1 MINUTES OF THE REGULAR MEETING OF COUNCIL HELD ON THE TWELFTH DAY OF APRIL, 2016 AT 4:00PM IN COUNCIL CHAMBERS, 420 LESLIE AVENUE, THUNDER BAY, ONTARIO THOSE PRESENT: WITH REGRETS: ALSO PRESENT: Acting Mayor Ron Giardetti Councillor Councillor Councillor Mayor Wendy Landry Nadene Hunley-Johansen, Clerk Paul Greenwood, CAO Blair Arthur, Fire Chief Craig Baumann, Manager of Operations 1) CALL TO ORDER Resolution No. 741/16 That this Regular Meeting of Council is hereby called to order at 4:04 p.m. Moment of Silence 2) DISCLOSURE OF PECUNIARY INTEREST 3) APPROVAL OF AGENDA Resolution No. 742/16 THAT the agenda be accepted as presented. 4) MINUTES OF PREVIOUS MEETING a) Minutes of the previous Meeting of Council held March 29, 2016 { Resolution No. 743/16 THAT Minutes of the previous Meeting of Council held March 29, 2016 be adopted as circulated and that same be filed in the Clerk's Office. b) Matters Arising from Previous Minutes Item 8 ii) was moved next in the Agenda

2 Application to Amend Zoning by-law site specific to allow commercial metal manufacturing shop, greenhouse and sawmill at 610 Rd #5 South. The clerk explained that her initial recommendation and zoning application would change because after more detailed review a split zone was warranted as well as a potential compatibility study. She would circulate to agencies and discuss with MOE regarding the D-6 guidelines and whether a study and mitigation might be required for the saw mill and machine shop. Resolution No. 744/16 THAT Council hereby receives the report and application for a site specific to allow commercial metal manufacturing shop, greenhouse and sawmill at 610 Rd #5 South; AND FURTHER directs the Clerk to set a Public Meeting as prescribed by the Planning Act. 5) PETITIONS AND DELEGATIONS -PRESENTATION a) Karen Zan and Domenica D'Amico MMM Group Limited and Rick Inman and Eric Osvath, MTO re: Highway 11/17 Four Laning McTavish Lane- Shuniah to Dorion Representatives from MMM Group and Ministry of Transportation reviewed the proposed plan for the twinning of Hwy 11/17 between McTavish Lane in Shuniah into Dorion at Poplar Lane. They indicated that there were several proposed changes to the preliminary 1997 design and they went over the evaluation criteria outlining their reasoning. Meyer's Road is being changed from a cross over to a right in right out. Council expressed their concerns regarding the Superior Shores RV park whose access is via Meyers Road. The initial design was a cross over and the future 400 lot RV park warrants consideration to maintain that initial design. MTO indicated that there could be a request for a "bump out" which could be done in the future if the traffic warranted it but they are designing for current circumstance which is 60 lots. The Municipality could challenge the design and a notice of the dates for the challenge period is forthcoming. 6) CLOSED SESSION a) To discuss possible acquisition of land Resolution No. 745/16 THAT, in accordance with Section 239(2) of the Municipal Act, we adjourn at the hour of 5:17p.m. to meet in closed session to discuss a) To discuss possible acquisition of land. 3 7) REPORTS & MINUTES FROM OTHER BOARDS & COMMITTEES 8) MOTIONS AND NOTICE OF MOTIONS a) By-law Enforcement b) Building and Planning i) Notice of minor change to zoning application-splett Z 2/16 Superior Shores Applicant is requesting additional amendment to the maximum lot coverage for accessory buildings from 140m 2 to 234m 2 to allow for a 54 X 40 garage. Resolution No. 747/16 THAT Council hereby receives notification of the amendment to the zoning application Z 2/16 made by Daryl Splett requesting an additional amendment to the maximum lot coverage for accessory buildings from 140m 2 to 234m 2 to allow for a 54 X 40 garage on Lot 41 Plan 55M563 and authorized the Clerk to proceed with setting the Public Meeting. ii) Report (brought back from July 13, 2015 meeting ) re: A TV's in Shuniah Resolution No. 7 48/16 THAT Council hereby receives a copy of the Clerk's Report previously submitted July 13,2015 regarding the regulating of A TV's in Shuniah; AND FURTHER THAT the Clerk is directed to invite Tom Marinis, Regional Planner with MTO to attend a Council Meeting to review the legislation and practicality of permitted A TV's in Shuniah. c) Public Works d) Fire Department e) Administration f) Finance Department 9) REPORTS OF MAYOR AND MEMBERS OF COUNCIL Later in the meeting. 1 0) GENERAL CORRESPONDENCE Resolution No. 749/16 THAT the following items of General Correspondence be received as circulated and same be filed in the Clerk's Office: a) Notice of Public Information Centre re: Highway 11/17 Four Laning McTavish Lane- Shuniah to Dorion b) Notice of Open Houses- Nextbridge East-West Tie Transmission Project c) Copy of Letter to Michael Gravelle from Bob Chiarelli Minister of Energy re: response to Natural gas expansion 1630 April12 COU Page 3 of6

4 11) BY-LAWS a) A by-law to set tax ratios for the Municipality for the 2016 taxation year Resolution No. 750/16 THAT A by-law to set tax ratios for the Municipality for the 2016 taxation year, is deemed to have been read a First and Second time this 1ih Day of April, Due to the nature of the by-law Councillor Smith requested a request a 3rd and final reading Resolution No. 751/16 BE IT RESOLVED THAT A by-law to set tax ratios for the Municipality for the 2016 taxation year, is deemed to have been read a Third and Final time this 12th Day of April 2016, and numbered ; AND THAT the said by-law be engrossed in the By-law Book. b) A by-law to set rates of taxation and to impose a tax levy for municipal and education purposes for 2016 Resolution No. 752/16 THAT A by-law to set rates of taxation and to impose a tax levy fo r municipal and education purposes for 2016, is deemed to have been read a First and Second time this 12th Day of April, Due to the nature of the by-law Councillor Blunt requested a request a 3 rd and final read1ng Seconded B Resolution No. 753/16 THAT A by-law to set rates of taxation and to impose a tax levy for municipal and education purposes for 2016 is deemed to have been read a Third and Final time this 12th Day of April 2016, and numbered ; AND THAT the said by-law be engrossed in the By-law Book April12 COU Page 4 of6

5 12) UNFINISHED BUSINESS a) List of Unfinished business dated April 5, 2016 Resolution No. 754/16 THAT Council hereby receives a copy of the list of Unfinished Business dated April 5, 2016, and that same be filed in the Clerk's Office Council discussed the remote designation of McKenzie School and directed staff to pursue this and to put forth a request to Ministry of Education and to look into an AMO delegation this August. Reports of Mayor and Council: Councillor Blunt indicated that she and the Mayor attended the Thunder Bay District Municipal League meeting and attended presentations by Chad Tanner from Municipal Property Assessment Corporation. Also a session with Shannon Bolton who indicated that she helps municipalities apply for funding and she indicated there were a lot of opportunities. Council requested that the ongoing issue with District Social Services Administration Board be added to the List of unfinished business. 13) NEW BUSINESS a) Resolution to support Northeastern Manitoulin and the Islands regarding Long Term Care Funding Resolution No. 755/16 THAT Council supports the resolution as passed by the Town of Northeastern Manitoulin and the Islands on February 15, 2016 which supports a request to the Province to increase funding to Long Term Care Facilities. AND FURTHER THAT copies of this resolution be sent to the Minister of Health, MPP Bill Mauro and to the Town of Northeastern Manitoulin and the Islands. 14) CONFIRMATORY BY-LAW Seconded B Resolution No. 756/16 THAT a by-law to confirm the proceedings of Council be read a First, Second, and Third time on this 1ih day of April 2016 and Numbered ; AND THAT the said by-law be engrossed in the By-law Book April12 COU Page 5 of6
