 20, 2015 is the Senate deadline for submitting requests for drafts of general bills and joint resolutions, including requests for companion bills. Abate of Florida is preparing for the 2016 session. We have another meeting in October, which would be very last minute. Enhanced Penalties for those who injure or kill vulnerable road users. We will seek to get a brand new statue that will hold up in traffic court. As we have learned, passage will only be possible by building coalitions, especially with bicyclists, who have been hit with increasing fatalities. Funding for ABATE s Motorcycle Safety and Awareness Program. This has been vetoed, removed and vetoed the last 3 years. The DHSMV is actually using the same $2.50 per registration fee for their Ride Smart Program ( There are other issues that our chapter is concerned about. Remember, by the time you read this report; it is out of date. Profiling. At the Bike Week Rights Rally, Jerry T said that we need to document incidents. Our lobbyist has talked to legislators. Legislators have said they want to see proof that profiling exists, in Florida, before sponsoring or supporting a bill. Relaxing the penalties for wheelies. A $1000 fine for a wheelie but nothing for killing someone in an accident seems draconian. However, sport bike riders shutting down an interstate and posting it on social media; to do wheelies; currently makes such legislative efforts tough. Vice Governor Cantera was the original sponsor of this legislation. Equal Access for those wearing club insignia. This is still an issue that motorcyclists have only addressed in the courts for public venues that use taxpayer money. This does not apply to private establishments. WASHINGTON DC HIGHWAY APPROBRIATIONS From The Motorcycle Riders Foundation, Sept 11, 2015 United States House of Representatives Subcommittee Improves Motorcycle Safety with Amendments to Highway Bill, Reports the Motorcycle Riders Foundation. The Science Committee, Subcommittee on Research and Technology, approved two amendments that both greatly benefit motorcyclists. The first amendment halts the federal funding of motorcycle-only roadside checkpoints and then assigns a study to the National Academy of Sciences to determine the best methods of preventing motorcycle crashes. The amendment sponsor, Representative Randy Hultgren (R-IL) had this to say: If the federal government is providing grants to improve motorcycle safety, these grants should be focused on ways that actually improve the safety of motorcycle riders. The second amendment would prohibit the Federal Department of Transportation from lobbying for actions at the federal, state or local levels of government. Currently the lobby ban is only applicable at the state level. Hultgren added, I do believe that we can be doing more to improve the safety of motorcyclists on the road, and there are reasonable laws that motorcyclists should all follow. But before the federal government casts down another top-down mandate on local law enforcement officers, we should be sure that we are not wasting valuable police time, while singling out and infringing on the rights of law abiding motorcycle riders, unless there is a compelling safety related reason for doing so. The Motorcycle Riders Foundation would like to thank Mr. Hultgren for his dedication to motorcyclists. We also cannot thank enough the Chairman Emeritus, the Honorable James F. Sensenbrenner, for his tireless work improving the lives of motorcyclists across the country

7 H.R. 22 Developing a Reliable and Innovative Vision for the Economy Act or DRIVE Act This bill passed the House in January. It then passed the Senate in July. In the engrossed amended Senate version, which is for six years, is the language to end federal funding of motorcycle-only roadside checkpoints is in the bill. But this bill now goes back to the House, which has funding issues with what the Senate finally passed. The specific language reads: SEC SHORT TITLE. This part may be cited as the ``Stop Motorcycle Checkpoint Funding Act''. SEC GRANT RESTRICTION. Notwithstanding section 153 of title 23, United States Code, the Secretary may not provide a grant or any funds to a State, county, town, township, Indian tribe, municipality, or other local government that may be used for any program (1) to check helmet usage; or (2) to create checkpoints that specifically target motorcycle operators or motorcycle passengers. CHECKPOINTS This is being addressed in the Highway bills H.R Stop Motorcycle Checkpoint Funding Act: Rep. Sensenbrenner S.127 Senators Shaheen (D-NH) and Ron Johnson (R-WI). ETHANOL H.R. 21 U.S. Rep. Jim Sensenbrenner (R-Wis.) This bill would repeal the U.S. Environmental Protection Agency s waiver decision related to E15 fuel and the authority of the agency to grant further decisions in the matter, until the EPA seeks an independent scientific analysis of the effects of gasoline containing up to 15 percent ethanol. BLACKBOX PRIVACY H.R.2526 Black Box Privacy Protection Act Amends the Automobile Information Disclosure Act to require manufacturers of new automobiles to disclose on the information label affixed to the window of the automobile: (1) the presence and location of an event data recorder (commonly referred to as a "black box"), (2) the type of information recorded and how such information is recorded, and (3) that the recording may be used in a law enforcement proceeding. NON-MOTORCYCLES CURRENTLY CLASSIFIED AS MOTORCYCLES S685 Autocycle Safety Act HR 2892 Autocycle Safety Act This bill defines "autocycle" as a motor vehicle with three wheels, a fully enclosed occupant compartment, and a steering wheel, which is subject to applicable federal motor vehicle safety standards. Specified interim automotive and motorcycle safety standards apply to autocycles until at most three years after enactment of this Act, by which time the Department of Transportation shall issue appropriate final rules, interpretations, and test procedures. Automotive fuel standards also apply to autocyles. OTHER H.R.1102 Police Accountability Act of 2015 Rep. Henry Johnson D GA Introduced Feb. 2015, 12 Democrat Co-sponsors. Amends the federal criminal code to require a state or local law enforcement officer in a public agency which receives federal funding under the Edward Byrne Memorial Justice Assistance Grant Program, who engages in conduct in the line of duty that would constitute murder or manslaughter if it were to occur in the special maritime and territorial jurisdiction of the United States, to be punished as provided for that offense under federal law. This bill would make any police shootings come under federal scrutiny. Then again, do you trust the federal government? They are the ones that classify which clubs are gangs. Waco PD seems to think if they wait long enough we will forget. From Yahoo News June 4, 2015: As questions remain unanswered about last month s deadly biker rampage in Waco, Texas, police there are trying to clamp down on public information about the case. The move comes as scrutiny intensifies over the Waco Police Department s handling of the sensational shootout that killed nine bikers, injured 18 and saw an unprecedented 175 people arrested and charged with engaging in organized crime. By law, crime and arrest reports containing basic data information such as a detailed description of the offense and the name and a description of the victim have to be provided. While some details about the dead, including identities, have trickled out, officials have been slow to provide information through documented reports as required by the Texas Public Records Act.
