2 PRESIDENT S MESSAGE BIKE WEEK 2018!! It's that time again! The 77th anniversary! Bikeweek in Daytona always takes me back to the 70's and my first trip to Daytona in 1977 as a kid that was only 17 with an $ Panhead in the stripped backseat of my 68 Chevelle SS (the front end and a handful of tools in the trunk). Was even a couple years before I had tattoos or could grow a beard..when I had a full head of hair..lol So here we are..times have changed and there are hundreds of thousands of people and bikes in our area..so like I say year after year.. HAVE FUN..DON'T DRINK (too much) AND RIDE..BE SAFE AND LOOK TWICE..EVEN THREE TIMES...IT MIGHT SAVE YOUR LIFE!! Thank you everyone that attended our last months meeting..we had a great turnout and we hope to see you again at this months meeting on Thursday March 1st. We have lots to talk about as we have the latest and greatest info from the State meeting in Monticello (Tallahassee) a couple weeks ago. I was there along with our very own, statewide known Legislative officer, John Banta. 6 Legislative Report February 19, 2018 John Banta Out of date as soon as I write it Session ends in March. The bill listing is separate and next month we shall see what has passed. I suspect that our correspondence with our local legislators has been minimal. Profiling Myself and Geno went to the February state meeting. Our lobbyist and state president, Doc Reichenbach, has said that he cannot find a sponsor for any future profiling bill because of recent club violence. He has also stated that of two incidents of profiling brought to his attention, the traffic stops were actually because of speeding and under 18 passenger without a helmet. While the motorcycle profiling project website has a great documentation of profiling during Biketoberfest 2017, that is only one Florida example. We need Florida examples. Snide comments by law enforcement are not profiling. There was no discussion about trying to jump on to a racial profiling bill. Daytona Beach Chapter members will not like hearing this. There are some alternatives. Alternative 1, ABATE of Florida is a grass roots organization, let's find a sponsor for our lobbyist. There are legislators who realize profiling exists. There are legislators who believe that law enforcement could use some guidance. There are legislators who believe the draconian laws, favored by law enforcement, should be revised. Some of these bills are not being heard in the first committee thus dying this session. This could take a few sessions. There are shootings everyday in Orlando but racial profiling bills have still been filed. Here are some bills. and their sponsors. CS/CS/HB33 and CS/SB504 Texting while driving. Rep. Barbara Watson and Sen. Perry Thurston added provisions to document how enforcement along racial lines could indicate profiling. HB931 and SB1148 De-escalation Training Pilot Program (for FDLE). Rep. Henry, Sen. Thurston HB 61 and SB430 Restoration of Civil Rights. Representatives Clovis Watson, Jacquet, Antone, Geller, Jacobs and Sen. Thurston, Sen. Keith Perry HB397 and SB592 Law Enforcement Practices Requires officer who issues a traffic citation during traffic stop to record certain information on citation; requires law enforcement agencies to provide information to DHSMV; requires DHSMV to report information to Governor & Legislature & make information available on website; defines & prohibits racial profiling. Rep. Stark, Sen. Bracy. Alternative 2, Find a new lobbyist. And pay him with what?. We have an exclusive arrangement with Doc and he has let slide the contracted fees because of ABATE's cash flow situation. Most lobbyists represent many principals. Here is an example. The Florida Surveying and Mapping Society has paid David Daniels of Smith, Bryan & Meyers between $10000 and $19999 for the last 4 quarters, ($40000 to $80000, 2017). He represents 58 other principals. The surveyors big goal is to get $ (HB5001) in funding for UF Geomatics program and survive the governor's veto plus monitoring any deregulation attempts. Spend $40000 to $80000 for $636120???? Autocycles Doc gave testimony on autocycles in the Senate Transportation committee. DHSMV said they are prepared to provided a separate box on accident forms for Autocycles which motorcyclists nation wide want. We need accident data separate from motorcycles. The bills were pretty good defining an Autocycle. Autocycles can not be straddled like trikes and some of those 2 wheels in the front contraptions. The bills also call for seatbelts and removed the motorcycle endorsement requirement even though they are still also classified as motorcycles and did not mention a separate license plate. The bills did not mention the insurance requirements. After judicial review, I suspect it will be like motorcycles, nothing to get registered. Who would benefit? Polaris who sells these vehicles without restrictions to the buyers. Here is what they paid to lobbyists. I will research further to see how the bill sponsors fared. Jan 1 to March 31, 2017; Southern Strategy Group $20000 to $29999; Ausley &McMullen PA $10000 to $19999; Dyal Consulting $1 to $9999 April 1 to June 30, 2017; Ausley &McMullen PA $20000 to $29999.

Williamson Passed all committees SB358 Greg Evers Memorial Highway Bill Senators Broxson; Book; Baxley; Campbell Greg Evers was a great friend to motorcyclists and deserves this honor. CS/CS/HB33 Texting While Driving Rep. Slosberg Passed all committees. CS/SB90 Use of Wireless Communications Devices While Driving Sen. Perry Motorcyclist see distracted drivers all the time. Make texting while driving a primary offense. There are provisions concerning profiling. CS/HB117 Bicycle and Pedestrian Safety Rep. Stone Passed all committees. SB116 Operation of Vehicles Sen. Baxley The Senate bill provides safety to vulnerable road users stopped on the side of the road. The House bill was changed to exclude motorcycles, which needs to be fixed. HB2103 Motorcycle Safety and Education Rep. McCain In July 2017 there were registered motorcycles in Florida. Those owners paid $2.50 to be used for motorcycle safety and awareness. That fee was originally asked for by motorcyclists to fund the Florida Motorcycle Riders Training Program. That program has evolved over the years. The subsidies for the riders beginning course have stopped and the funds are being used at the discretion of DHSMV with the remaining being transferred to the DHSMV general fund. For several years ABATE of Florida was able to use a portion of the funds for their Motorcycle Safety and Awareness program while the DHSMV did nothing. The DHSMV is now starting to use these funds. This bill will allocate $ for ABATE's program of reaching out to the non-riding public. Kudos to Rep. Santiago for his support. HB397 Law Enforcement Practices Rep. Stark SB592 Law Enforcement Practices Sen. Bracy These bills define and prohibit racial profiling. Motorcyclists, especially those having organization insignia have also been subjected to profiling. A recent Volusia County video portrayed offensive profiling. Jessica Wolfflesnider, executive assistant to Daytona Beach Police Department (DBPD) Chief Craig Capri, reports that, in response to the video captured at Biktoberfest, the DBPD Training Department is now working in conjunction with the Florida State Attorney s office to develop a curriculum to retrain all officers in the department. Volusia County Motorcyclists will not oppose these bills: HB215 Autocycles Rep. Payne Passed the House, in messages. CS/SB504 Autocycles Sen. Perry These bills will reclassify these newer three wheeled vehicles that the driver does not straddle as an Autocycle. The bills will make accident data separated from traditional two wheeled motorcycles. There are flaws in these bills concerning required insurance and that the plate will still be a motorcycle, although an endorsement will not be required. HB583 Motorcycle and Moped Riders Rep. Clemons
9 CS/SB346 Motorcycle and Moped Riders Sen. Perry The Senate bill will require a helmet for all persons, under 21 years of age, riding a moped or motorcycle under 50cc. While the staff reports do not give any accident statistics to justify this change, apparently there are presently some challenges in compliance and enforcement. CS/HB19 Motor Vehicle Insurance Rep. Grail Passed the House, in messages. CS/SB150 Motor Vehicle Insurance Sen. Lee These bills repeal Florida No- Fault Insurance Law. These bills will also create a PD and BI insurance requirement for motorcycle registration, although motorcyclist have always had to provide proof of financial responsibility after an accident. At issue is the medical payment requirements for motorcyclists. We expect that these bills will pass this session. Volusia County Motorcyclists oppose this bill: HB419 Motor Vehicle Insurance Rep. Perez This bill would require motorcyclists to have no-fault insurance which would be expensive. This bill will not proceed since no-fault is being revised by our legislators.
