1 Police Jury Room October 21, 2002 Abbeville, Louisiana Minutes of a regular meeting of the Vermilion Parish Police Jury held on October 21, 2002, with Mr. Edval Simon, Jr. presiding. Broussard, and unanimously carried, the reading of the minutes of the October 7, 2002 regular meeting, and the special meetings of October 9, 15, & 16, 2002 were dispensed with and were accepted. President Edval Simon, Jr. read the following announcements: (1) The Vermilion Association for Family and Community Education, Inc. cordially invites the Jurors to their 62 nd Annual Achievement Day, to be held on Wednesday, October 23, 2002, from 10:00 a.m. to 2:30 p.m. at the American Legion Home, located on North Irving Ave. in Kaplan. (2) The Acadiana Regional Development District s Third Quarter 2002 Board of Directors Meeting will be held at 10:00 a.m., on Tuesday, October 22, 2002 at the LEDA facility located in Lafayette. (3) A Governmental Seminar about the recent issues in governmental accounting sponsored by Postlethwaite & Netterville, will be held on Wednesday, October 30, 2002, in Baton Rouge. (4) Received a notice from Cox Communications that effective October 16, 2002, Basic Service will increase $3.04 to $18.89; Expanded service will remain intact at $19.15; and High Speed Internet Services will increase $5.00 to $29.95 for Interact; and $39.95 for Cox High Speed Internet.

2 (5) The annual Southern Gas Association - Annual Offshore Damage Prevention/Public Awareness Luncheon will be held on Tuesday, November 5, 11:00 a.m. 1:30 p.m. at Vermilionville in Lafayette. (6) The Vermilion Parish Library will hold its 8 th Annual Scare on the Square on Halloween Night, Thursday, October 31, Mr. Eugene Sellers, with Sellers & Associates, Inc. presented a report on loads of debris that have been hauled to the parish landfill since Friday, October 4, Regarding the contract for the debris removal, Mrs. Liz Girouard advised that faxed copies of the insurance and bond paperwork has been received and that the originals will be arriving tonight (11:00 p.m.) by courier. Once these items are received then the contract documents are to be signed and finalized. Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. Kenneth DeHart, and unanimously carried, the Public Road Committee Recommendations were approved as presented, and the appropriate officials of the Jury were authorized to carry out the recommendations. PUBLIC ROAD COMMITTEE OCTOBER 16, 2002 ABBEVILLE, LOUISIANA AS A RESULT OF A PUBLIC ROAD COMMITTEE MEETING HELD ON OCTOBER 16, 2002, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY S CONSIDERATION: 1. It is recommended that effective October 21, the operating hours of the road crews will return to the normal work schedule and that any overtime incurred will be voluntary. It is further recommended that any debris cleanup done by the Road Crews be limited to non-vegetative debris (i.e. metal, roofing, demolition debris). 2. It is recommended that a Gradeall grappling attachment be approved to be purchased for the Area 3 Gradeall. Cost to be paid from Road District No. 1 funds. 3. It is recommended that a pauper funeral allocation be provided on behalf of Raoul Demette and made payable to David Funeral Home. 4. It is recommended that the Police Jury enter into an intergovernmental agreement with the Coulee Des Jons Drainage District to clean a drainage ditch through the Vermilion Parish School Board land in the Kaplan area.

It is recommended that the Police Jury accept the resignation of Mr. Chris Theriot from the Hospital Service District No. 3 Board effective as of October 1, It is further recommended that a letter of commendation be sent to him in appreciation for his service. It is further recommended that Mr. Sean Gayle be appointed to fill the remaining term of Mr. Theriot until 12/4/ It is recommended that the following persons be authorized to attend the annual Louisiana Pesticide Applicators Association Conference on November 6, 7 & 8, 2002 to obtain or renew their herbicide applicators license: New - Terry Bourque Renewal- Eugene Mouton, Jeffery Bourgeois, Walter Toups, Jr, Ellis Rung, Jr., Wayne Touchet, Terrell Broussard, Lawless Broussard 7. It is recommended that the following reappointments be approved: A) Vermilion Parish Tourist Commission Arlene White - Effective 10/21/02 B) Waterworks District No. 1 Hubert Faulk Effective 10/20/02 8. It is recommended that the Building Permit process be amended to require a two-step electrical service procedure to require furnishing of a final elevation certificate prior to final power being provided. 9. It is recommended that the request of James W. Delcambre for a variance to the base flood elevation requirement for his home be denied. 10. It is recommended that the invoices shown on the attached sheets be approved to be paid. R.S. 33:1321 et seq.

5 GENERAL STATEMENT OF CONTRACTUAL AUTHORITY WHEREAS, the provisions of La. R.S. 33:1321 et seq, dealing with intergovernmental functions, authorize the police jury of a parish, and any city, town or village, and any special district or political subdivision of the state to agree between and among themselves to engage jointly in the exercise of any power, and in the construction, acquisition or improvement of any public project or improvement, or the promotion and maintenance of any undertaking when either one of the participants in the agreement is authorized under provision of general or specific law to perform such activity or exercise such power as may be necessary for completion of the undertaking (La. R.S. 33:1324); and PROJECT WHEREAS, there is a need to clean out a drainage ditch that runs through the Vermilion Parish School Board land in the Kaplan area. AGREEMENT NOW, THEREFORE, the Vermilion Parish Police Jury does; RESOLVE THAT, they will provide equipment and labor to do the said project. NOW, THEREFORE, the Coulee Des Jons Drainage District does RESOLVE THAT, they will provide a similar value of service at a later date. RESOLVED FURTHER, by both parties that a certified copy of this resolution shall immediately be filed and recorded in the records of the Clerk of Court for the Parish of Vermilion, Louisiana; and upon adoption of this

6 resolution by both parties and recordation of same, it shall constitute the agreement between the Police Jury and the Coulee Des Jons Drainage District and a copy of this resolution shall be published in the official journal of the above said parties concerned. * * * * * * * * * * Upon motion of Mr. T. J. Prejean, Jr., duly seconded by Mr. Minos Broussard, and unanimously carried, the Public Works Committee Recommendations were approved as presented, and the appropriate officials of the Jury were authorized to carry out the recommendations; PUBLIC WORKS COMMITTEE OCTOBER 16, 2002 ABBEVILLE, LOUISIANA AS A RESULT OF A PUBLIC WORKS COMMITTEE MEETING HELD ON OCTOBER 16, 2002, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY S CONSIDERATION: 1. It is recommended that Invoice dated 10/4/02 from Rodney P. Primeaux, Contractor in the amount of $6, be approved to be paid. Invoice represents miscellaneous repairs done at the 7 th Ward Fire station. Costs to be paid from the 76 Sales Tax Capital Outlay allocation. 2. It is recommended that the invoices shown on the attached sheets be approved to be paid. 3. It is recommended that the Police Jury work crews continue tree debris pickup through Saturday, October 19, 2002, until the contractor for the debris pickup starts his operation. It is further recommended that the mandatory 7:00 to 5:30 work schedule also continue until Saturday, October 19, After that date normal work schedules will resume and any overtime will be voluntary. It is further recommended that after 10/19/02, the solid waste and road crews will concentrate their pickup to all other debris (metal, roofing, etc.) on parish and city roads. 11 Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Ernal "E. J." Broussard, and unanimously carried, the Finance Committee Recommendations were amended to authorize that quotes be obtained for the purchase of a new copy machine for the Vermilion Council on Aging Office. It is further recommended that the budget 2002 allocation for the Council On Aging be amended to reflect the additional cost for this equipment. (Not to exceed $7,000.00) Budget Amendment GENERAL FUND: Expenditures: Council On Aging: Sundry (Miscellaneous): To increase the 2002 budget figures in the amount of $5, relative to the purchase of a new copy machine for the Council On Aging. Upon motion of Mr. Hubert Faulk, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury authorized payment of the deductible in the amount of $ to Deep South Surplus relative to the damage claim filed by Judy Sarpy. Cost to be paid from the 94 Sales Tax Fund.

16 Upon motion of Mr. Purvis Abshire, duly seconded by Mr. Terry Bessard, and unanimously carried, the Police Jury authorized payment of Invoice No in the amount of $2, to Onebane Law Firm relative to the D. Suire lawsuit. Cost to be paid from the Health Unit Fund. Upon motion of Mr. Minos Broussard, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury authorized payment of Invoice from Barry Toups in the amount of $ for labor to prepare electrical light cords for shelters to be used after Hurricane Lili. Upon motion of Mr. Ernal "E. J." Broussard, duly seconded by Mr. Pervis "Pee Wee" Meaux, and unanimously carried, the Police Jury authorized payment of Application No. 6 in the amount of $329, to Rudick Company, Inc. for construction of the Vermilion Parish Library in Abbeville. Cost to be paid from the Library Construction Fund. Upon motion of Mr. Ritter Trahan, duly seconded by Mr. Louis Joe Hardy, and unanimously carried, the Police Jury authorized payment of Invoice No in the amount of $5, to The Sellers Group for architectural services provided relative to the New Abbeville Library. Cost to be paid from the Library Construction Fund. Upon motion of Mr. Hubert Faulk, duly seconded by Mr. Carroll Duhon, and unanimously carried, the Police Jury authorized payment of Partial Payment Estimate No. 4 in the amount of $51, to M. P. Dumesnil Construction Co., Inc. relative to the F.Y LCDBG Water System Improvements North Vermilion Area VI Water Distribution System Project. Upon motion of Mr. Pervis "Pee Wee" Meaux, duly seconded by Mr. Ernal "E. J." Broussard, and unanimously carried, the Police Jury authorized payment of Invoice No. 867 in the amount of $6, to Minvielle and Associates for project administration relative to the F.Y. 01 LCDBG North Vermilion Area VI Water System Improvements Project. Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. Kenneth DeHart, and unanimously carried, the Police Jury approved the Revised Section 5311 Monthly Activity Report for the month of August, 2002 as submitted by the Vermilion Council On Aging and directing the Secretary to submit the report to the Department of Transportation and Development for reimbursement in accordance with the contract agreement. The Secretary advised the Police Jurors of an invitation from the Louisiana Cattle Festival and Fair Association, Inc. to ride on a float in the Annual Parade on Saturday, October 26, 2002, in recognition of the vast amount of help received from the Vermilion Parish Police Jury relative to the Hurricane Lili damage.

17 Upon motion of Mr. Ritter Trahan, duly seconded by Mr. Ernal "E. J." Broussard, and unanimously carried, the Police Jury adopted the following resolution authorizing the President and the Secretary-Treasurer to obtain interim financing to pay the cost of debris removal and other costs associated with Hurricane Lili disaster recovery: RESOLUTION 2002-R-14 A Resolution Authorizing the President and Secretary-Treasurer to Obtain Interim Financing for Excessive Debris Caused by Hurricane Lili WHEREAS, the Vermilion Parish Police Jury has received extensive damage due to Hurricane Lili, and WHEREAS, the debris developed from Hurricane Lili was in excess of normal debris produced in the Parish, and WHEREAS, the Vermilion Parish Police Jury will incur a significant cost in the clearing of this debris, and WHEREAS, the Vermilion Parish Police Jury does not have financing for the up front cost of this project, and WHEREAS, it will be necessary for the Vermilion Parish Police Jury to obtain interim short-term financing to proceed with this project. THEREFORE BE IT RESOLVED, that the President, Edval Simon, Jr., and the Secretary-Treasurer, Michael J. Bertrand, be authorized to take the necessary steps to obtain interim financing not to exceed $1,500,000 and, if necessary, to obtain authorization from the bond and tax commission of the State of Louisiana. ***************************************************************************

Prejean, Jr., duly seconded by Mr. Minos Broussard, and unanimously carried, the Police Jury approved the following state highway driveway installation permits: A) Glenn Romero La. Hwy 335 B) Jeffery Johnson La. Hwy 696 Upon motion of Mr. T. J. Prejean, Jr., duly seconded by Mr. Purvis Abshire, and unanimously carried, the Police Jury authorized the purchase of a pump to draft water from the oxidation pond for fire protection purposes. Upon motion of Mr. Minos Broussard, duly seconded by Mr. Kenneth DeHart, and unanimously carried, the Police Jury authorized Sellers and Associates to prepare the necessary applications to reapply for Capital Outlay Funding for for the following projects: A) Cooperative Extension Barn Addition B) Branch of Oaks Canal Drainage Project C) Erath and surrounding area Drainage Project Phase 2 Funding Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury allowed Ms. Liz Duhon and Mr. Melvin Clark with Entergy to answer questions regarding their maintenance operation and the Hurricane Lili repairs.

19 They provided a damage survey and pictures of areas damaged during the storm in which old and new (wooden and concrete) poles were affected. They gave a report on how repairs and restoring power were done. Nearly 39,000 customers were out of power. 5,000 people from outside the state were helping to restore power. 75% of customers back on line in a short time. Entergy is self-insured no insurance available. Copies of their maintenance procedures were provided to the Jury. Police Juror Luther "Buster" Hardee commented that during spring storms numerous poles over the last several years have broken one at a time. Appears that entire line should be changed over at one time. He was advised that his area was served by the Jennings District Office and that they will request the review of the system in his area. The Police Jury recognized that the Entergy Customer Services Center was set up in the Courthouse right after Hurricane Lili had passed. Upon motion of Mr. Kenneth DeHart, duly seconded by Mr. Luther "Buster" Hardee, and unanimously carried, the Police Jury approved the addition of Mr. Dudley Broussard to the list of employees to attend the Annual Weed Control Conference. Upon motion of Mr. Ernal "E. J." Broussard, duly seconded by Mr. Minos Broussard, and unanimously carried, the Police Jury authorized a pauper funeral allocation to be paid to Kinchen Funeral Home in Lafayette for Je Mari Fauntleroy. Police Juror Louis Joe Hardy inquired about the start up of the debris removal contract. A resident of the Pine Street Subdivision voiced his concern about the ongoing. Speeding in the area of Texas Street and Pine Street. Request Sheriff to patrol that area again. Upon motion of Mr. T. J. Prejean, Jr., duly seconded by Mr. Ernal "E. J."
