Mold Abatement and Remediation for Rentals Study the effect of including mold abatement and remediation for rentals in rental agreements. Sen. Jacob Anderegg 6. Workplace Discrimination Amendments Study the remedies available in an administrative action against an employer for a discriminatory or prohibited employment practice, as well as adding a sate cause of action for employees seeking relief from a discriminatory or prohibited employment practice. See H.B. 213, 2017 General Session. The committee may coordinate this study with its review of and recommendations for the Performance Audit of the Utah Antidiscrimination and Labor Division s Employment Discrimination Unit Report # Rep. Telecommunication Network Review Before the creation, expansion, or upgrade of a state owned or state funded telecommunication network, whether voice, data, or video transmission, the agency or entity proposing any change is required by Utah Code , to submit a plan to the governor detailing the proposed changes. The governor may then direct the Public Service Commission to prepare an advisory report detailing how implementing the plan will affect telephone ratepayers where the plan would be in effect. Audit Report of A Review of the Distribution and Use of Local 911 Surcharge Funds This audit report was presented to the Legislative Audit Subcommittee and referred to the Public Utilities, Energy, and Technology Interim Committee as the lead committee for further review and action as appropriate. The Office of the Legislative Auditor General will present this report which provides a review of local 911 taxes to determine if the use of these funds is in compliance with state statute. Sunset Review Utah Broadband Outreach Center The committee will conduct a sunset review of Title 63N, Chapter 12, Part 3, Utah Broadband Outreach Center, which will be repealed July 1, 2018, under current statute. The Governor's Office of Economic Development, which administers the center, will provide recommendations. Governor's Office of Economic Development 3. GOED Streamlining The committee will hear a presentation from the Governor's Office of Economic Development outlining proposed changes to the office that would require statutory modifications. State Economic Development Strategy Incentive Evaluation Methods The committee will hear a presentation from staff regarding evaluation methods for economic development incentives that have been implemented around the country. Committee staff JUDICIARY INTERIM COMMITTEE Wednesday, August 23, :15 p.m. Room 20 House Building 2. Sunset Review Administrative Office of the Courts Absent further action by the Legislature and pursuant to Utah Code Section 63I 1 278, on July 1, 2018, Section 78A 2 105, which applies to the Office of the Court Administrator, will be repealed. The Office of the Court Administrator oversees the Administrative Office of the Courts. The committee will conduct a sunset review to determine whether the section should be reauthorized for up to 10 years, with or without amendments, allowed to expire, or the sunset provision be eliminated from the statute. 4 4. Children s Justice Centers The Utah Children s Justice Center Program helps local communities respond to allegations of child abuse. The goal is to respond in ways that are effective, efficient, and that minimize trauma for the child. The program is administered by the Utah Attorney General and includes 20 locations statewide. Rep. Kim Coleman 5. Jury Nullification / Jury Instructions The committee will discuss the role of the jury in a criminal trial General Session H.B. 332, Criminal Procedure Revisions, as amended by the House Judiciary Standing Committee, proposed changes related to juries. Marc Roberts Timothy Lynch, Director of Project On Criminal Justice, CATO Institute Steven Burton, Utah Association of Criminal Defense Lawyers Statewide Association of Prosecutors Academic 6. Mens Rea Reform Mens rea, Latin for guilty mind, is the mental state of an individual accused of committing a crime, as opposed to the action or conduct of the accused. Proponents of men rea reform favor strengthening mens rea requirements. Rep. Brian Green 7. Indigent Defense The director of the Utah Indigent Defense Commission will provide an update. Indigent Defense Commission Report on the Operations of the Commission Pursuant to Utah Code section , the Indigent Defense Commission will present a report regarding the operation of the Commission and preliminary data collected about indigent defense in the state.
