1 Police Jury Room March Abbeville, Louisiana Minutes of a regular meeting of the Vermilion Parish Police Jury held on March 5, 2012, with President Nathan Granger presiding. The meeting was called to order by Mr. Granger, who asked Mr. Leon Broussard to lead the group in the Pledge of Allegiance. Following the pledge, the President asked for a moment of silent prayer or reflection. The President then reminded all present to turn all cell phones, pagers, etc. off or set to silent mode for the duration of the Police Jury meeting. The following members were present: Mr. Wayne Touchet Mr. Leon Broussard Mr. Dane Hebert Mr. Paul Bourgeois Mr. Errol J. Domingues Mr. Allen LeMaire Mr. Ronald Darby Mr. Cloris J. Boudreaux Mr. Ronald Menard Mr. Pervis Gaspard Mr. Kevin Sagrera Mr. Sandrus Stelly Mr. Nathan Granger Mr. Mark Poche' Absent: None President Granger stayed that the first item of business on the agenda tonight is Mr. Garret Graves Chairman, Governor' s Executive Assistant for Coastal Activities with the Coastal Protection and Restoration Authority. President Granger asked Juror Kevin Sagrera who is the Chairman of the Coastal Protection and Restoration Committee to lead into the topic of Senate Bill 693 for the Chenier Plain Coastal Restoration and Protection Authority. Juror Kevin Sagrera introduced Mr. Garret Graves, Governor' s Kline and Mr. Charles Sutcliffe. Office, Mr. Chip Juror Sagrera stated that at the last Police Jury meeting that some of the Jurors wanted some questions answered in reference to the appointments to the Chenier Plain Coastal Restoration and Protection Authority. Juror Sagrera stated that he was very pleased that Mr. Graves and his staff was able to attend the meeting tonight and thanked Mr. Graves for taking time. Mr. Graves thanked the President for the opportunity to be here tonight and appreciate giving him this opportunity to discuss the changes in the State of Louisiana regarding to coastal protection and restoration efforts in regards to levee districts and recent changes in the state law in regards to protection and restoration efforts.

2 Mr. Graves explained to the Jury how the Chenier Plain Coastal Restoration and Protection Authority would work if he Jury would decide to join the authority. Mr. Graves explained how being in the Chenier Plains Coastal Restoration and Protection Authority could result in billions of federal funds dedicated to the three parishes ( Vermilion, Cameron and Calcasieu) for coastal protection. Further discussion followed. Upon motion by Mr. Leon Broussard, duly seconded by Mr. Paul Bourgeois, and unanimously carried, the Police Jury approved to move forward submitting the ( 6) nominations to the Governor of Louisiana for the Chenier Plain Coastal Restoration and Protection Authority at the next committee meeting. Upon motion by Mr. Kevin Sagrera, duly seconded by Mr. Cloris J. Boudreaux, and unanimously carried, the Police Jury amended the agenda to allow Mr. Dennis Scott with the Calcasieu Parish Police Jury. Mr. Dennis Scott appreciated the momentum tonight moving forward and he explained that the more of us that work together the better we can help your chances to helping Iberia Parish, so with the new Chenier Plain Coastal Restoration and Protection Authority, I plan on being very involved in the authority just like you will be. If there is anything Calcasieu Parish can do to help you with the Delcambre and Avery Canal. Whatever that is that it will be our stand, we don' t agree, we don' t all know everything about each other parishes but whatever you feel that is important is what Calcasieu Parish will push, because we don' t live here. Mr. Scott stated that if there is anything that he can do to help to please let him know. President Granger recognized our Acadiana Delegation, State Representative Bob Hensgens. Representative Hensgens informed the Jury that Rep. Champagne apologies for not being able to attend the meeting tonight and Senator Perry had another meeting. We all look forward to working with all of you this session. Session starts next week and if you need anything please give us a call. President Granger recognized Sides & Vermilion Parish Comprehensive Resiliency Plan. Associates to present an update on the Mr. Bruce Sonnier newly elected Chair of the Vermilion Parish Comprehensive Resiliency Plan introduced Mr. Patrick Duhon the Co-Chair and several stakeholder members from the audience. Mr. Sonnier explained if you looked at the handout, you will see a list of names on the right, that is all citizens from out of the parish that has been participating in the stakeholders meetings. As of our last stakeholders meeting, we had a transition point where the citizens have taken control of the efforts. Mr. Sonnier stated now Side & Associates, Sellers and Associates and the planning committee are no long in the lead

3 advisory position. We will be holding Parish meetings throughout the Parish; we need everyone throughout the parish to participate. Ms. Kathy Ashworth, Senior Strategic Planner presented a brief update on the Comprehensive Resiliency Plan, Public Engagement and Outreach Plan. President Granger stated that the next order of business is the opening of bids for the Hardening of the Vermilion Parish Courthouse Annex and Sheriff' s Task Force Building". President Granger asked if there were any bids to be submitted from the audience. Upon motion by Mr. Wayne Touchet, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury closed the receipt of bids for the " Hardening of the Vermilion Parish Courthouse Annex and Sheriff' s Task Force Building". Upon motion by Mr. Wayne Touchet, duly seconded by Mr. Cloris J. Boudreaux, and unanimously carried, the Police Jury authorized the opening of the bids for the Hardening of the Vermilion Parish Courthouse Annex and Sheriff' s Task Force Building". Hardening of the Vermilion Parish Courthouse Annex and Sheriffs Task Force Building" License Base Contractor Number Bid Duane Davidson Construction, Inc , 000 E. I. Habetz Builders, Inc , 400 Ribbeck Construction, Corp , 751 Acadiane' Renovations, Ltd , 000 Miller Roodin, LLC , 300 Mr. Eugene Sellers, Jr., with The Sellers Group, advised the Jury that there were two bids received on the Central Bidding website. Mr. Eugene Sellers, Jr., with The Sellers Group, informed the Jury that the construction budget for this project is $268, Upon motion by Mr. Errol J. Domingues, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury approved taking all bids under advisement for the Hardening of the Vermilion Parish Courthouse Annex and Sheriff' s Task Force Building", and authorized the President to sign the contract and award the bid to the lowest bidder meeting specifications. Upon motion by Mr. Paul Bourgeois, duly seconded by Mr. Leon Broussard, and unanimously carried, the Police Jury approved dispensing of the reading of the minutes of the February 22, 2012 regular meeting and were accepted as presented.

4 President Granger recognized Mr. Eugene Sellers, Sr., with Sellers & Associates, Inc., to present his business to the Jury. Upon motion by Mr. Wayne Touchet, duly seconded by Mr. Ronald Menard, and unanimously carried, the Police Jury awarded the only bid received to Frenzel Motors, Inc., in the amount of$ 69, , relative to the purchase of a 2012 or latest Model 5- Cubic Yard Dump Truck Non-CDL". Upon motion by Mr. Kevin Sagrera, duly seconded by Mr. Errol J. Domingues, and unanimously carried the Police Jury accepted the cancellation of Project Permit No P to LLOG Exploration Company, for work which was to be done in Election District# 9 and refund the deposit. Upon motion by Mr. Allen Lemaire, duly seconded by Mr. Dane Hebert, and unanimously carried, with Juror Nathan Granger abstaining, the Police Jury approved Project Permit No D to Dunn Exploration Company, LLC for the proposed drill site for the HEB Brook RA SUA; Phil Duhon Well No Alt, located approximately 2. 5 miles northwest of Abbeville, off of Fore Road, in Election District No. 02. Approval contingent upon Vermilion Parish Office of Homeland Security/ Emergency Preparedness review of the emergency plan. Juror Ronald Menard asked Mr. Sellers if the Jurors could have a copy of the new road miles for the City and Parishes. Juror Kevin Sagrera asked Mr. Sellers on an update on the progress at North Airport Subdivision (Pine Street) levee. Mr. Sellers stated that the levee is still under review by FEMA, we should be hearing any day now that the construction funds are available on this project and is still waiting for a approval from DOTD and easements. Juror Dane Hebert asked Mr. Sellers gave an update on Victoria Acres Subdivision; Mr. Sellers stated that the Sate is trying to work out the cost of benefit ratio and is still in a waiting in line to be funded. Kim Touchet with, Primeaux, Touchet & Associates, LLC gave an update on the East Villien Bridge. I am waiting on the State this week for the approval of the plans and once received, I will send out the request for proposal at the end of next week. Upon motion by Mr. Leon Broussard, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury approved the Courthouse/Building Committee Recommendations, as presented, and the appropriate officials were authorized to carry out the recommendations. COURTHOUSEBUILDING COMMITTEE FEBRUARY 29, 2012 ABBEVILLE, LOUISIANA

5 AS A RESULT OF A COURTHOUSE/BUILDING COMMITTEE MEETING HELD ON FEBRUARY 29, 2012, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended that the Police Jury approve VPOHS/EP office entering into an agreement with ID Group, in the amount of $2, , relative to the software maintenance for Assest Manager and event manager software which is reimbursed by a grant. 2. It is recommended that the Police Jury approve the following reappointments: VERMILION PARISH TOURIST COMMISSION Mr. Jeff LeBlanc ( 02/29/ 12 02/ 29/ 15) TECHE-VERMILION FRESH WATER DISTRICT Mr. Michael Detraz ( 02/ 29/ 12 02/ 29/ 14) 3. It is recommended that the Police Jury approve the Vermilion Parish Police Jury Accounting Function Policy and Procedure Manual. 4. It is recommended that the Police Jury approve the issuance of a temporary liquor permit to Waikiki Trailriders for a three- day benefit to be held on April 13-15, 2012 at 7507 W. LA. Hwy. 338, Abbeville, LA It is recommended that the Police Jury approve the yearly termite service for the Vermilion Parish Government Complex Office to Dave' s Pest Control in the amount of$ It is recommended that the Police Jury authorize Legal Council to set up a meeting with the Vermilion Parish Sheriff, District Judges, District Attorney and Clerk of Court to discuss security in the Vermilion Parish Courthouse. Domingues, duly seconded by Mr. Ronald Menard, and unanimously carried, the Police Jury amend Item No. 2 that the Police Jury to add " It is recommended authorize Minvielle & Associates to prepare the necessary paper work to proceed with Phase IV of the project for the ( LTCR) Long Term Community Recovery Program for the bridge located on the south end of Wright Road." Upon motion by Mr. Leon Broussard, duly seconded by Mr. Errol J. Domingues, and unanimously carried, the Police Jury approved the Public Road Committee Recommendations, as amended, and the appropriate officials were authorized to carry out the recommendations.

6 PUBLIC ROAD COMMITTEE FEBRUARY 29, 2012 ABBEVILLE, LOUISIANA AS A RESULT OF A PUBLIC ROAD COMMITTEE MEETING HELD ON FEBRUARY 29, 2012, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended that the Police Jury approve payment of Invoice No. X25447 to Scott Equipment, in the amount of$ 49, , relative to the repair of the Area IV Motor Grader. 2. It is recommended that the Police Jury authorize Sellers and Associates Inc. to proceed with Phase IV of the project for the ( LTCR) Long Term Community Recovery Program for the bridge located on the south end of Wright Road. 3. It is recommended that the Police Jury approve the plans and specifications to the subdivision development identified as Southern Oaks Subdivision, in Election District No. 2, contingent upon the developer addressing the comments in the engineer' s letter dated February 29, It is recommended that the Police Jury approve payment of Final Payment to Glenn Lege Construction, in the amount of$ 39, , relative to the " Capital Improvements Program Road and Bridge Improvements Phase I". Cost to be paid from Royalty Road. 5. It is recommended that the Police Jury authorize the President to sign a " Substantial Completion" form for the " Capital Improvements Program Road & Bridge Improvements Phase IV", Preacher Road, Gladu Road and Bamboo Road. 6. It is recommended that the Police Jury amend Ordinance No to change the speed limit from 30mph to 40 miles per hour on Kirk Road, for its entire length, in Election District No It is recommended that the Police Jury adopt an ordinance establishing a 30 mph speed limit in Deere Park Subdivision on Deere Park Drive, Moline Avenue and Waterloo Avenue, for its entire lengths, in Election District No. 11. 7 AMENDMENT NO. 1 ORDINANCE AN AMENDMENT TO ORDINANCE NO , APPROVED BY THE VERMILION PARISH POLICE JURY AT THEIR REGULAR MEETING HELD ON MARCH 5, THE AMENDMENT RESCINDS SECTION I OF ORDINANCE TO CHANGE THE SPEED LIMIT ON KIRK ROAD AS FOLLOWS: WHEREAS, it has been brought to the Police Jury' s attention that a considerable amount of speeding exists, which is causing very hazardous conditions on Kirk Road, in Election District No. 01. SECTION 1: NOW THEREFORE, BE IT HEREBY ORDAINED, that the Vermilion Parish Police Jury does hereby impose a 40 mph speed limit on Kirk Road for its entire length; and SECTION II: BE IT HEREBY FURTHER ORDAINED, that the appropriate speed limit signs be installed in said area. SECTION III: BE IT HEREBY FURTHER ORDAINED, that for a first offense, a maximum penalty of a $ fine and/ or a 10 day jail sentence be imposed at the discretion of the court for the first offense. BE IT HEREBY FURTHER ORDAINED, that for a second offense, a maximum penalty of a $ fine and/or a 10 day jail sentence be imposed at the discretion of the court. BE IT HEREBY FURTHER ORDAINED, that for a third offense, a maximum penalty of a $ fine and/or a 10 day jail sentence be imposed at the discretion of the court. SECTION IV: BE IT HEREBY FURTHER ORDAINED, that the Vermilion Parish Sheriff's Department be and is hereby requested and/ or directed to enforce the speed limit by the use of radar and/ or regular patrolling. Upon motion by Mr. Mark Poche', duly seconded by Mr. Wayne Touchet, and unanimously carried, the Police Jury delete Item No. 5. Upon motion by Mr. Dane Hebert, duly seconded by Mr. Leon Broussard, and unanimously carried, the Police Jury approved the Finance Committee Recommendations, as amended, and the appropriate officials were authorized to carry out the recommendations.

9 FINANCE COMMITTEE FEBRUARY 29, 2012 ABBEVILLE, LOUISIANA AS A RESULT OF A FINANCE COMMITTEE MEETING HELD ON FEBRUARY 29, 2012, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended that the Police Jury authorize The Sellers Group to prepare a cost estimate to repair or replace a more modern heating system at the Vermilion Parish Law Enforcement Center. 2. It is recommended that the Police Jury adopt a resolution supporting St. James Parish and St. James Parish Youth Center in a petition to the Louisiana Legislature to enact legislation towards the delayed mandates as set forth in House Bill It is further recommended that the Police Jury authorize sending a copy of this resolution to the Acadiana Delegation. 3. 10 4. It is recommended that the Police Jury approve hiring Mr. Virgil Naron as a full time tractor operator for the Are IV Barn at a Grade 9 Step 0, replacing Mr. Kenneth DeVoltz. 5. It is recommended that the Police Jury approve to advertise for a Tractor Operator at the Area I Barn. 6. It is recommended that the Police Jury approve hiring Ms. Joni Rochelle Broussard as the Administrative Receptionist at a Grade 9 Step It is recommended that the Police Jury approve transferring Ms. Sabrina Guidry as the Permit Specialist at a Grade 10 Step It is recommended that the Police Jury approve payment of the attached bills that were submitted. PUBLIC WORKS COMMITTEE FEBRUARY 29, 2012 ABBEVILLE, LOUISIANA AS A RESULT OF A PUBLIC WORKS COMMITTEE MEETING HELD ON FEBRUARY 29, 2012, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended that the Police Jury award the only bid received to Frenzel Motors, Inc., pending the review and specifications from Sellers and Associates, in the amount of$ 69, , relative to the purchase of a 2012 or latest Model 5- Cubic Yard Dump Truck Non-CDL". 2. It is recommended that the Police Jury approve hiring Mr. Richmond Hardy as a CDL Driver for the Solid Waste Facility, at a Grade 10 Step It is recommended that the Police Jury approve the repairs to a fence that was damaged by a Solid Waste truck at a business known as Classic Cup which is located at the Intersection of Sweet Lane and Hwy. 14 bypass. It is further recommended that the Police Jury authorize Legal Council to send a letter informing the owner of Classic Cup that the Police Jury will look at a possible solution or alternative on Sweet Lane.

11 It is further recommended that the Police Jury authorize Legal Council to schedule a meeting with the City of Abbeville to resolve a workable solution or alternative on Sweet Lane. 4. It is recommended that the Police Jury authorize Sellers and Associates, Inc. to advertise for ( 4) 2012 or Latest Model Hydraulically Operated Knuckle Boom Trash Loader" for the Solid Waste Department. 5. It is recommended that the Police Jury ratify payment of Invoice No. JC to Ferrara Fire Apparatus, Inc., in the amount of $ , relative to the purchase of one commercial pumper for the Fire Protection District No It is recommended that the Police Jury approve payment of the attached bills that were submitted. 7. It is recommended that the Police Jury authorize Legal Council to send a letter to the following Blighted Property owners informing of the demolition of these properties as outlined in Ordinance No a) 3003 Cypress Street b) 3007 Cypress Street c) 3009 Cypress Street 8. It is recommended that the Police Jury authorize The Sellers Group to prepare a report on the feasibility of removal of the blighted property located at 3109 Lamas Street, Erath, LA It is further recommended that the Police Jury authorize The Sellers Group to prepare a assessment report to distinguish if the property located off of Darlene Street, Abbeville, LA. would meet the criteria of the Blighted Property Ordinance No Respectfully Submitted, Errol Domingues, Vice Chairman President Granger recognized Ms. Linda Duhon, Parish Administrator, to present her business to the Jury. Upon motion by Mr. Ronald Menard, duly seconded by Mr. Cloris J. Boudreaux, and unanimously carried, the Police Jury approved the issuance of an alcoholic liquor permit to Mr. Jarvis Dubois, dba The 8 Ball, located at 917 E. Veterans Memorial Drive, Kaplan, LA in Election District No. 12. President Granger recognized Mr. Paul Moresi, 111, Legal Counsel, to present his business to the Jury. Mr. Moresi stated that he had no business for the Jury at this time.

12 President Granger commended Juror Kevin Sagrera for his hard work and efforts on his Coastal Restoration Committee and everyone else listing to Mr. Garret Graves. Upon motion by Mr. Mark Poche', duly seconded by Mr. Errol J. Domingues, and unanimously carried, the Police Jury approved to hire Mr. Ronald Faulk as a full time tractor operator for the Area I Barn at a Grade 9 Step 0. Juror Paul Bourgeois announced that an informal meeting has been scheduled for March 20, 2012, at 5: 30pm, at the Abbeville Library to discuss economic development in our Parish. This meeting is being held off site because we are not truly formed yet. Upon motion by Mr. Cloris J. Boudreaux, duly seconded by Mr. Allen Lemaire, and unanimously carried, the Police Jury adopted an ordinance to install " NO DUMPING FINE" signs at the intersection of Mourning Dove and Hwy. 700, in Election District No. 12. ORDINANCE WHEREAS, it has been brought to the Police Jury' s attention that a considerable amount of litter exists, which is causing very hazardous conditions, at the intersection of Mourning Dove Road and Highway 700, in Election District No. 12. SECTION 1: NOW THEREFORE, BE IT HEREBY ORDAINED, that the Vermilion Parish Police Jury does hereby impose the following to install a " NO DUMPING - $ FINE" signs at the intersection of Mourning Dove Road and Highway 700, in Election District No. 12. SECTION II: BE IT HEREBY FURTHER ORDAINED, that the appropriate signs be installed in said area. SECTION III: BE IT HEREBY FURTHER ORDAINED, that for any offense, a maximum fine of$ fine. SECTION IV: BE IT HEREBY FURTHER ORDAINED, that the Vermilion Parish Sheriff' s Department be and is hereby requested and/ or directed to enforce the littering ordinance.
