1 REGULAR COUNCIL MEETING 7:00 P.M. The Council of the City of Cortland met in regular session on Monday, November 3, 2014 at 7:00 p.m. at the City Administration Building, 400 N High St, Cortland, Ohio with Council President Woofter presiding. Members of Council present were James Edwards, Dennis Linville, Deidre Petrosky, Kevin Piros, Scott Rowley and Terry Tackett. Also present at the meeting were Mayor Moll, Law Director Wilson, Police Chief Andrews, Fire Chief Rea, and Clerk of Council Horn; absent were Finance Director Moyer and Service Director Wittman. A motion to approve Council Minutes from the October 20, 2014 Regular Meeting was made by Councilman Piros and seconded by Councilman Rowley. ROLL CALL - Linville, aye; Petrosky, abstain; Piros, aye; Rowley, aye; Tackett, aye; Woofter, aye; Edwards, aye. MOTION PASSED A motion to approve Schedule of Bills to be paid totaling $96, was made by Councilwoman Petrosky and seconded by Councilman Rowley. MOTION PASSED OLD BUSINESS: ORDINANCE O An Ordinance authorizing a speed limit change from 55 mph to 45 mph along Phillips Rice Road within the city limits and requesting the Ohio Director of Transportation to review and investigate the engineering and traffic conditions of said road was read and moved for second reading by Councilman Linville and seconded by Councilman Piros. ORDINANCE PASSED SECOND READING ORDINANCE O An Ordinance authorizing an agreement for legal defense for indigents was read and moved for second reading by Councilman Rowley and seconded by Councilman Piros. ORDINANCE PASSED SECOND READING NEW BUSINESS: ORDINANCE O An Ordinance authorizing a one-time expenditure by the City of Cortland in the amount of $5,000 to help fund an updated study to determine the feasibility of constructing a lodge on Mosquito Lake was read and moved for first reading by Councilman Rowley and seconded by Councilman Piros. COUNCILMAN TACKETT - What was the total cost of the study? MAYOR MOLL - Well let me go back and give you some history. I did some research and we paid $10,000 the first time. It was a total of about $90,000 for that study. Other money came from Trumbull 100, the Tourism Bureau, the county and some other organizations. We authorized that in They finished the study in At that time we authorized another $5,000 to do the plans for the lodge. We never spent that; ODNR stopped us from going ahead with the plan. So, this time around we have ODNR in agreement. Hopefully we will update the study that was done back then. It s just been too long from 2005 when it started to now to say the economic conditions are the same. So, we are looking at that. Location is still the same so we don t have to go through that process again. Tom Chema who did the study before and was the president of Hiram is now retired. He still runs Gateway Consulting Group Inc. He is estimating $35,000. We are saying Cortland has a commitment. We will 1

2 put $5,000 up now. Trumbull 100 believes if they get enough commitments they will go ahead and fund it and then collect the money later. So, we are in a situation where we probably won t have to put out this money until next year, or maybe never. COUNCILMAN TACKETT - The study they did was favorable, correct? MAYOR MOLL - Yes. It was a favorable business model. We had good plans to go ahead. At the time ODNR didn t want to expand their footwork in the state of Ohio. As I mentioned at the last meeting, we went down about a month ago with Trumbull 100 and Tom Chema and met with ODNR again. They are very enthused about it now. We will get the business plan together. They are very supportive. COUNCILMAN PIROS - Have you had any conversations with Bazetta or Mecca? MAYOR MOLL - No, not yet. Once we get our commitment, we ll go back to Trumbull 100 and say we ve got a commitment let s go after some of these other organizations. They would all benefit from having a lodge on the lake. COUNCILMAN PIROS - Absolutely. MAYOR MOLL - I d like your support if you see fit to do that. ORDINANCE PASSED FIRST READNG MAYOR S REPORT: MAYOR MOLL Just a reminder that Election Day is tomorrow. There are some pretty important things on the slate. Not candidates necessarily but issues. I urge you all to vote. The Gingerbread Walk is Saturday, Nov 15 th with the Cortland Specialty Shops. They do it every year. It would be nice to support that activity as well. Don and Fran are not here tonight. They both had family commitments. If you have any questions related to what they would normally answer, I might be able to answer them. COUNCILMAN LINVILLE - Do you have a schedule as to when the holiday lights are going up? MAYOR MOLL No. We don t have a schedule yet. Usually it would be two to three weeks from now. COUNCILMAN LINVILLE - Speaking of lights, do we have a light bulb for the light by the entry door? MAYOR MOLL It s lit. COUNCILMAN LINVILLE - No, there s one underneath the awning that s out. CLERK OF COUNCIL HORN - It was working a few days ago. MAYOR MOLL I know I bought a light bulb for it; it s in the schedule of bills. 2

3 CLERK OF COUNCIL HORN - They guys were fixing it one morning last week or so. I don t know what happened. COUNCIL PRESIDENT WOOFTER - Are you anxious to get the Christmas lights up this year? COUNCILMAN LINVILLE - No, I was doing a segway to fixing the light by the door. I had trouble getting my key in the lock. FINANCE DIRECTOR S REPORT: (FINANCE DIRECTOR MOYER ABSENT) POLICE CHIEF S REPORT: POLICE CHIEF ANDREWS Halloween went off without a hitch. We had extra officers out. We had good weather for it. No problems whatsoever on our end. Other than that, things are running smoothly and I ll answer any questions you may have. FIRE CHIEF S REPORT: FIRE CHIEF REA I also have nothing to report. Trick or Treat went well for us too. I will be happy to answer any questions you may have for me. MAYOR MOLL Any feedback from the inspection they did? FIRE CHIEF REA No. It will be months. SERVICE DIRECTOR S REPORT: (SERVICE DIRECTOR WITTMAN ABSENT) NO COMMITTEE REPORTS COUNCIL PRESIDENT WOOFTER - Rhonda and I are working on a project as far as updating our camera system for the council chambers. We are getting prices from our IT specialist. Perhaps if prices come in correctly, we can eliminate the old recording system we have here and go directly to our server. From that, we hope to create a file and post on YouTube. The Time Warner channel hasn t been functioning and the image is poor anyway. This way it can be accessed from anyone s computer. Hopefully, by our next meeting we ll have some kind of resolution for that. DAVID CADWALLADER 231 FOX RUN DAVID CADWALLADER COUNCIL PRESIDENT WOOFTER - You had mentioned to me the stop light at Fowler and High St. Don and I went there the very next morning and we sat there and timed all the functions of the light and it s working properly. So, everything is working the way it s supposed to be working. One thing to remember, if you re on High St and you re going south, and you stop to turn left on Fowler, if you don t stop in the area of the actuation it won t 3

4 DAVID CADWALLADER 231 FOX RUN DAVID CADWALLADER - Well, the first time I saw it I as coming out on Fowler St. I was going to turn north. As I came out, I saw the light turn red for the northbound traffic on High St. The next thing I noticed, it turned green for that traffic without turning green for Fowler St. The next time I came, I came up Fowler St. and was turning south and it did the same thing. In between there were times it worked fine. Turning south from Fowler onto High St. the light turned red for the northbound traffic and the next thing I know it never turned red for the southbound traffic. There was nobody in the turning lane and the arrow turned on. Then the arrow went off and it turned green for the northbound traffic and never turned green for Fowler. I ve seen this happen four times. POLICE CHIEF ANDREWS - You and I talked and I told Don about that. It seems to be a timeframe. We had three or four of those over a course of a couple weeks and they were sporadic. Every time I told Don or our guys would go look and they d do the same thing. They would sit there for a half hour and there was nothing. DAVID CADWALLADER - I come through that intersection probably a couple dozen times and everything worked fine. The one time I was turning north, there was quite a line of traffic back there and I saw people going through the red light because they were tired of sitting there. That can create a problem. POLICE CHIEF ANDREWS - No doubt. COUNCIL PRESIDENT WOOFTER - You ve watched that Tom? POLICE CHIEF ANDREWS - Yes. About the same time we had a quite a few of them and we do go out and look at them. I know I told Don about yours. He went out and did his thing. COUNCIL PRESIDENT WOOFTER - I was there with him. We timed it and it ran flawlessly. DAVID CADWALLADER - This past week, every time I come through the intersection it s been fine. COUNCIL PRESIDENT WOOFTER - It is our responsibility to fix them. I was wrong. I misinformed you on that. I thought it was somebody other than us and that s not right. COUNCILMAN PIROS - Jim, as a segway, I know we had a study done about the light at the intersection by Beef O Brady s before they were there. It was deemed not to need any kind of additional signals or turns. With Beef O Brady s now funneling out at that intersection, do we have to initiate a new study of that intersection with additional traffic flow coming out right into it? COUNCIL PRESIDENT WOOFTER - If that was going to be done, we would have to do it and I believe we would have to pay for it. If something had to be changed with the light we would have to pay for that as well. Have you had any issues there, Chief Andrews? POLICE CHIEF ANDREWS - Surprisingly not. I thought we would have with all the traffic but we ve had nothing. COUNCILMAN PIROS - Good. 4

5 COUNCIL PRESIDENT WOOFTER - I think if there were a lot of problems there then it might be something we need to look into but I don t think it s something we will initiate that. A motion to adjourn the meeting was made by Councilman Piros and seconded by Councilman Rowley.
