I hope to see everyone on our ride to the Daytona Rahab center on Sat Dec 2nd, meeting at the Eagle in Ormond at 12 noon for a short ride to the Rehab center, please bring gifts for the elderly. There have been a lot of accidents and deaths lately, please ride careful and if you see someone that should not be riding, try to stop them. Accidents happen but needless carelessness is preventable. I have seen video of some pretty blatant motorcycle profiling during Biketoberfest and hope we can have a good discussion on ways to help prevent it in the future. We have to all stand together or we will all hang separately... Ideally you would get the latest legislative news and press releases. Contact the State Legislative Trustee, Darrin Brooks, to get on his list for alerts when bills are in committee. He sends news reports of legislative activities on a myriad of topics, not necessarily those that ABATE is involved in. Currently he is also sending out meet and greet notices from politicians that have been ABATE supporters. He also subscribes to a pricey news service which delivers news from Tallahassee before you read it in the newspaper. Consider signing up for the ( MRF or AMA alerts. The MRF monitors all legislation and provides input on new issues i.e. the automated intelligent vehicles (and the recent House Self Drive Act), classification on autocycles, lack of motorcyclists on the Motorcyclist Advisory Council. For profiling you will need to see the Motorcycle Profiling Project On the MRF alert there is an article by MRF Lobbyist Megan Ekstrom that is perfect to put in to the hands of legislators concerning profiling. Targeted For Existing: Where Pop Culture Ends and Real Life Begins for America s Bikers This should be used when contacting federal politicians for H.Res. 318 & S.Res We need to start raising awareness in Tallahassee so support HB397 and SB592 and use this article to point out that profiling happens all the time, not just to black or brown people. Emily Slosberg SB72 Use of Wireless Communications Devices While Driving withdrawn CS/SB90 Use of Wireless Communications Devices While Driving Sen Perry, Senators Garcia, Mayfield, Rodriguez ABATE of Florida supports these bills. A bipartisan group of lawmakers embarked Tuesday on a road that has resulted in a dead end in the past: getting the House and Senate to make texting while driving a primary traffic offense in Florida. The Senate Communications, Energy and Public Utilities Committee voted following testimony from family members of people killed by texting motorists --- to approve a primary-offense bill (SB 90). But the measure already faces questions over how the ban could be enforced without requiring motorists to be completely hands-free of wireless devices or if the law would create any noticeable change in motorists' behavior. Sen. Dana Young, a Tampa Republican who voted for the measure, said the bill might also not go far enough in tackling the issue of drivers distracted by watching movies, scrolling through music playlists, applying makeup or even reading books. Why would you not just deal with the issue, which is the elephant in the room, which is distracted driving, careless driving, Young said. ABATE of Florida is behind SB116, H117. They are still sitting in the first committees. SB116 Operation of Vehicles Sen. Baxley, Sen. Passidomo Requiring drivers to vacate lanes closest to, or reduce speed and pass, vulnerable road users, authorized emergency, sanitation, and utility service vehicles or workers, and wrecker operators under certain circumstances, subject to certain requirements, etc. That means motorcycles broken down on the shoulder. 8 (2) AUTOCYCLE. A three-wheeled motorcycle that has two wheels in the front and one wheel in the back; is equipped with a roll cage or roll hoops, a seat belt for each occupant, antilock brakes, a steering wheel, and seating that does not require the operator to straddle or sit astride it; and is manufactured in accordance with the applicable federal motorcycle safety standards provided in 49 C.F.R. part 571 by a manufacturer registered with the National Highway Traffic Safety Administration. HB583 Motorcycle and Moped Riders Rep. Clemons (the other Clemons) CS/SB346 Motorcycle and Moped Riders Sen. Perry This bill will require a helmet for all persons under 21 riding a moped or motorcycle under 50cc. Currently it is 16 years of age. All motorcycles and mopeds registered to someone under 21 years of age will have to have the special plate.. The CS added mopeds instead of just motorcycles to the under 21 helmet requirement. Our lobbyist, Doc Reichenbach, said the University of Florida is behind this. Previously the DHSMV was dealing with university of South Florida, USF, Center for Urban Transportation Research, CUTR. According to the DHSMV, motorcycles manufactured with a motor of 50CCs or less can be altered in order to make the motorcycle more powerful than is displayed on the motorcycle s body or included on the manufacturer s certificate of origin. This can make enforcement of the helmet law difficult for law enforcement, since the helmet requirement differs based on the power of the motorcycle and age of the individual. This is ludicrous. Who port and polishes or bores out a 50cc bike. I am waiting for the 2016 Traffic Crash Facts to come out. In 2015 there were 154 bicyclist fatalities (only 8 were wearing a helmet), 546 motorcyclist fatalities. For Mopeds there is no true total. Note: In the case of non-motorist safety equipment an individual can be using more than one equipment type, therefore column totals for injuries and fatalities will not be an accurate reflection of the true statistics. 5 Fatalities occurred while wearing a helmet; column total was 33. You would think the staff report would have some better numbers. Unelected bureaucrats love to impose their will on as many people as possible. The 18 to 21 year olds are considered expendable. They better start voting. I personally oppose this bill, ABATE of Florida is ambiguous. Ask your legislators if they should expand the bicycle helmet law from 16 to 21 years of age. SB384 Electric Vehicles Sen. Brandes HB19 Motor Vehicle Insurance Rep. Grail SB150 Motor Vehicle Insurance Sen. Lee Repealing provisions relating to application of the Florida Motor Vehicle No-Fault Law; revising requirements for a motor vehicle liability policy that serves as proof of financial responsibility for certain operators or owners; requiring specified motor vehicle liability insurance policies to include medical payments coverage, etc. Florida is one of a few states that does not require liability insurance for motorcycle registration. This will change. HB419 Motor Vehicle Insurance: Rep. Hahnfeldt Revises definitions of "motor vehicle," "motor vehicle insurance," & "policy" to include motorcycles in provisions relating to financial responsibility for property damage, regulation of insurance rates, motor vehicle insurance contracts, & Florida Motor Vehicle No-Fault Law. This standalone bill that specifically busts our chops but has no Senate version. I wonder if Rep. Hahnfeldt is aware of the comprehensive no-fault repeal bill which will remove the exemption. There are only a very few states like Florida that do not require liability insurance for registration. I do not know who is rattling this guy s cage. At one point he was going to file a bill dealing with gangs. Nothing on that yet, although he has filed a bill which makes it a 2 nd felony for a school employee or volunteer to have a romance with a student. HB2103Motorcycle Safety and Education Rep. McCaim Section 1. Motorcycle Safety and Education is an Appropriations Project as defined in The Rules of The Florida House of Representatives and is described in Appropriations Project Request 88, herein incorporated by reference.

9 Section 2. For fiscal year the nonrecurring sum of $300,000 from the Highway Safety Operating Trust Fund is appropriated to the Department of Highway Safety and Motor Vehicles to fund the Motorcycle Safety and Education as described in Appropriations Project Request 88. Watson There is also Democrat initiative for restoration of rights for some felons to be added as a constitutional amendment on the 2018 general election ballot It seems everyone is protected from discrimination except those who wear club insignia HB397 Law Enforcement Practices Rep. Stark Requires officer who issues a traffic citation during traffic stop to record certain information on citation; requires law enforcement agencies to provide information to DHSMV; requires DHSMV to report information to Governor & Legislature & make information available on website; defines & prohibits racial profiling. SB592 Law Enforcement Practices Sen. Bracy Both these guys are Democrats Racial profiling prohibited. (1) As used in this section, the term "racial profiling" means determining probable cause for and carrying out the detention, interdiction, or other disparate treatment of a person based solely on the person's race or ethnicity. (2) A law enforcement officer may not engage in racial profiling in the performance of his or her official duties, including, but not limited to, conducting a traffic stop, making a physical arrest, or taking a person into custody. (3) Each law enforcement agency in this state shall adopt departmental policies to prohibit the practice of racial 67 profiling. Section 4. This bill was originally sponsored by Sen. Jeff Clemons, who was very anti-motorcycle. He was caught in an affair with Lobbyist Devon West who represented Broward and Martin Counties. She left for Iceland, LinkedIn has her picture. Creating the Florida Competitive Workforce Act ; adding sexual orientation and gender identity as impermissible grounds for discrimination in public lodging establishments and public food service establishments; revising the purposes of the Florida Civil Rights Act of 1992 to conform to changes made by the act, etc. SLOSBERG OPENS ACCOUNT TO RUN FOR CLEMENS SEAT Setting up a high-profile Democratic primary, former state Rep. Irv Slosberg has opened a campaign account to run for a Palm Beach County Senate seat that became vacant last week with the resignation of Lake Worth Democrat Jeff Clemens. Slosberg opened an account Thursday, joining Rep. Lori Berman, D-Lantana, in the race, according to the state Division of Elections website. Clemens, who defeated Slosberg last year for the District 31 seat, announced his resignation from the Senate last Friday after disclosures about an affair with a lobbyist. Gov. Rick Scott will call a special election to fill the seat but had not announced election dates as of Friday morning. SCOTT SETS ELECTION DATES FOR CLEMENS SEAT Gov. Rick Scott on Monday set a Jan. 30 special primary election and an April 10 general election in Senate District 31, which became vacant when Lake Worth Democrat Jeff Clemens resigned after acknowledging he had an affair with a lobbyist. The special election dates in the Democratic-leaning Palm Beach County district could keep the seat vacant throughout the upcoming 60-day legislative session, which begins Jan. 9. The election dates matched a request by Palm Beach County Supervisor of Elections Susan Bucher, a former Democratic state House member. Rep. Lori Berman, D-Lantana, and former Rep. Irv Slosberg, a Democrat who lost to Clemens in 2016, have opened campaign accounts to run for the seat.

10 WASHINGTON, DC EPA S.203 HR.350 Recognizing the Protection of Motorsports Act of 2017 (RPM Act). These bills ensure that transforming motor vehicles, including motorcycles, into race cars or racing bikes used exclusively in competition does not violate the Clean Air Act. The bill would clarify that the anti-tampering provisions applicable to motor vehicles do not apply to motorcycles used for competition in racing. The EPA says they have the authority to enforce any modifications (they call it tampering ) you might make to your bike s emissions system. Ron DeSantis is a co-sponsor, Sen. Rubio and Nelson are among the cosponsors of the Senate bill. S cosponsors, HR cosponsors. The House bill has had a committee hearing. ETHANOL HR1314 Renewable Fuel Standard Elimination Act Rep. Goodlatte Eliminates Renewable Fuel Standard in the Clean Air Act that sets progressive minimum volumes of renewable fuel to be on the marketplace. This is the best bill. Rep. Ron DeSantis is a cosponsor, 66 total cosponsors. Caps blending to the current of 10% HR119 Leave Ethanol Volumes at Existing Levels Act or the LEVEL Act Rep. Burgess see Hr1314, this bill has no cosponsors Profiling H.Res.318. Sponsored by Rep Walberg. This was printed in the May report. Note the registration numbers in the resolution ( , 2015). 14 cosponsors. This is almost identical to H.Res.318 and is sponsored by Sen. Johnson. 5 cosponsors among them Sen Jeanne Shaheen D-NH, Sen Lisa Murkowski R-AK. HR3697 Alien Gang Members. This bill has passed and empowers immigration authorities to deport aliens if they are found to belong to criminal gangs. Arguments against this passed bill were the definitions of gang and gang member were overly broad and unconstitutional. Sound familiar? It has been said that since elections are coming up, nothing controversial will be passed. I am not so sure. No politician wants to appear to be soft on crime. Biketoberfest It never fails that the newspaper will always run a letter from someone whining about how his quality of life drops because of motorcycle events. How much can these events affect someone in Deland? (10/20/17) Four fatalities this year. Friday afternoon a northbound Anthony Petro, Orlando, veered into the other lane and hit a southbound Ronald Ackley, Eustis, both died and Susan Cox was injured. Mike K., who was on the scene reported everyone was wearing helmets. Saturday early morning, a Bunnell motorcyclist crashed and died on the I95 entrance ramp from US1. Sunday afternoon, Jeffery Martin was killed when a hit and run driver ran a stop sign at 13 th St. and San Jose Blvd, Ormond Beach. Halifax Health said there were 12 trauma cases this year, , No details on the severity of the cases. Kevin Captain, nurse manager of Florida Hospital emergency dept. does not track which cases are related to Biketoberfest. This time he did not have to spout his helmet propaganda.
