1 Police Jury Room January 7, 2013 Abbeville, Louisiana Minutes of a regular meeting of the Vermilion Parish Police Jury held on January 7, 2013, with President Mr. Nathan Granger presiding. The meeting was called to order by Mr. Nathan Granger who asked Mr. Ricky LeBlanc, to lead the group in the Pledge of Allegiance. Following the pledge, the President asked for a moment of silent prayer or reflection. The President then reminded all present to turn all cell phones, pagers, etc. off or set to silent mode for the duration of the Police Jury meeting. Boudreaux Mr. Mark Poche Mr. Kevin Sagrera Mr. Ronald Menard Mr. Ronald Darby Mr. Allen LeMaire Mr. Dane Hebert Absent: Mr. Sandrus Stelly President Granger stated that the first order of business this evening is the election of a President and Vice President for the Police Jury and opened the floor for nominations. Upon motion by Mr. Pervis Gaspard duly seconded by Mr. Paul Bourgeois, unanimously carried opened the floor for nominations. Upon motion by Mr. Wayne Touchet duly seconded by Mr. Pervis Gaspard, unanimously carried, Mr. Nathan Granger was nominated for the position of President of the Police Jury. Upon motion by Mr. Wayne Touchet, duly seconded by Mr. Ronald Darby., and unanimously carried, nominations for the position of President of the Police Jury were closed, and Mr. Nathan Granger was elected by acclamation. President Granger stated that the next order of business is electing a Vice President for the Police Jury and opened the floor for nominations. Upon motion by Mr. Pervis Gaspard duly seconded by Mr. Paul Bourgeois, unanimously carried opened the floor for nominations. Upon motion by Mr. Cloris Boudreaux duly seconded by Mr. Leon Broussard, unanimously carried, Mr. Ronald Menard was nominated for the position of Vice President of the Police Jury. Upon motion by Mr. Pervis Gaspard, duly seconded by Mr. Kevin Sagrera and unanimously carried, nominations for the position of Vice President of the Police Jury were closed, and Mr. Ronald Menard, was elected by acclamation. President Granger then handed out his appointments to the various Police Jury Standing Committees for the 2013 calendar year.

2 Upon motion by Mr. Wayne Touchet, duly seconded by Mr. Kevin Sagrera, and unanimously carried, the Police Jury approved the President Appointments for the 2013 Standing Committees as presented. President Granger read the following announcements: (A) (B) (C) There will be a meeting of the CWPRRA Regional Planning Team for Region IV on January 29, 2013, at the Vermilion LSU Ag Center, located at 1105 West Port Street, Abbeville, La at 11:00am, to propose projects to be included on the 23 rd Priority Project Lost (PPL23). There will be a meeting of the CWPRRA Regional Planning Team for Region III, on January 30, 2013, at the Morgan City Auditorium, located at 728 Myrtle Street, Morgan City, La at 9:00am, to propose projects to be included on the 23 rd Priority Project Lost (PPL23). There will be a meeting of the CWPPRA Task Force on January 24, 2013, at the US Corp of Engineers Office, located at 7400 Leake Avenue, New Orleans, LA at 9:30am., The Task Force may approve Phase II authorization and funding for projects ready to move to construction as well as select PPL 22 projects for Phase I Engineering and Design based upon the Technical Committee s recommendation. (D) Attached is the 2013 scheduled meeting for the following: 1) Coastal Protection Restoration Authority Board 2) Fiscal Year 2014 Draft Annual Plan Public Meetings 3) Governor s Oyster Advisory Committee 4) Governor s Advisory Commission on Coastal Protection, Restoration and Conservation (E) The 39 th Annual Vermilion Parish Jr. Livestock Sale will be held on Saturday, January 19, 2013, at 1:00 p.m., at the Cecil McCrory Exhibit Building, located behind the County Agent s Office at 1105 West Port Street, Abbeville. Upon motion by Mr. Leon Broussard, duly seconded by Mr. Ronald Darby, unanimously carried, the Police Jury approved dispensing of the reading of the minutes of the December 17, 2012 regular meeting, and was accepted as presented. Upon motion by Mr. Errol Domingues, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury approved to amend the agenda to discuss and consider action on any new items presented by Engineering & Architectural reports.

4 President Granger recognized Mr. Eugene Sellers, Sr., with Sellers & Associates, Inc., to present his business to the Jury. Mr. Sellers stated that at the last Committee meeting the Jurors talked about getting quotes for the 3 heaters at the Cecil McCrory Building that are not working, and that he has contacted 3 plumbers regarding this matter and received the following quotes: A. Bertrand Plumbing & Heating $10, B. Miller Roofing $15, Mr. Sellers stated that one of the Contractors did not offer a proposal, and recommends that the Police Jury except the lowest quote received. Upon motion by Mr. Errol Domingues, duly seconded by Mr. Dane Hebert, and unanimously carried, the Police Jury awarded the lowest quote received to Bertrand Plumbing & Heating, in the amount of $10,837.88, relative to the 3 heaters at the Cecil McCrory Building. Mr. Sellers stated that he has received bids for 2012 or Latest Model Track Mounted Long Reach Hydraulic Excavator for the Solid Waste Department, and that Mr. Ricky LeBlanc, Solid Waster Supervisor received some qualifications from the lowest bidder, and recommends that the Police Jury except the lowest bid received from M & L, in the amount of $224,000.00, relative to the Solid Waste Facility or Latest Model Track Mounted for the Solid Waste Long Reach Hydraulic Excavator Department For The Vermilion Parish Police Jury DEALER BID SECURITY BID H & E EQUIPMENT SERVICES $249, DOGGETT MACHINERY SERVICES $279, LOUISIANA MACHINERY COMPANY $275, SCOTT EQUIPMENT COMPANY LLC $244, QUEST CONSTRUCTION EQUIPMENT $241, M & L INDUSTRIES, LLC $224, STATE MACHINERY & EQUIPMENT SALES, INC 234, CLM EQUIPMENT CO., INC $270, Upon motion by Mr. Pervis Gaspard, duly seconded by Mr. Cloris Boudreaux, and unanimously carried, the Police Jury awarded the lowest bid to M & L, in the amount of $224,000.00, relative to the purchase of a 2012 or Latest Model Track Mounted Long Reach Hydraulic Excavator for the Solid Waste Department.. Mr. Sellers informed the jury that the landfill is down, and that the excavator is broke, furthermore, Mr. Sellers stated he has contacted M & L, and was informed that they have a piece of equipment that they can deliver within 30 days, but it has a Two Way Hydraulic option on the equipment, in the amount of $5,864.00, with additional freight cost at $

5 Mr. Sellers recommends that a Change Order #1 be issued to add the Two Way Hydraulic option in the amount of $5, with freight in the amount of $ Upon motion by Mr. Leon Broussard, duly seconded by Mr. Errol Domingues, and unanimously carried, the Police Jury approved a Change Order #1 to add Two Way Hydraulic in the amount of $5, with additional freight in the amount of $800.00, and to purchase the extended warranties, relative to 2012 or Latest Model Track Mounted Long Reach Hydraulic Excavator for the Solid Waste Department. Mr. Sellers stated that he has received bids for at a previous meeting for the Bus Garage and Diesel Generator at the Council on Aging, the bids were over the budget, and the State does not have any additional funds available, and they are recommending that the jury change the scope of the project and re-advertise. Upon motion by Mr. Ronald Menard, duly seconded by Mr. Ronald Darby, and unanimously carried, the Police Jury approved to reject the bids that were received on November 30, 2012, and authorize Sellers & Associates, Inc. to re-advertise the Bus Garage and Diesel Generator for the Vermilion Counsel on Aging. Upon motion by Mr. Errol J. Domingues duly seconded by Ronald Menard, with Mr. Nathan Granger, abstaining, the Police Jury approved a Letter of No Objection to PetroQuest Energy, LLC., to install 17 piling clusters to prevent potential marine accidents and damage to neighboring camps and docks within an existing slip, located ±8 miles south of Delcambre on Oaks Canal between Intracoastal Waterway and Vermilion Bay, in Election District No. 8. Upon motion by Mr. Pervis Gaspard duly seconded by Mr. Cloris Boudreaux, with Mr. Kevin Sagrera, abstaining, the Police Jury approved Permit No P, to Dunn Exploration Company, LLC, in Section 14, T-12-S, R-02, approximately 6 miles west of Abbeville off Veterans Memorial Drive, west of Red Road to install approximately feet of 2-4 inch flowline to serve Duhon 1-3 RB SUA; Winston Foreman Well No. 1ALT previously permitted under 2012/1703-D, in Election District No. 13. Mr. Granger at this time recognized Standing Committees to be presented. Mr. Ronald Darby asked if there were any changes or amendments to the Public Works Committee to be presented. Upon motion by Mr. Errol Domingues, and second by Mr. Ronald Darby, and unanimously carried, the Police Jury amended Item #2 of the Public Works Committee Recommendations to add Grade 9, Step 11. Upon motion by Mr. Ronald Darby, and second by Mr. Kevin Sagrera, and unanimously carried, the Police Jury accepted the Public Works Committee Recommendations as amended, and the appropriate officials were authorized to carry out the recommendations. PUBLIC WORKS COMMITTEE JANUARY 2, 2013 ABBEVILLE, LOUISIANA AS A RESULT OF A PUBLIC WORKS COMMITTEE MEETING HELD ON JANUARY 2, 2013, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY S CONSIDERATION:

6 1. It is recommended that the Police Jury grant a variance to Mr. Randall White in accordance with Ordinance No O-37, page 2, Section 8, (C). 2. It is recommended that the Police Jury transfer Mr. Nolan Borel, from part-time to full time Larvicider, for the Public Works Department. 3. It is recommended that the Police Jury approve hiring Mr. Johnny Clarence Levine, as an Animal Warden at the Rabies & Animal Control Facility, contingent upon passing all Per-Employment requirements, at a Grade 9, Step It is recommended that the Police Jury authorize the Solid Waste Supervisor to purchase from Rexnord Conveying Equipment LLC, 200 Rollers, 200 Roller Bushings, and 100 Washers, in the amount of $31,867.00, relative to the Solid Waste Facility mill conveyor system. 5. It is recommended that the Police Jury approve sending a letter to Mr. George Putnam, relative to trees on the side of Hwy It is recommended that the Police Jury authorize the Solid Waste Supervisor to purchase 100 NUWAVE 4 cubic yard dumpster covers, from Hedstrom Plastic, in the amount of $3, with unknown freight. 7. It is recommended that the Police Jury authorize the Parish Administrator to advertise for the Animal Control Clerk Position at the Rabies & Animal Control Facility. 8. It is recommended that the Police Jury authorize President Nathan Granger to sign for a Class B Permit application to the State Land Office, for the Shoreline Protection & Marsh Creation at Tiger Point Project. 9. It is recommended that the Police Jury award the only quote received to Mr. Donnie Derouen Electrical Service, Inc, in the amount of $1,990.00, to run the electricity to the heating units located at Cecil McCrory Building. 10. It is recommended that the Police Jury nominate Mr. Gene Sellers with Sellers & Associates, Inc. to represent the Vermilion Parish Police Jury on the Ground Water Resources Commission. 11. It is recommended that the Police Jury approve sending a letter to VFIS, relative to issuing all claim checks to the Vermilion Parish Police Jury and identify claims by fire departments and/or districts. 12. It is recommended that the Police Jury adopt Amendment No. 4 to Ordinance 2008-O-37, in reference to the Animal Control. 13. It is recommended that the Police Jury adopt Ordinance No O-01, relative Prohibiting Animals Roaming at Large in the Parish. 7 AMENDMENT NO. 4 ORDINANCE 2008-O-37 AN ORDINANCE AMENDING ORDINANCE 2008-O-37 REGULATING ANIMAL CONTROL IN VERMILION, LOUISIANA BE IT ORDAINED by the Police Jury of Vermilion Parish, in regular session convened on this 7th day of January, 2013, proceeding under its police power pursuant to the laws of the State of Louisiana, that the Vermilion Parish Police Jury hereby amends the Parish Ordinance No O-37 relative to animal control in Vermilion Parish, Louisiana. BE IT FURTHER ORDAINED that it is the desire of the Vermilion Parish Police Jury to amend Ordinance No O-37 to AMEND. the following Articles and Sections of said ordinance to have same read as follows: WHEREAS, the Parish of Vermilion has experienced and continues to experience a population growth with a corresponding growth in its pet animal population, and WHEREAS, the Parish of Vermilion recognizes its responsibility to promote responsible pet ownership and to uphold the care and custody of pet animals in the interest of public health, safety and welfare. WHEREAS, the Parish of Vermilion recognizes a need for an Ordinance providing for the registration and immunization against rabies, with an approved anti-rabies vaccine of all dogs and cats in Vermilion parish: providing that such immunization must be performed once a year: providing proper means of identifying dogs or cats so immunized: providing that dogs and cats not immunized and properly tagged may be impounded: That on failure of owner to redeem impounded dog or cat and pay impounding fees, as well as immunization fee within the time provided the dog or cat shall be destroyed, and also that any animal that has bitten a human being or any or animal that is a rabies carrier shall be impounded as specified by the parish board of health: providing a penalty for willfully or negligently allowing a dog or cat not immunized and properly tagged to run at large: providing for the effective date of this ordinance. Repealing all ordinances or parts of ordinances in conflict herewith. ARTICLE I. DEFINITIONS S. PET ANIMAL: Any dog or cat owned or kept by a person for companionship or protection or for sale to others for such purposes. U. NUISANCE ANIMAL OR STRAY: Any pet animal that is at large, has not been spayed or neutered, or is a vicious dog. ARTICLE II - ADMINISTRATION AND ENFORCEMENT A. Enforcement Personnel: 1. The office of Vermilion Parish Animal and Rabies Control, through the Vermilion Parish Police Jury is recognized as the entity with continuing jurisdiction over pet animal and rabies control within the Parish of Vermilion, La. Vermilion Parish Animal Control Officers, along with

8 law enforcement officers and shall be charged with all duties, including the issuing of verbal and written warnings, pertaining to the enforcement of ordinances regulation or controlling the keeping of pet animals within the parish for the purpose of performing such function. 2. Whenever a Vermilion Parish Animal Control Officer has probable cause to believe that a violation of this Ordinance has occurred, the Animal Control Officer may issue a warning or contact law enforcement to summons and complaint to the violator, stating the nature of the violation with sufficient particularity to give notice of said charge to the violator. Animal Control Officers, along with law enforcement officers, shall enforce all of the provisions of this Ordinance as set forth herein and shall take up and impound any pet animal authorized to be impounded by Vermilion Parish Ordinances and/or any provision of law. B. Right of Entry Granted: 1. Animal Control Officers are hereby authorized to enter upon any premises in the Parish, (excluding a dwelling), for the purpose of impounding pet animals which they are authorized herewith to impound, or for any other purpose authorized by this Ordinance or by law. ARTICLE IV - CONTROL OF ANIMALS F. Animal Curbing Requirements: 1. No person shall knowingly allow an pet animal which is kept by that person to urinate upon private property or defecate upon a public street, right of way, public or private property, without the prior permission of the owner; however, it shall be a defense to said violation if, a. when a pet animal defecates on property described in this subsection, the pet animal s owner or keeper immediately shall remove any feces to a waste container, b. if the pet animal is serving a vision impaired person in any capacity to assist such person with a physical impairment; 3. No person shall allow his or her pet animal to disperse waste material placed for public or private collection upon any public street, right of way, or upon any public or private property. H. Abandonment of Animals: It shall be unlawful for a person to abandon any pet animal on any public or private property in the Parish. ARTICLE V- IMPOUNDMENT AND RECLAMATION A. Authorization for Capture and Impoundment: In addition to the authority to issue warnings, summons and citations in conjunction with local law enforcement (police departments and/or Vermilion

9 Parish Sheriff), Animal Control Officers are hereby further authorized to take or capture pet animals deemed by them to be included in the categories listed below, and to impound them at Vermilion Parish Animal and Rabies and Control Facility or other appropriate location where the animals will be confined in a humane manner. Such officers may utilize such means as is necessary in order to capture a pet animal which appears to be vicious or is not able to be captured in any other humane manner. The officer may destroy such pet animal if necessary to avoid a physical threat to human beings: 1. Small nuisance animals. 2. Pet animals at large, mistreated, or abused. 3. Pet animals that constitute a safety or health hazard. 4. Pet animals which were being transported by a person involved in a vehicular accident when such person becomes unable to care for or maintain control over the animal as a result of the accident and there is no responsible person present to take possession of the pet animal. 5. Pet animals that will apparently be and have been left uncared for as a result of the death, arrest, detention or other incapacitation of the owner or keeper BE IT FURTHER ORDAINED that all other provisions of Ordinance No O-37, and any amendments thereto, shall remain the same. This amendment having been submitted in writing, having been read and adopted at a public meeting of the Police Jury of the Parish of Vermilion, State of Louisiana was then submitted to an official vote as a whole, the vote was thereon being as follows: YEAS: Mr. Nathan Granger, Mr. Ronald Menard, Mr. Dane Hebert, Mr. Errol J. Domingues, Mr. Allen LeMaire Mr. Kevin Sagrera, Mr. Ronald Darby, Mr. Pervis Gaspard, Mr. Wayne Touchet, Mr. Cloris Boudreaux, Mr. Mark Poche, Mr. Paul Bourgeois, Mr. Leon Broussard NAYS: ABSENT: Mr. Sandrus Stelly O R D I N A N C E 2013-O-01 AN ORDINANCE PROHIBITING ANIMALS ROAMING AT LARGE IN VERMILION PARISH, LOUISIANA WHEREAS, there is a need to protect the public safety, health and welfare of the citizens of the Parish of Vermilion in regards to the hazards associated with animals roaming at large within the Parish of Vermilion, Louisiana; and

10 NOW THEREFORE, BE IT ORDAINED by the Police Jury of Vermilion Parish, in regular session convened on this 7 th day of January, 2013, that the Vermilion Parish Police Jury adopt Parish Ordinance No O-01 in the following specific: SECTION 1: Definitions Animal means any living, vertebrate creature, domestic or wild, except human beings. At Large means any animal not physically controlled by a human being by means of a leash or lead held by the human being, or not at all times accompanied by a persona and does not at all times immediately respond to sound, mechanical, electrical or other command of its accompanying person. Exception are: a dog while actually working livestock, locating or retrieving wild gamin in season for licensed hunter, assisting law enforcement officers or while actually being trained for any of these specifically enumerated pursuits, and an animal that is physically or electronically secured within the confines of the real property of its owner or keeper or other real property that the owner or keeper has permission to use or is within a motor vehicle (excluding an unleashed animal in an open bed of a truck). SECTION: 2: Animals Roaming at Large Prohibited SECTION 3: Enforcement It shall be unlawful for any person, including but not limited to the owner and/or possessor of any animal to allow same to be at large in the Parish of Vermilion, Louisiana. The provisions of this Ordinance shall be enforced by the Sheriff of Vermilion Parish, Louisiana. SECTION 4: Repeal of Conflicting Ordinances All ordinances or resolutions or parts thereof in conflict herewith are hereby repealed. SECTION 5: Severability Should any part of this ordinance be declared null, void, invalid, illegal or unconstitutional, the remainder of the said ordinance shall remain in full force and effect. SECTION 6: Effective date This ordinance shall become effective upon the signature of the President of the Vermilion Parish Police Jury. Mr. Dane Hebert asked if there were any changes or amendments to the Finance Committees Recommendation to be presented.

11 Upon motion by Mr. Dane Hebert, duly seconded by Mr. Kevin Sagrera, and unanimously carried, the Police Jury approved the Finance Committees Recommendation, as presented, and the appropriate officials were authorized to carry out the recommendations FINANCE COMMITTEE JANUARY 2, 2013 ABBEVILLE, LOUISIANA AS A RESULT OF A FINANCE COMMITTEE MEETING HELD ON JANUARY 2, 2013, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY S CONSIDERATION: 1. It is recommended that the Police Jury approve payment of the following invoices to Primeaux, Touchet, & Associates, LLC, relative to professional services provided: A. Invoice No Capital Improvements Program, Road & Bridge Improvements, Phase V, East Villien Road, Crabapple Road, and Noah Road Bridges, F P & C Project No. 50-J Date: 12/18/12 Amount = $5, Cost to be paid from Royalty Road Funds B. It is recommended that the Police Jury approve payment of Invoice No , to Dennis Lawn Care Services, in the amount of $500.00, relative to Ordinance No O-09, cleaning property identified as 8820 Oak Crest Lane Lot # It is recommended that the Police Jury approve Invoice No , to Miller Roofing LLC, in the amount of $3,800.00, relative to the replacement of a door frame located at the Vermilion Parish Solid Waste Facility. Cost to be paid from 94 Sales Tax Funds. 5. It is recommended that the Police Jury approve payment of Invoice No. 3780, to The Sellers Group, in the amount of $1,075.46, relative to professional services for the observation of construction for the Vermilion Parish Wind

12 Retrofit Hazard Mitigation Grant Program, for the Hardening of the Vermilion Parish Courthouse Annex and Sheriff s Deputy Task Force Building. 6.
