1 Police Jury Room September 16, 2002 Abbeville, Louisiana Minutes of a regular meeting of the Vermilion Parish Police Jury held on September 16, 2002, with Mr. Edval Simon, Jr. presiding. The following members were present: Mr. Purvis Abshire Mr. Terry Bessard Mr. Ernal "E. J." Upon motion of Mr. Ritter Trahan, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Jury closed the receipt of all bids for tonight s meeting. Upon motion of Mr. Minos Broussard, duly seconded by Mr. Purvis Abshire, and unanimously carried, the Jury authorized the opening of the following bids: 2002 OR NEWER MODEL ECONOMY / MID-SIZE PICKUP TRUCK FOR THE PUBLIC WORKS PROGRAM Bay City Ford - $13, Frenzel Motors - $13, Upon motion of Mr. Kenneth DeHart, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury authorized the award of the contract to furnish the above to the low bidder, Bay City Ford. President Edval Simon, Jr. welcomed Mr. Joseph Miller and Ms. Peggy Matthews with the American Legion and Ladies Auxiliary to present their business at this time. Mr. Miller advised the Police Jury that Vermilion Parish is the only parish in the state that has a Parish Government Day Program for high school students and asked for continued support. The next Parish Government Day will be held on February 6, & 7, 2003.

2 Upon motion of Mr. Ritter Trahan, duly seconded by Mr. Carroll Duhon, and unanimously carried, the Police Jury authorized the continued support of the Parish Government Day Program. The President then called on Vermilion Parish Assessor Mike Langlinais. Mr. Langlinais advised the Jury that he had not been made aware of any protests. The Secretary- Treasurer also advised the Police Jurors that no protests had been submitted to the Administrative Office. Mr. Langlinais then gave a report of the assessment values established for He commented on changes observed during this year s assessment review. His office provided documentation for each city s and/or ward s gain or loss. There was an overall increase in assessment value in the parish for 2002 based on the combination of real and movable property and public service property. Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Luther "Buster" Hardee, and unanimously carried, the Jury accepted the following assessment valuations for the 2002 Tax Year as submitted by Assessor Michael Langlinais: 2002 Values 2001 Values 1. Real Property $113,435,360 $109,250, Personal Property $106,698,400 $112,228,830 TOTAL $220,133,760 $221,479,340

4 Upon motion of Mr. Purvis Abshire, duly seconded by Mr. Hubert Faulk, and unanimously carried, the reading of the minutes of the September 3, 2002 meeting were dispensed with and were accepted. President Edval Simon, Jr. read the following announcements: (1) Received Notice that the next meeting of the Louisiana Wetlands Conservation and Restoration Authority will be held on Thursday, October 10 at 9:30 a.m. in the Louisiana Room at the Department of Wildlife & Fisheries. (2) Received a copy of a resolution from Concordia Parish endorsing Mr. Charlie Blaney for re-election as a Member-At-Large on the Executive Board of the Police Jury Association of Louisiana, and requesting the Police Jury s support of his candidacy. Mrs. Liz Girouard, with Sellers & Associates, Inc. presented a report from the 4 th Annual Household Hazardous Waste Collection Day along with the following for the Jury s consideration. Upon motion of Mr. Minos Broussard, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury gave final approval of Lahasky Subdivision subject to receipt of the revisions to the Act of Dedication and receipt of Final Plat Review fees. Upon motion of Mr. Minos Broussard, duly seconded by Mr. Pervis "Pee Wee" Meaux, and unanimously carried, the Police Jury approved the issuance of a letter of no objection to Omega Protein Corporation for maintenance dredging of the channels, boat slips and Vermilion in the are of the existing Menhaden processing facility. Upon motion of Mr. Minos Broussard, duly seconded by Mr. Pervis "Pee Wee" Meaux, and unanimously carried, the Police Jury approved the issuance of a letter of no objection to McAlester Fuel Company for the installation of approximately 100-feet of two (2) 6-inch flow-lines, two (2) barges and a 100-foot walkway to produce the SL No. 2 Well in Vermilion Bay. Upon motion of Mr. Minos Broussard, duly seconded by Mr. Pervis "Pee Wee" Meaux, and unanimously carried, the Police Jury approved the issuance of a letter of no objection to the Louisiana Department of Wildlife and Fisheries to dredge in the Vermilion Bay and then deposit the dredged material in an existing pipeline canal to prevent breaching of a tidal pass across the Lake Portage land bridge. Upon motion of Mr. Hubert Faulk, duly seconded by Mr. Purvis Abshire, and unanimously carried, Item No. 12 of the Public Road Committee Recommendations was amended to add the following driveway installation permits:

Hwy 14 Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Purvis Abshire, and unanimously carried, Item No. 8 of the Public Road Committee Recommendations was deleted and referred back to Road Committee. Upon motion of Mr. Hubert Faulk, duly seconded by Mr. Louis Joe Hardy, and unanimously carried, the Public Road Committee Recommendations were further amended to authorize the Secretary to get three quotes to sell Unit #4-696, an old weed control spray rig which has been scrapped and to sell to the highest bidder. Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. Ritter Trahan, and unanimously carried, the Public Road Committee Recommendations were approved as amended, and the appropriate officials of the Jury were authorized to carry out the recommendations. PUBLIC ROAD COMMITTEE SEPTEMBER 11, 2002 ABBEVILLE, LOUISIANA AS A RESULT OF A PUBLIC ROAD COMMITTEE MEETING HELD ON SEPTEMBER 11, 2002, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY S CONSIDERATION: 1. It is recommended that the Police Jury support the plan concept presented by Mr. John Winn with the Community Awareness Program to locate shelters for bus students at various locations throughout the cities. 2. It is recommended that the Police Jury approve the corrected Partial Payment Estimate No. 1 from M. Matt Durand in the amount of $22, Reflects work done for Road Improvements on Marlin and Everglade Roads. It is further recommended that Contract Change Order No. 1 for the above project reflecting a net increase to the project of $1, be approved. It is further recommended that Invoice No from Sellers and Associates, Inc. in the amount of $1, be approved. Invoice represents engineering services provided relative to the Road Improvements on Marlin and Everglade Roads. 3. It is recommended that the Police Jury adopt resolutions requesting design exceptions from the Department of Transportation and Development for the following bridge construction projects.

6 A) Bridge located on Romeal Road over Robins Canal B) Bridge located on Charley Field Road over Bayou Tigre Coulee 4. It is recommended that a Letter of No Objection be issued to Maurice Properties, Inc. relative to their property development located in the area of Allen and Cedric Roads. 5. It is recommended that the Police Jury adopt a policy prohibiting the wearing of radio headphones by employees while working. It is further recommended that the policy be sent to all area barns and work sites. 6. It is recommended that the proposal by Asphalt Products Unlimited to replace the 7,700 gallon tank with a 9,000 gallon tank as previously specified be accepted. 7. It is recommended that Deaf Child Area signs be placed on St. Elmo Road. It is further recommended that Trucks Entering Roadway signs be placed on Arestide Road in the area of the Texaco Plant. 8. It is recommended that Mr. Perry Picard be suspended without pay for three (3) days. 9. It is recommended that the policy regarding the suspension/termination of an employee be established as follows: A) 1 st Suspension 3 days without pay B) 2 nd Suspension for same offense subject to termination It is further recommended that the secretary be directed to send the policy to all area barns and work sites. 10. It is recommended that authorization be given to hire, if needed, a temporary replacement for Darvey Dupuis who will be out due to an illness for 4 to 6 weeks. 11. It is recommended that the Department of Transportation and Development be requested to change the speed limit on La. Highway 14 Bypass through Erath from 55 mph to 45 mph. 12. It is recommended that the following state highway driveway permit installations be approved to be paid: A) Clyde Nugier La. Hwy 699 B) Jackie Walker La. Hwy 82

It is recommended that Mr. Rene Breaux be reappointed to the Vermilion Parish Library Board effective September 16, It is recommended that a letter of no objection be sent to the City of Kaplan relative to their proposed corporate limit extension to annex the Adams property on Klaby Meaux Road. 15. It is recommended that the invoices shown on the attached sheets be approved to be paid. Prejean, Jr., and unanimously carried, the Public Works Committee Recommendations were amended to authorize Antoinette Derouen, John Earl Harrington, and Russell Gary to attend the LMCA/TMCA Annual Meeting in Beaumont on October 28 31, Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Terry Bessard, and unanimously carried, Item No. 3 of the Public Works Committee Recommendations was amended to reflect that the starting date would be October 10, 2002, instead of October 12, Upon motion of Mr. T. J. Prejean, Jr., duly seconded by Mr. Hubert Faulk, and unanimously carried, the Public Works Committee Recommendations were approved as amended, and the appropriate officials of the Jury were authorized to carry out the recommendations; PUBLIC WORKS COMMITTEE SEPTEMBER 11, 2002 ABBEVILLE, LOUISIANA AS A RESULT OF A SPECIAL PUBLIC WORKS COMMITTEE MEETING HELD ON SEPTEMBER 11, 2002, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY S CONSIDERATION: 1. It is recommended that the damage claim of Mrs. Cynthia Primeaux be denied. 2. It is recommended that the equipment damage claim of Head and Engquist be denied. 3. It is recommended that Sellers and Associates, Inc. be directed to obtain quotes for the installation of a grinder system for the law enforcement center sewer plant. 4. It is recommended that the meeting room at the Cooperative Extension Center office be named in honor of Mrs. Alice Lancon. Broussard, and unanimously carried, the Police Jury approved a pauper funeral allocation to be paid to Raphael Funeral on behalf of Jonathan K. Triche (infant). Upon motion of Mr. Kenneth DeHart, duly seconded by Mr. Minos Broussard, and unanimously carried, the Police Jury authorized payment of the deductible in the amount of $4, to Deep South Surplus relative to the settlement of the damage claim filed by Edwin Hebert. Cost to be paid from 94 Sales Tax Fund. Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Hubert Faulk, and unanimously carried, the Police Jury approved entering into the following intergovernmental agreement with the Coulee Kinney Drainage District to haul dirt on a culvert crossing in the area of the Al Villien property:

20 Upon motion of Mr. Minos Broussard, duly seconded by Mr. Louis Joe Hardy, and unanimously carried, the Police Jury approved payment of Partial Payment Estimate No. 4 in the amount of $23, to Minvielle Lumber Company and Invoice No in the amount of $ to The Sellers Group both relative to the Renovation of an Existing Building to House the Erath Branch of the Vermilion Parish Library. Cost to be paid from the Library Construction Fund. In Legal Counsel Business, Mr. Paul Moresi, III advised the Police Jury that the lawsuits have been filed against Med-Express Ambulance Service, Inc. and Hartec Corporation. He is waiting on word that service to these companies has been made. Upon motion of Mr. Ritter Trahan, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury allowed anyone in the audience to present their business at this time. Mr. Clint Marceaux, who was terminated by Solid Waste Supervisor, Mr. Ricky LeBlanc for damage to Police Jury equipment stated that he was wrongfully terminated. Mr. Marceaux s wife and father also made comments in his defense. Mr. Marceaux was directed to put his claim for wrongful termination in writing and to submit it to the Administrative Office for further processing to the legal counsel. Upon motion of Mr. Minos Broussard, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury directed the Secretary to request the Louisiana Department of Wildlife and Fisheries to check the spacing of crab cages in the Vermilion Bay. Upon motion of Mr. Ritter Trahan, duly seconded by Mr. Ernal "E. J." Broussard, and unanimously carried, that there being no further business to be presented, the meeting was duly adjourned.
