1 Police Jury Room May 21, 2012 Abbeville, Louisiana Minutes of a regular meeting of the Vermilion Parish Police Jury held on May 21, 2012 with President Nathan Granger presiding. The meeting was called to order by Mr. Nathan Granger, who asked Mr. Pervis Gaspard, to lead the group in the Pledge of Allegiance, The President then reminded all present to turn all cell phones, pagers, etc. off or set to silent mode for the duration of the Police Jury meeting. Boudreaux Mr. Allen LeMaire Mr. Pervis Gaspard Mr. Mark Poche' Absent: Mr. Dane Hebert Mr. Ronald Darby Upon motion by, Mr. Pervis Gaspard, duly seconded by Mr. Leon Broussard, and unanimously carried, the Police Jury approved dispensing of the reading of the minutes of the May 7, 2012, regular meeting, and was accepted as presented. President Granger recognized Mr. Eugene Sellers, Sr., with Sellers and Associates, Inc., to present his business to the Jury. Upon motion by, Mr. Errol Domingues, duly seconded by Mr. Kevin Sagrera, and unanimously carried, the Police Jury approved the following" Letters of No Objection". A) PetroQuest Energy, LLC for the proposed installation of a platform, boat landing and 45, 352 feet of pipeline to serve the Bayou Hebert Production Facility, Section 17 & 18, T- 14- S, R- 5- E: Vermilion Bay, 8. 4 miles southeasterly of Henry, Louisiana. B) Henry Hebert for the proposed Aurore Ranch Project: Flag-gates and weirs to manage water levels in critical waterfowl habitat, Section 8, T- 14-5, R-4- E: South of Abbeville, near Henry, at the end of Magee Road. Mr. Sellers informed the Jury that the bids that were submitted at the General Needs Committee Meeting for the purchasing of " 2012 or Latest Model Automated Side- Loading Refuse Collection Truck and Body", one bid was from Kenner Equipment Co. and stated that Kenner Equipment Co. did not meet the specifications that were required, the second bid was from Frenzel Motors, with a base bid of $ 194, ,

2 Alternate No. 1 bid for the automatic greasers $ 7, , and Alternate No. 2 bid for a backup safety signal $2, , total cost $204, Further discussion followed the issue on bid laws. Upon motion by, Mr. Errol Domingues, duly seconded by Mr. Kevin Sagrera, and unanimously carried, the Police Jury authorized Legal Counsel, to research the bid laws in reference to the submitted bids, relative to the " 2012 or Latest Model Automated Side- Leading Refuse Collection Truck& Body". Upon motion by, Mr. Ronald Menard, duly seconded by Mr. Cloris J. Boudreaux, and unanimously carried, the Police Jury approved Partial Payment No. 5 ( Final), to Coastal Bridge Company LLC, in the amount of$ 31, , relative to the 2011 Road Improvement Program. Upon motion by, Mr. Pervis Gaspard, duly seconded by Mr. Ronald Menard, and unanimously carried, the Police Jury approved Contract Change Order No 4, in the amount of $71, , relative to FY 2010 LCDBG/USDA-RD Water Distribution System( Leleux, West of Kaplan and West of Delcambre Areas). Upon motion by, Mr. Pervis Gaspard, duly seconded by Mr. Ronald Menard, and unanimously carried, the Police Jury adopted a Resolution authorizing the President to Execute an Act of Acceptance from Jans' s Construction Co, pertaining to the completion of the contract for the " FY 2010 LCDBG/ USDA-RD Water Distribution System ( Leleux, West of Kaplan and West of Delcambre Areas). Mr. Sellers further stated that Change Order No. 1 for the Chipping/ Grinding Service Contract with Cecil Perry Improvements, LLC, that there was an error in their first payment and requests to reduce the fuel adjustment over charge, and increase his chipping fee' s with fuel increase by $3, Upon motion by, Mr. Errol Domingues, duly seconded by Mr. Paul Bourgeois, and unanimously carried, the Police Jury approved Change Order No. 1, to adjust the contract to delete fuel adjustment contractor not entitled to and adjust add debris that exceeds size requirements specified in the contract, relative to the Chipping/Grinding Service Contract. Mr. Sellers requests to amend Change Order No. 2, relative to adjust contract to add mixed debris as stated: processing and reduction of vegetative debris with diameter greater than 18" and length greater than 6" this is combined with the originally specified size debris, cost will be paid as a mixed debris pile, volume will be measured as a cube based on the average height of the pile, not the maximum height of the pile, per cubic yard.

3 Upon motion by, Mr. Cloris Boudreaux duly seconded by Mr. Ronald Menard, and unanimously carried, the Police Jury approved Change Order No. 2, to adjust contract to add mixed debris as stated: processing and reduction of vegetative debris with diameter greater than 18" and length greater than 6" this is combined with the originally specified size debris, cost will be paid as a mixed debris pile, volume will be measured as a cube based on the average height of the pile, not the maximum height of the pile, per cubic yard, relative to Chipping/ Grinding Service Contract. Upon motion by, Mr. Pervis Gaspard, duly seconded by Mr. Leon Broussard, and unanimously carried, the Police Jury approved Partial Payment No. 2, to Cecil Perry Improvements, LLC, in the amount of $ 22, , relative to Chipping/ Grinding Service Contract. Upon motion by, Mr. Errol Domingues, duly seconded by Mr. Leon Broussard, and unanimously carried, the Police Jury adopted a resolution to place Jude Road Bridge and Eddie Road Bridge be placed as first and second in the priority of Bridges to be funded for replacement in the Off-System Bridge Program. Mr. Sellers requests the Police Jury to authorize placing signs at Hebert' s Landing in regards to Littering, and what boat can tie up at the dock., and funds to come from the Safe Harbor General Fund. Upon motion by, Mr. Sandrus Stelly, duly seconded by Mr. Cloris Boudreaux, and unanimously carried, the Police Jury authorized Sellers & Associates, Inc. to have signs placed at the " Safe Harbor Boat Docking Facilities & Parking Area at Hebert' s Landing". Upon motion by Mr. Kevin Sagrera, duly seconded by Mr. Ronald Menard, and unanimously carried, the Police Jury approved the Coastal Protection & Restoration Committee Recommendations, as presented, and the appropriate officials were authorized to carry out the recommendations. COASTALPROTECTION& RESTORATION COMMITTEE MAY 16, 2012 ABBEVILLE, LOUISIANA AS A RESULT OF A COASTAL PROTECTION & RESTORATION COMMITTEE MEETING HELD ON MAY 16, 2012, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended that the Police Jury authorize Mr. Todd Vincent with Sellers and Associates, Inc. to electronically sign and submit CIAP applications, forms, and documents on behalf of the Vermilion Parish Police Jury. 2. It is recommended that the Police Jury authorize Sellers and Associates to advertise for the " Oyster Reef at Chenier Au Tigre Project. 3. It is recommended that the Police Jury approve to send a Letter of Support to the US Army Corp of Engineers requesting there support of the following PPL22 Projects: a) South Vermilion Bay Terracing

4 b) Front Ridge Freshwater Bayou Intrusion and Terracing Respectfully submitted, Kevin Sagrera, Chairman Upon motion by, Mr. Wayne Touchet, duly seconded by Mr. Kevin Sagrera, and unanimously carried, the Police Jury Committee recommendations. deleted Item No. 1 of the General Needs Upon motion by Mr. Errol Domingues, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury approved the General Needs Committee Recommendations, as amended, and the appropriate officials were authorized to carry out the recommendations. GENERAL NEEDS COMMITTEE MAY 16, 2012 ABBEVILLE, LOUISIANA AS A RESULT OF A GENERAL NEEDS COMMITTEE MEETING HELD ON MAY 16, 2012, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended that the Police Jury approve to award the lowest bid to Kenner Equipment Co., contingent upon the review and specifications from Sellers and Associates Inc., relative to the " 2012 or Latest Model Automated Side- Loading Refuse Collection Truck and Body". 2. It is recommended that the Police Jury authorize Sellers & Associates, Inc. to prepare a bid package and advertise for a " 2012 or Latest Model Asphalt Distributor Truck". 3. It is recommended that the Police Jury approve and clarify Mr. Jeffery Bourgeois pay at a Grade 8 Step 20, which is $ per hour. 4. It is recommended that the Police Jury approve the repair of a damaged driveway, located at Wesley Road, which was damaged by a solid waste employee. 5. It is recommended that the Police Jury authorize the solid waste supervisor to rent an excavator from H & E Equipment, in the amount of$ 5, per month and a. one-time fee of$ for delivery/pickup. 6. It is recommended that the Police Jury approve hiring part time laborers for the summer months to clean the solid waste facility. 7. It is recommended that the Police Jury approve to provide food and drinks during the Regent IV Communication exercise, at a total cost of$ It is recommended that the Police Jury approve Contract Change Order No. 1 for the " Drainage Pumping Station in the Town of Gueydan", to add a transformer

5 concrete pad. Change Order reflects an increase in the project, in the amount of 3, , funds to be paid for by the Town of Gueydan. 9. It is recommended that the Police Jury adopt William LaPointe ( Pvt.) Road into the Parish Road System as a private road, which is in Election District No It is recommended that the Police Jury authorize Sellers & Associates, Inc. to prepare a bid package and advertise for a " 2012 or Latest Model Sanitary Landfill Bulldozer" for the Solid Waste Facility. 11. It is recommended that the Police Jury adopt a resolution committing local funds towards the Disaster Recovery Community Development Block Grant Long Term Community Recovery Program, Phase IV Bridge replacement Project and authorize the President to sign all necessary documents. 12. It is recommended that the Police Jury rescind the amended Vermilion Parish Building Inspection fee' s that was approved at the April 16, 2012, Police Jury Meeting. 13. It is recommended that the Police Jury adopt an ordinance establishing a 35 mph speed limit on Lake Road, for its entire lengths, in Election District No It is recommended that the Police Jury approve to appoint Mr. Jamie Stelly, to the Coulee Baton Drainage District, to serve the remainder of Mr. Roland Harrington term until July 19, It is recommended that the Police Jury ratify payment of Invoice No. dated April 17, 2012, to Richland Parish Detention Center, in the amount of $2, , relative to Housing Vermilion Parish Inmates for the month of March It is further recommended that the Police Jury authorize Legal Counsel to send a letter with the attached check to Richland Parish Detention Center, stating that the Police Jury is not binding itself to any rate by making the payment for the housing of Vermilion Parish inmates. 16. It is recommended that the Police Jury approve to reimbursement to Mr. Paul Moresi, III, Legal Counsel, the amount of$ , relative to the opposition to the City of Abbeville, et al vs. the Vermilion Parish Police Jury writ application. 17. It is recommended that the Police Jury authorize the President to sign the renewal of the General Liability Insurance policy, for the Police Jury from Travelers Insurance Company, at an annual cost of $115, and approved the payment of the invoice when received. 18. It is recommended that the Police Jury authorize payment of an Invoice dated 04/ 30/ 12, in the amount of $ 24, , to Kolder, Champagne, Slaven & Company, LLC, relative to professional service, audit of 12/ 31/ 11 financial statements. 19. It is recommended that the Police Jury approved the lowest quote to L & R Construction Co. of Kaplan, in the amount of$ 36,360.37, relative to the repairs of Spencer Road Bridge.

It is recommended that the Police Jury approve the lowest quote to Vermilion Shell & Limestone, in the amount of $3, , relative to the demolition of blighted property located at 3003 Cypress Street, Abbeville. 21. It is recommended that the Police Jury approve payment of an invoice dated 05/ 02/ 12, to Glass and Mirror Outlet, in the amount of $ , relative to damage caused by a Parishwide employee. 22. It is recommended that the Police Jury approve payment of the following invoices, relative to the BP Tourism Recovery Program, with costs to be paid from the BP Tourism Recovery Program fund. A. 7 Amount= $ Amount= $ It is recommended that the Police Jury approve the issuance of an alcoholic liquor permit to the Fishing for Memories event to be held on June 22-24, 2012, at the Abbeville Harbor and Terminal Public Boat Launch, Pintail Avenue, Intracoastal City, in Election District No It is recommended that the Police Jury approve payment of the attached bills that were submitted. 25. It is recommended that the Police Jury approve an intergovernmental agreement with Gravity Drainage District #2, to construct a retention pond at 2208 S. Monte Blanc and Lot No. 87A and 88 in Monte Blanc subdivision, whereby the Drainage District will provide the labor and equipment and the Police Jury will provide a similar value of service at a later date. It is further recommended that Police Jury approve payment of the cost for the hauling of the Gravity Drainage District #2 equipment to the designated project location. Cost to be paid from Parishwide Fund. Respectfully submitted, Nathan Granger, In accordance with the General Needs Committee Recommendations, the following ordinances were adopted: ORDINANCE WHEREAS, it has been brought to the Police Jury' s attention that a considerable amount of speeding exists, which is causing very hazardous conditions on which is causing very hazardous conditions on Lake Road, for its entire length, in Election District No. 13. SECTION I: NOW THEREFORE, BE IT HEREBY ORDAINED, that the Vermilion Parish Police Jury does hereby impose a 35 mph speed limit on Lake Road, for its entire length. SECTION II: BE IT HEREBY FURTHER ORDAINED, that the appropriate speed limit signs be installed in said areas. SECTION III: BE IT HEREBY FURTHER ORDAINED, that for a first offense, a maximum penalty of a $ fine and/ or a 10 day jail sentence be imposed at the discretion of the court for the first offense. BE IT HEREBY FURTHER ORDAINED, that for a second offense, a maximum penalty of a $ fine

8 and/ or a 10 day jail sentence be imposed at the discretion of the court. BE IT HEREBY FURTHER ORDAINED, that for a third offense, a maximum penalty of a $ fine and/ or a 10 day jail sentence be imposed at the discretion of the court. SECTION IV: BE IT HEREBY FURTHER ORDAINED, that the Vermilion Parish Sheriff' s Department be and is hereby requested and/ or directed to enforce the speed limit by the use of radar and/ or regular patrolling. ORDINANCE WHEREAS, it has been brought to the Police Jury' s attention that a considerable amount of litter exists, which is causing very hazardous conditions, on Gladu Road, in Election District No. 2. SECTION I: NOW THEREFORE, BE IT HEREBY ORDAINED, that the Vermilion Parish Police Jury does hereby impose the following to install a " NO DUMPING - $ FINE" sign to be placed at the beginning of Highway 343 traveling West, to the first bridge on Gladu Road, in Election District No.2. SECTION II: BE IT HEREBY FURTHER ORDAINED, that the appropriate signs be installed in said area. SECTION III: BE IT HEREBY FURTHER ORDAINED, that for any offense, a maximum fine of$ fine. SECTION IV: BE IT HEREBY FURTHER ORDAINED, that the Vermilion Parish Sheriff' s Department be and is hereby requested and/ or directed to enforce the littering ordinance. President Granger recognized Ms. Linda Duhon, Parish Administrator to present her business to the Jury. Ms. Duhon, reminded all Jurors that if they did not complete their Ethics training for this year, there will be classes held on May 31, 2012 at the Abbeville Library, with the first training beginning at 9: 00 a.m., 10: 30a.m, and at 1: p. m., or you can go on line to receive certification.

9 Ms. Duhon informed the Jurors that she would be on vacation starting Saturday, May 26, 2012 for one week. Upon motion by, Mr. Leon Broussard, duly seconded by Mr. Ronald Menard, and unanimously carried, the Police Jury authorized Sellers & Associates, Inc. to advertise for bids, relative to the " Material for Parish Road Maintenance for the period of July 1, 2012 December 31, Upon motion by, Mr. Errol Domingues, duly seconded by Mr. Paul Bourgeois and unanimously carried, the Police Jury authorized Sellers & Associates, Inc. to prepare a bid package and advertise for One ( 1) 30 Ton Articulated Dump Truck, One ( 1) Used/ Secondhand Excavator, and Two (2) Automated Dump Trucks. Ms. Duhon informed the Jurors that BP will have a settlement Public Informational meeting on Wednesday May 23, 2012, starting at 6: 00 p.m., at the VN Hall, located at 1201 N. Lafitte Road, Abbeville, LA Upon motion by, Mr. Wayne Touchet, duly seconded by Mr. Mark Poche', and unanimously carried, the Police Jury approved payment of an invoice to Emerald Correctional Management ( West Carroll Detention Center), in the amount of$ 5, , relative to housing Vermilion Parish Inmates for the month of April 2012, and authorized Legal Counsel to send a letter with the attached check to Emerald Correctional Management ( West Carroll Detention Center), stating that the Police Jury is not binding itself to any rate by making the payment for the housing of Vermilion Parish inmates. Upon motion by, Mr. Wayne Touchet, duly seconded by Mr. Allen LeMaire, and unanimously carried, the Police Jury ratified payment of Invoice No. 5678, to Gordon Vice, in the amount of $ 25, , relative to the Maurice Volunteer Fire Station Addition. Upon motion by, Mr. Errol Domingues, duly seconded by Mr. Paul Bourgeois, and unanimously carried, the Police Jury approved the following invoices to Sellers & Associates, Inc. relative to professional services provided. Invoice No CGG Veritas/ South Erath 3D Seismic Permit Date: 05/ 06/ 12 Amount= $ 1, Upon motion by, Mr. Pervis Gaspard, duly seconded by Mr. Kevin Sagrera, and unanimously carried, the Police Jury approved hiring Mr. Johnny LeBouef as a part time Mower Operator, at the Area II Barn.

10 Upon motion by, Mr. Cloris Boudreaux, duly seconded by Mr. Ronald Menard, and unanimously carried, the Police Jury approved payment of the attached bills that were submitted. President Granger recognized Mr. Paul Moresi, Legal Counsel to present his business to the Jury. Mr. Paul Moresi stated that the insurer that damaged Guillot Road, has sent the release and they have agreed to the payment of$ 25, , but Mr. Moresi stated that there are changes that have to be made to the release. Mr. Moresi further stated that he has reviewed the claim made by Ms. Crystal Saltzman, and feels the damages were not the liability of the Police Jury. Upon motion by Mr. Pervis Gaspard, duly seconded by Mr. Paul Bourgeois, and unanimously carried, the Police Jury authorized Legal Counsel to send a letter to Ms. Crystal Saltzman, informing here that the Police Jury is denying her claim to damages. Mr. Moresi continues to state that he researched the Video Poker Laws, and the law requires there be a local option election, but the Legislative would have to approve the election to be held. Mr. Moresi requested the Police Jury to amend the agenda to discuss the adjudicated property located on S. Hospital Dr and Jacqulyn St. Upon motion by Mr. Wayne Touchet, duly seconded by Mr. Kevin Sagrera, and unanimously carried, the Police Jury to amend the agenda to discuss the adjudicated property located on S. Hospital Dr. and Jacqulyn St. Upon motion by Mr. Allen LeMaire, duly seconded by Mr. Cloris Boudreaux, and unanimously carried, the Police Jury adopted an ordinance establishing " NO DUMPING - $ 500 FINE" sign to be placed at the beginning of Highway 343 traveling West, to the first bridge on Gladu Road, in Election District No.2. Upon motion by, Mr. Mark Poche', duly seconded by Mr. Errol Domingue and unanimously carried, the Police Jury adopted an ordinance establishing a 45 mph speed limit on Boat Shop Road, for its entire length, in Election District No. 6 & 8. SECTION III: BE IT HEREBY FURTHER ORDAINED, that for a first offense, a maximum penalty of a$ fine and/or a 10 day jail sentence be imposed at the discretion of the court for the first offense. BE IT HEREBY FURTHER ORDAINED, that for a second offense, a maximum penalty of a $ fine and/or a 10 day jail sentence be imposed at the discretion of the court. SECTION IV: BE IT HEREBY FURTHER ORDAINED, that the Vermilion Parish Sheriff' s Department be and is hereby requested and/ or directed to enforce the speed limit by the use of radar and/ or regular patrolling. Mr. Paul Bourgeois reminded the Police Jury that on Wednesday, May 23, 2012 there will be an Economical Development Meeting at 500 N. Monceaux Road, in Kaplan, LA, at 5: 30 p.m. Upon motion by Mr. Leon Broussard, duly seconded by Mr. Kevin Sagrera, and unanimously carried, there being no further business to be presented, the meeting was duly adjourned.
