6 Legislative Report August 19, 2018 John Banta WASHINGTON, DC The AMA and MRF websites do have automated letters that will go to your congressman. The MRF letter can be tweaked before you send it. Navigation is not that easy. MRF members get an of weekly congressional activity. From November to December, Congress is basically running out the clock, with little happening. Self Driving Cars: S.1885 AV Start Act. Sen. Thule SD To support the development of highly automated vehicle safety technologies, and for other purposes. EPA: S.203: HR.350 Recognizing the Protection of Motorsports Act of 2017 (RPM Act). These bills ensure that transforming motor vehicles, including motorcycles, into race cars or racing bikes used exclusively in competition does not violate the Clean Air Act. The bill would clarify that the anti-tampering provisions applicable to motor vehicles do not apply to motorcycles used for competition in racing. The EPA says they have the authority to enforce any modifications (they call it tampering ) you might make to your bike s emissions system. Ron DeSantis is a cosponsor, Sen. Rubio and Nelson are among the co-sponsors of the Senate bill. Light weight feel good legislation, but we need to reel in our federal agencies. ETHANOL: The MRF lobbyist attends all the committee hearings concerning Ethanol. E15, E30 and E85 will damage your motorcycle. HR1314 Renewable Fuel Standard Elimination Act Rep. Goodlatte. Eliminates Renewable Fuel Standard in the Clean Air Act that sets progressive minimum volumes of renewable fuel to be on the marketplace. This is the best bill. Rep. Ron DeSantis is a cosponsor. Caps blending to the current of 10%. You do not want to run E15 in your bike. The EPA is pushing E15 although my owners manual for my 2012 car says only use E10. Running E15 will burn up your engine, if it is not designed for it. HR5855 Consumer Protection and Fuel Transparency Act of 2018 Rep. Austin Scott (R-GA). To require the Administrator of the Environmental Protection Agency to revise labeling requirements for fuel pumps that dispense E15, and for other purpose. Doc's buddy Rep. Lois Frankel (D-FL) is a co-sponsor. PROFILING : H.Res.318. Promoting awareness of motorcycle profiling and encouraging collaboration and communication with the motorcycle community and law enforcement officials to prevent instances of profiling. Sponsored by Rep Walberg. Note the registration numbers in the resolution ( , 2015). S.Res.154 is almost identical to H.Res.318 and is sponsored by Sen. Johnson. 5 cosponsors among them Sen. Jeanne Shaheen D-NH, Sen. Lisa Murkowski R-AK. ELECTIONS Primary August 28 7 AM to 7 PM, August 13 to 26 early voting General November 6. By the time you read this the ballot will be down to 2 candidates and we will see who our judges are. Governor: For Republicans it is between DeSantis and Putnam. Putnam has been a proven supporter for ABATE. DeSantis is liked by many. Four Democrats, except for #5 Graham, want full marijuana legalization. Democrats all want more gun control. There idea of reasonable is baloney. Attorney General: Republicans Frank White and former Hillsborough County Judge Ashley Moody. All support old Jim Crow legislation. Democrats Sean Shaw, Ryan Torrens Agriculture Commissioner: Republicans Grimsley, Caldwell, McCalister, and Troutman ;Democrat Jeffery Porter, Nikki Fried, Rod David Walker. Caldwell has the NRA nod. US House of Representatives District 6: Democrats John Upchurch, Nancy Soderberg, Stephen Sevigny. Upchurch is local. Republicans John Ward, Michael Waltz, Fred Costello. Fred was approachable while a State Representative. He supported the non ethanol gas bill and was sympathetic to my arguments of why that helmet does not do what the bureaucrats says it does. I do not expect him to support any profiling resolutions. Alfy likes Michael Waltz. John Ward does not realize how many people from Puerto Rico live here.

At Large Ben Johnson, Dr L. Ronald Durham. Old Sherriff Ben has gotten allot of money from developers. District 1 Jeffery Brower, Barbara Girtman, Eddie Molina, Pat Patterson. District 3 Michael Arminio, Deb Denys. District 5 Dan Hunt, Fred Lowry. We do have choices. Some good some not so good. Constitutional Amendments: Amendments 6 thru 13 are from the committee and are bundled. Feel good amendments are paired with controversial amendments that should be rejected. This list includes info sent by Darrin (What it means). Get on Darrin's list, he has sent out info on all of theses amendments. Amendment 1: Increased Homestead Property Tax Exemption. What it means: Would increase the portion of a home s value that s exempted from non-school property taxes. The changes would apply to the value of a home between $100,000 and $125,000 with the maximum exemption climbing to $75,000. This only will help the rich people. Where is the money going to come from for our services? Amendment 2: Permanent Cap on Non-homestead Parcel Assessment Increases. What it means: Would limit increases to assessment rates to 10-percent per year. Secures an existing cap on non-homestead property assessments. Florida Association of Realtors supports this. Amendment 3 Voter Approval for Casino Gambling. What it means: Would provide voters with the exclusive right to decide whether to authorize casino gambling and expansions in the state. Both the state legislature and the voters currently have the authority to authorize casino gambling through constitutional amendment. Disney and the Seminoles support this. People do not trust their legislators. Amendment 4. Restoring of Voting Rights for Individuals with Felony Convictions. What it means: Would restore the right to vote for more people with prior felony convictions upon completion of their sentences. It would exclude those convicted of murder and felony sexual offenses. Amendment 5: Increase to Two-Thirds Vote Majority in Legislature to Increase Taxes. What it means: Would increase the majority needed in the state Legislature to two-thirds to impose, approve or raise taxes. It would also mean it would take only a third of members in either the House or Senate to block tax increases or repeal exemptions. VICTIMS RIGHTS AND JUDGES (Amendment 6): It would establish a series of rights for crime victims, including the right to be notified of major developments in criminal cases and the right to be heard in legal proceedings. It would increase the mandatory retirement age for judges from 70 to 75. It would provide that judges or hearing officers should not necessarily defer to the interpretation of laws and rules by governmental agencies in legal proceedings. What it means: Would add a list of rights for crime victims, known as a Marsy s Law. The other two aspects of this measure would increase the retirement age for judges to 75 and would prohibit judges from deferring to administrative agencies interpretations of a law when ruling in cases. The News Journal has called this amendment sneaky. FIRST RESPONDERS AND HIGHER EDUCATION: (Amendment 7): It would require the payment of death benefits when law enforcement officers, paramedics, correctional officers and other first responders are killed while performing official duties. It also would apply to Florida National Guard and active-duty military members stationed in Florida. It would establish a governance system for the 28 state and community colleges. It would require a supermajority vote by university boards of trustees and the Board of Governors when raising student fees. What it means: Would require employers to provide benefits to surviving spouses of first responders if they die on duty, and it would require the state to provide benefits to surviving spouses of active-duty military members who are killed. The last parts of the measure would require university trustees to agree by a third-thirds super-majority to raise college fees and establish the state college system in the state Constitution. Universities are currently in the Constitution, but state colleges (community colleges) are not. PUBLIC SCHOOLS (Amendment 8): It would impose an eight-year term limit on school board members. It would allow an alternative process for approving public schools, including charter schools, rather than by local school boards. It would establish a requirement for the teaching of civic literacy in public schools. What it means: Creates a consecutive eight-year term limit for school board members, allows state governments to control public schools not established by the school board and requires the Legislature to promote civic literacy in public education. The League of Women Voters is challenging this amendment

8 OIL DRILLING AND VAPING (Amendment 9): It would prohibit drilling for gas and oil in state coastal waters and ban vamping and the use of electronic cigarettes in workplaces. What it means: It would ban offshore drilling for oil and natural gas on all lands beneath state waters. The measure also bans the use of vapor-generating electronic devices, including electronic cigarettes, in indoor workplaces. GOVERNMENTAL STRUCTURE (Amendment 10): It would require all charter-county governments to have elected constitutional officers, including sheriffs. It would lead to the Legislature beginning its annual session in January in even-numbered years. It would create an Office of Domestic Security and Counterterrorism in the Department of Law Enforcement. It would revise the constitutional authority for the Department of Veterans Affairs. Sheriff Chitwood has asked everyone to vote yes. What it means: Would add a state Department of Veterans Affairs and create a state office of Domestic Security and Counter-terrorism. The measure would also require the Legislature session to start in January rather than March in even-numbered years. Lastly, the measure includes a proposal that would require five county-level offices to be elected statewide: sheriffs, tax collectors, property appraisers, supervisors of elections and clerks of circuit court. Many counties already elect these positions PROPERTY RIGHTS AND HIGH-SPEED RAIL (Amendment 11): It would remove language that prohibits aliens ineligible for citizenship from owning property. It would remove obsolete language that authorizes a high-speed rail system. It would revise language to make clear that the repeal of a criminal statute does not affect the prosecution of any crime committed before the repeal. What it means: Would do away with the prohibition against foreign-born persons from owning, inheriting, disposing or possessing property. The measure removes a provision that stated a highspeed rail system be developed in Florida and revises a provision on criminal prosecution so that it s clear that repealing a criminal statute does not retroactively affect the prosecution of a previously-committed crime. ETHICS (Amendment 12): It would impose a six-year lobbying ban on former state elected officials, state agencies heads and local elected officials. It would also create a new ethics standard that would prohibit public officials from obtaining a disproportionate benefit from their actions while in office. GREYHOUND RACING (Amendment 13): It would ban greyhound racing at Florida tracks after Dec. 31, Currently taken off the ballot but there is an appeal to get it back on.
