1 NORTH RIDGEVILLE CITY COUNCIL MEETING MINUTES MAY 1, 2017 CALL TO ORDER: 7:30 P.M. President Corcoran: Calling to order the Monday, May 1, 2017 regular Council meeting. INVOCATION: Led by President Corcoran. PLEDGE OF ALLEGIANCE: Led by President Corcoran. ROLL CALL: Present were Council members Dennis Boose, Bruce Abens, Bernadine Butkowski, Roseanne Johnson, Gregg Westover and President Kevin Corcoran. Robert Chapek was excused. Also present was Mayor G. David Gillock, Safety-Service Director Jeff Armbruster, Law Director Andrew Crites, Auditor Jeffrey Wilcheck, City Engineer Scott Wangler and Acting Clerk of Council Tara L. Peet. MINUTES - Corrections (if any) and approval: President Corcoran: You have before you the City Council minutes of April 17, Are there any objections or corrections to approving those minutes? Seeing none, those minutes are approved. President Corcoran: Please note we received the Board of Drainage and Flood Control minutes of October 25, 2016 and January 24, 2017 and the Civil Service Commission minutes of April 18, LOBBY: President Corcoran: We are only going to have one lobby session this evening. We are opening up lobby session right now. If you would like to speak, please step up to the podium. You will be given three minutes to speak. Would anybody like to speak? President Corcoran: Moving on to the Administrator s reports. Mayor, you are up first. ADMINISTRATORS REPORTS: A. Mayor: Thank you. On tonight s agenda is T , a Resolution to authorize participation in the ODOT winter contract for road salt. Mr. President, I am requesting the Resolution be passed this evening to meet ODOT s deadline of May 10th to lock the City into the current pricing.

2 NORTH RIDGEVILLE CITY COUNCIL 2 The Service Department is scheduled to begin tomorrow the milling and prepping of Fairacres, Glendale, Dodge & Woodlawn with paving to occur the week of May 8th. Of course this is subject to change depending on weather conditions. For the complete list of streets on this year s schedule, please visit our website at Please note we added Harding to that list. University Hospitals will be performing work at their construction site that will require a lane closure on Lorain Road from May 8 through May 19, depending on weather. The northern westbound lane, from Speedway to the Ohio Turnpike entrance will be closed. Signs will be posted and two-way traffic will be maintained. The Lorain County General Health will be sponsoring bloodwork: learn your numbers in which they ll be offering a number of days and locations throughout Lorain County. Public health nurses will conduct blood tests for adults fifty-five years and older to learn how their cholesterol, sugar and other health numbers are doing. The schedule and locations for the month of May and June have been posted on our City s website at You can call the Health Department at (440) to make a reservation. There are two offerings in North Ridgeville; however, you can schedule an appointment for any of the dates and locations that fit your schedule. The Lorain County General Health District will also be offering an additional place where families and individuals can get the vaccines they need. Every third Wednesday of the month, public health nurses will be at the Avon VFW on Mills Road to provide vaccines. Please call (440) to schedule an appointment. You ll also find this information on our city s website. As a reminder, tomorrow, Tuesday, May 2 is the Primary Election. Polls open at 6:30 a.m. and close at 7:30 p.m. There are no issues on the ballot; however, you ll be voting for Council-at- Large candidates to determine who moves forward to the November election. The annual fishing derby will be held this Saturday, May 6 from 8:00 a.m. to noon at South Central Park. The derby is free with donations of $5 accepted the day of the event for aluminum cans for burned children. Please bring your own rod and bait. This event is sponsored by the Parks and Recreation Department, North Ridgeville Firefighters and the North Ridgeville Fishing Club. Moved by Mayor Gillock and seconded by Johnson to go into executive session in place of the recess to discuss the purchase/sale of property and economic development matters. President Corcoran: Are the any questions about the motion.

3 NORTH RIDGEVILLE CITY COUNCIL 3 The motion carries. Mayor Gillock: This concludes my report. President Corcoran: Thank you Mayor. Mr. Safety-Service Director. B. Safety-Service Director: All of us in the City of North Ridgeville and including all of the entire Cleveland area had more than its share of rain in the last several weeks. To my amazement, today, we actually got a call from a constituent that wants to remain anonymous she said she is very proud of the City and what it has done to alleviate the flooding issues in the Pitts/Gina area. She also mentioned in the Bainbridge area. I wasn t sure, but then we did some research, there were homes in that area that had some flooding. The City continues to clean the ditches, the dead trees out; we are not done over at Highland. We go back over there and everyone seems to be happy in the Highland area in what we have done. I certainly appreciate the residents that are calling and saying we are doing a good job. It really feels good sometimes that we get an accolade rather than beat up. Thanks. Appreciate it. That concludes my report. President Corcoran: Mr. Engineer. C. Engineer: Thank you. In the same vein as the Safety-Service Director s report, I would like to point out that the weather man is forecasting at this point between two and three inches of rain over the course of Thursday, Friday and Saturday. That should come slow enough that it shouldn t give us too much trouble, but it is a message I have delivered many times it bears repeating. Secure your floatables, pallets, playground toys, surf boards because they caused us a headache recently because it doesn t matter how much work the Service Department does on the ditches and if the ditches are great and something goes down and obstructs those storm pipes, it creates a lot of headache. That concludes my report. President Corcoran: Thank you. Mr. Auditor. D. Auditor: Thank you. The other new Ordinance is T and that is to appropriate funds for the Center Ridge Road Project and also to amend the existing appropriations for the Capital Projects Fund and the DUI Enforcement and Education Fund. The amount appropriated in the Capital Projects Fund and the Turnpike Mitigation Project was only the City s portion. We also need to appropriate the grant proceeds that will commence. We have the entire project appropriated that was a miss in during appropriations for this year. The DUI Education and Enforcement Fund we only appropriated what the Police Chief asked for as far radar detectors go. We didn t appropriate for other expenditures in the funds such as the cost of DUI testing. We need to get that in and increase the appropriations there.

4 NORTH RIDGEVILLE CITY COUNCIL 4 Last meeting there were two Ordinances also presented: one was for the creation of the Avon Belden Road Roundabout Project a fund for that project, I m sorry. That one again is required because the grant proceeds and the City of Avon s contributions for the project so we can account for the project correctly. There was also a supplemental appropriation at that meeting and it was under first reading, was the appropriation for the Avon Belden Roundabout Project and some additional appropriations for the Fire Department because we missed a couple of line items in his budget when we passed the Ordinance. The last item that I have and this is T is an Ordinance changing the threshold for blanket purchase orders. The Ordinance was originally written without a dollar limit leaving the discretion up to the Mayor and City Auditor. I would like to have that amended to set the limit at $15,000. That is an increase from $5,000 which was originally passed several years ago. The four items: T 41, 42, T 39 and T 40 I ask that they be considered passed with the emergency so we can move forward with the projects and the encumbrance of obligations. That concludes my report. E. Other Reports: President Corcoran: We have the March 2017 Building Department report, the March 2017 Police Department report and the April 2017 Parks and Recreation Director s report. T AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH RIDGEVILLE TO RETAIN SQUIRE PATTON BOGGS (US), LLP FOR LEGAL SERVICES IN CONNECTION WITH THE RIDDELL PROJECT AND BOND COUNSEL, NOT TO EXCEED $200, FOR THE YEAR (Introduced by Mayor Gillock) Moved by Mayor Gillock and seconded by Johnson to dispense with the second and third readings for T 43. President Corcoran: Are there any comments or questions? Just to make everyone aware, this money that we are paying is not actually coming out of taxpayer funds. It is being paid for by the project itself which will be reimbursed by the project fund. Still ultimately it comes out of the taxpayer s pocket. Councilman Boose: Can you clarify that? Law Director Crites: That will be satisfied by a stream of revenue coming from the tax increment financing from the new property improvements that do not exist there today. Councilman Boose: From what fund will that come from since the TIF money is not there? Auditor Wilcheck: Our General Fund it relates to Performance Lane, correct? Law Director Crites: It is one of the construction costs that are paid back immediately from the bond issuance proceeds. Councilman Boose: So it will be there this year? Law Director Crites: Yes. Councilman Boose: Thank you. President Corcoran: All those in favor say yes. Those

9 NORTH RIDGEVILLE CITY COUNCIL 9 SECOND READINGS: T AN ORDINANCE AUTHORIZING AND APPROVING A COOPERATIVE AGREEMENT BY AND AMONG THE CITY, THE LORAIN COUNTY PORT AUTHORITY, SCANNELL PROPERTIES #277, LLC, LCN RDL, CLEVELAND (OH) LLC, RIDDELL SPORTS GROUP INC. AND U.S. BANK NATIONAL ASSOCIATION PROVIDING FOR THE CONSTRUCTION AND FINANCING OF PERFORMANCE LANE AND OTHER IMPROVEMENTS AND AUTHORIZING AND APPROVING RELATED AGREEMENTS. (Introduced by Mayor Gillock; First reading 04/17/2017) Moved by Mayor Gillock and seconded by Johnson to dispense with the third reading for T 37. Councilman Boose: Does this need amended to account for the changes to the new agreement? Law Director Crites: There is language in the Ordinance that makes reference to the agreement being on file with the Clerk instead of making it an exhibit to the Ordinance. I don t believe we need to amend by substitution. President Corcoran: In Section 1, it says this Council hereby approves the cooperative agreement a copy of which is on file with the Office of the Clerk of Council. Law Director Crites: If I may Mr. President, let me ask our Assistant Clerk of Council you have received the most recent version as is on file with the Clerk of Council. Yes sir. Law Director Crites: It was never originally an attachment. Our bond counsel asked that we didn t attach it. I wanted it attached because I know Council prefers it and I prefer it but they stated they did not want it that way. Mayor Gillock: Councilman Boose brings up a good point however, Section 1 of the Ordinance states that the Council hereby approves the agreement a copy of which is on file. The Mayor is authorized to sign the cooperative agreement on behalf of the City in substantially the form on file with the Clerk together with such revisions or additions as are approved by the Director of Law as being consistent with the objectives and requirements of this Ordinance all of which shall be conclusively evidence by the signing of the agreement. I think it is built in there that it will allow as long as the Law Director says they are consistent. The changes we ve talked about are covered by the Ordinance itself.

Councilman Boose: Mr. President, I just want to go on record that I was the only Council person to not vote in favor of the original Ordinance that brought this roundabout forward. In my review of the documentation and as it says in the Ordinance that this was one of the best solutions and though I have negotiated roundabouts in the past, quite successfully, I m still not convinced that a roundabout at this particular location by the size and what we are building is the best possible solution. However, the project is moving forward and it would be fiscally irresponsible for me or anyone else, in my opinion, to vote against providing the funding and getting the grant for it. So I will be voting in favor of it. Thank you. Councilwoman Johnson: Well, they have been around for a long time. President Corcoran: Gosh, I have been through there I don t know how many times the last couple of days and it has been backed up and a nightmare. That location needs something. The motion carries and becomes Ordinance number President Corcoran: T 35. T AN ORDINANCE AMENDING ORDINANCE NUMBER WHICH ESTABLISHED THE MONETARY LIMIT FOR "BLANKET" FISCAL OFFICER CERTIFICATES. (Introduced by Mayor Gillock; First reading 04/03/2017; Second reading 04/17/2017) Moved by President Corcoran and seconded by Johnson to amend T 35 in Section 1 to take out the words: an amount determined by the Mayor and City Auditor and replace with $15,000. President Corcoran: T 35 has now been amended. Moved by Butkowski and seconded by Johnson to adopt T 35 Amended. President Corcoran: Are there any comments or questions? Councilman Boose: Mr. President, first I want to thank the Auditor for recommending that change. I personally had an issue with an unlimited amount. I thought that we would be passing on our authority or our oversight as a legislative branch of government in doing so. I am just curious, I know it is currently $5,000 how did we arrive at the $15,000 number?

14 NORTH RIDGEVILLE CITY COUNCIL 14 Auditor Wilcheck: I took into consideration some of the things that were going on in some of the larger departments and how fast they can use up a blanket purchase order for $5,000 so we were trying to get something that would last a few months out there. The two bigger departments that run into an issue, actually there are three the Service Department with certain items, French Creek and the Senior Center dealing with the Meals on Wheels.
