1 Police Jury Room April 17, 2017 Abbeville, Louisiana Minutes of a regular meeting of the Vermilion Parish Police Jury held on April 17, 2017, with President Ronald Darby presiding. The meeting was called to order by President, Ronald Darby, who asked Mr. Jason Picard to lead the group in the Pledge of Allegiance. Following the pledge, Mr. Ronald Darby, took a moment to give prayer and reflection, President Ronald Darby asked for all phones, pagers, etc. off or set to silent mode for the duration of the Police Jury meeting. No comments were presented or discussed at this time. President Darby read the following Bid Opening: Accept bids relative to public sale of adjudicated property at 412 E. Bourque St., Erath, LA. President Darby recognized at this time if there is anyone in the audience to submit bids relative to this adjudicated property. Upon motion by Ronald Menard, and duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury approved to close receipt of bids. 1

2 Upon motion by Errol Domingues, and duly seconded by Mr. Leon Broussard, and unanimously carried, the Police Jury approved to authorize opening bids. Public sale of adjudicated property at 412 E. Bourque St., Erath LA Mr. Richard Suire 3, Ms. Duhon stated need a motion to take the bid under advisement until Mr. Paul Moresi, III, Legal Counsel can review bids and meet with the Town of Erath, relative to liens on this property. Upon motion by Pervis Gaspard, and duly seconded by Mr. Wayne Touchet, and unanimously carried, the Police Jury approved to take the bid for the adjudicated property at 412 E. Bourque St., Erath, LA under advisement until Mr. Paul Moresi, III, Legal Counsel can review the bid and meet with the Town of Erath, relative to liens on this property. Ms. Duhon stated the bidder is not responsible for any liens. If an arrangement can be made with the Town of Erath the Jury will award to lowest bidder if not the Jury will reject all bids. President Darby recognized those persons who had requested time on the agenda to present their business at this time: Ms. Donna Libersat stated Beanies for St. Jude is an organization that is non-profit that began in 2001 for about seventeen ( 17) years, we have raised a total of over 400, in monetary donations and gifts that we have given to St. Jude, Target House, Ronald McDonald House and Tri Delta House. We leave on Wednesday to give our yearly donations, the oilfield has had an impact on donations in this area and we are about $ 5, short of our goal this year. We do accept donations, also have a Tax ID Number, I have an itinerary if anyone would like to see what we do when we are there. We provide a meal to the different houses, we also have a Stuff the Truck event where people in the community came out and gave all kinds items we bring to St. Jude Hospital Target House, Ronald McDonald House and Tri Delta House. We do the dinner and donation at Target House and Ronald McDonald House, Enterprise donates a cargo van for our transportation there, and we pay for our own expenses. We have picked up donations within the last few days and would appreciate anything the Jury can do. This year we are on a mission to get pathfinder wagons, we have collected thirty one ( 31) wagons so far and at St. Jude Hospital the children roll around in the wagons so the parents don' t have to carry them the whole time. We try to make it a family atmosphere and for the children so it is not so scary for them. 2

3 Ms. Libersat stated Ms. Billy Menard started Bennies for St. Jude, she is from Kaplan, LA and has been working at this for a long time. Our group is made up of about forty (40) volunteers that will be bringing the donations. It is a wonderful experience to see all of the smiles on the children' s faces and the families. If you get a call and your child has cancer you pick up and go, St. Jude provides everything for you and if you forget something there is a huge closet take what you need. All is provided from people like yourselves with big hearts to help these in need. We go to drop off donations every year around Spring Break, and if you would ever decide you would like to come please let me know. Discuss overflow at the Vermilion Parish Law Enforcement Center Mr. Wayne Touchet stated overflow is currently below budget. Referred to 2017 Overflow Costs Chart. Upon motion by, Mr. Leon Broussard, duly seconded by Mr. Cloris Boudreaux, and unanimously carried, the Police Jury approved dispensing of the reading of the minutes of April 03, 2017, regular meeting, and was accepted as presented. President Darby considered action to amend the agenda to discuss and consider actions on any new items presented by Engineering & Architectural reports. Upon motion by Mr. Dane Hebert, duly seconded by Mr. Paul Bourgeois, and unanimously carried, the Police Jury approved to amend the agenda to discuss and consider action on any new items presented by the Engineering & Architectural reports. President Darby recognized Mr. Gene Sellers, Sr., with Sellers & Associates, Inc., to present his business to the Jury. Mr. Gene Sellers, Sr., with Sellers & Associates, Inc., stated I need approval of Partial Payment No. 05, to Coastal Bridge Co., LLC, in the amount of $182, , relative to the " Capital Improvements Program Phase I". Upon motion by Ronald Menard, and duly seconded by Mr. Leon Broussard, and unanimously carried, the Police Jury approved Partial Payment No. 05, to Coastal Bridge Co., LLC, in the amount of $182, , relative to the " Capital Improvements Program Phase I". Cost to be paid from Parishwide. Mr. Sellers, Sr., stated the Jury had requested a review of Vermilion Acres Mobile Home Park and that a Public Hearing was conducted and the Engineer has submitted Preliminary Plats for our review. We recommend approval of the Preliminary Plat subject to the various items we suggest to be corrected in submittal of the final plat. One will need some consideration by the Police Jury in order for them to move forward this 3

4 has to be granted. The variations are the setback that the ordinance calls for and the ordinance requires twenty five ( 25) foot setback from the front property line and he is requesting that to be reduced down to five ( 5) foot. The second one on the rear property line set back, requirements are fifteen( 15) foot he is requesting a change be made to ten 10) foot and the rear setback is fifteen ( 15) foot he is requesting a five (5) foot setback. These variations are for him to move forward and to fit the mobile homes on the lots he has designed for. This is on a private right of way. Upon motion by Pervis Gaspard, and duly seconded by Mr. Errol, and unanimously carried, the Police Jury granted a preliminary plat approval to the subdivision identified as Vermilion Acres Mobile Home Park, and approve the setback variance and items being addressed on a letter from Sellers & Associates, Inc. dated April 17, 2017, located in Election District No. 11. Mr. Kim Touchet with The Sellers Group stated the contractor for Phase 7 has submitted Partial Payment No. 1, to L& R Construction Co. Inc. of Kaplan, in the amount of $38, , relative to the 2015 Bridge Improvements Project, Vermilion Parish Police Jury Phase VI Placide Road Bridge Replacement. The contractor has also submitted his Certificate of Substantial Completion being he is 100% complete and I also need a motion for the President to sign the certificate. Upon motion by Dane Hebert, and duly seconded by Mr. Jason Picard, and unanimously carried, the Police Jury approved Partial Payment No. 1,- to L& R Construction Co. Inc. of Kaplan, in the amount of $38, , relative to the " 2015 Bridge Improvements Project - Phase VI Placide Road Bridge" and a Certificate of Substantial Completion and authorized the President to sign the Notice of Acceptance for the completed project. Cost to be paid from Royalty Road. President Darby recognized the report of Standing Committees, Coastal Protection Restoration Committee. Upon motion by Mr. Pervis Gaspard, duly seconded by Mr. Ronald Menard, and unanimously carried, the Police Jury approved the Coastal Protection & Restoration Committee Recommendations, as presented and the appropriate officials were authorized to carry out the recommendations. COASTAL PROTECTION & RESTORATION COMMITTEE APRIL 12, 2017 ABBEVILLE, LOUISIANA AS A RESULT OF A COASTAL PROTECTION & RESTORATION COMMITTEE MEETING HELD ON APRIL 12, 2017, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 4

It is recommended that the Police Jury approve sending a Letter of Support to Congressional Delegation for the National Coastal Zone Management Program CZM Program), relative to this program being a critical tool for states and local governments; and its loss would be felt by all citizens that live, visit, and work in coastal regions. 2. It is recommended that the Police Jury approve sending a Letter of Support to Congressional Delegation & Dr. Robert Twilley, relative to requesting Appropriations Committees fund the National Sea Grant College Program at a level of$ 80 million in fiscal year 2018 which would support the key focus areas in the program' s strategic plan. 3. It is recommended that the Police Jury approve to submit to Governor John Bell Edwards the following ( 3) three nominations for the Chenier Plain Coastal Restoration and Protection Authority as follows: a. Mr. Ralph Libersat b. Ms. Angela Love c. Mr. Charles Dill, Jr. Respectfully Submitted, Kevin Sagrera Chairman President Darby recognized the report of Standing Committees, General Needs Committee. Upon motion by Mr. Errol Domingues, duly seconded by Mr. Jason Picard, and unanimously carried, the Police Jury approved the General Needs Committee Recommendations, as presented and the appropriate officials were authorized to carry out the recommendations. GENERAL NEEDS COMMITTEE APRIL 12, 2017 ABBEVILLE, LOUISIANA AS A RESULT OF A GENERAL NEEDS COMMITTEE MEETING HELD ON APRIL 12, 2017, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended that the Police Jury approve Vermilion Parish Rabies/Animal Control to close on Saturday, April 15, 2017, relative to Easter Holiday. 5

6 2. It is recommended that the Police Jury approve to reject the bid from M. Matt Durand, LLC, which was received on April 11, 2017, relative to the bond was not signed by the " Attorney-in-Fact on behalf of the Surety Company", Hoffpauir Road Bridge over Indian Bayou for the Vermilion Parish Police Jury and the Lafayette City-Parish Consolidated Government and authorize Sellers & Associates, Inc. to reschedule bids for May 15, It is recommended that the Police Jury approve Change Order No. 1, to L& R Construction, Inc., in the amount of+$ 1, to fix washouts on Placide Road. 4. It is recommended that the Police Jury approve charging Representative Blake Miguez rent for the use of the Old Erath Health Unit at /monthly and authorize Mr. Paul Moresi, III, Legal Counsel to prepare the necessary documents. 5. It is recommended that the Police Jury authorize Mr. Gary Guidry, Road Supervisor to install " No Dumping" signs north of 7635 Sidney Gautreaux Road on the east side near the drainage ditch, relative to Ordinance No , in Election District No It is recommended that the Police Jury authorize Mr. Gary Guidry, Road Supervisor to install " No Dumping" signs at the intersection of LA Hwy. 92 and Woodlawn Road, relative to Ordinance No , in Election District No It is recommended that the Police Jury approve an Invoice dated April 4, 2017, to Babineaux, Poche, Anthony & Slavich, LLC, in the amount of , relative to Legal Fees associated with Vermilion Parish Police Jury vs. Shalena Carter v. Vermilion Parish Police Jury, et al. Cost to be paid from 78' Sales Tax. 8. It is recommended that the Police Jury ratify payment of Invoice No , to 5 Alarm Fire Apparatus, Inc., in the amount of $73, , for the remaining balance to purchase one ( 1) Custom Rescue Pumper, 2017 Blaze HME)/ ( VIN No: 44KFT428XHWZ22967), for the Abbeville Fire Department. Cost to be paid from 76' Sales Tax. 9. It is recommended that the Police Jury approve payment of Invoice No. VP , to Rivers Security, LLC, in the amount of$ 3, , relative to armed security guard service for the Courthouse from to Cost to be paid from General Fund. 10. It is recommended that the Police Jury approve payment of Invoice No to Progressive Waste Solutions of LA, Inc., in the amount of 6

7 196, , relative to the month of March Cost to be paid from 94' Sales Tax. 11. It is recommended that the Police Jury approve to ratify Ms. Linda Duhon, Parish Administrator to advertise for the Rabies Clinic which will be held on Saturday, April 22, 2017, at the Vermilion Parish Rabies and Animal Control Facility and approve to and close the office to the public, and to Animal Aid for Vermilion Area ( AAVA) volunteers for the Rabies Clinic, from 8 a.m. until Noon. 12. It is recommended that the Police Jury approve 78' Sales Tax to Loan Project Account $ 13, , relative to the following invoices: Sellers & Associates, Inc. a) Invoice No $ b) Invoice No $ 3, c) Invoice No $ 5, d) Invoice No $ 5, It is recommended that the Police Jury approve General Fund to Loan Project Account $45. 00, relative to the following invoices: Sellers & Associates, Inc. a) Invoice No $ It is recommended that the Police Jury approve Partial Payment No. 1 to Glenn Lege Construction, Inc., in the amount of$ 161, , relative to the HMGP # " Vermilion Parish Detention Center Flood Protection Embankment". 15. It is recommended that the Police Jury approve Partial Payment No. 1 to Kenneth Hebert Builders, Inc., in the amount of $14, , relative to repairing the Old Erath Health Unit which was damaged in the August storm event. Cost to be paid from Health Unit Fund. 16. It is recommended that the Police Jury approve to send an electrician to determine if the electrical panel and breaker box needs to be changed at the Old Erath Health Unit. 17. It is recommended that the Police Jury approve an application for the use of Commercial Trash Dumpsters by Charitable, Nonprofit Organization to Mount Carmel School of Abbeville for six ( 6) Commercial Trash Dumpsters for" Fund Raiser" for Mount Carmel & Vermilion Catholic, to be used on May 4 6, 2017, at 405 Park Avenue, Abbeville, LA It is recommended that the Police Jury approve Section 5311 Financial Activity Report for the month of March 2017, as submitted by the St. Mary Community Action Agency and direct the Parish Administrator to submit 7

8 the report to the Department of Transportation and Development for reimbursement in accordance with the contract agreement. 19. It is recommended that the Police Jury approve payment of the following invoices to Sellers & provided. It is recommended that the Police Jury approve payment of the attached bills that were submitted. 21. It is recommended that the Police Jury adopt a resolution authorizing the President to advertise and receive bids for Oil, Gas and Mineral Lease of property owned by the Vermilion Parish Police Jury located on the Southeast Quarter Track 1 of Section 18, Township 12, South, Range 3 East, Lot # 23 containing acres and Track 2 in Section 18, Township 12, South, Range 3 East, acres. 22. It is recommended that the Police Jury approve to hold Resolution No R-09 until meeting with Vermilion Legislative Delegation. 23. It is recommended that the Police Jury approve to recommend our Vermilion Delegation to put an emphasis on House Bill 294 passing in all three parishes ( Vermilion, Cameron & Calcasieu) that make up the Chenier Plain Coastal Restoration and Protection Authority for three parishes to be assessed the tax. 24. It is recommended that the Police Jury authorize Mr. Paul Moresi, III, Legal Counsel, to have some latitude to re- negotiate with the Police Jury' s ex- employee of the District Judges Office who was overpaid. 8

9 25. It is recommended the Police Jury authorize Mr. Paul Moresi, III, Legal Counsel to send a demand letter to One Beacon Insurance from Arthur J. Gallagher Risk Management Services, Inc., relative to Shelena Carter vs. et al Vermilion Parish Police Jury. 26. It is recommended that the Police Jury approve Indian Bayou Fire Department to build a 30x40 structure on Vermilion Parish property next to the Fire Department. President Darby presented new business: Respectfully Submitted Mr. Errol Domingues Chairman Mr. Darby stated to consider action to adopt a resolution granting authority to the president to sign an Intergovernmental Cooperative Agreement with Waterworks District No. 1 of Vermilion Parish, relative to the FY 2016 Louisiana Community Development Block Grant Projects. Upon motion by Mr. Mark Poche', and duly seconded by Mr. Paul Bourgeois, and unanimously carried, the Police Jury adopted a resolution granting authority to the president to sign an Intergovernmental Cooperative Agreement with Waterworks District No. 1 of Vermilion Parish, relative to the FY 2016 Louisiana Community Development Block Grant Projects. Upon motion by Mr. Mark Poche', and duly seconded by Mr. Paul Bourgeois, and unanimously carried, the Police Jury amend the agenda to discuss and consider actions on any new items presented by the Parish Administrator. Ms. Duhon stated to discuss Resolution R-09 whereas the Police Jury supports via Resolution Louisiana Levee Reform Bill (HB259). 10 Resolution R-09 whereas the Police Jury supports via Resolution Louisiana Levee Reform Bill (HB259). President Darby considered action to amend the agenda to allow Mr. Ralph Libersat to speak, relative to Resolution R-09 whereas the Police Jury supports via Resolution Louisiana Levee Reform Bill (HB259). Upon motion by Mr. Mark Poche', and duly seconded by Mr. Brent Landry, and unanimously carried, the Police Jury amend the agenda to allow Mr. Ralph Libersat to speak, relative to Resolution R-09 whereas the Police Jury supports via Resolution Louisiana Levee Reform Bill (HB259). Mr. Ralph Libersat, Coastal Protection & Restoration Committee stated last Thursday Representatives Blake Miguez and Bob Hensgens as the Jury directed to discuss the Levee Reform Bill, a resolution the Jury passed. The Jury had two votes against the resolution and the rest were for it. Representative Hensgens was asking for 100% approval and the Jury wanted some additional clarification on the bill, the way it was introduced there. Representative Hensgens came in and discussed the bill with us and basically said I think Mr. Poche' you were asking that an amendment be made to that bill if in the Chenier Plain Coastal Restoration and Protection Authority which comprises of Vermilion, Cameron and Calcasieu Parishes that if the tax did not pass that it wouldn' t be imposed. Representative Hensgens stated he would love to put that onto the bill but that would make it a local bill and therefore that could not be introduced in this manner. This would have had to be done prior to the session. So at this point what he would want to do is go ahead and put that on this bill now that the bill would have to be amended to state that the Constitutional Amendment had to pass and it some of the Coastal Protection & Restoration Committee met with had to go back before the districts and have to pass within the districts after this amendment to pass. So this allowed the district which is the Chenier Plain Coastal Restoration and Protection Authority, all three parishes to vote on this bill again with a majority of the vote. The cavort was the compromise was it allowed the vote to go to the people as this Police Jury wanted. It first has to pass the amendment, a scenario would be the amendment pass and Vermilion Parish didn' t pass it but the amendment passed statewide so what Representative Hensgens is stating that even though it did pass you have to now go back to the Chenier Plain Coastal Restoration and Protection Authority and get a vote of the citizens that this millage is needed. It was a majority of the Chenier Plain Coastal Restoration and Protection Authority and not each individual parish so there is a slight variation which is for our benefit. Mr. Errol Domingues asked why if we have to go back to the citizens for the second election, first being the Constitutional Amendment, why are we not going back to the citizens, what is Representative Hensgens reason for not following the written verbiage of the Chenier Plain Coastal Restoration and Protection Authority. It would have to pass 10

11 by majority in all three respective parishes and if one does not pass proposition would fail. it then the Mr. Libersat stated that was basically a compromise to let it go at that point which makes it easier for the Chenier Plain Coastal Restoration and Protection Authority. If we would not have at least agreed in principal with Representative Hensgens on this it would have died right then and there. It gives us an opportunity to basically have a polling, a sample ballot to let us know the boxes that could potentially have problems for passing this millage or not. And also the State of Louisiana covers this cost for the election. The next election would be sponsored by the Chenier Plain Coastal Restoration and Protection Authority and I' m sure they would ask the parish for some assistance but they could piggy back on appropriate elections to reduce the cost. The key thing is it would not have to be a majority within those three parishes rather than a pass by individual parishes. Lengthy discussion followed Ms. Duhon stated to clarify exactly what Representative Hensgens stated I texted him to double check so the Jury does understand. I said the Jury is not clear on the you sent out, the second resolution will state that the Jury will support House Bill 259 only if the final bill after amendment states if the majority of the entire Levee District approve. Representative Hensgens stated yes something like that correct, and I asked does this mean if the amendment is approved that the majority of just Chenier Plain Coastal Restoration and Protection Authority or the six ( 6) Levee Districts that was created after Representative Hensgens stated all six ( 6). Mr. Libersat stated Chenier Plain Coastal Restoration and Protection Authority is the only multiple parish, all the other parishes are individual. Mr. Errol Domingues stated that does not change what is submitted now, it doesn' t protect Vermilion Parish or our concerns. Mr. Libersat stated the concern is if the amendment passes statewide we still have to have an election in the Chenier Plain Coastal Restoration and Protection Authority that says the people of the district want to have this. This was Representative' s Hensgens intent. Mr. Gene Sellers, Sr., Sellers & Associates, Inc. stated one more clarification, if it passes statewide and the amendment is passed the Chenier Plain Coastal Restoration and Protection Authority will have the authority to let in five ( 5) mills but the amendment Representative Hensgens will put will implement the five ( 5) mills without the vote of the people within the Chenier Plain Coastal Restoration and Protection Authority. 11

12 Mr. Wayne Touchet asked so we are back to having to call an election locally regardless. What is the point of having the first election if we are going to have the second election? Mr. Paul Bourgeois stated basically what Representative Hensgens wants the Jury to do is to unanimously support if the majority of the entire Levee District approves, in other words everything we just heard, if it passes from the state it still goes to the six (6) districts where they can have it all six ( 6) including Vermilion Parish and.,all he is wanting to do is to change the wording for the Jury for us to be the majority vote not the three ( 3) parishes. Representative Hensgens is not sure how the whole amendment will play out before it will go in front of the house and the whole process. It is not finished being written. He just wants to make sure it is a majority of the district and not just the three ( 3) parishes. Lengthy discussion followed. Ms. Duhon stated the way the Chenier Plain Coastal Restoration and Protection Authority is created now there is no majority the way it states if they would call an election it has to pass in all three ( 3) parishes. Mr. Sellers, Sr. stated if it passes right where it stands now and passes statewide, then Chenier Plain Coastal Restoration and Protection Authority has the authority to levy five (5) mill on this district. If the bill passes. Mr. Libersat stated the thing is it was a compromise to get the local people, the election was statewide if we weren' t going to get Representative Hensgens compromise it would stop right here and everyone has and voiced that they are very concerned about Coastal Restoration and protection. This gives an opportunity to let it go before the voters. President Darby considered action to amend the agenda to allow Mr. Ray Fremin, Jr., Executive Director of the Iberia Parish Levee, Hurricane, & Conservation District to speak, relative to Resolution R-09 whereas the Police Jury supports via Resolution Louisiana Levee Reform Bill (HB259). Upon motion by Mr. Dane Hebert, and duly seconded by Mr. Brent Landry, and unanimously carried, the Police Jury amend the agenda to allow Mr. Ray Fremin, Jr., Executive Director of the Iberia Parish Levee, Hurricane, & Conservation District to speak, relative to Resolution R-09 whereas the Police Jury supports via Resolution Louisiana Levee Reform Bill (HB259). Mr. Ray Fremin, Jr., Executive Director of the Iberia Parish Levee, Hurricane, & Conservation District stated I can say I am in support of the Constitutional Amendment being put forward. I am really here to listen to see what the Jury' s discussion is about. 12

13 The Constitution of the State of Louisiana has been this way since 1896 and wasn' t changed until 2006 so for one hundred and ten years ( 110) that is the way it was. I think we also need to remember that when it started in 1896 only property owners could vote. At the time was a ten ( 10) mill tax, they felt it important enough to be able to protect themselves and that importance did not go away and it is still here. It was changed in 2006 which I think I know the reasoning for this, after the storms of 2005 there were a lot of problems all over, so this was put on the ballot thinking that this was some sort of correction it didn' t affect them they still get their funding. It was maybe a good idea in the beginning but all we are trying to do is put it back to where it was before. Mr. Libersat stated I would have a problem with if all of my money is all going to Calcasieu or Cameron Parish but every penny Vermilion Parish puts into this millage you get it all back plus some. Mr. Poche' stated suppose the people of Vermilion Parish overwhelmingly say they are not in favor of it and you still get imposed. Mr. Libersat asked I am unaware of if this Police Jury supports Coastal Restoration and that is what matters. Mr. Touchet stated it is not about that, your constituents you represent at this table, it' s what they want. I am their voice, I am for Coastal Restoration but I represent the people in my district who are adamant and they do not want to pay five ( 5) mills and that is what I am hearing. Lengthy discussion followed. President Darby considered action to amend the agenda to allow Ms. Donna Libersat to speak, relative to Resolution R- 09 whereas the Police Jury supports via Resolution Louisiana Levee Reform Bill( HB259). Upon motion by Mr. Ronald Menard, and duly seconded by Mr. Dane Hebert, and unanimously carried, the Police Jury amend the agenda to allow Ms. Donna Libersat to speak, relative to Resolution R-09 whereas the Police Jury supports via Resolution Louisiana Levee Reform Bill (HB259). Ms. Donna Libersat asked what next special election is there. Mr. Wayne Touchet state we are not there yet, it has to go through the legislative process. Ms. Libersat stated it is upsetting as a Commissioner in Charge to see people who come and tells us direct I don' t understand all of the amendments and I just skip them. 13

14 This is not a good thing and sitting here watching the Jury not understand something is scaring me even more. We definitely need education on it. Mr. Bourgeois stated we understand the Constitutional Amendment, we are trying to understand what Representative Hensgens wants to be able to support and change things so everyone can be happy. Mr. Mark Poche' stated Representative Hensgens wants what the Jury wants but he wants all unanimous votes from the Jury. He is not carrying the bill for him, he will fight the fight for us but wants all fourteen ( 14) Jurors in the same favor. Mr. Dane Hebert stated we want to keep it as is the Chenier Plain Coastal Restoration and Protection Authority Act. President Darby stated we need to send a resolution stating that is what we want. Mr. Mark Poche' stated my resolution is we send a letter supporting the Chenier Plain Coastal Restoration and Protection Authority Tax with a passing of it individually in each parish. Mr. Errol Domingues stated following the guidelines of the current Chenier Plain Coastal Restoration and Protection Authority Act. Mr. Poche' stated the resolution is for Representative Hensgens to get an amendment to allow us to call a second election and in that election it has to pass in all three parishes, as the Chenier Plain Coastal Restoration and Protection Authority states now. Mr. Touchet stated I think his motion also needs to state this motion has to rescind the previous motion. Upon motion by Mr. Brent Landry, and duly seconded by Mr. Jason Picard, and unanimously carried, the Police Jury rescinded the action taken at the April 3, 2017 Police Jury Meeting adopting Resolution No R-09 requesting the Vermilion Parish Police Jury to support the Louisiana Levee Reform Bill which allows for up to 5 mills to be constitutionally levied; and whereby upon passing the Levee Reform Bill is a statewide vote of the people that the Chenier Plain Coastal Restoration and Protection Authority would only levy a 1 mill initially and consequently provide an annual report to the VPPJ on the progress and expenditures of the Authority and after each year the millage rate would be set based on input from the VPPJ and the VP Coastal Protection Restoration Committee and Commissioners of the Chenier Plain Coastal Restoration and Protection Authority. 14

15 Upon motion by Mr. Mark Poche', and duly seconded by Mr. Wayne Touchet, and unanimously carried, the Police Jury approved sending a resolution to the entire Vermilion Delegation requesting that an Amendment be submitted relative to the Louisiana Levee Reform Bill (HB259) stating that in the Chenier Plain Coastal Restoration and Protection Authority that it must pass in all three parishes ( Vermilion, Cameron& Calcasieu) to tax the residents. Ms. Duhon stated to discuss the electrical changes to the Old Erath Health Unit. Mr. Wayne Touchet stated there needs to put a new breaker panel the old one is obsolete and outdated. Upon motion by Mr. Wayne Touchet, and duly seconded by Mr. Mark Poche', and unanimously carried, the Police Jury approved Change Order No. 2 to Kenneth Hebert Builders, Inc., to install a new electrical panel and breaker box, relative to repairing the Old Erath Health Unit which was damaged in the August storm event. Cost to be paid from Health Unit Fund. Ms. Duhon stated Midway on the Square Restaurant is requesting that the Vermilion Parish Police Jury " Vermilion Parish Courthouse and Abbeville Cultural & Historical Museum& Art Gallery" does not object to the opening of this business for the selling of alcoholic beverages and authorize Ms. Linda Duhon, Parish Administrator to sign the necessary documents. Upon motion by Mr. Leon Broussard, and duly seconded by Mr. Paul Bourgeois, and abstained by Mr. Wayne Touchet, the Police Jury approved Midway on the Square Restaurant is requesting that the Vermilion Parish Police Jury " Vermilion Parish Courthouse and Abbeville Cultural & Historical Museum & Art Gallery" does not object to the opening of this business for the selling of alcoholic beverages and authorize Ms. Linda Duhon, Parish Administrator to sign the necessary documents. Ms. Duhon stated I need some clarification, the Jury took action and adopted the new Area Barns Formula' s. The formula' s, for the two largest barns was 10-2, one of the Area Barns is 8-2 right now and they are asking to hire someone. Do we hire someone or look somewhere else within the barns to transfer. Upon motion by Mr. Errol Domingues, and duly seconded by Mr. Leon Broussard, and unanimously carried, the Police Jury approved to discuss at the next Public Road Committee Meeting the formula for the Area Barns. Upon motion by Mr. Cloris Boudreaux, and duly seconded by Mr. Mark Poche', and unanimously carried, the Police Jury approved to reappointment Mr. Winnie B. Broussard on the Hospital Service District No. 1, term expires 04/ 17/

16 Upon motion by Mr. Dane Hebert, and duly seconded by Mr. Jason Picard, and unanimously carried, the Police Jury approved to transfer Mr. Steven Thibodeaux from a Mower Operator to a Motor Grader Operator at the Area IV Barn, at a Grade 13, Step 1. Upon motion by Mr. Ronald Menard, duly seconded by Mr. Wayne Touchet, and unanimously carried, the Police Jury approved payment of the attached bills that were submitted. Mr. Errol Domingues stated we have a current foreman starting pay is around 12.25/ hour. The others who have years are way more as they gain years. We had in our Area Barn the foreman wanted to retire any day we have been begging him for two years not to retire because we can' t find anyone. At our next Public Road Committee to discuss starting pay for Forman and Supervisors. Upon motion by Mr. Errol Domingues, and duly seconded by Mr. Jason Picard, and unanimously carried, the Police Jury approved to discuss at the next Public Road Committee Meeting the starting pay for Forman and Supervisors. Ms. Duhon stated I have a meeting on Wednesday, April 19, 2017 with the Col. Bergeron with the National Guard. They are looking to build a brand new National Guard Facility I will ask Mr. Homer Stelly to attend the meeting. Mr. Dane Hebert stated this might be something the Economic Development Director can assist with. She is supposed to have a list of property available. President Darby recognized Mr. Paul Moresi, III, Legal Counsel, to present his business to the Police Jury at this time. Mr. Moresi was not present. Ms. Liz Landry stated I really enjoyed myself tonight I hadn' t been here in a while but I am a member of NAACP, Vice President, and Secretary Treasurer and I will be coming to the Police Jury meetings so if I can help in any way please let me know. 17 Mr. Jason Picard stated Progressive Waste Solutions of LA is leaving trash cans in the middle of the road. On LA Hwy 82 around Woodlawn Bridge I will get name and addresses. Ms. Duhon stated we have received another complaint about the Rosenberg property. Upon motion by Mr. Wayne Touchet, duly seconded by Mr. Paul Bourgeois, and unanimously carried, the Police Jury authorized Ms. Carolyn Bessard, Assistant Parish Administrator to acquire quotes, relative to cleaning the lot located at 1914 North State Street, in Election District No. 05, as outlined in Ordinance No Mr. Mark Poche' stated on most properties the reasons we need to move on them and not sit on them is the perfect example of what happened in the Town of Erath they sat on the property and paid someone to cut it and accumulated $ 14, of liens. $6, for asbestos removal of the house and the rest were liens of people cutting it because we sat on it so long before we did something. We need to see about adding an administrative fee. Mr. Poche' stated I would like to make a motion to ask Mr. Paul Moresi, III, Legal Counsel and Sellers & Associates, Inc. to look into what percent can add as an administrative fee for having repetitive circumstances of cutting grass, relative to ordinance Long Grass Ordinance. Frederick St., Kaplan, LA and bill the charges to the City of Kaplan, relative to a dismantled mobile home.
