2 PRESIDENT S MESSAGE Happy 4th of July USA and Happy 1st to all of our Canadian Members!! Summer is here and the heat is on! The chapter elections are over and I'd like to personally thank all officers (elected and nonelected) for your time and for doing a great job for the past year. All officers will stay in there current positions except the Sergeant at Arms, who will be Grog, the Secretary who is now Sarah and the Safety Officer who is now Tom. Congratulations to all!! Everyone is enthused and ready to get to work at keeping us the best Abate chapter in the state of Florida!! I'm looking forward to seeing everyone at the July 5th meeting on Thursday night, 7:30pm at the Fraternal Order of Eagles #3800 on Nova Rd. in Ormond Beach. We have lots to talk about. Alfy and John rode 350 miles to the State meeting on Saturday 6/09 and have important news to share, including info about the winners of the State Board of Directors election. 4 Daytona Beach Chapter Chapter Meeting June 7, 2018 Fraternal Order of Eagles 7:30 p.m. President: Geno called meeting to order at 7:37pm. We opened the meeting with the pledge of allegiance VP: Alfy- Spoke to Senator Perry. Secretary: Report was in the newsletter and on the website. Treasurer: John- gave treasury report. John has gun tickets for sale 5.00 per ticket and he also has pictures of the gun. Membership: Steve- Don t have anything to report have to add the new members tonight. Legislation: John- See report in newsletter. Bobby C: talked about being in Washington DC he said there were multiple clubs that showed up and that it was time well spent and everyone felt welcomed no matter what type of club they were in. He is pushing the weblink for the profiling survey which is motorcycleproject.com. He said Steve is the man vote him in. Sgt At Arms: Tim- Absent tonight Products: Frank is not here tonight but there are t-shirts available for sale. Mike asked if anyone hears about accidents to please him the information you get the state is not wanting to give to much information. 6 Legislative Report June 20, 2018 John Banta Alfy and myself went to the State Meeting in Stuart. We did not get wet. Upon re-election, President and Lobbyist Doc Reichenbach presented the goals of next legislative session. Lobbyist contract is $36000/ year. Do not get spoiled by the weekly reports MRF Lobbyist Megan Elkstrom makes by to MRF members or compare to the monthly full page report Steve Christenberry gives to ABATE of Kansas. Look closely at the reports and you will hear about where the bill is, and what it will do, but no real listing of which legislators were talked to prior to committee hearings. Our lobbyist reports to the vice president. Get on Darrin's list. It is up to the chapters to provided legislation information. Not all Chapters give as much detail as this one. Support of the Texting Bill. We all see it. This bill is to make it a primary offence for those writing a novel on their steering wheel while driving. Last session Appropriation Chairman Bradley' stopped the bill over concerns about profiling. He is from the big bend area, Dixie, Swannee, Baker, Clay counties NOT South Florida. He was not a co-sponsor to the racial profiling bills which had some stronger language for ALL traffic stops. There was originally profiling concerns with the seatbelt law, the anti-profiling language is the same as what is being used in the texting bill. Rep. Emily Slosberg. the original sponsor, was not able to push this bill until she got Republican Representatives Tom Leek and David Santiago (our local representatives) as cosponsors. Tallahassee politics. Safety Money. We want a portion of the money for projects. Some legislators are eyeing the money to fund driver's education. Last session; Speaker of the House Corcoran took it out of the budget. During committee hearings Rep. David Santiago was very supportive. $2.50 is paid by every registered motorcycle. Florida Motorcycle registrations in July (35355 Volusia County). There were no categories for ATVs or Mopeds, so they are probably included in that number. Stiffer Penalties. Doc believes we can get some strong advocates for a middle set of penalties between vehicular manslaughter and the $1000 fine. Our chapter does have concerns about making more laws and regulations. Mandatory Helmets for all moped and motorcycle riders under 21 years old, regardless of engine size. This is being pushed buy University of Florida, Gainesville, who says they are concerned about their students. Last sessions staff reports mention the current laws, for mopeds and motorcycles under 50CC. Really not that confusing. Mention was made on how performance has greatly increased but the idea that it was from aftermarket modifications is nonsense. There were no safety stats. The 2016 Crash Facts says for Moped and ATV riders: Helmet worn 6 fatalities, 281 accidents (2.13%); No Helmet worn 29 fatalities 1292 accidents (2.24%). What is surprising is that helmets are only effective at speeds lower than 15mph, as per the manufacturer disclaimer. Like motorcycles the stats do not prove the effectiveness of helmets. There we 45 deaths total including passengers. So it is the old "If we can save one Life". Sorry. If you would want to save lives look at all the drowning deaths life jackets would prevent. What about the un-funded mandates for school protection or not funding Reality House for those incarcerated with Opoid addiction. ABATE's position is we will throw the under 21 folks under the bus to prevent mandatory helmet laws for those over 21 years old. That age group does not seem to care about losing freedom, just look at their suggestions in the aftermath of school shootings. The media has sure jumped on that. Profiling. Our lobbyist does not want to use the Motorcycling Profiling Project survey (which the MRF is using). Doc wants verifiable facts, which we will not get from state agencies. The Racial profiling bill went nowhere last session. Nevertheless, I urge all those who have been profiled to take the survey. The survey bogs down for those who have not been subjected to profiling, but you would be surprised where there are pictures of you. NO MORE LINKS. Links expire or do not work despite being checked when reports are written. Google Motorcycle Profiling Project, easy navigation to and inside the site. Racial profiling means determining probable cause for and carrying out the detention, interdiction, or other disparate treatment of a person based solely on the person s race or ethnicity. There has to be reason for a traffic stop. But we all know how easy that is circumvented. If you stop on the stop bar that is reason enough for a traffic stop in Volusia County. See last month's segment on judges. WHAT WAS NOT DISCUSSED Repeal of No-Fault. Legislation gets further each year. Last year it died when the Senate could not agree with the House bill. Motorcyclists will be required to have liability insurance. At issue is what the medical insurance requirement will be and what it will cost for auto drivers and motorcyclists. The staff reports do NOT give exact details. In July 2017;There are people with motorcycle endorsements in Volusia; Florida.

7 Besides Legislators and Bureaucrats, there are other groups that are undermining us. The Suncoast Brotherhood originally had founders that were members of ABATE of Florida but in June 1998 left ABATE because of a tiff with Doc. They are active in Pinellas and Pasco counties. In 2000 ABATE of Florida repealed the mandatory helmet law. Now they want to be more legislatively active. We all want to see fatalities lowered. Riders now have to take a MSF Riders course. We all say that you lower your edge if you drink and ride. We all have disdain for those who text and ride. This is what Suncoast Brotherhood wants in addition: No motorcycle sales unless you have a motorcycle endorsement; 6 month probationary period with probation license plate so you will be targeted. During probation, no passengers; no night time riding; and wear a helmet. Hold on, I have been saying for years, AND HAVE THE STATS TO PROVE IT, that a helmet does not statistically help you survive. It would be so easy to make it mandatory for all in any legislation before a committee. They want Road test to be on a tier motorcycle size with 700cc being the size between tiers. They want more stringent laws for stunt riders, I suppose that means confiscation for popping a wheelie. They have a legislator listening to them, Former State Representative Ed Hooper, running for Senate 16 district. They have my contempt. Knee jerk ideas that I expect from those who really want to see motorcycles disappear. From the Traffic Safety Facts 2016 Motorcycles.: (Nationally) 59% motorcycle fatalities occur in daylight. From 2007 to 2016, The number of motorcyclist fatalities on 501 to 1000cc or less decreased from 36% to 27% cc to 1500cc, 36% to 27%. Those in the same time period riding 1501 cc or higher saw an increase of 8% to 22%. 80 cubic inches is 1380cc. WASHINGTON, DC Will anything get done? The AMA and MRF websites do have automated letters that will go to your congressman. The MRF letter can be tweaked before you send it. Navigation is not that easy. MRF members get an with a link on upcoming legislation. EPA: S.203: HR.350 Recognizing the Protection of Motorsports Act of 2017 (RPM Act). These bills ensure that transforming motor vehicles, including motorcycles, into race cars or racing bikes used exclusively in competition does not violate the Clean Air Act. The bill would clarify that the anti-tampering provisions applicable to motor vehicles do not apply to motorcycles used for competition in racing. The EPA says they have the authority to enforce any modifications (they call it tampering ) you might make to your bike s emissions system. Ron DeSantis is a co-sponsor, Sen. Rubio and Nelson are among the co-sponsors of the Senate bill. Light weight feel good legislation, but we need to reel in our federal agencies. ETHANOL: HR1314 Renewable Fuel Standard Elimination Act Rep. Goodlatte. Eliminates Renewable Fuel Standard in the Clean Air Act that sets progressive minimum volumes of renewable fuel to be on the marketplace. This is the best bill. Rep. Ron DeSantis is a cosponsor. Caps blending to the current of 10%. You do not want to run E15 in your bike. The EPA is pushing E15 although my owners manual for my 2012 car says only use E10. Running E15 will burn up your engine, if it is not designed for it. HR5855 Consumer Protection and Fuel Transparency Act of 2018 Rep Austin. To require the Administrator of the Environmental Protection Agency to revise labeling requirements for fuel pumps that dispense E15, and for other purpose. Doc's buddy Rep. Lois Frankel is a co-sponsor. PROFILING : H.Res.318. Promoting awareness of motorcycle profiling and encouraging collaboration and communication with the motorcycle community and law enforcement officials to prevent instances of profiling. Sponsored by Rep Walberg. Note the registration numbers in the resolution ( , 2015). S.Res.154 is almost identical to H.Res.318 and is sponsored by Sen. Johnson. 5 cosponsors among them Sen. Jeanne Shaheen D-NH, Sen. Lisa Murkowski R-AK. Last session in Tallahassee saw Sen. Rob Bradley, chairman of appropriations, killing the texting bill over privacy concerns and profiling. which were somewhat addressed in the bill. However he was not a co-sponsor on the racial profiling bill which had stronger language. ELECTIONS Governor: For Republicans it is between DeSantis and Putnam. Putnam has been a proven supporter for ABATE. DeSantis is liked by many. Democrats, except for Graham, want full marijuana legalization. They all want more gun control. There idea of reasonable is baloney. Attorney General: Republicans House members Frank White and Jay Fant and former Hillsborough County Judge Ashley Moody. All support old Jim Crow legislation. Agriculture Commissioner: Republicans Grimsley, Caldwell and Troutman ;Democrat Porter US House of Representatives District 6: Democrats John Upchurch, Nancy Soderberg, Stephen Sevigny. Republicans John Ward, Michael Waltz, Fred Costello. Fred was approachable while a State Representative. He supported the non ethanol gas bill and was sympathetic to my arguments of why that helmet does not do what the bureaucrats says it does. I do not expect him to support any profiling resolutions. Alfy likes Michael Waltz. John Ward does not realize how many people from Puerto Rico live here. Florida State Representatives: Qualifying is still open till June 22 for State Candidates Volusia County Council: The developers are pouring in money to the incumbents. At Large Ben Johnson, Dr L. Ronald Durham. Old Sherriff Ben has gotten allot of money from developers. District 1 Jeffery Brower, Barbara Girtman, Eddie Molina, Pat Patterson. District 3 Michael Arminio, Deb Denys. District 5 Dan Hunt, Fred Lowry. We do have choices. Some good some not so good. Hey!! You get a discount with Allstate if you are a member of the AMA or MRF. Go figure.
