2 PRESIDENT S MESSAGE HAPPY NEW YEAR!! President's year ending statement: During the year 2018, I have been rude, bad tempered, obnoxious and down right dirty and just want let you all know 2019 will be exactly the same! Wow!! Sure seems like 2018 flew right by! Looking forward to another year with the Daytona Beach Chapter of Abate...fighting for the rights of bikers across the great state of Florida. Lots of good things going on in 2019! My favorite, we're going to have more fun runs this year, since the last one, way back when, was a hit so we'll start planning for the next ride at the February meeting Steve and me attended the December State meeting in Naples. He drove the whole way there and back! With the meeting, it took us 13 hours. But we did get a free lunch..meatloaf and mashed potatoes..lol Next one is in Ocala in February..a slight bit closer! Our Annual ride to the Daytona Health and Rehab Center on Saturday, December 1st was a blast as usual. We handed out over 100 wrapped gifts to the residents and exchanged Holiday cheer. They even had a BBQ lunch waiting for us afterwards. Was a great time had by all. If you missed it..you have 11 months to plan for this years ride..lol Also..be sure not to miss the January 3rd meeting...we have some good news and we'll tell you the details of what happened at the state meeting PLUS...we'll have our 3rd annual "Member of the year Award" Come on out and find out who it is..and support your local Abate Chapter! 7 egislative Report December 16, 2018 John Banta Committee hearings start Dec 11-13, Jan 7-11, 22-25; Feb 4-8, 11-15, Session starts during Bike Week, March 5. Here are the issues that will affect motorcyclists. Some of them will be part of ABATE of Florida legislative agenda. Texting While Driving a Primary Offense Texting is the worst; we have all seen people writing novels on their steering wheels. These bills cover all handheld cell phone usage. I personally think that approach is flawed. Laws to ban or curb drivers use of cell phones and other handheld devices have greatly reduced the rate of fatalities for motorcyclists, according to a new study by faculty at Florida Atlantic University and the University of Miami. The study s findings, recently published in Social Science & Medicine, show that states with moderate to strong bans have motorcycle fatality rates that differ by as much as 11 percent compared to states with no bans. In the case of motorcycles, these laws seem to be effective, said study co-author Gulcin Gumus, Ph.D., an associate professor in health administration in the Department of Management Programs at FAU s College of Business. While it s not clear that these laws have had an impact on reducing the overall number of traffic fatalities, when we focus specifically on motorcycles, we find that these laws are having a major impact in reducing deaths among motorcycle riders. This article is being promoted by our lobbyist and State President Doc Reichenbach. HB45, Rep Slosberg D Use of Wireless Communications Devices While Driving: Revises short title & legislative intent; prohibits operation of motor vehicle while holding or touching wireless communications device; provides exceptions; requires law enforcement officer to record certain information on citation; requires law enforcement agencies to provide such information to DHSMV; requires report to Governor & Legislature; removes requirement that enforcement be accomplished only as secondary action. This bill is for handheld devices and includes profiling provisions. SB79, Sen. Simpson R Use of Wireless Communications Devices While Driving: Creating the "Florida Ban on Wireless Communications Devices While Driving Law"; prohibiting a person from operating a motor vehicle while listening or talking on a wireless communications device for the purpose of voice interpersonal communication; deleting a provision requiring that enforcement of this section be accomplished only as a secondary action. This covers handheld devices but the bill should of been written like HB45. Currently texting while driving is a secondary offense. These bills would make texting and all handheld communicating a noncriminal traffic infraction, punishable as a nonmoving violation as provided in chapter 318. If you make another offense within 5 years it is a noncriminal traffic infraction, punishable as a moving violation as provided in chapter 318. In Canada they are taking it very seriously. Please note as of January 1, 2019, a cell phone ticket in Ontario will carry a 3-day license suspension and a $ Fine. What does this have to do with your insurance? Well if you receive this conviction it will be seen as a Major Conviction (minimum surcharge of $350.00) plus a ratable license suspension (minimum surcharge of $150.00) and a guaranteed non-renewal/cancellation
8 of your auto policy. The reason for this is that insurance companies do not want to insure drivers who text and drive as they are at a higher risk of a fatal accident. Insurance companies are even taking into consideration the people who received a texting and driving ticket prior to January 1, 2019 and may be rating their insurance policies accordingly to the new rules. That is in Canada. If you have this ticket on your record currently, you might be seen as a high-risk driver and we may need to place you in a high-risk market come your renewal. Please note that all convictions and license suspensions stay on your record for 3 years similar to Florida insurance companies. Bicycle and Pedestrian Safety that includes provisions for motorcycles Motorcycle Safety and Education Funding Law Enforcement Practices (Racial Profiling) Motorcycle and Moped Riders Under 21 to wear a helmet Liability Insurance to register a motorcycle if they change no-fault. WASHINGTON, DC Consider subscribing to the AMA or MRF Alerts. The AMA and MRF websites do have automated letters that will go to your congressman. The MRF letter can be tweaked before you send it. Congress is basically running out the clock, with little happening. We will have to wait till the next Congress. The MRF is gearing up to make sure provisions such as no funding for Motorcycle only checkpoints, NHSTA lobbying ban, continuation of Motorcycle Advisory Council get included in the next highway bill in Former MRF lobbyist Megan Ekstrom has left to work for Proctor and Gamble. Before working for the MRF she was a lobbyist for cosmetics, however I was impressed with her work for the MRF. As the 115th Congress nears an end the Motorcycle Riders Foundation (MRF) has contracted with Husch Blackwell Strategies (HBS) a Washington, DC. based lobbying firm to pursue passage of our anti-profiling resolutions in both the House of Representatives and the Senate. H.Res.318. Promoting awareness of motorcycle profiling and encouraging collaboration and communication with the motorcycle community and law enforcement officials to prevent instances of profiling. Sponsored by Rep Walberg. Note the registration numbers in the resolution ( , 2015). S.Res.154 is almost identical to H.Res.318 and is sponsored by Sen. Johnson. The MRF has asked that everyone take the survey at The Motorcycle Riders Foundation (MRF) is proud to announce that the Motorcycle Profiling Resolution (S. Res. 154) passed the U.S. Senate with unanimous consent on Tuesday evening, December 11, 2018.Russell Radke, MRF Sustaining Member Motorcycle Club Representative, said, We are now one step closer to ending the attacks on our civil liberties from unconstitutional motorcyclist profiling. MRF President Kirk Hardtail Willard said upon learning of the adoption of the resolution, Passage of Senate Resolution 154 has been the Motorcycle Riders Foundation s number one legislative initiative in this current Congress. This act today by the Senate is very important, as it recognizes that the profiling of motorcyclists because of our mode of transportation or choice of attire is unacceptable. The personal relationships, the tens of thousands of contacts, the visits, and the highlighting of this issue as a top priority during the MRF s Bikers Inside the Beltway speaks highly of our passion on this issue and demonstrates our ability as grassroots lobbyists to be effective on Capitol Hill. Willard went on to say, It is important to note that this cause united the Motorcycle Riders Foundation, our state motorcyclists rights organizations (SMROs), the National Council of Clubs (NCOC), the National Coalition of Motorcyclists (NCOM) and the Motorcycle Profiling Project (MPP), all of which brought even greater attention to this critical issue. Our resolution s co-sponsor, Senator Ron Johnson (R-WI), has played an integral role in ensuring that the issues of motorcyclists in this country were addressed in the U.S. Senate. Higher Ethanol use will be expanded and we hope to get better warnings at the gas pump. We hope to make sure automated driving legislation will make sure motorcycles are recognized.
