Emert, City Clerk Councilwoman Angel Racca, District I Councilman David Bonin, District II Councilman Ray Bourque, District II Councilman Kenny Higginbotham, District V Councilwoman Gertrude Batiste, District IV Councilman Ray Gary, District VI Councilman Johnnie Foco, At Large Don Landry, City Attorney Walter Comeaux, City Engineer Mark Savoy, City Engineer Gene Chiarulli, City Bookkeeper Brannon Decou, Police Chief Bryan Champagne, Fire Chief Larry Champagne, City Superintendent Mel Bertrand, City Supervisor Elmer Girouard, City Supervisor Mayor Langlinais called the meeting to order and Councilwoman Batiste lead with the Pledge of Allegiance and a silent prayer. Adopt Minutes of the December 9, 2014 Regular Meeting = Moved by Councilman Gary and second by Councilwoman Batiste to adopt the minutes of the December 9, 2014 Regular Meeting. Roll call: NEW BUSINESS: Adopt Resolution/Appointing Municipal Officials, Naming Official Journal and Establishing Meeting and Amending Budget = Moved by Councilman Higginbotham and second by Councilman Gary to adopt resolution #414-15, a resolution of the City Council of the City of Broussard, LA appointing municipal officials, naming The Advertiser newspaper as the official journal of the City of Broussard and establishing regular meetings for the City Council on the second and fourth Tuesday of each and

2 2 every month, said meeting to commence at 6:00 p.m. and to amend the Operating Budget to provide financing for legislative functions and officers. They are as follows: City Clerk: Tina Emert City Attorney: Don Landry w/perrin, Landry, delaunay & Oullet Street Commissioner: Russell Broussard City Engineers: Mark Savoie w/grooms Engineering City Auditor: Burton Kolder w/kolder, Champagne, Slaven & Co. City Accountant: Gene Chiarulli Magistrate Judge: Carroll Spell, Jr. Magistrate Prosecutor: James Simon Tax Collector: Tina Emert Gene stated his position is not appointed. He is appointed at the discretion of the Mayor. Roll call: Moved by Councilman Bourque and second by Councilman Bonin to nominate Councilman Foco as Mayor Pro Tem. Roll call: Adopt Resolution #415-15/ FY 2015 Louisiana Community Development Block Grant = Moved by Councilwoman Racca and second by Councilman Bourque To adopt Resolution #415-15, a resolution granting the authority to the Mayor to sign and submit all necessary documents and appoint a grants administrative consultant and engineer for FY 2015 Louisiana Community Development Block Grant Economic Development Projects. The projects are as follows: 1) Project 1 on LA Hwy 182 to extend the City s water distribution system to serve a proposed Industrial Park; and 2) Project 2 on Park Center Road to extend the City s sewer collection system to serve a proposed business, the Balbesi Food Manufacturing project Roll call: Request for front set-back variance for Morgan Grove = Walter stated this is a project that Will Mills is planning on doing. They have planning commission approval. They want to put small mixed townhouse lots and they want to move the set-back up to 15 feet from 20 feet. This is the internal setback in the subdivision that will be

3 3 developed. They are just starting the design. Mayor Langlinais asked Walter to get with Ms. Gert for the drainage study. It will be 5 feet away from the utility servitude. The sidewalk will be up to the back of the curve. It will curb and gutter. Moved by Councilman Gary and second by Councilman Higginbotham to grant the variance for the front set-back for the Morgan Grove Development from 20 feet to 15 feet. Roll call: South Broussard Residential Development/John C. Broussard, Tex Plumley and Steve Ashy = Mayor Langlinais stated that they came to ask for an adjustment for Fairfield Road extension. Steve stated he represents Sabal Palms. He met with the Mayor about the sewer. There will be 112 of the lots in Broussard. The sewer for it they are requesting to build a larger lift station facility for their subdivision. Billeaud Companies will donate the site and they will pay for the lift station that is needed to supply their subdivision. Billeaud Companies is willing to donate 6.29 acres for the Fairfield Road. They are asking the city to construct 2 lanes of it, to intersect with the road in their subdivision instead of going back to the Youngsville Highway. Councilman Bourque stated that City of Youngsville is interested in the project. The only problem is the landowners that will not give a right of way. This will benefit Fairfield Extension. Part of the roundabout on Hwy 89 and Fortune Road, we could build it out. Mayor Langlinais stated it was his intentions to provide a lift station at no cost. Mark questioned about the funding mechanism for the lift station; does the city want to do the impact fee? Mark explained to Mr. Ashy how it works. Mr. Ashy stated that they would consider either way. Walter stated they have all permits for Morgan Street and Dustin Circle force main. The contractor will start getting the materials together. Mark stated the two lift stations are about ready to go. Councilman Foco stated we need some numbers to amend the budget. Walter stated he will get some numbers for the road. They expect to have finish lots in 7 or 8 months. The council asked them to come back with the numbers. Rate Increases for: Water Deposits/Water Connections/Sewer Tap/Water and Sewer Rates and Garbage = After a lengthy discussion per the suggestion of the auditors being the city is losing money on utility services, the council agreed to increase the rates for: water deposits, water connections, sewer connections, water rates, sewer rates and garbage rates effective February 1, Moved by Councilman Bonin and second by Councilman Bourque to adopt Resolution #417-15, approving the following rate increases effective February 1, 2105 for: Water Deposit $ ¾ Water Connection $ inch Water Connection $1, inch Water Connection $4, Sewer Connection $ Residential Water and Sewer Rates: (Water) $7.03 for the first 2,000 gallons and $2.43 per thousand after that

4 4 Roll call: (Sewer) $4.82 for the first 3,000 gallons of water and $2.16 per thousand after that (Garbage) $19.00 per month Commercial IN TOWN Rates: (Water) $14.05 for the first 2,000 gallons and $2.43 per thousand after that (Sewer) $4.82 for the first 3,000 gallons of water and $2.16 per thousand after that Commercial OUT OF TOWN Rates: (Water) $26.01 for the first 2,000 gallons and $4.85 per thousand after that Adopt Resolution #416-15/Property donation from F.I.L., LLC (Al Theriot) = Mayor Langlinais stated that Mr. Theriot came forward a couple of months ago about water and sewer. Mayor Langlinais then met with Mike Maraist and also Cliff Guidry about property in that area. On the water issue, Al agreed to provide us a location for a deep well. They haven t done any numbers on the force main. Al stated they need to know the numbers for the lift station. This would give sewage for all four developments. The lift station will also be on the site of the test well. Don stated we are obligated under this resolution to provide water to Mr. Theriot within a year. Moved by Councilman Bourque and second by Councilman Gary to adopt Resolution #416-15, a resolution of the City Council of the City of Broussard, LA authorizing the Mayor of the City of Broussard to accept the donation of certain property from F.I.K., LLC, represented by Alfred J. Theriot, said property located in Sections 10, 15, and 37, township 11-south, range 5-East, Lafayette Parish, Louisiana. Roll call: Introduce Ordinance #15-474, Purchase of Wainwright Property = This is the site that we were looking at for a water well site. This property is on Garber Road. Don will advertise and we should be ready in a month to adopt it. There will be 3 sites to drill the wells. We tried several times to give Sheandoah some water and we were blocked by Lafayette administration. Now we can help them. Moved by Councilwoman Racca and second by Councilwoman Batiste to introduce Ordinance #15-474, an ordinance of the City Council of the City of Broussard, LA, authorizing the Mayor to purchase, by cash sales, certain real estate located within the Parish of Lafayette, Louisiana, said real estate having measurements of approximately X and containing approximately two acres of land from the Wainwright Family. Roll call:

5 5 ENGINEER s REPORT: Mark s Report: Thanks = Mark thanked the council for keeping him on as City Engineer. Overlay = The overlay project is moving along. Alberstson Parkway Drainage = The Albertson Parkway drainage is about done. Heart D Farm Road Drainage = They are clearing trees on Heart D Farm. The pipe will be in, in a couple of days. Walter s Report: Force Main = All the permits for the force main are in. South Bernard Road = Progress on South Bernard is moving slow due to weather. South Morgan Lift Station = The South Morgan Lift station finished. Drainage Improvements = They are getting ready for the drainage improvements on Morgan and Fairfield. They will need to build up another ditch behind some of the pipes. Business = Walter stated this is his 20 th year in business. They will change the logo of the business. He will change a few things also. Al s Report: Design Build for Highway 90 = Al stated that in reference to the design build project, there were four areas where the water had to be relocated. Sewer = Al stated they are working on some gravity sewer lines along St. Nazairre. Park: Second Phase = Mayor Langlinais asked Jack the status of the second phase. Jack stated David is working on this. He is just crossing the t s and dotting the I s. It

6 6 should be bidded out next month. Mayor Langlinais stated he would like it done at the end of the month. The concrete was poured on the concession stand. Accountant s Report: Monthly Report = Gene stated the expenditures on the sewer and water improvements are up. We will have to amend the budget later on. The sales tax does show a little difference. Nothing to be alarmed about right now. We will monitor the tax for the next couple of months. Bond Issues = Gene stated he received an yesterday from Donnie Cunningham about consolidating bond issues. Gene stated he will review this and he will have something at the next meeting. Attorney s Report: Thanks = Don thanked the Mayor and Council for re-appointing him. He will continue to be proud of the City of Broussard and serve them. Police Department: them. Thanks = Chief Decou thanked the council and look forward to working with Burglary = Chief Decou stat that they had a store and lock burglary on Highway 90. They were caught in progress. They made 3 arrests on that. Fatality = Chief Decou stated that they also had a fatality on Main Street which was a very tragic accident. The driver of the car committed suicide the following day. He hasn t spoken to the family yet. Fire Department: House Fire = Chief Champagne stated that they had a house fire last week in Deer Meadow subdivision. They had 17 people on the scene from Broussard. Definitely thank the paid on call system for that. Councilman Bonin stated he spoke to some residents in Deer Meadow and they were very impressed with the Fire Department. Council Business: District I/Councilwoman Racca: Thanks = Councilwoman Racca thanked the council, the employees, fire department and police department for allowing her to serve in her position and for all the help. She stated she is looking forward to working with everyone for the next 4 years.

7 7 District II/Councilman Bonin: Councilman Bonin thanked everyone also. District III/Councilman Bourque: Property Taxes = Councilman Bourque stated at the last meeting it was said that Broussard may be the only city that doesn t charge property taxes. Ryan LaGrange with LEDA is checking into this. The council thanked Ryan for doing this. District IV/Councilwoman Batiste: Councilwoman Batiste stated she is happy to be back and looking forward to working with everyone. District V/Councilman Higginbotham: Councilman Higginbotham welcomed Ms. Gert back. He stated that our show of the police force was pretty impressive tonight. District VI/Councilman Gary: Councilman Gary stated that he had nothing to report on. At Large/Councilman Foco: Thanks = Councilman Foco thanked the council for electing him Mayor Pro Tem. It has been great to help our town. Without all these businesses and this revenue, we would not be able to do what we do. He thanked the citizens of Broussard for his third term unopposed. Mayor Langlinais: Morgan Street = Mayor Langlinais stated he needs some numbers on the widening of the east side of Morgan Street. Thanks = Mayor Langlinais stated that it has been a ride. He thanked God for Don being here with him and guiding him these past years. He plans on being here as long as he is healthy and able to. He enjoys working with a council that will work with him.
