1 Police Jury Room January 03, 2017 Abbeville, Louisiana Minutes of a regular meeting of the Vermilion Parish Police Jury held on January 03, 2017, with President Ronald Darby presiding. The meeting was called to order by President, Ronald Darby who asked Mr. Elbert Dawson to lead the group in the Pledge of Allegiance. Following the pledge, Mr. Paul Moresi, III, took a moment to give prayer and reflection, President Ronald Darby asked for all phones, pagers, etc. off or set to silent mode for the duration of the Police Jury meeting. No comments were presented or discussed at this time. President Darby recognized those persons who had requested time on the agenda to present their business at this time: Presentation to Juror Nathan Granger. Mr. Granger is not present. Discuss overflow at the Vermilion Parish Law Enforcement Center. Ms. Linda Duhon, Parish Administrator stated Ms. Roberta Boudreaux, Vermilion Parish Liaison is not in attendance tonight, the overflow count is at thirty six ( 36), jail count is one hundred forty six ( 146) and DOC prisoners is twenty two (22). 1

2 President Darby considered action to amend the agenda to allow Ms. Selina Montet Bennett to speak relative to the Community of Henry' s Fire Department. Upon motion by Mr. Mark Poche', duly seconded by Mr. Kevin Sagrera, and unanimously carried, the Police Jury approved to amend to allow Ms. Selina Montet Bennett speak about the Henry' s Fire Department. Ms. Selina Montet Bennett stated I reside in Henry, Louisiana, Mr. Kevin Sagrera is my Juror. I am assuming they asked me to speak because something came up this week we the residents of Henry did not know something about in concern to our Fire Department. I understand there was some sort of discussion in past meetings and all I want to say is the residents in Henry deserve to keep our Fire Department. We pay taxes and deserve the protection. Mr. Errol Domingues stated I have received attacks on social media relative to the Henry Fire Department, when this all came up I had missed three meetings because of a family emergency and trouble in the Sugar Cane harvest. I was not here when this discussion had come up. Mr. Domingues asked Chief Ronald Broussard about a phone call he received from myself, the night before the parish meeting. Chief Ronald Broussard stated Mr. Domingues called myself and he was not aware of what was going with the Henry Fire Department and the talk on social media. I told Mr. Domingues in my position we were not going to close any Fire Departments. Mr. Domingues' concern to me was please do not close any Fire Departments. Mr. Domingues stated going back five ( 5) years ago, Mr. Gerald Butaud and I, the Fire Department South of Gueydan, Little Chapel had enrollment trouble and they came to the Jury to combine it with Gueydan Fire Department because they didn' t have adequate personnel to fight a fire. Mr. Butaud and I went to a Fire Department Meeting in Henry and told them what was taking place in Little Chapel, we needed recruiting before that happened in Henry and we worked with them to get the enrollment up, I fought for the department. Anytime they needed something for the fire trucks I came to this table and asked for it and no other Juror has done this, they all go through the Vermilion Fire Protection Association, I went above and beyond. With the new station it was going to be District 14, the plaque is in the office, I came to the Jury and said that is Henry Volunteer Fire Department' s you are taking our identity. We spent another 1, to do that plaque, so no one can say I never support the Community of Henry. Mr. Domingues stated Ms. Bennett said on social media it was a disgrace for the people who elected me because I did not support, and was not there for the Fire Department. I was not at the meetings this topic was discussed and as soon as I did find out about it I called the President of Association and stated to him this could not happen until I could attend a meeting. 2

3 Ms. Montet stated what you need to do Mr. Domingues, as a Public Servant is come into our community, speak to our neighbors and let us know what is going on, none of the residents of Henry knew this was even going to be an issue. Mr. Mark Poche' stated I want to thank Ms. Montet for even taking an interest, as a citizen of any community if there is something in government and have you have questions it is your duty and responsibility to ask why. To go back on history, with myself being the Juror whom has been here the longest and has been through the actual closing or consolidation of a fire station. What we do is assess the issues at the fire station with responses, no shows, etc. What is happening in Henry we are receiving complaints the Henry Volunteer Fire Department is not showing up to a fire. In 2016 we had forty three ( 43) first responder calls in Henry, of that number seven ( 7) of them no one from Henry showed up. These are statics that we receive from 911 Communications District Office. So anytime things like this happens we look into the issue and investigate, in this case a meeting was called, Mr. Paul Bourgeois attended the meeting to represent the Police Jury. They met in Kaplan and came up with solutions and everything ended well. It is very important for everyone to understand this Jury and know that no one person of this Jury has ever said we need to close Henry Fire Department. Mr. Poche' stated anytime there is an issue like the Henry Volunteer Fire Department where they are struggling for volunteers, I would encourage and challenge you, Ms. Bennett to go back into the community and find people to get involved in the Fire Department. There are only ten ( 10) members and only five ( 5) are certified there now and this is a concern because it is hard to find firemen these days. Thank you for being concerned. One thing I can tell you about Mr. Errol Domingues, he is the only Juror that will consistently break protocol and come to this table to fight for money for Henry Fire Department without going through Vermilion Fire Protection Association. We have an agreement every member of the Jury has to go through the Vermilion Fire Protection Association and I will tell you I get mad at Mr. Domingues all of the time because he is the only Juror who does not follow the protocol. Ms. Montet stated the Jury needs to also understand about the people of Henry, we are small and don' t have a lot of people left because the hurricanes. We lost our school because of politics, we almost lost our church. We have to fight for every single thing because there is always a bigger group trying to take something away from the Community of Henry. We believe at least some protection is better than no protection. Mr. Paul Bourgeois stated when we met at the Vermilion Fire Association meeting in Kaplan, most of the citizens there were volunteers. The great thing about the meeting was all of the fire fighters showed their support for each other and when there may be a slack in one area the other departments pitch in without hesitation. President Darby read the following announcement: 43rd Annual Vermilion Parish Jr. Livestock Sale of 4- H Market Animals on Saturday, January 28, 2017 at the Cecil McCrory Exhibit Building. 3

4 Mr. Dane Hebert stated we as Jurors contribute every year to the Annual Vermilion Parish Jr. Livestock Sale of 4-H Market Animals and after the meeting I will be picking up a donations for anyone who would be interested. President Ronald Darby stated that the first order of business this evening is the election of a President and Vice President for the Police Jury and opened the floor for nominations. Upon motion by Mr. Kevin Sagrera, duly seconded by Mr. Paul Bourgeois, unanimously carried nominations for President of the Police Jury were opened. Upon motion by Mr. Wayne Touchet, duly seconded by Mr., unanimously carried, Mr. Ronald Darby was nominated for the position of President of the Police Jury. Upon motion by Mr. Paul Bourgeois, duly seconded by Mr. Kevin Sagrera, and unanimously carried, nominations for the position of President of the Police Jury were closed, and Mr. Ronald Darby was elected by acclamation. President Ronald Darby stated that the next order of business is electing a Vice President for the Police Jury and opened the floor for nominations. Upon motion by Mr. duly seconded by Mr. Sandrus Stelly, unanimously carried nominations for Vice- President of the Police Jury were opened. Upon motion by Mr. Errol Domingues duly seconded by Mr. Cloris Boudreaux, unanimously carried, Mr. Pervis Gaspard was nominated for the position of Vice President of the Police Jury. Upon motion by Mr. Paul Bourgeois, duly seconded by Mr. Jason Picard, and unanimously carried, nominations for the position of Vice President of the Police Jury were closed, and Mr. Pervis Gaspard, was elected by acclamation. President Darby stated he would like to leave all the appointments as they are. Upon motion by Mr. Dane Hebert, duly seconded by Mr. Jason Picard, and unanimously carried, the Police Jury approved the President Appointments for the 2017 Standing Committees as presented. President Darby considered action to amend the agenda to discuss and consider actions on any new items presented by Engineering & Architectural reports. Upon motion by Mr. Kevin Sagrera, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury approved to amend the agenda to discuss and consider action on any new items presented by the Engineering & Architectural reports. President Darby recognized the report of Standing Committees, Courthouse/ Building Committee. Mr. Paul Bourgeois duly seconded by Mr. Sandrus Stelly, and unanimously carried, the Police Jury approved the Courthouse/ Building Committee Recommendations, as presented, and the appropriate officials were authorized to carry out the recommendations. 7 AS A RESULT OF A COURTHOUSE/ BUILDING COMMITTEE MEETING HELD ON DECEMBER 28, 2016, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended that the Police Jury adopt a resolution endorsing Mr. Ronald Darby as Executive Board of the Police Jury Association of Louisiana. a candidate for the Executive Member At Large position on the 2. PUBLIC WORKS COMMITTEE DECEMBER 28, 2016 ABBEVILLE, LOUISIANA AS A RESULT OF A PUBLIC WORKS COMMITTEE MEETING HELD ON DECEMBER 28, 2016, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended that the Police Jury approve to the enter into an Intergovernmental Agreement with the City of Kaplan and the Vermilion Parish Police Jury, relative reimburse mileage expense to the City of Kaplan when said vehicle is used by Mr. Jacob Mathiew in his capacity as Vermilion Parish Fire Coordinator. 2. 9 AS A RESULT OF A FINANCE COMMITTEE MEETING HELD ON DECEMBER 28, 2016, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended that the Police Jury approve a hiring freeze in all departments with the exception of the 94' Sales Tax. 2. It is recommended that the Police Jury authorize Sellers & Associates, Inc. to create a formula based on road miles in the unincorporated and city together and a formula in just the unincorporated areas, to determine the number of employees required at each Area Barn including two part time employees at each barn. 3. It is recommended that the Police Jury approve the proposal from Site Engineering, in the amount of$ 2, , to update the Geotechnical Engineering Report done that includes an additional 35' deep soil boring with recommendations of how to remove the slab and building as well as backfill the site and also make recommendations for the depth and type of foundation system, especially in light of the fact that we will be building the site up to elevation 12', relative to the " New Multi-Purpose Building at the Vermilion Parish County Agent Complex" 4. It is recommended that the Police Jury approve payment of Invoice No , to Primeaux, Touchet & Associates, and L.L.C., in the amount of$ 4, , relative to 2015 Vermilion Parish Bridge Improvements Project, Phase VI Bella & Pickett Road Bridges, additional services rendered to evaluate Bella & Pickett Road Bridges on La DOTD' s Engineering Directives & Standards for the establishment of regulatory weight limits on public bridges. 5. It is recommended that the Police Jury ratify to transfer Mr. Joe Reed back to a CDL day driver at a Grade 10, Step It is recommended that the Police Jury approve payment of Invoice No. VP , to Rivers Security, LLC, in the amount of$ 3, , relative to armed security guard service for the Courthouse from 12/ 02 12/ 15/ 16. Cost to be paid from General Fund. 7. It is recommended that the Police Jury ratify payment of an Invoice dated 12/ 05/ 2016 to LaSalle Correctional Center, in the amount of$ 10, , relative to the housing of inmates for the Month of November. Cost to be paid from General Fund. It is further recommended that the Police Jury authorize Mr. Paul Moresi III, legal Counsel to send letters with the attached checks stating that the Police Jury is not binding itself to any rate by making the payment for the housing of Vermilion Parish inmates. 8. It is recommended that the Police Jury ratify payment of an Invoice dated 12/ 05/ 2016 to Richland Parish Detention Center, in the amount of $1, , relative to the housing of inmates for the Month of November. Cost to be paid from General Fund. It is further recommended that the Police Jury authorize Mr. Paul Moresi III, legal Counsel to send letters with the attached checks stating that the Police Jury is not binding itself to any rate by making the payment for the housing of Vermilion Parish inmates. 9

10 9. It is recommended that the Police Jury approve to enter into a Cooperative Endeavor Agreement with Mr. Keith A. Stutes, 15`" Judicial District Attorney for the Budget Year 2017, whereby the District Attorney shall pay to the Vermilion Parish Police Jury for administrative services in the sum of$ 25, per year payable monthly, in addition to any sums actually received by State Grant for the fiscal year commencing January 1, 2017 and ending December 31, It is recommended that the Police Jury approve payment of the attached bills that were submitted. 11. It is recommended that the Police Jury reject all bids for the " Hoffpauir Road Bridge over Indian Bayou for the Vermilion Parish Police Jury and Lafayette City-Parish Consolidated Government" Project based on the bids where over budget. It is further recommended that the Police Jury authorize Sellers& Associates, Inc. to re-advertise for the " Hoffpauir Road Bridge over Indian Bayou for the Vermilion Parish Police Jury and Lafayette City-Parish Consolidated Government" Project. Respectfully Submitted Mr. Wayne Touchet Chairman President Darby recognized at this new business: Consider action to appoint replacement of Mr. Nathan Granger District 3 Contingent upon receipt by Secretary of State). Seat Mr. Paul Moresi, III, Legal Counsel stated I transmitted Mr. Nathan Granger' s resignation to the Secretary of State by fax and certified mail and they have not received the original as of four o' clock this afternoon. Until they receive the original there is no vacancy for the Jury to fill. So I suggest at this time the Jury tables Item A to appoint a replacement of Mr. Nathan Granger District 3 Seat ( Contingent upon receipt by Secretary of State) and hopefully in a couple weeks from now the Jury will be in a position to do this. Upon motion by Mr. Kevin Sagrera and duly seconded by Mr. Leon Broussard and unanimously carried, the Police Jury tabled Item A to appoint a replacement of Mr. Nathan Granger District 3 Seat ( Contingent upon receipt by Secretary of State). President Darby considered action to adopt the compliance questionnaire presented by Kolder, Champagne, Slaven and Company, LLC, related to the audit of the financial statements as of January 1, 2016 through December 31, 2016 and authorize the President to sign the compliance questionnaire. Upon motion by Mr. Wayne Touchet and duly seconded by Mr. Jason Picard and unanimously carried, the Police Jury adopted the compliance questionnaire presented by Kolder, Champagne, Slaven and Company, LLC, related to the audit of the financial statements as of January 1, 2016 through December 31, 2016 and authorize the President to sign the compliance questionnaire. 10

11 President Darby considered action to amend the agenda to discuss and consider actions on any new items presented by the Parish Administrator. Upon motion by Mr. Kevin Sagrera, and duly seconded by Mr. Leon Broussard, and unanimously carried, the Police Jury amend the agenda to discuss and consider actions on any new items presented by the Assistant Parish Administrator. President Ronald Darby recognized Ms. Linda Duhon, Parish Administrator to present her business to the Jury. Ms. Duhon stated Ms. Vicky Toups at the Health Unit asked me to ask Mr. Errol Domingues to share about Mr. Quentin Comeaux situation. Mr. Errol Domingues stated they were able to get this rectified with the Drainage Board. Upon motion by Mr. Paul Bourgeois, duly seconded by Mr., and unanimously carried, the Police Jury reappointed Ms. Betty Girouard for one year term to the Vermilion Parish Tourist Commission, term to expire 01/ 18/ Upon motion by Mr. Leon Broussard, duly seconded by Mr. Cloris Boudreaux, and unanimously carried, the Police Jury reappointed Ms. Judy LeBlanc to the Vermilion Parish Tourist Commission, term to expire 01/ 18/ Upon motion by Mr. Paul Bourgeois, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury approved to hire Mr. Michael C. Williams as a Commercial Truck Operator CDL night driver, at a Grade 10, Step 0. Upon motion by Mr., duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury approved payment of the attached bills that were submitted. President Darby recognized Mr. Paul Moresi, III, Legal Counsel, to present his business to the Police Jury at this time. Mr. Moresi stated about the terms of the legal requirements of the Police Jury Meetings, you must have this first meeting in January to elect your officers and there after you shall fix the date and times of your other meetings. There are no minimum number of meetings, and you can have regular or special meetings. The only practical thing is to have Committee Meetings on Wednesday so you have Thursday and Friday before your Monday Police Jury Meetings if something comes up and needs to be addressed you have time to do so between Meetings. President Darby recognized Police Jury President Business to be presented. 11

12 President Darby stated I want to thank everyone for trusting me to serve again as President and will do my best to represent the Police Jury as best as possible. President Darby stated I would like to make a motion to authorize Mr. Gary Guidry, Road Superintendent to have the FRS Crew blacktop the Vision of Hope School Parking Lot, cost to be paid from my Road District No. 4. Upon motion by Mr. Ronald Darby, duly seconded by Mr., and unanimously carried, the Police Jury authorized Mr. Gary Guidry, Road Superintendent to have the FRS Blacktop Crew to resurface Vision of Hope School Parking Lot, cost to be paid from my District No. 4. President Darby recognized Police Juror Business to be presented. Mr. Jason Picard stated Indian Bayou Fire Department is having their annual fundraiser and they are requesting two ( 2) dumpsters to be delivered on February 3, Ms. Linda Duhon, Parish Administrator stated they would just need to come by the Police Jury Office to fill out necessary paperwork. Upon motion by Mr. Dane Hebert, duly seconded by Mr. Jason Picard, and unanimously carried, the Police Jury approved Indian Bayou Fire Department request for two ( 2) Commercial Trash Dumpsters for their " Annual Fundraiser", which will be held on Sunday, February 03, 2017, at Indian Bayou Fire Department Building, in Election District No. 2. Mr. Pervis Gaspard stated I would like to thank the Jurors again for re-appointing me to Vice President and I will do my best.
