1 Police Jury Room October 6, 2014 Abbeville, Louisiana Minutes of a regular meeting of the Vermilion Parish Police Jury held on October 6, 2014, with President Ronald Menard presiding. The meeting was called to order by President Ronald Menard, who asked Mr. Dane Hebert the group in the Pledge of Allegiance. Following the pledge, Mr. Ronald Darby took a moment to give prayer and reflection, President Ronald Menard asked for phones, pagers, etc. off or set to silent mode for the duration of the Police Jury meeting. President Ronald Menard recognized Ms. Jessie LeMaire, relative to Dog Bite Case which occurred on September 14, President Ronald Menard stated for the record that Ms. Jessie LeMaire was not present at the Police Jury meeting. President Ronald Menard considered the reading or approval of the minutes of the previous meeting of September 15, 2014 Upon motion by, Mr. Leon Broussard, duly seconded by Mr. Sandrus Stelly, and unanimously carried, the Police Jury approved dispensing of the reading of the minutes of the September 15, 2014, regular meeting, and was accepted as presented. President Menard recognized at this time a period for public comment on any agenda item to be considered from the audience. No Comments were presented or discussed at this time. President Menard considered action to amend the agenda to discuss and consider actions on any new items presented by Engineering & Architectural reports.

2 Upon motion by, Mr. Ronald Darby, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury approved to amend the agenda to discuss and consider actions on any new items presented by Engineering & Architectural reports. President Menard recognized Mr. Gene Sellers, Sr., with Sellers & Associates, Inc., to present his business to the Jury. Mr. Gene Sellers, informed the Jury that a bull dozer is not needed at this time at the School Board Site, but if there is a need at a later time I will go back and receive quotes. Mr. Gene Sellers, presented the following Project Permit to the Jury for their approval. Upon motion by Mr. Sandrus Stelly, duly seconded by Mr. Leon Broussard, the Police Jury approved Project Permit No D to Peak Operating Company for a proposed drill site for producing the Vermilion Parish School Board " A" Well #55, located S16 T 15S ROLE; approximately miles southwest of Abbeville, east of White Lake, South of Schooner Bayou, in Election District No. 13. Approval Contingent upon the VP- OHS/ EP Review. Upon motion by Mr. Sandrus Stelly, duly seconded by Mr. Leon Broussard, the Police Jury approved Project Permit No P to Peak Operating Company for a proposed pipeline installation to serve Vermilion Parish School Board " A" Well # 55 ( Ref: No D), in Election District No. 13. Approval Contingent upon the VP- OHS/ EP Review. Upon motion by Mr. Allen LeMaire, duly seconded by Mr. Cloris Boudreaux, the Police Jury approved Project Permit No SWD to Dunn Exploration Company, LLC for a proposed Bertrand SWD Well No. 1 t serve D/Hazel Nunez Well No. 1 and D/ Motty Estate Well No. 1 in Election District No. 2. Mr. Gene Sellers presented to the Police Jury for their approval a Letters of No Objection as follows: Upon motion of Mr. Sandrus Stelly, duly seconded by Mr. Kevin Sagrera the Police Jury approved a " Letters of No Objection" to Michael Pisani & Associates, Inc., for proposed Court ordered remediation to remove arsenic contaminated soil at four former vat sites, all sites are located west of Abbeville and South of Kaplan, in Election Districts No. 9 & 13 as follows: 1) ED 13: Couvillon Site Junius 2) ED 13: G Broussard Site Waldo Road 3) ED 9: Wilhelm Site Prairie Road 4) ED 13: Flying J Site S La Highway 82 Mr. Gene Sellers presented a Permit Amendment to the Police Jury for their approval as follows: Upon motion by Mr. Leon Broussard, duly seconded by Mr. Kevin Sagrera the Police Jury approved Permit Amendment No D to Mack Energy for a proposed revise location of drill site, north 161 feet, due to existing flow line and pipeline, located West Gueydan Field, approximately 5 miles west of Gueydan on La 14 between Reese Road and Diana Road, in Election District No. 14.

3 Mr. Gene Sellers, presented Seismic Operation Permit from CGG Land, ( U.S.) Inc., to conduct seismic operation in Vermilion Parish, and CGG Land, (U. S.) Inc., has requested that the Abbeville 3 D Seismic Project be extended further into an additional area with the Parish, the southwest ( SW) additional proposed area encompasses approximately 565 acres. Upon motion by Mr. Pervis Gaspard, duly seconded by Mr. Allen LeMaire, and unanimously carried, the Police Jury approved a proposed extension to Seismic Operation Permit No. 681 from CGG Land, ( U.S.) Inc., to conduct seismic operation in Vermilion Parish, and CGG Land, ( U.S.) Inc., has requested that the Abbeville 3 D Seismic Project be extended further into an additional area with the Parish, the southwest( SW) additional proposed area encompasses approximately 565 acres. Mr. Gene Sellers presented the Police Jury a final plat approval, to Entergy-Richard L. LeBlanc, Property Partition in Election District No. 3 & 8. Upon motion by Mr. Dane Hebert, duly seconded by Mr. Mr. Allen LeMaire and unanimously carried, the Police Jury gave final plat approval, for the property partition of a acre tract from Richard L. LeBlanc, to Entergy Louisiana, LLC, in Election District No. 3 & 8. Mr. Gene Sellers presented the Police Jury with approval of a Subdivision Review for Stormwater Management Plan & Plans and Specifications Approval, for the Belvedere East Subdivision Phase I, in Election District No. 3. Upon motion by Mr. Mark Poche', duly seconded by Mr. Mr. Cloris Boudreaux, and unanimously carried, the Police Jury gave approval of a Subdivision Review for Stormwater Management Plan & Plans and Specifications to the Subdivision development identified as Belvedere East Subdivision Phase I, in Election District No. 3. President Menard recognized Mr. Kim Touchet, with Primeaux, Touchet, & Associates Inc., to present his business to the Jury. Upon motion by Mr. Leon Broussard, duly seconded by Mr. Allen LeMaire and unanimously carried, the Police Jury adopted a Resolution, requesting Financial Assistance from the State of Louisiana under the Fiscal Year Capital Outlay Program, relative to Bridge Repairs and Improvements, and authorize Primeaux, Touchet & Associates, LLC, to apply for the Bridge Repairs and Improvements President Menard recognized Mr. Gene Sellers, Jr., with The Sellers Group, to present his business to the Jury. Mr. Gene Sellers, Jr., presented the Police Jury an approval for the a Substantial Certificate of Completion, dated October 3, 2014, relative to Long Term Community Recovery Program Project LTR Phase II, relative to the elevation of the Municipal Building for the Town of Delcambre, Upon motion by Mr. Errol Domingues, duly seconded by Mr. Wayne Touchet, and unanimously carried, the Police Jury approved the Certificate of Substantial Completion, relative to Long Term Community Recovery Program Project #LTR Phase II, relative to the elevation of the Municipal Building for the Town of Delcambre. Mr. Gene Sellers, Jr., presented Two ( 2) quotes to install three ( 3) powder coated Schedule 80 aluminum handrails on the East side of the Courthouse, on Tivoli Street as follows;

Minvielle Lumber In the amount of$ 6, Upon motion by Mr. Ronald Darby, duly seconded by Mr. Pervis Police Jury awarded the lowest quote to Duane Davidson, In the amount of $2, , relative to installing three ( 3) powder coated Schedule 80 aluminum handrails on the East side of the Courthouse, on Tivoli Street. Cost to be paid from General Fund. Mr. Gene Sellers, Jr., informed the Police Jury that they have issued three ( 3) notices to proceed, relative to the Hardening Projects, of the Courthouse Building, Public Works Building, and the County Agent Building, and at this time we are waiting for Abrom' s Hospital in Kaplan for the proper Insurance from the contractor. Lengthy discussion followed Mr. Gene Sellers, Jr., stated that they have sent CDBG the revised plans for the Government Office Complex, and we are waiting on them for their approval to advertise that Project, we had to revise the Specifications mainly to put in wage, rates, that CDBG agreed to fund the Vermilion Police Jury 25% share. Mr. Gene Sellers, Jr., present the following Invoices for professional service rendered for the Police Jury' s approval. Upon motion by, Mr. Kevin Sagrera, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury approved payment of Invoice No. 4112, to The Sellers Group. Inc. in the amount of$ , relative to Blighted Property Surveys as follows: S. Hospital Dr. Abbeville Community Road, Abbeville W. La Hwy 82, Abbeville Upon motion by, Mr. Kevin Sagrera, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury approved payment of Invoice No. 4113, to The Sellers Group. Inc. in the amount of $ , relative to Professional Services through the Bidding Phase on the " Vermilion Parish Wind Retrofit Buildings" Projects Harding of the Public Works Building. Upon motion by, Mr. Kevin Sagrera, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury approved payment of Invoice No. 4114, to The Sellers Group. Inc. in the amount of $1, , relative to Professional Services through the Bidding Phase on the " Vermilion Parish Wind Retrofit Buildings" Projects Harding of the County Agent Building. President Ronald Menard recognized the reports of the Public Works Committees Recommendation to be presented. Mr. Ronald Darby asked if there were any changes or amendments to the Public Works Committees Recommendation to be presented. Upon motion by Mr. Ronald Darby and duly seconded by Mr. Cloris Boudreaux, and unanimously carried, the Police Jury accepted the Public Works Committees Recommendation as presented, and the appropriate officials were authorized to carry out the recommendations.

5 PUBLIC WORKS COMMITTEE OCTOBER 1, 2014 ABBEVILLE, LOUISIANA AS A RESULT OF A PUBLIC ROADS COMMITTEE MEETING HELD ON OCTOBER 1, 2014, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended that the Police Jury approve to deem the animal owned by Ms. Jessie LeMaire, vicious and follow the ordinance requirements, relative to the Rabies/Animal Control Program: 2. It is recommended that the Police authorize Jury Mr. Billy Noegel, Public Works Director/Mosquito Control Director, to allow Ms. Jessie LeMaire to make an appointment to visit her dog" Charlie" at the Rabies/Animal Control Facility. 3. It is recommended that the Police Jury authorize Ms. Linda Duhon, Parish Administrator to advertise for the Rabies Clinic on Saturday November 22, 2014, at the Vermilion Parish Rabies and Animal Control Facility and approve to close the office to the public from 8 a.m. until Noon. 4. It is recommended that the Police Jury authorize Mr. Gene Sellers with Sellers & Associates, Inc. to prepare a bid package and advertise for a Track Hydraulic Excavator for the Solid Waste Program 5. It is recommended that the Police Jury authorize Mr. Gene Sellers with Sellers & Associates, Inc. to hire Louisiana Testing to do the bore testing at the Vermilion Parish School Board property. 6. It is recommended that the Police Jury authorize Mr. Gene Sellers with Sellers & Associates, Inc. to prepare a bid package and advertise for the fencing around the Vermilion Parish School Board property. 7. It is recommended that the Police Jury authorize Mr. Gene Sellers with Sellers & Associates, Inc. to prepare a bid package and advertise for the Borrow Material hauling from the Vermilion Parish School Board property to the landfill for a period of one ( 1) year. 8. It is recommended that the Police Jury authorize Ms. Linda Duhon, Parish Administrator to send a letter to Congressman Charles Boustany Office to show the need for the Maurice Volunteer Fire Department to be brought back to their non-profit status. 9. It is recommended that the Police Jury approve an Invoice dated August 15, 2014, to reimburse the City of Abbeville, in the amount of $1, , relative to the repairs to the Abbeville Parish Tanker. 10. It is recommended that the Police Jury authorize Ms. Linda Duhon, Parish Administrator to send the following equipment to Guinn Auction Company, which is scheduled for November 1, 2014 and approve to pay to haul this equipment if needed to the auction site in Jennings, LA. It is further recommended the Police Jury authorize Ms. Linda Duhon, Parish Administrator to advertise the following auction items in the Official Journal;

It is further recommended that the Jury approve the President to send Governor Jindal or the Governor' s designee the Vermilion Parish Comprehensive Resiliency Plan along with certification that the Parish has completed their Parish Land Use Plan and that it is consistent with, or complementary to the most recent version of the State' s Coastal Master Plan approved by the Louisiana Legislature, relative to the Direct Component( Pot 1) of the Restore Act. 14. It is recommended that the Police Jury adopt a Resolution by the Vermilion Parish Police Jury, in legal session convened, that it does hereby consideration to direct and authorize the Louisiana State Mineral and Energy Board and the Office of Mineral Resources to accept nomination, advertise for, accept and award bids, and execute all oil, gas and mineral leases pertaining to the immovable property listed on the attached Exhibit" A" (Pennington Oil & Gas Interest, LLC). 15. It is recommended that the Police Jury authorize Ms. Linda Duhon, Parish Administrator to advertise in house for a Permit Clerk/Receptionist at the Solid Waste Facility. 16. It is recommended that the Police Jury adopt a Formal Resolution authorizing the sale of property, relative to the Kaplan Library, and to authorize the President to sign all necessary documents. 7 President Ronald Menard recognized the reports of the Courthouse/ Building Committees Recommendation to be presented. Mr. Pervis Gaspard, asked if there were any changes or amendments to the Courthouse/ Building Committees Recommendation to be presented. Upon motion by Mr. Pervis Gaspard, and duly seconded by Mr. Allen LeMaire, and unanimously carried, the Police Jury accepted the Courthouse/ Building Committees Recommendation as presented, and the appropriate officials were authorized to carry out the recommendations. COURTHOUSEBUILDING COMMITTEE OCTOBER 1, 2014 ABBEVILLE, LOUISIANA AS A RESULT OF A COURTHOUSEBUILDING COMMITTEE MEETING HELD ON OCTOBER 1, 2014, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended that the Police Jury approve to pay $ towards the bus fees, relative to the Vermilion River Alliance Media Tour Day, on October 6, 2014, and to approve trash bags when they hold the river cleanup day. 2. It is recommended that the Police Jury adopt an ordinance establishing guidelines for the use of video or audio recording devices in buildings or at facilities owned by the VPPJ. 3. It is recommended that the Police Jury authorize the President Mr. Ronald Menard, Ms. Linda Duhon, Parish Administrator and Ms. Carolyn Bessard, Assistant Parish Administrator to attend the NACO' s Gulf States Counties and Parishes Caucus Annual Meeting scheduled for Wednesday, October 15, 2014, at the Beau Rivage Resort and Casino, 875 Beach Blvd., Biloxi, Mississippi. 4. It is recommended that the Police Jury authorize the President Mr. Ronald Menard by Proxy, to authorize Ms. Linda Duhon, Parish Administrator to vote on behalf of the Police Jury at the PACE meeting on October 7, It is recommended that the Police Jury authorize The Sellers Group, to prepare a report on the feasibility of rehabilitation for the structure located at the following. a) 3202 Anna Drive, Erath, La, in Election District No. 6. b) 4123 Eve Road, Erath, La, In Election District No It is recommended that the Police Jury authorize Mr. Paul Moresi, III Legal Counsel to send a letter to the owner of Community Road, Abbeville, La informing the owner that the property and structures have been deemed beyond rehabilitation, relative to a blighted property complaint received. It is further recommended that the Police Jury authorize Ms. Carolyn Bessard, Assistant Administrator to acquire quotes to clean and demolish the property located at Community road, Abbeville, La. 8 ORDINANCE NO AN ORDINANCE ESTABLISHING GUIDELINES FOR THE USE OF VIDEO OR AUDIO RECORDING DEVICES IN BUILDINGS OR AT FACILITIES OWNED BY THE VERMILION PARISH POLICE JURY BE IT ORDAINED by the Vermilion Parish Police Jury that there is a need to protect the public safety, health and welfare of the citizens of the Parish of Vermilion in regards to the use of video or audio recording devices in buildings and facilities owned by the Vermilion Parish Police Jury. BE IT FURTHER ORDAINED by the Police Jury of Vermilion Parish, in regular session convened on this 6th day of October, 2013, that the Vermilion Parish Police Jury adopt Parish Ordinance No as follows: Sec. 1. Prior Approval Required The use of video or audio recording devices in buildings or at facilities owned by the Vermilion Parish Police Jury is prohibited without obtaining the prior consent of the Vermilion Parish Police Jury, or the authorized occupant of the facility. Sec. 2. Order and Decorum If approved by the Vermilion Parish Police Jury, or exempted by this ordinance, the use of any video or audio recording devices must be done in such a way that does not disrupt the business of the Vermilion Parish Police Jury or any of the authorized occupants of any building and/ or facility owned by the Vermilion Parish Police Jury. Sec 3. Exemptions This ordinance shall not apply to: 1) The use of video or audio recording devices being used with the consent of the Vermilion Parish Police Jury or the authorized occupant of the building or facility. 2) Security systems approved by the Vermilion Parish Police Jury or the authorized occupant of the building or facility. 3) Court reporters during judicial proceedings. 4) The use of video or audio recording devices by law enforcement personnel while on duty. Sec. 4. Criminal liability. Any person who violates this Ordinance shall, upon conviction thereof, be guilty of a misdemeanor and shall be subject to a fine of not more than Five Hundred and no/ 100 ($ ) Dollars, or a prison term of not more than thirty( 30) days, or both, for each violation. Sec. 5. Repeal of conflicting ordinances. All ordinances or resolutions or parts thereof in conflict herewith are hereby repealed.

9 Sec. 6. Severability. Should any part of this ordinance be declared null, void, invalid, illegal or unconstitutional, the remainder of the said ordinance shall remain in full force and effect. Sec. 7. Effective date. This ordinance shall become effective after final approval of the Vermilion Parish Police Jury, signature of the President of the Vermilion Parish Police Jury, promulgation and legal delay. President Ronald Menard recognized the reports of the Public Roads Committees Recommendation to be presented. Mr. Leon Broussard, asked if there were any changes or amendments to the Public Roads Committees Recommendation to be presented. Upon motion by Mr. Errol Domingues, and duly seconded by Mr. Kevin Sagrera, and unanimously carried, the Police Jury amended Item # 9 of the Public Roads Committee Recommendations to add: Gazette Road, in Election District No. 10, and Daniel and Brenda Road, in Election District No. 5. Upon motion by Mr. Leon Broussard, and duly seconded by Mr. Cloris Boudreaux, and unanimously carried, the Police Jury accepted the Public Roads Committees Recommendation as amended, and the appropriate officials were authorized to carry out the recommendations. PUBLIC ROADS COMMITTEE OCTOBER 1, 2014 ABBEVILLE, LOUISIANA AS A RESULT OF A PUBLIC ROADS COMMITTEE MEETING HELD ON OCTOBER 1, 2014, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended that the Police Jury adopt a Resolution, requesting Financial Assistance from the State of Louisiana under the Fiscal Year Capital Outlay Program, relative for a Bridge Replacement at Catalon/ Petite Road, over Granger Coulee. It is further recommended to authorize Sellers & Associates, Inc., to apply for the Capital Outlay Program, relative for a Bridge Replacement at Catalon/ Petite Road, over Granger Coulee. 2. It is recommended that the Police Jury adopt a Resolution, requesting Financial Assistance from the State of Louisiana under the Fiscal Year Capital Outlay Program, relative to Street Improvements. It is further recommended to authorize Sellers & Associates, Inc., to apply for the Capital Outlay Program, relative to Street Improvements. 3. It is recommended that the Police Jury authorize Mr. Paul Moresi, III, Legal Counsel to prepare an Intergovernmental Agreement between the City of Abbeville, whereby there is a need to do

10 drainage improvements on Martin Luther King Avenue, whereby the City of Abbeville will pay 'h of the cost of the project, Sub 1 of 2, in Election District No. 5, will pay '/ a of the cost, and Sub 1 or 2 in Election District No. 4 will pay '/4 of the cost. 4. It is recommended that the Police Jury adopt a resolution authorizing the President to execute an Intergovernmental Cooperative Endeavor Agreement, between the State of Louisiana through the Department of Transportation and Development and the Vermilion Parish Police Jury, relative to the Right Sizing Project whereby State Route La 717 in its entirety, in Election District No It is recommended that the Police Jury approve to install a " No Dumping" $ fine sign on Steamboat Road, in Election District No. 1, relative to Ordinance No It is recommended that the Police Jury hire Mr. Elliot Simon, as a part time Mower Operator at the Area IV Barn, contingent upon a criminal and vehicle background checks being completed. 7. It is recommended that the Police Jury transfer Mr. John Delino from part time employee to full time as a Packer Operator, at a Grade 10, Step 0, FRS Crew. 8. It is recommended that the Police Jury authorize Sellers & Associates, Inc., to prepare a drainage study on a drainage ditch located off of East Woodman and E. Elina Road. Cost to be paid from Sub 1 of 2 in Election District No It is recommended that the Police Jury authorize Sellers & Associates, Inc., to prepare a bid package and advertise to reconstruct Aurelien Road, in Election District No. 8. Upon motion by Mr. Mark Poche', and duly seconded by Mr. Kevin Sagrera, and unanimously carried, the Police Jury accepted the Finance Committees Recommendation as presented, and the appropriate officials were authorized to carry out the recommendations. FINANCE COMMITTEE OCTOBER 1, 2014 ABBEVILLE, LOUISIANA AS A RESULT OF A FINANCE COMMITTEE MEETING HELD ON OCTOBER 1, 2014, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended that the Police Jury approve an Invoice dated September 28, 2014, to Ms. Belinda R. Guidroz in the amount of$ , relative to necessary repairs on 101 pairs ofjeans and changed zippers & buttons for the Vermilion Parish Law Enforcement Center.

Mr. Paul Moresi, III, Legal Counsel informed the Jury that he has been back and forth through e- mails on some of the existing charges of whether or no they were our juveniles, or if they were Lafayette' s juveniles, and it is difficult to get to the bottom of this situation, and at this time Lafayette Juvenile Detention Home has considered our account to be delinquent, and I do not want to lose the relationship that we have with Lafayette Juvenile Detention Home, and I would like to recommend that the Jury approve the Invoices, subject to my review, and the review of the City Judges in the two Courts. President Ronald Menard recognized Mr. Paul Moresi, III, Legal Counsel to present his business to the Jury. Mr. Paul Moresi, III, Legal Counsel informed the Police Jury we are in position to close on the acquisition of the Kaplan Library Property, and I want to make sure that the Jury has adopted a Resolution authorizing the Sale and authorized the President to sign all documents. Mr. Paul Moresi, III, Legal Counsel informed the Police Jury that Mr. Chadwick Girouard has come in and signed the Buy/Sale Agreement on the property which is located on Mack Switch Road, Erath for the Area I Barn. Upon motion by Mr. Nathan Granger, duly seconded by Mr. Allen LeMaire, and unanimously carried, the Police Jury adopted a Resolution authorized the President to sign all necessary documents, relative to the Buy/ Sale Agreement on the property which is located on Mack Switch Road, Erath, La. for the Area I Barn. Mr. Paul Moresi, III, Legal Counsel stated that he called Judge Theall today about cell phone policy in the Courthouse, and she has asked us to hold off on this matter until after the November Election is over. Mr. Paul Moresi, III, Legal Counsel informed the Police Jury that this is the attempt of the Attorney' s General to answer the question of can the Jury hire a Lobbyist, and it is still not answered, the general rule is " if a public bodies is not given a specific legal authority to do it, then the answer is no you can' t, but if you want to be more specific and advise me on why the Jury would want to hire a Lobbyist to do, we could at least ask for an opinion. Upon motion by Mr. Wayne Touchet, duly seconded by Mr. Nathan Granger and unanimously carried, the Police Jury authorized Mr. Paul Moresi, III, Legal Counsel to send a letter to the Attorney General' s Office, relative to hiring a Lobbyist.

16 Mr. Paul Moresi, III, Legal Counsel informed the Police Jury that Ms. Linda Duhon, Parish Administrator, sent me some articles of incorporations and some by-laws on the Acadiana Planning Commission, which appears to be a regional Economic Development effort. Mr. Paul Moresi, III, Legal Counsel stated that he wants to make sure that the Police Jury does not get something imposed on you from some regional authority without any notification. Mr. Paul Moresi, III, Legal Counsel informed the Police Jury that the Court of Appeals has now turned away both the landowners and the child that started the fire at the Landfill, and we are going to start looking for trial dates, and I believe we may be able to try the case sometime next year. President Menard considered action to amend the agenda to discuss and consider actions on any new items presented by Mr. Paul Moresi, III, Legal Counsel Upon motion by Mr. Cloris Boudreaux, duly seconded by Mr. Errol Domingues, and unanimously carried, the Police Jury amended the agenda to discuss and consider adopting the following Ordinance that deals with Itinerant vendors or Door to Door salesman, and an Ordinance for the regulation of election signs. Upon motion by Mr. Cloris Boudreaux, duly seconded by Mr. Errol Domingues and unanimously carried, the Police Jury adopted an Ordinance that deals with Itinerant vendors or Door to Door salesman. ORDINANCE NO AN ORDINANCE ESTABLISHING REGULATIONS OF ITINERANT OR DOOR-TO- DOOR VENDORS IN THE PARISH OF VERMILION, LOUISIANA BE IT ORDAINED by the Vermilion Parish Police Jury that there is a need to protect the public safety, health and welfare of the citizens of the Parish of Vermilion in regards to itinerant and door-todoor vendors in Vermilion Parish, Louisiana. BE IT FURTHER ORDAINED by the Police Jury of Vermilion Parish, in regular session convened on this 6th day of October, 2014, that the Vermilion Parish Police Jury adopt Parish Ordinance No as follows: Sec. 1. Definitions Itinerant Vendor" and/ or " Itinerant Vendors" as used in this Ordinance means and includes and shall be construed to mean and include all persons, firms and corporations, as well as their agents and employees, who engage in the temporary or transient business in this Parish of selling or offering for sale, any goods or merchandise, or exhibiting the same for sale, or exhibiting the same for the purpose of taking orders for the sale thereof; and who for the purpose of carrying on such business or conducting such exhibits thereof either hire, rent, lease, occupy or receive by donation, any room or space in any building, structure, or other enclosure, or on any lot in the Parish in, through, or from which any goods or merchandise may be sold, offered for sale, exhibited for sale or exhibited for the purpose of taking orders for the sale thereof.

17 Door-to- Door Vendor" and/ or " Door-to-Door Vendors" as used in this Ordinance means and includes and shall be construed to mean and include all persons, firms and corporations, as well as their agents and employees, who engage in the temporary or transient business in the Parish of selling, or offering for sale, any goods or merchandise, or exhibiting the same for sale, or exhibiting the same for the purpose of taking orders for the sale thereof; and who for the purpose of carrying on such business or conducting such exhibits thereof do not hire, rent, Sec. 2. Sec. 3. Permit required. It shall be unlawful for any itinerant vendor or any door-to- door vendor to sell, offer for sale, exhibit for sale or exhibit for the purpose of taking orders for the sale of any goods or merchandise within the city, not having been required or invited to do so by the owner or occupant of a residence, without first obtaining a permit from the Vermilion Parish Police Jury. Conditions for issuance of permit of itinerant vendor. The permit for the itinerant vendor required by this section shall be issued upon receipt of the following information which shall be required upon the application of the permit: 1. The full name and physical address of the itinerant vendor. 2. The location of his principal office and place of business. 3. The location within the Parish from which the itinerant vendor shall sell, exhibit for sale, offer for sale or exhibit for the purpose of taking orders for the sale of his goods or merchandise. 4. The name and address of each assistant, associate or employee who shall work for and under the itinerant vendor. Sec. 4. Conditions for issuance of permit for door-to- door vendor. The permit for the doorto-door vendor required by this section shall be issued upon receipt of the application for a permit of a door-to- door vendor which must be accompanied by: 1. A statement showing the kind of character of the goods or merchandise to be sold, offered for sale or exhibited. 2. A certified copy of the charter if the door-to-door vendor is a corporation incorporated under the laws of the state. 3. A certified copy of his permit to do business in this state if the door-todoor vendor is a corporation incorporated under the laws of some state other than this state. Sec. 5. Exemptions. This ordinance shall not be applicable to the selling or offering for sale any goods or merchandise or exhibiting the goods or merchandise for sale or exhibiting the good or merchandise for the purpose of taking orders for the sale thereof in the following instances: 1. If all of the proceeds thereof are applied to any charitable or philanthropic purpose;

18 2. At any crafts and arts fairs or festivals sponsored by a state nonprofit organization; 3. At any event commonly known as a garage sale, flea market, exhibition of antiques, stamp, arts, crafts, festivals or fairs; 4. Vendors of farm products, poultry, stock or agricultural products in their natural state produced by the vendor or fresh seafood caught by the vendor. Sec. 6. Time Allowed. Itinerant vendors and/or door-to- door vendors may only conduct business from sunrise to 30 minutes after sunset. Sec. 7. Violation, penalty. Any person violating this section shall, upon conviction, be punished as provided in Section 8. Each sale, exhibition for purpose of sale or exhibition for the purpose of taking orders for the sale thereof shall be a separate offense. Sec. 8. Criminal liability. Any person who violates this Ordinance shall, upon conviction thereof, be guilty of a misdemeanor and shall be subject to a fine of not more than Five Hundred and no/ 100 ($ ) Dollars, or a prison term of not more than thirty (30) days, or both, for each violation. Sec. 9. Repeal of conflicting ordinances. All ordinances or resolutions or parts thereof in conflict herewith are hereby repealed. Sec. 10. Severability. Should any part of this ordinance be declared null, void, invalid, illegal or unconstitutional, the remainder of the said ordinance shall remain in full force and effect. Sec. 11. Effective date. This ordinance shall become effective after final approval of the Vermilion Parish Police Jury, signature of the President of the Vermilion Parish Police Jury, promulgation and legal delay.' Upon motion by Mr. Nathan Granger, duly seconded by Mr. Cloris Boudreaux, and unanimously carried, the Police Jury adopted an Ordinance for the regulation of election signs. ORDINANCE NO AN ORDINANCE REGULATING ELECTION SIGNS IN THE PARISH OF VERMILION, LA. BE IT ORDAINED by the Vermilion Parish Police Jury that there is a need to protect the public safety, health and welfare of the citizens of the Parish of Vermilion in regards to the regulation of election signs in the unincorporated areas of the Parish of Vermilion, Louisiana.

19 BE IT FURTHER ORDAINED by the Police Jury of Vermilion Parish, in regular session convened on this 6th day of October, 2014, that the Vermilion Parish Police Jury adopt Parish Ordinance No as follows: Sec. 1. Definitions. Election Sign means a sign: 1) Designed, used or intended to induce voters to vote for either the passage or defeat of a measure appearing on the ballot of any election, or for either the election or defeat of a candidate for nomination or election to any public office in any election; and 2) Constructed of= reinforced cardboard, paper, plastic, plywood, or similar product; and 3) Includes without limitation banners, campaign signs, posted handbills and notices of any kind. Erection ofa sign means the construction, placement, relocation, enlargement, alteration, posting or display of a sign. Illegal Election Sign means any sign not in conformity with this ordinance. Parish means Vermilion Parish Police Jury, its officials and employees. Parish may also mean the Parish of Vermilion, Louisiana. Public right-of-way, means Public Street, right-of-way, alley, or other public outdoor area such as a plaza or a park. Public property, for purposes of this article, means any property owned or controlled by a public entity, including but not limited to: 1) Recreational areas such as museums, playgrounds, parks, plazas and gardens; and 2) Public buildings such as libraries, fire stations, and Parish Court House; and 3) Public right-of-way and structures on right-of-way, including but not limited to lampposts, utility poles, utility wires, street signs, traffic signs, benches, hydrants, fountains, trees, bushes, public bridges, sidewalks, park strips and curbstones. Sign means any structure, display, device, balloon or graphic on or attached to any land, building or structure, which is used to communicate any message, or which advertises or promotes any business, product, activity, person or interest. Signs include, but are not limited to, letters, numbers, word, illustrations, decorations, decals, emblems, trademarks, logos and lights. Sec. 2 General Provisions. a) Application. 1) This Ordinance shall apply to the unincorporated areas of Vermilion Parish, Louisiana. 2) Unless otherwise expressly provided in this article, this ordinance shall apply only to signs visible from off-site or from any outdoor parking lot or outdoor pedestrian walkway accessible for use by the public. b) Conformity required. No person shall erect, maintain or suffer, or cause to be erected, maintained or suffered, any Election Sign except in conformity with this ordinance. c) Injunctive relief. 1) The erection of any Election Sign determined to be violation of this article shall be, and is hereby declared to be, unlawful and a public nuisance. 2) In any action with regard to such use, any court of competent jurisdiction may award any relief as will abate or remove such use and restrain any person from using any Election Sign and/ or property contrary to the provisions of this ordinance. 3) An injunction may be issued by any court of competent jurisdiction for any violation of this ordinance upon suit by the Parish. d) Authority to remove Election Signs in public right-of-way. 1) Any Election Sign and the supporting structure( s) located in the apparent public right-of-way or on public property may be removed by the Parish.

20 2) No notice shall be required prior to removal of Election Signs in the public right-of-way or on public property. e) Disposition of unclaimed signs. Any Election Sign removed by the Parish may be destroyed by the Parish if not reclaimed within ten( 10) days after notice to the candidate or his/her campaign. f) Reclamation of signs. In order to reclaim an Election Sign removed by the Parish pursuant to this Ordinance, the owner or other person in control of such sign shall first pay to the Parish a fee as set forth in the schedule of fees adopted by resolution of the Parish. g) Signs of de minimus value-destruction. Any Election Sign in the public right-of-way or on public property of de minimus value shall be deemed to be abandoned and may be destroyed by the Parish after removal. No opportunity to reclaim such a sign shall be given by the Parish. For purposes of this section, any sign made of cardboard, Styrofoam, or other nondurable material shall be deemed to be of de minimus value. Sec. 3. Election Signs. In its regulation of Election Signs, it is the intent of the Parish to achieve a fair and reasonable accommodation between the public' s interest in the full and vigorous debate of election issues and the community' s interest in public order, cleanliness and community aesthetics. Election Signs are relatively inexpensive. As a result, without reasonable regulation, the community could be inundated by their profusion prior to elections and by their litter after elections. Election Signs also are particularly susceptible to the effects of the elements. It is the Parish' s intent in regulating Election Signs to control the proliferation of clutter but to be no more restrictive than necessary and not to unduly restrict the public' s right to communicate about election issues. Sec. 4. Quantity, size and placement of Election Signs. Unless otherwise expressly provided in this section, the quantity, size and location of Election Signs shall be governed herein. Sec. 5. Election Signs on private property. a) Shall not be illuminated. b) If an attached sign, shall not extend above the eaves of the building or structure where located. c) If a freestanding sign: 1) Shall not exceed eight ( 8) feet in height; and 2) Shall not exceed eight ( 8) feet in width, and 3) Shall be located in such a fashion so as to create any safety hazard. Sec. 6. Time limit for display of Election Signs. a) All Elections Signs shall be removed from the parcel where erected or displayed within fourteen 14) days after the date of the election to which they pertain. b) Notwithstanding subsection ( a) above, if Election Signs pertain not only to a primary election but also to a succeeding general election, they may be displayed until the general election and shall be removed within fourteen( 14) days after the date of general election. c) The timely removal of Election Signs shall be a joint and several obligation of: 1) Each person who erects or displays an Election Sign; 2) Each person who causes or authorizes the erection or display of such sign; and 3) The owner or other person in control of the property where such sign is erected or displayed. Sec. 7. Criminal liability. a) Any person who violates this Ordinance shall, upon conviction thereof, be guilty of a misdemeanor and shall be subject to a fine of not more than Five Hundred and no/ 100 ($ ) Dollars, or a prison term of not more than thirty (30) days, or both, for each violation.
