1 Police Jury Room April 7, 2003 Abbeville, Louisiana Minutes of a regular meeting of the Vermilion Parish Police Jury held on April 7, 2003 with Mr. Edval Simon, Jr. presiding. The meeting was called to order by Mr. Simon, who asked that the meeting begin with the Pledge of Allegiance. The following members were present: Mr. Purvis Abshire Mr. Terry Bessard Mr. Ernal "E. Prejean, Jr. Mr. Edval Simon, Jr. Mr. Ritter Trahan Absent: None Attorney Chad Edwards, Legal Counsel for the City of Abbeville, spoke on the City of Abbeville s efforts to revise their garbage, trash and construction debris ordinance, and specifically contractor waste which would make the homeowner and contractor jointly responsible for cleaning the debris. Other changes would be included in the revised ordinance. The City does not want to conflict with any parish requirement. Requesting the Jury to consider having a uniform ordinance parishwide which would include all municipalities to address this matter. Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Terry Bessard, and unanimously carried, the Police Jury directed their legal counsel, Mr. Paul Moresi, III, to meet with Mr. Chad Edwards. Request other municipalities to be involved and to consider adopting a similar ordinance in order to establish a uniform parishwide requirement relative to garbage and trash pickup. Mrs. Rebecca Shirley, suggested that maybe the Police Jury and municipalities may want to consider some type of prepared notice which could be handed out to inform persons obtaining a building permit of any construction debris disposal requirements. Upon motion of Mr. Ritter Trahan, duly seconded by Mr. Purvis Abshire, and unanimously carried, the reading of the minutes of the March 17, 2003 meeting were dispensed with and were accepted.

2 President Edval Simon read the following announcements: (1) The Acadiana Regional Planning District will be hosting a Business Incentives Briefing and Workshop on Wednesday, April 16, 2003, at the Lafayette Economic Development Authority (LEDA). (2) Lorman Education Services will sponsor a seminar entitled How To Write A HIPAA Compliance Manual In Louisiana on April 23, 2003 in Lafayette. (3) The 2003 Legislative Conference for parish government officials will be held in Baton Rouge on Wednesday, April 23 at 9:30 a.m. beginning with a briefing in the Governor s Press Conference Room, located in the Capitol. (4) Lorman Education Services will sponsor a seminar entitled Payroll Basics in Louisiana on May 1, 2003 in Alexandria. (5) Colonel Peter J. Rowan, New Orleans District Engineer will be in Abbeville on Thursday, May 1, 2003 at 10:00 a.m. for a Vermilion Parish Familiarization Briefing. (6) The United States Equal Employment Opportunity Commission, New Orleans District Office will present a Technical Assistance Program Seminar on Thursday, May 1, 2003 in New Orleans. (7) Lorman Education Services will sponsor a seminar entitled HIPAA Implementation: Beyond the Basics In Louisiana on June 3, 2003 in Lafayette. (8) The Council on Education In Management will sponsor a seminar entitled FMLA Update 2003 on June 16, 2003 in Baton Rouge. (9) The Louisiana Tax Commission, in performance of its duties as required by LSA- R.S. 47:1837, has completed the Measurement of Commercial Properties Review Study in the parish. As to this study, the measurements indicate that the assessed values are within the tolerances allowed by the law. (10) Received a copy of the 2002 Abbeville Harbor & Terminal District financial reports, which will be kept on file. A copy is attached for your review. Upon motion of Mr. T. J. Prejean, Jr., duly seconded by Mr. Carroll Duhon, and unanimously carried, the Police Jury authorized acceptance of the proposal from Soil Testing Engineers in the amount of $12, to obtain soil borings to develop the next phase for a Sub-Title D Cell to be constructed.

3 Upon motion of Mr. Minos Broussard, duly seconded by Mr. Louis Joe Hardy, and unanimously carried, the Police Jury approved payment to Sellers & Associates, Inc. for the following invoices: A) Invoice No = $ B) Invoice No = $ Topographic survey, drainage Update Parish Road Name System Map study and design for drainage culvert crossing Jude Road & La. Hwy 14 C) Invoice No = $ D) Invoice No = $ Rural Development Program KAJN Subdivision Review Parish Road Repairs Application for funds. E) Invoice No = $ Loneoak Subdivision Review Upon motion of Mr. Ernal "E. J." Broussard, duly seconded by Mr. Pervis "Pee Wee" Meaux, and unanimously carried, the Police Jury approved payment of Partial Payment Estimate No. 2 (Final) in the amount of $6, (10% retainage) to Teche Construction, Inc. relative to the contract for Hurricane Lili Debris Removal from Approved Private Properties Right of Entry Program contingent upon receipt of the Clear Lien Certificate. Upon motion of Mr. Ernal "E. J." Broussard, duly seconded by Mr. Pervis "Pee Wee" Meaux, and unanimously carried, the Police Jury approved payment of Partial Payment Estimate No. 5 (Final) in the amount of $55, (5% retainage) to Pete & Ron s Tree Service, Inc. relative to the contract for Hurricane Lili Debris Removal and Debris Reduction Project. A Clear Lien Certificate has been received. Upon motion of Mr. Louis Joe Hardy, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury approved the issuance of a letter of no objection to Cox Communications to bury CATV coaxial or fiber optic cable within the parish road right of way at the following locations: a) North Road near La.Hwy 338, E.D. No. 3 b) Ranch Road near La. Hwy 338, E.D ft. of two (2), 1 ½ inch PVC Conduits. 77 ft. of 1 ½ inch PVC Conduit c) Sunshine and S. John M. Hardy Drive d) S. John M. Hardy Drive, E.D. 4 and 9 E. D. 4 and 9, 182 ft. of 1 ½ inch PVC 142 ft of 1 ½ inch PVC Conduit. e) Chaisson Road, E.D. 6, 100 ft. of 1 ½ inch f) Clifton and Kirk Road, E.D. No. 1 PVC Conduit and pedestal installation 163 ft. of 1 ½ inch PVC Conduit g) Shanna, Nicole, and Clarise, E.D. No. 11 h) Nicole Road, E. D. No. 11 2,820 ft. of 1 ½ inch PVC Conduit and 60 ft. of 1 ½ inch PVC Conduit new pedestals

4 i) Hargrave Road, E.D ft. of two (2) 1 ½ inch PVC Conduit Upon motion of Mr. T. J. Prejean, Jr., duly seconded by Mr. Luther "Buster" Hardee, and unanimously carried, the Police Jury approved the issuance of Permit No O to Hunt Petroleum Corporation to install and maintain approximately 12,808-feet of two (2), 6-inch pipelines beginning at S.L Well No. 1 and ending at the existing Maritech Resources production platform in Election District No. 13. Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury approved the issuance of Permit No D to Dragon Energy corporation to install and maintain a board road and drill site to drill and complete the proposed Sharon Leleux Romero No. 1 Well in Election District No. 14. Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Luther "Buster" Hardee, and unanimously carried, Item No. 14 of the Public Road Committee Recommendations was amended to add a state highway driveway permit installation for Mr. Todd Sonnier on La. Hwy 699. Unit (tractor) is currently attached to a brushcutter for Area 1. To sell this unit would leave Area 1 short one tractor. Upon motion of Mr. Mark Poche, duly seconded by Mr. Minos Broussard, and unanimously carried, relative to Item No. 9 of the Public Road Committee Recommendations, the Jury directed the road supervisor and mechanic shop foreman to check if one of the other tractors to be sold at auction is better than Unit 1-713, then an exchange is authorized, if not, then Unit will not be sold. Upon motion of Mr. Mark Poche, duly seconded by Mr. Luther "Buster" Hardee, and unanimously carried, Item No. 2 of the Public Road Committee Recommendations was deleted. By same action, the Police Jury authorized taking one of the extended cab pickup trucks from the auction list and assign same to the blacktop crew equipment inventory. Upon motion of Mr. Hubert Faulk, duly seconded by Mr. Mark Poche, and unanimously carried, the Public Road Committee Recommendations were further amended relative to Item No. 7 to reflect a 25 mph speed limit on Reme Road instead of a 35 mph speed limit. Upon motion of Mr. Ritter Trahan, duly seconded by Mr. Purvis Abshire, and unanimously carried, the Public Road Committee Recommendations were further amended to adopt an ordinance establishing a 35 mph speed limit on Amerada Hess Road from Wildflower Road, southward for a distance of ¼ mile.

5 Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Public Road Committee Recommendations were approved as amended, and the appropriate officials of the Jury were authorized to carry out the recommendations; PUBLIC ROAD COMMITTEE APRIL 1, 2003 ABBEVILLE, LOUISIANA AS A RESULT OF A PUBLIC ROAD COMMITTEE MEETING HELD ON APRIL 1, 2003, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY S CONSIDERATION: 1. It is recommended that an ordinance be adopted establishing a 45 mph speed limit on Isidore Road from Jude Road to S. Broadway (La. Hwy 685). 2. It is recommended that Unit 1020 (Road Supervisor Pickup Truck) be assigned to the asphalt crew. It is further recommended that bids be received for a 2003, or newer model, 4-door ½ ton pickup truck. 3. It is recommended that the damage claim of Kenneth Vondenstein be approved to be paid in the amount of $ Replacement of dump cart. 4. It is recommended that the following personnel changes in the trash program be made: A) Terminate Charles Weatherly - Unable to come to work. B) Reassign Frank Guidry to the Area 2 barn to replace Charles Weatherly. C) Hire James Romero as a trash truck driver and that he be assigned to the Area 4 barn. 5. It is recommended that the Solid Waste Program supervisor be authorized to hire an additional contract mechanic when the repair workload in the shop is backed up. 6. It is recommended that the Police Jury ratify the hiring of the following persons as parttime spray truck drivers for the mosquito control program: A) Aaron Briggs 3/26/03 B) Shane Bullington 3/26/03

6 C) Eric Douglas 3/25/03 D) James Landry 3/25/03 E) Robert Schexnayder 3/25/03 7. It is recommended that an ordinance be adopted establishing a 35 mph speed limit on Reme Road. 8. It is recommended that Mr. Noicy Langlinais be appointed to the Twin Parish Port Commission. 9. It is recommended that Unit 1-713, 1988 Case Tractor be declared as surplus and authorized to be included in the auction to be held on April 12, It is recommended that the Police Jury adopt the following position regarding the Deepwater Access Channel (Freshwater Bayou/Intracoastal Canal/Commercial Canal Deepening): That the Police Jury only support the project if the following conditions are made part of the authorizing legislation: A) Rock armoring of the banks/levees for the entire length of the project. B) That perpetual maintenance funding authorization be included in the legislation. C) That all dredged material be utilized along the banks of the channel to backfill behind the rock armament and/or to develop a levee system. 11. It is recommended that the Police Jury go on record in opposition to Senate Bill 230 by Senator Hines, and that the Parish legislative delegation be requested to support this position. 12. It is recommended that the Police Jury establish November 15, 2003 as the election date to be included in the proposed legislation to authorize the call of a referendum to consider allowing video poker machines to be placed in Vermilion Parish. 13. It is recommended that the lawn maintenance contract at the parish government office complex be awarded to All Seasons Maintenance Service at a cost of $ per month, being the lowest of the four quotes received.

7 14. It is recommended that the following state highway driveway permit installations be approved: A) Charles Arceneaux La. Hwy 330 B) Russell Campisi La. Hwy 335 Respectfully submitted, Luther Buster Hardee, III, Chairman Upon motion of Mr. Ernal "E. J." Broussard, duly seconded by Mr. Terry Bessard, and unanimously carried, the Police Jury approved payment to Laborde & Neuner in the amount of $64.61 relative to the G. Duhon suit. Cost to be paid from 94 Sales Tax fund. Upon motion of Mr. T. J. Prejean, Jr., duly seconded by Mr. Luther "Buster" Hardee, and unanimously carried, the Police Jury approved payment to Laborde & Neuner in the amount of $ relative to the H. Taylor suit. Cost to be paid from Parishwide Road Funds. Upon motion of Mr. Hubert Faulk, duly seconded by Mr. Louis Joe Hardy, and unanimously carried, the Police Jury authorized the issuance of a letter of no objection relative to the Abbeville Country Club s request for a Corps of Engineers Permit to construct erosion protection along the Coulee Kinney. Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. Kenneth DeHart, and unanimously carried, the Police Jury authorized the issuance of a letter of no objection relative to Talens Marine & Fuel request for a Department of Natural Resources and Corps of Engineers permit to construct a bulkhead along Freshwater Canal. Upon motion of Mr. Ritter Trahan, duly seconded by Mr. Hubert Faulk, and unanimously carried, the Police Jury authorized the President to sign a proclamation declaring April 6 12, 2003 as National Library Week in Vermilion Parish. PROCLAMATION NATIONAL LIBRARY WEEK 2003 WHEREAS, our nation s libraries are modern community centers for education, information and entertainment and play a vital role in providing millions of people with the resources they need to live, learn and work in the 21 st century; WHEREAS, libraries are changing and dynamic places and librarians are the ultimate search engine, helping people of all ages find the information they need in print and online. In a world that s information rich, librarians are information smart, and help ensure a society where everyone is information literate.

8 WHEREAS, libraries are places of opportunity, Libraries are part of the American dream. They are a place for education, self-help and lifelong learning. And because they offer free access to all, they bring opportunity to all. WHEREAS, libraries bring you the world. Libraries are unique. In person. Online. Where else can you have access to nearly anything on the Web or in print as well as personal service and assistance in finding it? WHEREAS, librarians are the ultimate search engine. The are trained experts at finding information in all formats for people of all ages: WHEREAS, librarians must be brought tot he table at public policy discussions on key issues, such as intellectual freedom, equity of access, and narrowing the digital divide; WHEREAS, awareness and support must be increased for libraries by raising the visibility of libraries in a positive context and by communicating clearly and strongly why libraries are both unique and valuable; WHEREAS, more individuals must be recruited to the profession of librarianship to maintain its vitality in today s changing workplace; WHEREAS, libraries and library supporters across America are celebrating National Library Week with Some of my Best Friends are Books NOW, THEREFORE BE IT RESOLVED THAT, Edval Simon, Jr., President of the Vermilion Parish Police Jury, proclaim April 6 12, 2003, as National Library Week in Vermilion Parish, Louisiana and encourage all residents to support and use their library. Discover or rediscover the wealth of resources available at your library. EDVAL SIMON, JR. PRESIDENT Upon motion of Mr. Hubert Faulk, duly seconded by Mr. Ritter Trahan, and unanimously carried, the Police Jury approved a resolution authorizing the issuance, sale and delivery of $2,265,000 of Water Revenue Bonds, Series 2004A, of Waterworks District No. 1 of the Parish of Vermilion, State of Louisiana, and other matters relating thereto, including to provide interim financing for said District s waterworks project (Indian Bayou), and the issuance, sale and delivery of $2,265,000 of Bond Anticipation Notes, Series 2003A, of said District.

9 Upon motion of Mr. Kenneth DeHart, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury approved a resolution authorizing the issuance, sale and deliver of $2,193,000 of Water Revenue Bonds, Series 2004B, of Waterworks District No. 1 of the Parish of Vermilion, State of Louisiana, and other matters relating thereto, including to provide interim financing for said District s waterworks project (Intracoastal City, Esther and Forked Island), and the issuance, sale and delivery of $2,193,000 of Bond Anticipation Notes, Series 2003B, of said District.

10 Upon motion of Mr. Hubert Faulk, duly seconded by Mr. Carroll Duhon, and unanimously carried, the Police Jury authorized the President to execute a drainage right of way agreement to maintain a ditch located off of Baylee Road. Upon motion of Mr. Pervis "Pee Wee" Meaux, duly seconded by Mr. Ernal "E. J." Broussard, and unanimously carried, the Police Jury approved payment of Invoice No in the amount of $8, to Coastal Environments, Inc. relative to the environmental assessment of the effects of the proposed Deepwater Access Channel to the Port of Iberia Project. Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. Minos Broussard, and unanimously carried, the Police Jury went on record opposing HB114 which would increase the amount to be paid for feeding/maintaining prisoners from $3.50/day minimum to $22.39/day (same as state reimbursement rate). Police Jury currently pays $4.50/day plus medical expenses. Upon motion of Mr. Terry Bessard, duly seconded by Mr. Carroll Duhon, and unanimously carried, the Police Jury ratified the Section 5311 Monthly Activity Report for the month of February, 2003, as submitted by the Vermilion Council On Aging and directed the Secretary to submit the report to the Department of Transportation and Development for reimbursement in accordance with the contract agreement. The Secretary provided the Jurors with a draft letter that is being requested to be sent out to the Congressional Delegation and Corps of Engineers concerning the proposed deepwater access channel project. He also advised of News Releases received from the Department of Transportation and Development advising of an asphaltic concrete overlay project on La. Hwy. 14 at its junction with La. 91 going east to the Gueydan City limits and also on La. Hwy 35 (Cushing Avenue) at its junction with La. 14 in Kaplan. Upon motion of Mr. Ernal "E. J." Broussard, duly seconded by Mr. Luther "Buster" Hardee, and unanimously carried, the Police Jury approved the termination of Mr. Archie Hebert and Mr. Jack Richard, Sr. effective immediately, for failure to comply with Police Jury policies. Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Terry Bessard, and unanimously carried, the Police Jury approved payment of Invoice No in the amount of $10, to Wayne Touchet Building Contractor for labor and materials used to date relative to the Misc. Improvement To Building #4 at the Public Works Complex Project. Upon motion of Mr. Kenneth DeHart, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, the Police Jury approved giving verbal authorization to Chevron Texaco Pipeline to proceed with a project at the Henry Plant pending submittal of the actual permit for consideration.

11 Mr. Hubert Faulk advised the Jurors of proposed drainage improvements to be done along Sidney Gautreaux Road, however a cable is in the ditch, belonging to either Cox Communication, or Bell South. Mr. Faulk requested the Road Superintendent to identify the cable and to have the secretary notify the cable owner to either reattach to the poles or bury the cable. Regarding the trash pickup program, Juror Louis Joe Hardy asked his fellow Jurors whether they were satisfied with the new system. Numerous comments were made. Agreed to continue current method for a few months. Upon motion of Mr. Ernal "E. J." Broussard, duly seconded by Mr. Minos Broussard, and unanimously carried, the Police Jury approved payment of a pauper funeral allocation made payable to Fletcher Funeral Home on behalf of Mr. Darrell Bessard. Regarding a complaint dealing with noise, Mr. Carroll Duhon advised the Jurors that he had received a petition from residents living near the nightclub Nitelife. Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Terry Bessard, and unanimously carried, the Police Jury requested the legal counsel to send a copy of the noise ordinance to the operator of Nitelife lounge, and to the Sheriff s Office. Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. Ritter Trahan, and unanimously carried, the Police Jury approved the transfer of Mr. Glenn Mallet to the Area 3 Road Crew and that he be promoted to excavator operator. By same action, the Police Jury approved the hiring of Mr. Alvin Lejeune, Jr. for the Solid Waste Trash Program and assigned him to the Area 3 Barn. Employment to begin when he furnishes documentation of a commercial drivers license. Upon motion of Mr. Ritter Trahan, duly seconded by Mr. T. J. Prejean, Jr., and unanimously carried, that there being no further business to be presented, the meeting was duly adjourned. Secretary-Treasurer President
