1 THE CORPORATION OF THE TOWNSHIP OF MADAWASKA VALLEY REGULAR COUNCIL MEETING MINUTES Monday, June 16, 2014 COUNCIL PRESENT: STAFF: OTHERS: David Shulist, Mayor Carl Bromwich, Councillor (absent) Bob Kulas, Councillor Linda Neuman, Councillor Sylvie Yantha, Councillor Craig Kelley, CAO/Clerk Brenda Sabatine, Treasurer/Deputy Clerk Gwen Dombroski, Administrative Assistant-Recording Secretary Christine Hudder, The Valley Gazette Mary-Rose Dawes, Kim Love, Kevin Marquardt, Mary Marquardt, Martin Serran and Halinka Shulist 1. Call to Order The Meeting was called to order at 7:00 p.m. 2. Moment of Reflection Mayor Shulist congratulated all students on their upcoming graduations and wished them well in their future endeavors. Mayor Shulist welcomed Craig Kelley in his new role as CAO/Clerk and thanked Brenda Sabatine for her dedication in the past months as Acting CAO/Clerk. 3. Declaration of Pecuniary Interest - None 4. Adoption of the Agenda 4.1 Monday, June 16, THAT the Regular Council Meeting Agenda for Monday, June 16, 2014 be approved as amended. 5. Delegation - None 6. Confirmation of the Minutes 6.1 Regular Council Meeting Minutes - June 2, THAT the Regular Council Meeting Minutes of June 2, 2014 be approved as presented.
2 7. Business Arising from the Minutes - None 8. Committee Reports 8.1 Recreation, Heritage, Community Economic Development Committee Meeting Minutes - June 4, THAT the Recreation, Heritage, Community Economic Development Committee Meeting Minutes of June 4, 2014 be approved as presented with the following recommendations: 1. THAT the Recreation, Heritage and Community Economic Development Committee recommend that Council approve a 50% reduction to the rental fees for the Paul J. Yakabuski Community Centre the hosting of a Video Dance for one time only to the Barry's Bay and Area Minor Hockey Association. 2. THAT the Recreation and Community Development Committee recommend that Council adopt the Ice Allocation Policy (as amended) to be implemented for the 2014/2015 Ice Season. 3. THAT the Recreation, Heritage and Community Development Committee recommend Council approve the Wilno Recreation Corporation receive the annual $2, operating grant provided they present an annual budget and financial statements prior to receiving this funding. 8.2 Special Roads, Property and Planning Committee Meeting Minutes - June 5, Moved by: Councillor Kulas THAT the Special Roads, Property and Planning Committee Meeting Minutes of June 5, 2014 be approved as presented with the following recommendation: 1. THAT the Roads, Property and Planning Committee recommend Council approve the directions given In-Camera to Mary Shushack and Gord Kreiger to forward correspondence to Lakewood Developments Inc. 8.3 Roads, Property and Planning Committee Meeting Minutes - June 11, THAT the Roads, Property and Planning Committee Meeting Minutes of June 11, 2014 be approved as presented with the following recommendations: 1. THAT the Roads, Property and Planning Committee subject to the recommendations made by Mr. Cheesman and the letter from Mr. Howe, and the fact that no new development is being proposed, it is recommended Council
3 approve severance application File Number B40/14, as applied for with the only requirement being a Reference Plan of survey. 2. THAT the Roads, Property and Planning Committee recommend Council deny the request from Lorraine Carr at 360 Horseshoe Lane. 3. THAT the Roads, Property and Planning Committee recommend Council direct staff to provide the Ministry of Environment and abutting landowner the Geo-Logic Report and proceed with Geo-Logic's recommendation; AND THAT staff remove buildings and landscape the property at 236 John Street to include topsoil, grass seed and gravel to make the property visually appealing. 4. THAT the Roads, Property and Planning Committee recommend Council direct the Chief Building Official to complete a full building inspection on the Adrain Museum including determining if the building is safe to currently occupy as well as costs associated with repairs and provide the Combermere Craft Committee with a report on the status of the building and the costs for moving the building and the repairs required for the building. 5. THAT the Roads, Property and Planning Committee recommend Council approve Margaret and Martin Serran at their cost be allowed to construct a road for access purposes to Con 1, Lot 5, Radcliffe within the road allowance subject to entering into a "Use of Road Allowance agreement" registered on title, with all survey and legal costs. 8.4 Special Water, Wastewater, Waste Management Committee Meeting Minutes - June 12, Seconded by: Councillor Neuman THAT the Special Water, Wastewater, Waste Management Committee Meeting Minutes of June 12, 2014 be approved as presented. 9. By-Laws 9.1 By-Law RE: Shoreline Road Allowance closure and disposition along Blackfish Bay, in front of Lot 6, Concession 10, designated as Parts 2 & 3 on Reference Plan 49R-18272, geographic Township of Radcliffe (Roe) THAT By-Law Being a By-Law to provide for the closing and stopping up of parts of an original allowance for road along the shore of Blackfish Bay in front of Lot 6 Concession 10 in the geographic Township of Radcliffe, in the Township of Madawaska Valley in the County of Renfrew and for the sale thereof to the abutting land owners be given third and final reading this 16th day of June 2014.
4 9.2 By-Law RE: Municipal Employment By-Law (2014) THAT By-Law Being a By-Law regulating the appointment, duties and remuneration of Township Officers and Staff be given first and second reading this 16th day of June Accounts THAT By-Law Being a By-Law regulating the appointment, duties and remuneration of Township Officers and Staff be given third and final reading this 16th day of June New Business 11.1 Letter from Joan Booth, Executive Director, Spina Bifida & Hydrocephalus - June 5, 2014 RE: Proclamation Request - Spina Bifida and Hydrocephalus Awareness Month Moved by: Councillor Kulas Seconded by: Councillor Neuman WHEREAS Spinda Bifida is a birth defect that develops within the first four weeks of pregnancy resulting in varying degrees of permanent neurological damage; and WHEREAS hydrocephalus is an excessive accumulation of fluid in the brain. It may be present at birth or may develop at any stage later in life; and WHEREAS there is no cure for either of these conditions that result in varying degrees of disability; and WHEREAS the Spina Bifida and Hydrocephalus Association of Ontario serves people with spina bifeda and hydrocephalus, their families and the public; and WHEREAS Health Canada has proclaimed June as Spina Bifida and Hydrocephalus Awareness Month; and WHEREAS there are many people who are not aware of the Association or that it offers support, information and education programs and funds research to find ways to prevent and treat these conditions; and WHEREAS the Association encourages all Ontarians to learn more about these conditions and to appreciate the challenges faced by individuals affected by them, therefore
5 BE IT RESOLVED THAT Council hereby proclaims the month of June to be SPINA BIFIDA AND HYDROCEPHALUS AWARENESS MONTH in the Township of Madawaska Valley and urges all citizens to give full consideration and attention to the Spina Bifida and Hydrocephalus Association of Ontario for their work on behalf of those with spina bifida and hydrocephalus and their families Letter from Bell - June 6, 2014 RE: CRTC letter re: Broadband Expansion in your Area Information. 12. Old Business 12.1 Letter from Canadian Wireless Telecommunications Association - June 5, 2014 RE: Township of Madawaska Valley Cell Tower Resolution - May 5, 2014 Information. Direction was given to staff to contact CanACRE Ltd. regarding other possible sites for the cell tower currently proposed in the vicinity of Serran Road. Direction was also given to Staff to invite Canadian Wireless Telecommunications Association to a Committee/Council Meeting as per their offer to provide more information and assistance in regards to cell towers from Ish Theilheimer, Stone Fence Theatre - June 12, 2014 RE: Stone Fence Theatre Donation/Sponsorship Request Council reviewed Stone Fence Theatre's sponsorship request, in exchange for a reduction in the lounge rental fee at the Paul J. Yakabuski Community Centre and decided to remain status quo and charge applicable fees for the 2014 rental. 13. In-Camera THAT the meeting enter In-Camera Session at 7:19 p.m. to discuss matters pertaining to the "security of the property of the municipality or local board", "personal matters about an identifiable individual, including municipal or local board employees", "advice that is subject to solicitor-client privilege, including communications necessary for that purpose", Ontario Municipal Act 2011, c.25, s.239 (2)(a)(b)(f). 1. Return to Open Session THAT the Meeting return to open session at 7:42 p.m. Mayor Shulist advised that the In-Camera Meeting Minutes were approved as presented, the statement of claim was received as information and the Scholarship and Bursary donation will be divided between two recipients. 15. Confirming By-Law 15.1 By-Law RE: Confirming By-Law - Regular Council Meeting of June 16, THAT By-Law
