1 Police Jury Meeting Police Jury Room June 04, 2018 Abbeville, Louisiana Minutes of a regular meeting of the Vermilion Parish Police Jury held on June 04, 2018, with President Kevin Sagrera presiding. The meeting was called to order by President Mr. Kevin Sagrera, who asked Mr. Mark Poche' to lead the group in the Pledge of Allegiance. Following the pledge, the President asked Mr. Ronald Darby for a moment of prayer or reflection. The President then reminded all present to turn all cell phones, pagers, etc. off or set to silent mode for the duration of the Police Jury Meeting. Sagrera recognized a period for public comment on any agenda item to be No business to be presented at this time. President Sagrera stated it is Beef Month in Louisiana. We have a Proclamation stating its beef month and I think the Cattle Women' s Association and some of the local kids are here and we would like for you' ll to come up to the mic and speak. Ms. Tweety Trahan stated I am Vice-President of Vermilion Parish Cattle Women' s Association and we have a couple of officers with us tonight. Ms. Gwen Broussard is President and Ms. Carline Frederick is Secretary and we want to thank all of you for allowing us to come in tonight and talk to you. Every year we bring you something different so this year we brought an ink pen and a meat thermometer. It is pretty cool because you can put it in your pocket when you are grilling. We always want to thank you' ll for having us and signing the Proclamation and I will go ahead and let the kids talk. Ms. Fallon Leger stated I am a junior at Vermilion Catholic High School and my parents are Chad and Nicole Leger. I have been showing Red Brangus and Commercial Heifers for eight years. 1

2 I am a fifth generation Cattlemen of Vermilion Parish. We are here tonight to thank the Vermilion Parish Police Jury members for all they do to assist the Cattlemen of Vermilion Parish. In 2016, there were six hundred and thirty producers in Vermilion Parish with thirty-six thousand twelve head of cattle on them. Of that number two hundred eighty were members of the Vermilion Parish Cattlemen' s Association. On behalf of the beef industry I would like to thank you for signing the Beef Month Proclamation tonight. We appreciate your continued support. Mr. Christopher Broussard stated I am the son of Timothy and Gwen Broussard. I am going to be a freshman at Abbeville High this fall. I have been exhibiting registered Braford Cattle in the show ring for six years and I am a fifth generation cattle producer. My family and I raise Braford and Braford based registered cattle. I have competed in 4H Beef Cookery Contest and Beef and Horse Demonstrations on the Parish and State level. Ms. Emma Leger stated she is the daughter of Chad and Nicole Leger. I am an eighth grade student at Mount Cannel Elementary. I have been exhibiting registered Red Brangus Cattle and Commercial Heifers in the show ring for five years. I am a fifth generation cattle producer. I enjoy showing cattle and also work to promote beef by participating in other 4H activities. On behalf of my family, other cattlemen in Vermilion Parish and across the State of Louisiana I want to thank you for your continued support of our organization and our work to promote beef as an important part of the Parish economy. Thank you. Mr. Lane Frederick stated he is the son of Craig and Carline Frederick. I am an eighth grade 4H member at JH Williams Middle School. I am a fifth generation cattle producer and I have shown registered Brahman Cattle for four years. We are here tonight to thank the Vermilion Parish Police Jury for their continued support of the beef industry in Vermilion. We also want to extend our deepest appreciation to the Jury for everything you' ll have done to aid our cattlemen and farmers. Thank you for signing the Beef Month Proclamation and for letting all of us speak to you tonight. Mr. Ty Hebert stated last but not least I am the son of James and Charlsie Hebert. I am in ninth grade and a fifth generation cattlemen. My family and I raise registered Brahman and Fl cattle. As a cattle producer I believe that lean beef is an essential part of a balance diet. One three ounce serving of lean beef is only one hundred and fifty-three calories. Yet it is a naturally rich source of nutrients including protein, zinc, iron and B Vitamins. All of these nutrients are needed for a healthy active lifestyle. On behalf of all Vermilion 4H Livestock Exhibitors to thank you for your continued support of our livestock sale and every aspect of the 4H program. We are better, stronger organization because of you. Thank you. Ms. Tweety Trahan stated again on behalf of the Vermilion Parish Cattle Women and the Louisiana Cattle Women and the 4H Program in Vermilion we appreciate you doing this every year. Thank you. 3 President Sagrera recognized Reading or Approval of the minutes of the previous meetings- Special Meeting of May 21, 2018, Public Hearing Meeting of May 21, 2018, Regular Meeting of May 21, 2018, & Special Meeting of May 30, Upon motion by Mr. Leon Broussard, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury approve to dispense of the reading of Special Meeting of May 21, 2018, Public Hearing Meeting of May 21, 2018, Regular Meeting of May 21, 2018, & Special Meeting of May 30, President Sagrera recognized the Bid Opening for the Official Journal. Upon motion by Mr. Leon Broussard, duly seconded by Mr. Paul Bourgeois, and unanimously carried, the Police Jury approve to open the Bid Opening for the Official Journal. Mr. Keith Roy, Parish Administrator, stated we have two bids. One from the Kaplan Herald, the bid is first insertion at a rate of$ 6.25 per square of 100 words. Any subsequent insertions are per 100. The circulation per issue of this newspaper is 800. The Abbeville Meridional' s bid is first insertion at a rate of$6. 00 per square of 100 words. For all subsequent insertions at a rate of$ 6.00 per square of 100 words and the circulation per issue of this newspaper is Those are your two bids. Upon motion by Mr. Wayne Touchet, duly seconded by Mr. Ronald Darby, and unanimously carried, the Police Jury approve to go with the lowest bidder, Abbeville Meridional, with a bid of first insertion at a rate of$ per square of 100 words. For all subsequent insertions at a rate of per square of 100 words and the circulation per issue of this newspaper is President Sagrera recognized to consider action to amend the agenda to discuss and consider actions on any new items presented by Engineering and Architectural reports. Upon motion by Mr. Ronald Darby, duly seconded by Mr. Brent Landry, and unanimously carried, the Police Jury approve to amend the agenda to discuss and consider actions on any new items presented by Engineering and Architectural reports. Mr. Gene Sellers, SR, Sellers & Associates, Inc., stated at your committee meeting we presented to you the Final Change Order for the work completed at the Detention Center- Flood Protection Program and also the Final Estimate for their work. I have tonight for you to adopt a Resolution accepting the project is complete, authorizing the President to sign the Notice of Acceptance to be recorded for the forty-five day lien period. Upon motion by Mr. Errol Domingues, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury approve to adopt a Resolution accepting the project at the Detention Center- Flood Protection Program as complete, authorizing the President to sign the Notice of Acceptance to be recorded for the forty-five day lien period. 3

4 Mr. Sandrus Stelly stated we have a problem at Acadiana Marina. Somebody pulled one of those big pipes out that drains. Half the pipe is on the road. I wanted to get Mr. Gene to see if that is the State or who. President Sagrera stated I know it is over a state road and there is no drainage board there. Mr. Gene Sellers, SR stated what the pipe does is drain the state road so he was asking us to ask the state to go back and replace it. I can check with District office and see what can be done about that. Upon motion by Mr. Sandrus Stelly, duly seconded by Mr. Leon Broussard, and unanimously carried, the Police Jury authorize Sellers and Associates, Inc. to check with the State about the pipe that was pulled out at Acadiana Marina( Pecan Island). President Sagrera recognized Report of Standing Committees, Rabies/ Animal Control Sub- Committee. RABIES/ ANIMAL CONTROL SUB - COMMITTEE MAY 21, 2018 ABBEVILLE, LOUISIANA AS A RESULT OF A RABIES/ANIMAL CONTROL SUB - COMMITTEE MEETING HELD ON MAY 21, 2018, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended the Police Jury authorize Ms. Debra Garrot and Ms. Cindy Hunt to do the research on getting a grant for the spay and neuter of the animals. It is recommended the Police Jury approve a quote from Minvielle Lumber Company Inc. in the amount of$ , in regards to the Clerk of Courts Office wanting to cut a window into a wall to create more office space. 9. It is recommended the Police Jury approve a Proclamation for Mr. Minos Broussard. 10. It is recommended the Police Jury to approve payment of the attached bills that were submitted. Respectfully Submitted, Mr. Paul Bourgeois Chairman Mr. Keith Roy stated there were two items voted on last week in the meeting but were not put in the recommendations so I need to add them now. I can go over them now. One was a need for a motion to approve a Resolution granting the authority to the President to sign and submit all necessary documents in connection with the Community Development Block Grant Disaster Recovery Program through the Restore Louisiana Infrastructure FEMA Public Assistance Non- Federal Share Match Program. President Sagrera stated we will go with what we did in the meeting and then accept them as is. Motion by Mark and second by Jason. Mr. Keith Roy stated the next motion was we need a motion to approve a six ( 6) month extension for Permit No , Mr. Nick George, Jane Street, Abbeville, Election District No. 5, financial difficulties. That was also motioned by Mr. Picard and Mr. Poche'. 6

7 Mr. Paul Bourgeois stated I do have something I would like to discuss before we approve the Courthouse Recommendations. It has to do with the request for DOTD and the culverts below and along John Hardy. We seem to have a response. I must have missed the meeting where we received a response because I had asked to send another one to them. They are saying there is nothing wrong in the culverts from this letter. I believe Mr. Touchet may have something. Mr. Wayne Touchet stated today I went to the Gulf Port Coulee where the box culverts cross the bypass because the tide was low enough to see. Right now the dirt in the culvert is approximately, if you look at the picture, two foot higher than the water on the upstream side of the coulee. Mr. Keith Roy stated there are pictures on your tablets. Mr. Wayne Touchet stat: d there is probably about three or four foot of settlement in those box culverts right now. Mr. Paul Bourgeois stated according to this letter they went and checked out the culverts and they are saying there is no restrictions. Now, anybody who passed along the bypass after it rained will notice the ditches are full on one side of the culvert and the other side will have nothing. In some places there is no restrictions but in some places there is definitely restrictions. It is visible. I know Wayne and I in the last six or seven months have put some serious consideration in this. We have had our people going and checking on our culverts, washing out our culverts, and changing of culverts. We have done a lot to try to alleviate the flooding from John Hardy all the way to the Bayou. As you' ll know how much flooding is happening in that area that is what is driving this. I don' t quite agree with this report. Mr. Errol Domingues stated you' ll want to send the pictures Wayne took with the dates and make sure they are checking the same culverts we are. Mr. Wayne Touchet stated every ditch on John Hardy Drive to the Vermilion River, north of the bypass up to the end of my district and Paul' s district had been cleaned. If water cannot cross the bypass it does absolutely no good. Mr. Errol Domingues stated one of the gentlemen that was carbon copied on the letter was Mr. Randy Abshire, he is the division superintendent located here in Abbeville. Can we petition him to come and explain what culverts and we could personally express our concerns to him? If he wants a field meeting then we can send him with Gary. Upon motion by Mr. Errol Domingues, duly seconded by Mr. Leon Broussard, and unanimously carried, the Police Jury approve to amend the Courthouse Recommendations to add to petition Mr. Randy Abshire to come to the next committee meeting and explain which culverts they are inspecting. President Sagrera stated the meeting that I had with Randy and two other gentlemen at their office, before the letter was sent out, it was discussing them going out and seeing about it. There 7

8 is some areas on 82 in my district that the Drainage Board needed to clean our part before they could go in and clean the ditches. At that meeting they said they were going to go out and inspect everything. This is their report so evidently the inspection may not have gone where we wanted it. Get Mr. Abshire here for the next committee meeting. Upon motion by Mr. Paul Bourgeois, duly second by Mr. Jason Picard, and unanimously carried, the Police Jury approve to accept the Courthouse Committee Recommendations as amended and authorize the appropriate officials to carry out the recommendations. President Sagrera recognized Public Road Committee. PUBLIC ROAD COMMITTEE MAY 30, 2018 ABBEVILLE, LOUISIANA AS A RESULT OF A PARISH ROAD COMMITTEE MEETING HELD ON MAY 30, 2018, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 2. It is recommended the Police Jury approve Final Change Order No. 4, Glenn Lege Construction-Vermilion Parish Detention Center, in a reduction of$ 48, It is recommended the Police Jury approve Partial Payment No. 11, Glenn Lege Construction- Vermilion Parish Detention Center Flood Protection Embankment ( HMGP # ), in the amount of$ 74, Along with the Punch List Invoice in the amount of$ 1, , Sellers & Associates, Inc. 4. It is recommended the Police Jury approve to advertise for bids for road maintenance from June 20, 2018 to December 31, It is recommended the Police Jury approve to grant the lowest bidder, L & R Construction Company, for Phase X-Elliot& Trinity Road Bridge Improvements, with a bid of$118, It is recommended the Police Jury authorize Legal Counsel to give advice on the set back restrictions and how to implement them. 7. It is recommended the Police Jury authorize Mr. Keith Roy to provide input to the farmers at Field Day (Rice Farmers Meeting & Sugar Cane Farmers Meeting). 8. It is recommended the Police Jury approve to fill the vacant Assistant Mechanic Position at Solid Waste. 9. President Sagrera recognized Finance Committee. FINANCE COMMITTEE MAY 30, 2018 ABBEVILLE, LOUISIANA AS A RESULT OF A FINANCE COMMITTEE MEETING HELD ON MAY 30, 2018, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended the Police Jury approve Alicia Motes to receive $ 100 for becoming a Certified Ethics Liaison. 2. It is recommended the Police Jury to approve payment of the attached bills that were submitted. Upon motion by Mr. Jason Picard, duly seconded by Mr. Brent Landry, and unanimously carried, the Police Jury approve to amend the agenda to discuss and consider actions on any new items by the Parish Administrator. Mr. Keith Roy, Parish Administrator, stated Mr. Menard would like to appoint Mr. Mark Comeaux to the Board of the Consolidated Gravity Drainage District No. 2A replacing Mr. Brent Abshire (Term to July 30, 2020). Upon motion by Mr. Cloris Boudreaux, duly seconded by Mr. Sandrus Stelly, and unanimously carried, it is recommended the Police Jury approve to appoint Mr. Mark Comeaux to the Board of the Consolidated Gravity Drainage District No. 2A replacing Mr. Brent Abshire ( Term to July 30, 2020). 9

10 Mr. Keith Roy stated we already submitted a Request for Proposal to Provide Hazard Mitigation Services. We received one bid. With that being said we have to re- announce it so it is going to be run in the Lafayette paper and the Baton Rouge paper June 6th. This means we have to run it for thirty days so we won' t be able to move forward until July 6th. This puts us outside the window because the last one was started on June 26th of So on June 26th of 2018 will be the end of our five years. Between that time there will be no contracted services. A lot of the programs we have now have specific contracts related just to them. As long as those contracts are going all those things will actually be covered according to the state. So all those things will be monitored and will be paid for. This also allows you to hire someone in an emergency without going through the bid process so technically you won' t be out of service. Sellers & Associates, Inc. was the only bid. I wanted to let you know Vermilion Parish Cattlemen' s Association, Inc. Annual Barbecue is scheduled for Saturday, June 16th at the Woodman of the World in Abbeville beginning at 6: 00 p.m. There will be a dance and auction held. I also go a letter for Mr. Wayne LeBleu, Commissioner of Abbeville Harbor & Terminal District, letting us know his time is expired. However, back in May we had a list of positions we were renewing and he was already re-appointed. His letter says that The City and the Parish each submit two names to the board and then the board decides who it is going to be. Mr. Mark Poche' stated did we just submit one back in May? I thought we submitted two because I thought I had submitted Joseph Hebert. Let me resubmit Joseph Hebert and Wayne LeBleu. Upon motion by Mr. Mark Poche', duly seconded by Mr. Ronald Darby, and unanimously carried, it is recommended the Police Jury approve to submit Mr. Joseph Hebert and Mr. Wayne LeBleu for Commissioner of Abbeville Harbor & Terminal District Board. Mr. Keith Roy stated a motion is needed to approve payment of invoice for the month of May 2018, Richland Parish Detention Center, in the amount of$ 2, , in regards to the housing of inmates. Cost to be paid out of General Fund. Upon motion by Mr. Paul Bourgeois, duly seconded by Mr. Dane Hebert, and unanimously carried, it is recommended the Police Jury approve payment of invoice for the month of May 2018, Richland Parish Detention Center, in the amount of$2, , in regards to the housing of inmates. Cost to be paid out of General Fund. Mr. Mark Poche' stated I was with a gentleman who was running for. Sheriff. The city of Morgan City has turned their prison facility into a female holding facility. They entertain female prisoners from other parishes that could be held in overflow. If we want to maybe contact the city of Morgan City for when they do have openings. Mr. Wayne Touchet stated we could maybe request an Intergovernmental Agreement ( IGA) with them for female prisoners. Get prices. 10

11 Mr. Keith Roy stated a motion is needed to approve payment of invoice for the month of May 2018, Jackson Parish Correctional Center, in the amount of$ 3, , in regards to the housing of inmates. Cost to be paid out of General Fund. It is further recommended that the Police Jury authorize Mr. Paul Moresi III, legal Counsel to send letters with the attached checks stating that the Police Jury is not binding itself to any rate by making the payment for the housing of Vermilion Parish inmates. Upon motion by Mr. Mark Poche', duly seconded by Mr. Leon Broussard, and unanimously carried, it is recommended the Police Jury approve payment of invoice for the month of May 2018, Jackson Parish Correctional Center, in the amount of $3, , in regards to the housing of inmates. Cost to be paid out of General Fund. It is further recommended that the Police Jury authorize Mr. Paul Moresi III, legal Counsel to send letters with the attached checks stating that the Police Jury is not binding itself to any rate by making the payment for the housing of Vermilion Parish inmates. President Sagrera recognized Legal Counsel Business, Mr. Moresi. Mr. Paul Moresi, III, Legal Counsel, stated I received a Termination of Lease from Capital One on the Old Hibernia Building. They have already signed it. You have already approved it. I will get the President and Administrator to sign the Resolution. We will get this recorded. At that point the termination of the lease on that old building will be complete and you' ll will be free to do whatever you want. I know you approved an appraisal but I am not sure if it came back yet. Once this is recorded, I will let Keith know and provide him with a copy, you' ll are free to move in whatever direction you want to go. President Sagrera recognizes Police Jury President Business. I have a couple of things. Fishing for Memories is this weekend in Intracoastal City. If you have a chance go out there and support a good cause. Last Tuesday I was in Baton Rouge, they had an Acadiana Planning Commission 11

12 Meeting ( APC) and the Governor spoke about water shed and all of this. The Corps also spoke and they talked about money and trying to get money to do dredging and different things on the Vermilion River. It is just in the beginning stages but it is something we need to keep a pulse on in Vermilion Parish. I said we would have major concerns. We would want to know exactly where they were dredging, what they would be doing and how it would affect us. The Core assured me that they would come and meet with us. I am trying to pull together a meeting with the Mayor of the Village of Maurice, Abbeville and the Corps so we could have this discussion and I would invite any Juror who would want to come once I have that set up. Billy we at Hurricane Season and all that. Do we have our training done to open up a facility? What do we need to do to get certified? Mr. Billy Noegel stated we need volunteers. If they are willing to staff up a building. Mr. Ronald Darby stated I thought we had to use our people first. We are supposed to mandate that for forty-eight hours before Red Cross can come. President Sagrera stated we have a contract on a building but we have to have people trained. That is something we have to look at. Mr. Ronald Darby stated Becky is supposed to set it up because GOSHEP and Red Cross were doing it and they were doing it in Lafayette. They were supposed to do it over here and she said she didn' t have anyone at the time. President Sagrera stated we need to get with Ms. Broussard at the beginning of the week. Upon motion by Mr. Errol Domingues, duly seconded by Mr. Dane Hebert, the Police Jury approve to get with Becky for an update on what we are short to solicit volunteers or personnel we need to put in place for the training. Also, to ask Ms. Broussard to ask Mr. Stelly for assistance. President Sagrera recognizes Police Juror Business. Mr. Ronald Darby stated keep Mr. Kojo and his family in your prayers. It was his grandson who got killed last weekend. We have been having a lot of murders in Abbeville. We had four in the last three months or so. We are trying to come up with a solution to prevent these crimes before they happen. I need the DOTD to try and cut the grass from John Hardy all the way back to State Street on the Westside. Upon motion by Mr. Ronald Darby, duly seconded by Mr. Leon Broussard, and unanimously carried, the Police Jury approve to send a letter to DOTD requesting them to mow on John Hardy from Jacqueline all the way to State Street. Mr. Mark Poche' stated I don' t know what the latest update on the routes are. How many days? Is Zone III finished? Does anybody know? Do we know how many days it took? Mr. Keith Roy stated yes they are done with Zone III. It took about six days. 12

13 Mr. Paul Bourgeois stated, I can say on my end that some things were left. Mr. Errol Domingues stated, I went back Paul the last two days on the eastern end and there were a few piles but I couldn' t tell if they were recently put. They don' t look like they have been there long and I find they did a thorough job. Mr. Paul Bourgeois stated, Charity never got touched and some stuff on John Hardy never got touched. It was scattered throughout. Mr. Mark Poche' stated I don' t know if we will have the ability to do this but it would be nice if at the end of the month we could get a map of our zone and we could prove to our people that they are passing. President Sagrera stated we made a request a couple of meetings ago. Mr. Roy is going to be getting it out for Mr. Noegel to get a report. Get with Mr. Roy, Billy, and he could tell you what we requested and we can see if we can map it. Mr. Errol Domingues stated when we made our first pass. No one zone took ten days. I think in the future we may want to take the ten days. This way if someone cleaned up in that period they know they are there those days.
