1 Police Jury Room September 15, 2003 Abbeville, Louisiana Minutes of a regular meeting of the Vermilion Parish Police Jury held on September 15, 2003, with Vice-President Ritter Trahan presiding. The following members were present: Mr. Purvis Abshire Mr. Terry Bessard Mr. Ernal "E. J." Prejean, Jr. Mr. Ritter Trahan Absent: Mr. Edval Simon, Jr. Upon motion of Mr. Ernal "E. J." Broussard, duly seconded by Mr. Carroll Duhon, and unanimously carried, the reading of the minutes of the September 2, 2003 meeting were dispensed with and were accepted. The Vice-President announced that the next item on the agenda was for the Vermilion Parish Police Jury, acting as the Parish Board of Review, to hear any protests dealing with the 2003 assessment values established by the Assessor s Office. The Secretary advised the Board of Review that a written protest had been received from Jordan Oil Company, Inc., but that it had since been withdrawn. The Vice-President then called on Vermilion Parish Assessor Mike Langlinais. Mr. Langlinais advised the Jury that Seminole Pipeline will be attempting to protest directly to the State Tax Commission regarding a pipeline they purchased. They are wanting to claim a value of $100,000, but the property has been assessed for $500,000 by the Assessor s Office. Mr. Langlinais then gave a report of the assessment values established for He commented on changes in each ward observed during this year s assessment review. His office provided documentation for each city s and/or ward s gain or loss compared to There was an overall increase in assessment value in the parish for 2003 based on the combination of real and movable property and public service property. Upon motion of Mr. Hubert Faulk, duly seconded by Mr. Minos Broussard, and unanimously carried, the Jury accepted the following assessment valuations for the 2003 Tax Year as submitted by Assessor Michael Langlinais:

Real Property $116,049,240 $113,435, Personal Property $108,628,740 $106,698,400 TOTAL $224,677,980 $220,133,760 The Vice-President then invited Mr. Francis Plaisance, President of the Vermilion Cattle Festival Association, to present his business at this time. Mr. Plaisance commented on the upcoming festival activities, invited the Jurors to attend and participate in the Festival and thanked the Police Jury for moving the voting precinct from the Courthouse to the Hibernia Bank Building. Mr. Plaisance requested the use of the 2 nd floor balcony on the east side of the courthouse as a reviewing stand for Festival Corporate Sponsors, only. Upon motion of Mr. Louis Joe Hardy, duly seconded by Mr. Terry Bessard, and unanimously carried, the Police Jury approved the request of the Vermilion Cattle Festival Association to use the Courthouse Balcony on the eastside during the parade for corporate sponsors, only. The Vice-President then invited Mrs. Beverly B. LeBlanc to present her business at this time. Mrs. LeBlanc requested the Police Jury to proclaim September 25, 2003 as Ataxia Awareness Day in Vermilion Parish. Upon motion of Mr. Kenneth DeHart, duly seconded by Mr. Carroll Duhon, and unanimously carried, the Police Jury approved proclaiming September 25, 2003 as Ataxia Awareness Day in Vermilion Parish, and authorized the President /Vice-President to sign the proclamation. The Vice-President then invited Mr. Carl Turnley with Kaplan Telephone Company to present his business at this time. Mr. Turnley advised that his company wants to provide cable TV service to the areas in and around the Kaplan area which comprises parts of Election Districts 10, 11, 12 & 13. To do so requires, the Police Jury to advertise for a non-exclusive franchise. Upon motion of Mr. Purvis Abshire, duly seconded by Mr. Ernal "E. J." Broussard, and unanimously carried, the Police Jury authorized advertising for a non-exclusive cable television franchise for the area intended to be served as noted above. Upon motion of Mr. Terry Bessard, duly second by Mr. Mark Poche, and unanimously carried, the Police Jury amended the Agenda to allow Ms. Janice Macomber to present her business at this time.

3 Regarding the recent voting precinct changes, Ms. Macomber had concerns about notification given to voters in Precincts 35 and 34. She was advised that letters would be sent to registered voters in those precincts regarding the change. She also expressed concern about recent precinct consolidations and changes made to precinct locations. She was advised that consolidation of precincts are required when one precinct has less than 300 registered voters. She also inquired whether voter parking had been addressed at the Hibernia Bank during the time of the parade. She was advised by Mr. Plaisance that the Cattle Festival Association had addressed the problem with the Clerk of Court and they intend on having personnel stationed at the bank to maintain a parking area for persons wanting to vote. Vice-President Ritter Trahan then read the following announcement: (1) The Beauregard Parish Police Jury will be the host of the 49 th Annual Meeting of the 7 th Region of the Louisiana Police Jury Association which will be held on Saturday, September 27, 2003, at the VFW-Post 3619 building in Deridder. Registration and social hour will begin at 4:30 p.m., followed by a business session and meal. Mrs. Liz Girouard, with Sellers and Associates, Inc. presented the following business for the Police Jury s consideration. Upon motion of Mr. Pervis "Pee Wee" Meaux, duly seconded by Mr. Louis Joe Hardy, and unanimously carried, the Police Jury approved the issuance of Permit No WL to Southeast Waterworks District No. 2 to install and maintain a 3-inch water line on Lynn Drive in Elie Addition Subdivision in Election District No. 5. By same action, the Police Jury approved the issuance of Permit No D to Summit Energy Company, LLC, to install a board road and to drill and maintain their well site located off La. Hwy 339, north of Erath in Election District No. 3. Regarding the LCDBG 2004/2005 Funding Cycle, Mrs. Girouard advised that an application can be developed to do Road Improvements for qualifying roads located in Election Districts 2, 3 and 11. Two (2) areas can be included in one application. The Police Jury is eligible to apply for two (2) applications. The Secretary-Treasurer asked the Jury to consider applying for a community services center which would house things like the health unit and other health care programs. Police Jury could apply for up to $800,000. A preliminary meeting with LCDBG officials would need to be held to see if the project would be considered for funding.

4 Upon motion of Mr. Ernal "E. J." Broussard, duly seconded by Mr. Pervis "Pee Wee" Meaux, and unanimously carried, the Police Jury authorized having a preliminary meeting to apply for LCDBG funds for a community services building. Upon motion of Mr. Kenneth DeHart, duly seconded by Mr. Luther "Buster" Hardee, and unanimously carried, the Police Jury approved the abandonment of a drainage easement on the last lot located on the west side in Windy Hills Subdivision, since it serves no public purpose. Relative to the 2003 Road Improvements Project, Mrs. Girouard advised the Police Jury that H & S Construction, Inc. would be moving back into the Parish tomorrow (Tuesday). Upon motion of Mr. T. J. Prejean, Jr., duly seconded by Mr. Minos Broussard, and unanimously carried, Item No. 7 of the Public Road Committee Recommendations was amended to add the following state highway driveway permit installations: C) Shirley Monceaux La. Hwy 89 D) Mathias W. Saltzman La. Hwy 14 E) Farley Painter La. Hwy 35 Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Kenneth Dehart, and unanimously carried, the Public Road Committee Recommendations were further amended to accept the naming of a private road as C. Savoie Private Lane, located off of Woodlawn Road, and authorizing Sellers & Associates, Inc. to plot the road on the parish road system map and that the 911 Communications District Office be advised of the new private road location. Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Public Road Committee Recommendations were further amended to adopt an ordinance establishing a 3-Way Stop at the intersection of Pine Street and Texas Street. Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Public Road Committee Recommendations were approved as amended, and the appropriate officials of the Jury were authorized to carry out the recommendations; PUBLIC ROAD COMMITTEE SEPTEMBER 9, 2003 ABBEVILLE, LOUISIANA AS A RESULT OF A PUBLIC ROAD COMMITTEE MEETING HELD ON SEPTEMBER 9, 2003, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY S CONSIDERATION:

5 1. It is recommended that Sellers and Associates, Inc. be authorized to prepare a Capital Outlay Application to construct a truck bypass route in the area of the Town of Gueydan. Cost to prepare the application is to be paid from Road District No. 1 funds. 2. It is recommended that the culvert beautification project at 2311 Barton Street be authorized to be installed. 3. It is recommended that an ordinance be adopted establishing a No Trucks Allowed zone on Allen Road. The zone is to be from 1,400 north of Cedric Road and 1,600 south of Cedric Road. It is further recommended that efforts be made to route traffic to La. Hwy 92 for ingress and egress to the dirt pit location. 4. It is recommended that Sellers and Associates, Inc. be authorized to do a drainage study to verify the culvert size needed for a beautification project for Howard Cormier on Cheneau Road. Costs of the study to be paid from Road District Sub 4 of 2 funds. 5. It is recommended that the afternoon of Friday, October 3, 2003 be declared a holiday for all Police Jury employees. 6. It is recommended that Sterling St. Julien be hired as a CDL Truck Driver assigned to the FRS and Parishwide crew. 7. It is recommended that the following state highway driveway permit installations be approved: A) Entergy La. Hwy 14 (Erath area) B) Terry Benoit La. Hwy It is recommended that Invoice No from Louisiana Testing & Inspection, Inc. in the amount of $ be approved to be paid. Invoice represents testing work done relative to the 2003 Road Improvements Project. Costs to be prorated to the respective road maintenance districts. 9. It is recommended that the Police Jury issue a letter of no objection to Kaplan Telephone Company, Inc. to construct a tower on Arthur Bourgeois Road, subject to the normal conditions being met (beacon light, building permit, etc.). 10. It is recommended that Invoice No from Sellers and Associates, Inc. in the amount of $ be approved to be paid. Invoice represents engineering services provided relative to their review of the seismic permit application for Seismic Exchange Inc. for the Catapult Phase 2 project.

6 11. It is recommended that the Police Jury accept into the parish road maintenance system the extension of Honeyman Road for a distance of 2,528 feet, subject to the paperwork being in order. 12. It is recommended that Sellers and Associates, Inc. be authorized to prepare a Rural Development Grant application to do drainage improvements in the Pecan Island area at a cost of approximately $20, Application to include charges for a COE/CU permit, engineering fees, and construction costs. 13. It is recommended that the Police Jury amend the following project permits to allow for the use of SDR 17 HDPE pipe, in lieu of SDR 11 HDPE pipe: A) Permit No WL B) Permit No WL 14. It is recommended that the invoices shown on the attached sheets be approved to be paid. 15. OF ROAD #7: Acadiana Shell Co $ 1, In accordance with the Public Road Committee Recommendations, the following ordinances were adopted: O R D I N A N C E 2003-O-17 WHEREAS, it has been brought to the Police Jury s attention that a very hazardous and dangerous condition exists at the intersection of Pine Street and Texas Street; and SECTION I: SECTION II: NOW THEREFORE, BE IT HEREBY ORDAINED, that the Vermilion Parish Police Jury does hereby impose a 3-way stop at said intersection; and BE IT HEREBY FURTHER ORDAINED, that the appropriate stop signs be installed in said area. SECTION III: BE IT HEREBY FURTHER ORDAINED, that a maximum penalty of $ and/or a 10 day jail sentence may be imposed at the discretion of the court.

8 SECTION IV: BE IT HEREBY FURTHER ORDAINED, that Honorable Sheriff Raywood Lemaire be and is hereby requested and/or directed to enforce the stop signs by the use of regular patrolling. * * * * * * * * * O R D I N A N C E 2003-O-18 WHEREAS, it has been brought to the Police Jury s attention that a considerable amount of heavy vehicles are passing on Allen Road and causing very hazardous conditions as well as an imposition and abuse; and SECTION I: SECTION II: NOW THEREFORE, BE IT HEREBY ORDAINED, that the Vermilion Parish Police Jury does hereby impose a No Trucks Allowed zone on said road, from 1400 north of Cedric Road and 1,600 south of Cedric Road; and BE IT HEREBY FURTHER ORDAINED, that the appropriate signs installed in said area. SECTION III: BE IT HEREBY FURTHER ORDAINED, that a maximum penalty of $ and/or a 10 day jail sentence may be imposed at the discretion of the court. SECTION IV: BE IT HEREBY FURTHER ORDAINED, that Honorable Sheriff Raywood Lemaire be and is hereby requested and/or directed to enforce the speed limit by the use of radar and/or regular patrolling. * * * * * * * * * Upon motion of Mr. T. It is recommended that the Louisiana State Police Office be requested to attend the next Police Jury meeting. 4. Broussard, and unanimously carried, Item No. 5 of the Courthouse (Building) Committee Recommendations was amended to correct the contract time to reflect a total of 30 days instead of 25 days. TO COX COMMUNICATIONS LOUISIANA, L.L.C. WHEREAS, Telecable Associates, L.L.C., d/b/a Cox Communications ( Franchisee ) owns, operates, and maintains a cable system (the System ) in Vermilion Parish, Louisiana pursuant to a cable franchise (the Franchise ) issued by the Vermilion Parish Police Jury (Franchising Authority), and Franchisee is the duly authorized holder of the Franchise;

19 WHEREAS, pursuant to a series of transactions among Franchisee and affiliated entities of Franchisee (the Transactions ), Cox Communications Louisiana, L.L.C. ( Cox ) will acquire the assets of Franchisee used in the operation of the System, including the Franchise; and WHEREAS, Franchisee and Cox have filed an FCC Form 394 with the Franchising Authority; NOW, THEREFORE BE IT RESOLVED BY VERMILION PARISH POLICE JURY, AS FOLLOWS: Section 1. The Franchising Authority, in accordance with the terms of the Franchise, hereby consents to and approves the Transactions and the resulting transfer and assignment of the System, including the Franchise and all rights thereunder, from Franchisee to Cox. Section 2. The Franchising Authority confirms that, to the best of its knowledge, (a) the Franchise was properly granted and/or been transferred to Franchisee, and is in full force and effect; and (b) Franchisee is materially in compliance with the provisions of the Franchise and there exists no fact or circumstance known to the Franchising Authority which constitutes or which, with the passage of time or the giving of notice or both, would constitute a material default or breach under the Franchise, or would allow the Franchising Authority to cancel or terminate the rights thereunder. Section 3. The Franchising Authority hereby agrees not to unjustly withhold consent to any subsequent transfer of the Franchise or control related thereto to any entity controlling, controlled by, or under common control with Cox, pending notification and review of documents relating to said transfer. Section 4. The Franchising Authority subject to the conditions of the original franchise agreement hereby consents to and approves the assignment, mortgage, pledge, or other encumbrance, if any, of the Franchise and the System as collateral for a loan. Section 5. This Resolution shall be deemed effective upon the closing date of the Transactions. Section 6. This Resolution shall become part of the original franchise agreement with Franchisee and Cox, and the Franchising Authority shall not revoke, amend or otherwise alter this Resolution without due notice given to Franchisee and Cox. Hwy 92, in view of the land owners having changed their minds about the proposed development. Relative to the lawsuit filed by H. Taylor vs. VPPJ suit, the Police Jury has been advised by the insurance company that the case has been settled and that the balance of the deductible is due. Upon motion of Mr. Mark Poche, duly seconded by Mr. Pervis "Pee Wee" Meaux, and unanimously carried, the Police Jury approved payment of the amount of $18,710.13, which represents the balance of the deductible.

21 Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. Hubert Faulk, and unanimously carried, the Police Jury approved sending a conditional letter of support for the creation of a new coalition to address coastal erosion, to be named Parishes Against Coastal Erosion. The concern is that too many groups are being named which would water down the effectiveness of the program needs. Upon motion of Mr. Mark Poche, duly seconded by Mr. Ernal "E. J." Broussard, and unanimously carried, the Police Jury, at the request of its legal counsel, Paul Moresi, III, went into executive session to discuss the Mia Nolan, et al vs. The Vermilion Parish Police Jury, et al litigation, (Docket #79373) at 7:45 p.m. Upon motion of Mr. Minos Broussard, duly seconded by Mr. Purvis Abshire, and unanimously carried, the Police Jury returned to its regular agenda at 7:52 p.m. Mr. Moresi advised the Police Jury regarding various items that he had been requested to address: Relative to the request to obtain an Attorney General s Opinion regarding the LeBlanc Fire Department s request to pursue a grant which would provide a fire truck for a three (3) year period and would have private company advertisements shown on the vehicle. Representative Mickey Frith has already requested this opinion. Mr. Moresi will request the Attorney General s Office to provide him with a copy once it is sent to Representative Frith. Relative to the Parish Rabies Control Ordinance, Mr. Moresi is currently in the process of comparing it to the state statute. Regarding the parish noise ordinance, he has compared it to the Lafayette Parish ordinance. Their ordinance is very detailed and requires monitoring equipment. He asked the Jury if they still wanted to pursue a stricter ordinance. The Jury advised him to draft an updated ordinance that is easily enforceable. Relative to the City of Abbeville s request to require a special permit to construct anything over forty (40) feet in height located near the airport flyway, he has some concerns about the implementation of such an ordinance and will be meeting with the City Attorney to discuss it in more detail. Mr. Kenneth Dehart inquired about whether the State Police had been contacted about attending tonight s meeting. He was advised that the contact could not be made. Mr. Purvis Abshire inquired if an ordinance existed pertaining to junk vehicles located on private property. Mr. Bertrand advised that he will research files to see if such an ordinance exists.

22 Mr. Bob LeBlanc, Director of the V.P. Office of Emergency Preparedness, commented on possible funding sources to relocate his office. Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Mark Poche, and unanimously carried, the Police Jury referred the matter to the next Courthouse/Building Committee meeting.
