1 Police Jury Room January 20, 2015 Abbeville, Louisiana Minutes of a regular meeting of the Vermilion Parish Police Jury held on January 20, 2015, with President Mr. Ronald Menard presiding. The meeting was called to order by President, Mr. Ronald Menard who asked Mr. Pervis Gaspard to lead the group in the Pledge of Allegiance. Following the pledge, Mr. Ronald Darby took a moment to give prayer and reflection, President Ronald Menard asked for phones, pagers, etc. off or set to silent mode for the duration of the Police Jury meeting. President Menard stated for the record that Mr. Ray Palmer, with Crown Architectural Metal Company, LLC, was not present for the Police Jury meeting. Upon motion by, Mr. Leon Broussard, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury approved dispensing of the reading of the minutes of the January 5, 2015, regular meeting, and was accepted as presented. President Menard recognized at this time a period for public comment on any agenda item to be considered from the audience. No comments were presented or discussed at this time. President Menard considered action to amend the agenda to discuss and consider actions on any new items presented by Engineering & Architectural reports. Upon motion by Mr. Ronald Darby, and duly seconded by Mr. Wayne Touchet, and unanimously carried, the Police Jury approved to amend the agenda to discuss and consider action on any new items presented by the Engineering & Architectural reports. President Menard recognized Mr. Gene Sellers, Jr., with The Sellers Group, to present his business to the Jury.

2 Mr. Sellers, stated the first item he would like to review with the Police Jury is the bidding of the Hardening of the Vermilion Parish Government Office Complex". Mr. Sellers informed the Police Jury that they received and submitted bids last Wednesday January 14, 2015, to the Committee and there were some irregularity with two (2) of the bids, the first bid was the low bidder and second one was the high bidder, and we have reviewed gone through the specifications and have discussed the same with Mr. Paul Moresi, III, Legal Counsel, and I have also placed a call to Facility Planning & Control, which is the State Office that takes public bids on State Projects. Mr. Sellers stated that it is clear to him that the specifications require that the contractor must have a bid bond, and the specifications require that the bid bond be accompanied by a Power of Attorney, and the low bidders bid did not have a Power of Attorney, and the high bidders bid had a bid bond that was for a different project then the one he submitted on. Mr. Sellers states that in his and Mr. Paul Moresi, III, Legal Counsel, opinion we believe those bids are non-responsive, because they do not comply with the requirements of the specifications, and there is a State Law that states " That no public entity can waive a requirement of the bid requirements". Upon motion by Mr. Errol Domingues, and duly seconded by Mr. Cloris Boudreaux, and unanimously carried, the Police Jury rejected the lowest bid received from Crown Architectural Metal Company, LLC, for being non-responsive to the bid specifications or failure to provide the Power of Attorney, relative to the " Hardening of the Vermilion Parish Government Office Complex". Upon motion by Mr. Pervis Gaspard, and duly seconded by Mr. Cloris Boudreaux, and unanimously carried, the Police Jury rejected the highest bid received from Miller Roofing, LLC, for having an invalid bid bond, relative to the " Hardening of the Vermilion Parish Government Office Complex". Upon motion by Mr. Kevin Sagrera, and duly seconded by Mr. Errol Domingues, and unanimously carried, the Police Jury awarded the lowest bid meeting specifications to Ribbeck Construction Corp, in the amount of $445, , relative to the " Hardening of the Vermilion Parish Government Office Complex". Contingent upon the CDBG approval. Mr. Seller' s states that along those lines The Sellers Group requested an amendment to our Contract between the Vermilion Parish Police Jury and The Seller' s Group, to add the CDBG provisions for professional services, and at this time we would like to offer to amend our contract again because the project is under the budget, and we agree to lower our fees to the actual bid. Mr. Seller' s follows: presented two ( 2) quotes for a flared ramp at the Vermilion Parish Courthouse as a) Venable Contractors 12, ( Assumes no Building Permit fee required) b) Quality Concrete 13, Upon motion by Mr. Nathan Granger, and duly seconded by Mr. Wayne Touchet, and unanimously carried, the Police Jury authorized The Sellers Group to acquire quotes to install hand rails in front of the Vermilion Parish Courthouse, with an approximate cost of $9, , and authorize Ms. Linda Duhon Parish Administrator to award the lowest quote received, relative to installing hand rails in front of the Vermilion Parish Courthouse. Mr. Seller' s states that he has a budget estimate to do the installation of the truck bays at the Henry Fire Station, where there were problems with the heating of the building, and the insulation that will be installed is a " Retro Fit Vinyl Faced Insulation", which is what was installed on the roof of the Henry Fire Station, and this cost was approximately$ 4,000.00, according to the estimate.

3 Lengthy discussion followed: Upon motion by Mr. Errol Domingues, and duly seconded by Mr. Kevin Sagrera, and unanimously carried, the Police Jury approved to install " Retro Fit Vinyl Faced Insulation", at the Henry Fire Station, at an approximate cost of$4, Cost to be paid from 76' Sales Tax. President Ronald Menard recognized Mr. Todd Vincent, with Sellers & Associates, Inc., to present his business to the Jury. Mr. Vincent presented to the Police Jury for their approval two ( 2) Letters of No Objection as follows: Upon motion of Mr. Sandrus Stelly, duly seconded by Mr. Cloris Boudreaux, the Police Jury approved a " Letters of No Objection" to Slemco, for a proposed bore and installation of ( 1) 2- inch conduit to provide electrical service for John G. Broussard, located at Linda Road: approximately 10 miles southwest of Abbeville at the intersection of 5 Oaks Road and Linda Road off Highways 35 and 692, in Election District No. 13. Upon motion of Mr. Errol Domingues, duly seconded by Mr. Pervis Gaspard, with Mr. Nathan Granger abstaining, the Police Jury approved a " Letters of No Objection" to Hilcorp Energy Company, for a proposed approximately 220 feet of( 2) 4- inch sales flow lines to serve the Chris R. Prospect Well, aka Adelaide D. Broussard Well No. 11 ( D), located S 28, T13A, R3E: 7. 5 miles southeast of Abbeville, north side of Highway 330 between Highway 331 and Aurelien Road on private lands. Mr. Vincent presented to the Police Jury for their approval Partial Payment No. 5, to LeBlanc Marine, LLC, in the amount of$ 61, , relative to the Coastal Impact Assistance Program No. F12AF70192, Shoreline Protection and Marsh Creation at Tiger Point for the Vermilion Parish Police Jury". Upon motion of Mr. Errol Domingues, duly seconded by Mr. Kevin Sagrera, the Police Jury approved Partial Payment No. 5, to LeBlanc Marine, LLC, in the amount of$ 61, , relative to the Coastal Impact Assistance Program No. Fl2AF70192, " Shoreline Protection and Marsh Creation at Tiger Point for the Vermilion Parish Police Jury". Mr. Vincent stated that sometime back the Police Jury approved a final plat of Mr. Richard L. Leblanc property partition for Entergy, and the Permit person found a mistake on their final plat and they are requesting a revised final plat approval, which we are recommending. Upon motion of Mr. Pervis Gaspard, duly seconded by Mr. Dane Hebert, the Police Jury gave revised final plat approval, to Mr. Richard L. Leblanc property partition for Entergy, in Election Districts No. 3 & 8. Mr. Errol Domingues, asked Mr. Gene Sellers, about the last water lines that was installed through Henry, and they ran the waterlines through the ditches when it was wet, and the Parish Roads ditches we have already taken care of when they were stopped up, and they never came back to address the reaming ditches, and we were supposed to meet to look at some of the State Road concerns, and I have been cleaning the ditches that are in my fields with my excavator, and there are some that are along fence lines that I am unable to get to. President Ronald Menard recognized Mr. Kim Touchet, with Primeaux, Touchet, & Associates to present his business to the Jury. Mr. Kim Touchet, with Primeaux, Touchet, & Associates, stated that he has no business to be presented to the Police Jury at this time.

4 President Menard recognized the reports of the General Needs Committees Recommendation to be presented. Mr. Errol Domingues asked if there were any changes or amendments to the General Needs Committees Recommendation to be presented. Ms. Linda Duhon, Parish Administrator stated that Item No. 3, which states, " It is recommended that the Police Jury adopt a Budget Amendment to purchase a pickup truck for the Area I Barn", and I went on State Contract and the type of a V- 8 pickup truck is not available at this time and they are renegotiating their contracts with the State, and this pickup truck will not be available until March 1, Ms. Linda Duhon, Parish Administrator stated that she needs to add: It is recommended that the Police Jury approve the request of District Attorney Mr. Keith Stutes, an annual salary of$ 26, , as of January 12, Ms. Linda Duhon, Parish Administrator stated that Mr. Gene Sellers, Jr., with the Sellers Group would like to amend Item No. 8, of the General Needs Recommendations. Mr. Gene Sellers, Jr., with the Sellers Group informed the Police Jury that since the amount to do the project is $ 50, less, The Sellers Group fee would be reduced, because our fee is a certain percentage based on the estimated construction cost. Upon motion by Mr. Mark Poche', and duly seconded by Mr. Kevin Sagrera, and unanimously carried, the Police Jury approved to delete Item No. 3. Upon motion by Mr. Mark Poche', and duly seconded by Mr. Kevin Sagrera, and unanimously carried, the Police Jury approved to amend Item No. 8 to add: to agree to lower the fees to the actual bid. Upon motion by Mr. Errol Domingues, and duly seconded by Mr. Dane Hebert, and unanimously carried, the Police Jury accepted the General Needs Committees Recommendation as amended, and the appropriate officials were authorized to carry out the recommendations. Upon motion by Mr. Errol Domingues, and duly seconded by Mr. Paul Bourgeois and unanimously carried, the Police Jury considered action to amend the agenda to discuss District Attorney Mr. Keith Stutes, annual salary. Upon motion by Mr. Errol Domingues, and duly seconded by Mr. Paul Bourgeois, and unanimously carried, the Police Jury approved District Attorney Mr. Keith Stutes an annual salary in the amount of 26,208.00, as of January 12, GENERAL NEEDS COMMITTEE JANUARY 14, 2015 ABBEVILLE, LOUISIANA AS A RESULT OF A GENERAL NEEDS COMMITTEE MEETING HELD ON JANUARY 14, 2015, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY' S CONSIDERATION: 1. It is recommended that the Police Jury approve Ward 9 City Court Judge Frank Stanton Hardee III, an annual salary of$ 7, , as of January 12, It is recommended that the Police Jury approve to purchase through State Contract a pickup truck for the Area I Barn and send Unit to auction.

5 3. It is recommended that the Police Jury adopt a Budget Amendment to purchase a pickup truck for the Area I Barn. 4. It is recommended that the Police Jury appoint Mr. Wayne Touchet, to serve on the Local Emergency Planning Committee. 5. It is recommended that the Police Jury authorize Ms. Linda Duhon, Parish Administrator to release the Seismic Performance Bond for Permit No. 678, to Western G E Company, in Vermilion Parish, and West Cameron Parish. 6. It is recommended that the Police Jury approve not to repair the mill and no longer use the mill at the Solid Waste Facility. 7. It is recommended that the Police ratify the " Right Sizing Project" to transfer Pleasant Drive from its intersection with State Route La 690 proceeding south approximately miles to the entrance to Palmetto Island State Park, and the State will exchange State Route La 1260 in its entirety from the east side of the Vermilion Parish ( at the old Banker Ferry Landing) proceeding east for approximately miles to its intersection with State Route La Hwy 330, and to authorize the President to sign. 8. It is recommended that the Police amend the Contract between the Vermilion Parish Police Jury and The Seller' s Group, to add the CDBG provisions for professional services. 9. It is recommended that the Police approve Final Payment, to Glenn Lege Construction, in the amount of $4, , relative to the " Vermilion Parish School Board Roadway Improvements Pirate Lane Kaplan High School, Kaplan, Louisiana". 10. It is recommended that the Police Jury place a freeze on hiring and withhold from adopting budget amendments unless there is a critical need. 11. It is recommended that the Police Jury purchase one ( 1) 24 foot Tag- A-Long Trailer for the Public Works Barn, and award the lowest quote to Thib' s Trailers Inc. in the amount of 11, , relative to purchase a 24 foot Tag- A-Long Trailer for Parishwide. 12. It is recommended that the Police Jury authorize the President, Vice President, and Treasurer, & Assistant Treasurer, to sign any and all official Police Jury documents. 13. It is recommended that the Police Jury hire Ms. Bridgitte Castaneda, as a part time employee in the Administrative Office, to take care of complaints relative to Progressive Waste Solutions of La, Inc. garbage pickup. Salary will be charged to the 94' Sales Tax. 14. It is recommended that the Police Jury nominate Ms. Pat Ross as the Parish Lender Representative and Ms. Anne Falgout as the Economic Development Representative on the Acadiana Planning Committee/ District 4 authorize the President to sign the nomination form. 15. It is recommended that the Police Jury approve to purchase ( 18) eighteen Samsung Galaxy Tab Protective Cases from Radio Shack, at a cost of$39.99 each= $ Cost to be paid from FY Louisiana Government Assistant Program ( LGAP) Grant. 16. It is recommended that the Police Jury approve payment of an Invoice dated January 6, 2015, to Ms. Melissa R. Guidry, in the amount of $90. 00, relative to the Website maintenance for the Vermilion Parish Police Jury ( vppj. org), for the months of (September 1, December 31, 2014).

It is recommended that the Police Jury approve payment of an Invoice No , to Louisiana Testing & Inspection Inc., in the amount of$ 1, , relative to testing performed at the landfill associated with the Vermilion Parish Police Jury Leachate Subtitle D-Phase II, Area II-B. 18. It is recommended that the Police Jury approve payment of Invoice No , to Pace Analytical, in the amount of $4, , relative to the Leachate Testing for ground water monitoring wells at the landfill. 19. It is recommended that the Police Jury approve the request of District Attorney Mr. Keith Stutes, to hire Ms. Amanda Liotto- Rogers, who will be replacing Mr. Michael Barras as a full time Assistant District Attorney at a salary of$ 10, annually. 20. It is recommended that the Police Jury rescind Ordinance No , authorizing the Private Sale of Surplus Property owned by the Vermilion Parish Police Jury, " Old Herod School". 21. It is recommended that the Police Jury approve payment of Invoice No , to Arthur J. Gallagher Risk Management Services, Inc., in the amount of $ , relative to the Renewal Surety Oath of Office Bond, for the Mr. Ronald Menard President Vermilion Parish Police Jury. 22. It is recommended that the Police Jury approve payment of Invoice No , to Kolder, Champagne, Slaven & Company, LLC, in the amount of $12, , relative to professional services provided for the audit of the 12/ 31/ 14 financial statement. 23. It is recommended that the Police Jury approve payment of Invoice No , to Progressive Waste Solutions of LA, Inc., in the amount of$ 173, relative to the December, 2014 Residential Garbage Service. 24. It is recommended that the Police Jury approve payment of Application Payment No. 1, to The Lemoine Company, LLC, in the amount of$ 15, , relative to the HMGP, Project No , Hardening of Abrom Kaplan Memorial Hospital". 25. It is recommended that the Police Jury ratify a 180- day extension of Building Permit No , issued to Mr. Scott Montet, for an extension of additional 180- days ( expiring May 29, 2015), relative to Building Permit No located at 2423 La Hwy 343, Maurice, La in Election District No It is recommended that the Police Jury approve payment of Invoice No. 3016, to Minvielle & Associates, Inc., in the amount of $ , relative to prepared application under the Local Government Assistance Program for a $ 16, 167 Grant for new Accounting Software, Application dated December 16, It is recommended that the Police Jury ratify authorizing The Sellers Group to acquire quotes or bids, relative to installing a ramp at the Tivoli Street Entry at the Vermilion Parish Courthouse. 28. It is recommended that the Police Jury approve the Section 5311 Financial Activity Report for the month of DECEMBER, 2014, as submitted by the Vermilion Council on Aging and direct the Parish Administrator to submit the report to the Department of Transportation and Development for reimbursement in accordance with the contract agreement. 29. 7 President Menard considered action to adopt Budget Amendment Upon motion by Mr. Mark Poche', duly seconded by Mr. Ronald Darby, and unanimously carried, the Police Jury adopted Budget Amendment as presented. Budget Amendment GENERAL FUND: Expenditures: Economic Develop. & Promotion: V.P. Economic & Development District: Appropriation: To increase the 2015 budget figures in the amount of$ 100, for the yearly allocation in accordance with the agreement. The anticipated 12/ 31/ 15 Fund Balance is to be adjusted accordingly. SALES TAX & BOND FUND: Expenditures: Public Safety: Fire Protection - Rural: To increase the 2015 budget figures by the following amounts to include carry over balances from the 2014 allocation: Indian Bayou 3, Maurice Vol. Fire Dept. 1, District 13 Vol. Fire Dept Pecan Island Fire Dept t' Ward Fire Department 1, Gueydan Sub. Bldg. & Eqpt. 22, Klondike Vol. Fire Dept. 13, Leleux Vol. Fire Dept. 1, LeBlanc Vol. Fire Dept. 6, Meaux-Nunez Vol. Fire Dept President Menard considered action to adopt a resolution authorizing the filing of an application with the Louisiana Department of Transportation and Development for a Grant under 49 CFR 5311, Non- Urbanized Area Formula Program and/ or 49 CFR 5309, Discretionary Capital Program. Upon motion by Mr. Ronald Darby, duly seconded by Mr. Wayne Touchet, and unanimously carried, the Police Jury adopted a resolution authorizing the filing of an application with the Louisiana Department of Transportation and Development for a Grant under 49 CFR 5311, Non-Urbanized Area Formula Program and/or 49 CFR 5309, Discretionary Capital Program. President Menard considered action to amend the agenda to discuss and consider actions on any new items presented by the Parish Administrator. Upon motion by Mr. Kevin Sagrera, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury amended the agenda to discuss and consider actions on any new items presented by the Parish Administrator. President Ronald Menard recognized Ms. Linda Duhon, Parish Administrator to present her business to the Jury.

8 Ms. Linda Duhon, Parish Administrator informed the Police Jury that they held a Coastal Protection Restoration Committee meeting prior to tonight' s Police Jury meeting, and due to the fact that the recommendations are now before you, I will ask for action to be taken before the Police Jury at this time. Upon motion by Mr. Kevin Sagrera, duly seconded by Mr. Pervis Gaspard, and unanimously carried, the Police Jury amended the agenda to discuss and consider actions, relative to the Coastal Protection & Restoration Committee Recommendations. Ms. Linda Duhon, Parish Administrator informed the Police Jury that if the Vermilion Parish Police Jury' s request that should funds be available, that the CWPPRA Task Force consider approving Southeast Pecan Island Marsh Creation and Freshwater Enhancement for E & D Phase I approval, this project received support from four agencies and was next in line for Phase I funding should funding be available. This project would restore, create and improve emergent marsh in Vermilion Parish and throughout the project area, it would also supply needed freshwater into the Chenier Sub-basin ( below Hwy 82) to increase the productivity of the marshes, and your consideration is this matter is greatly appreciated Upon motion by Mr. Kevin Sagrera, duly seconded by Mr. Mark Poche', and unanimously carried, the Police Jury approved to send a request that should funds be available, that the CWPPRA Task Force consider approving Southeast Pecan Island Marsh Creation and Freshwater Enhancement for E & D Phase I, which would restore, create and improve emergent marsh in Vermilion Parish and throughout the project area, it would also supply needed freshwater into the Chenier Sub- basin ( below Hwy 82) to increase the productivity of the marshes. Upon motion by Mr. Kevin Sagrera, duly seconded by Mr. Errol Domingues, and unanimously carried, the Police Jury approved to send a letter to Mr. Troy Mallach, to support the NRCS proposal for the Region 3, PPL 25 Project North Vermilion Bay and Marsh Creation and Shoreline Projects, and in Region 4, PPL 25 Project to support the NRCS proposal for South Pecan Island Anchor Marsh and Terrace Project, for engineering and design. Ms. Linda Duhon, Parish Administrator informed the Police Jury that she received a quote in the amount of$ 117, , from Langlinais Tractor Inc., ( State Contract No ), relative to purchasing one ( 1) New Holland Tractor, and one ( 1) Tiger Boom Mower, for the Area II Barn. In the 2015 Budget these two (2) pieces of equipment was budgeted for$ 95, Upon motion by Mr. Pervis Gaspard, duly seconded by Mr. Allen LeMaire, with Mr. Errol Domingues, Mr. Dane Hebert, and Mr. Kevin Sagrera, abstaining the Police Jury authorized the purchase through ( State Contract No ), from Langlinais Tractor Inc., to purchase one ( 1) New Holland Tractor, and one ( 1) Budget Amendment No Tiger Boom Mower, for the Area II Barn, in the amount of$ 117,206.25, and adopt Budget Amendment PARISHWIDE: Expenditures: Transportation: Road Maintenance: Purchase Heavy Equipment/ Vehicles: To increase the 2015 budget figures in the amount of$ 23, relative to the additional purchase cost for the tractor and brush cutter for Area II Barn. The anticipated 12/ 31/ 15 Fund Balance is to be adjusted accordingly.

9 Ms. Linda Duhon, Parish Administrator informed the Police Jury that she has received few quotes for Judge Hulin' s Office, but we still have not received three ( 3) quotes which we are still working on it. Upon motion by Mr. Mark Poche', duly seconded by Mr. Ronald Darby, and unanimously carried, the Police Jury approved to place a cap in the amount of$ 15, , relative to the renovations in Judge Hulin' s Office, and anything more than $ 15, , will need to be presented before the Police Jury for further approval. Ms. Linda Duhon, Parish Administrator informed the Police Jury that attached in their packets is a Court Order from 15th Judicial District Court for the guidelines for District Wide Security, and I will be meeting with Rivers Security tomorrow morning. Mr. Paul Moresi, III, Legal Counsel informed the Police Jury that he has read the Court Order from 15th Judicial District Court for the guidelines for District Wide Security, and the District Judge' s together issued an Order, and put together guidelines with the intent of all three ( 3) Parish Courthouse' s in the 15th Judicial District Courts to have consistent guidelines. Upon motion by Mr. Ronald Darby, duly seconded by Mr. Allen LeMaire, and unanimously carried, the Police Jury approved payment of Invoice Dated 01/ 06/2015 to LaSalle Correctional Center, in the amount of$2, , relative to the housing of inmates for the Month of December, It is further recommended that the Police Jury authorize Legal Counsel to send a letter with the attached check stating that the Police Jury is not binding itself to any rate by making the payment for the housing of Vermilion Parish inmates. Upon motion by Mr. Ronald Darby, duly seconded by Mr. Cloris Boudreaux, and unanimously carried, the Police Jury approved payment of Invoice Dated 01/ 05/ 2015 to Richland Parish Detention Center Sheriffs Office, in the amount of$ 2, , relative to the housing of inmates for the Month of December It is further recommended that the Police Jury authorize Legal Counsel to send a letter with the attached check stating that the Police Jury is not binding itself to any rate by making the payment for the housing of Vermilion Parish inmates. Ms. Linda Duhon, Parish Administrator informed the Police Jury that on the County Agent Building, the Police Jury had taken action to send a letter to Foley & Judell authorizing them to prepare the paperwork, relative to the holding an election on May 2, President Menard recognized Mr. Paul Moresi, III, Legal Counsel to present his business to the Jury. Mr. Moresi, informed the Police Jury that he has completed the annual audit letter to your auditors, relative to Law Suits, and there are only three ( 3) other suits that are pending now, the first one is a damage suit, and the other two (2) are relatively modest, which is good news. Mr. Moresi, informed the Police Jury that he sent the letters out to the residence located in Election District No. 8, relative to leaving their garbage cans out on the road over 24 hours. Mr. Moresi gave his update on the Landfill Fire, and stated that the Attorney that represents Maurice Sand and Dirt has asked me to provide them a list of all the witness that I intend to call, and he informed me that he would like to approach his client to possibly making a settlement offer. President Menard reminded the Police Jury that the Police Jury Convention will be held on January 29-31, 2015, in New Orleans, La. President Menard recognized Police Juror Business to be present.
