ADOPTION OF MINUTES 1. Committee of the Whole minutes of May 6, 2013 for adoption. 2. Parcel Tax Roll Review Panel minutes of May 6, 2013 for receipt. 2. Regular Open minutes of May 6, 2013 for adoption. 3. Special Open minutes (Business Plan Update) of May 13, 2013 for adoption. The Committee of the Whole minutes of May 6, 2013, the Regular Open minutes of May 6, 2013, and the Special Open minutes of May 13, 2013 were adopted by consensus. The Parcel Tax Roll Review Panel minutes of May 6, 2013 were received by consensus. BUSINESS ARISING FROM PRIOR MINUTES 1. Airport Study Funding Motion released from In Camera meeting held May 6, Report from CAO MOTION 135 /13 Moved by Councillor Rhodes and seconded by Councillor Plante and resolved that Council approves providing to a maximum of $5,000 as the Town s contribution to the Airport assessment study. 2. Osoyoos Indian Band Phase 3 Spirit Ridge Sewer Service Motion from In Camera meeting held May 6, 2013 MOTION 136 /13 Moved by Councillor Rhodes and seconded by Councillor Plante and resolved that the following motion be released to a public meeting: MOTION IC 626/12 Moved by Councillor Ryan and seconded by Councillor McKortoff and resolved that staff be directed to return to the OIB with an offer of $8,000 per unit sewer fee for Spirit Ridge Phase 3. 2 DELEGATIONS 1. Presentation of Community Services Grants - Director of Community Services Cheques were presented to community organizations. A photo was taken with Council and all recipients. 2. Notice on Title Josip Erdeljac, of th Street, Osoyoos in attendance - Report from Chief Building Inspector - Mr. Erdeljac came forward to speak to the matter. - Stated that $10,000 was taken from his account. Requested a meeting to inspect documents including receipts from the Town. - Senior Building Inspector stated that two Ombudsperson inquiries found the Town was not responsible and had treated Mr. Erdeljac fairly. - Senior building inspector has all receipts and records show services were disconnected MOTION 137/13 Moved by Councillor Rhodes and seconded by Councillor Plante and resolved that Council approves proceeding with filing of a Notice on Title for property located at th Street, Osoyoos. WATER MATTERS 1. Water Accounts in the amount of $29, for approval. MOTION 138/13 Moved by Water Councillor Moreira and seconded by Councillor McKortoff and resolved that the Water District Accounts in the amount of $29, be approved. Water Councillor Moreira, Senior Building Inspector Pagett and Mr. Erdeljac left the meeting at 2:33 p.m. CORRESPONDENCE 1. Report from Okanagan Basin Water Board May 9, 2013 meeting highlights BYLAWS The report be received for information by consensus. 1. Land Use Procedures (LUP) Amendment Bylaw No , 2013 and the Terms of Reference (TOR) of the Advisory Design Panel (ADP) MOTION 139 /13 Moved by Councillor McKortoff and seconded by Councillor Ryan and resolved that Land Use Procedures Amendment Bylaw No , 2013 be read a first, second and third time. 3 BUSINESS MOTION 140/13 Moved by Councillor McKortoff and seconded by Councillor Ryan and resolved that Council approves the changes to the Terms of Reference of the Advisory Design Panel and directs staff to proceed with advertising for the recruitment of Panel members to be considered by Council. ACTION: Letters of thanks to be sent to the past panel members for their service. 1. Council Meeting Report Expenses for Mayor Wells, Councillors Ryan and McKortoff - Councillor McKortoff requested that the date on her report be amended to read April 30 to May 3. MOTION 141/13 Moved by Councillor Rhodes and seconded by Councillor Plante and resolved that the expenses for Mayor Wells in the amount of $200.00, for Councillor Ryan in the amount of $300.00, and for Councillor McKortoff, as amended, in the amount of $ be approved. 2. Fireworks Fundraising - Report from CAO MOTION 142/13 Moved by Councillor McKortoff and seconded by Councillor Rhodes and resolved that staff be directed to advertise an intention to loan the funds requested for the July 1 st fireworks display; and that Council follows the Community Charter requirements for newspaper notification. 3. Osoyoos Indian Band Phase 3 Sewer servicing agreement - Report from CAO - Discussion on completion of capacity study MOTION 143/13 Moved by Councillor Rhodes and seconded by Councillor McKortoff and resolved that Council approves the sewer service agreement with the OIB enabling them to access 45 units of sewer capacity at a rate of $8,000 per unit. 4 1 Councillor Plante opposed MOTION 144/13 Moved by Councillor Ryan and seconded by Councillor Plante and resolved that Council will not approve any further extraterritorial sewer services until Council has received and approved the pending capacity study Storm Sewer Tender - Report from Director of Financial Services - Mayor Wells noted the significant dates section added to staff reports to address the length of time that projects may take to complete. 4 MOTION 145 /13 Moved by Councillor Rhodes and seconded by Councillor McKortoff and resolved that Council approves awarding the 2013 Storm Sewer Tender to V-Line Construction in the amount of $133,444.60, including contingency allowance and G.S.T. Building Permit Report for the month of April, 2013 MOTION 147/13 Moved by Councillor Rhodes and seconded by Councillor Ryan and resolved that the Building Permit Report for the month of April, 2013 be received as information. 3. Committee Reports - Councillor McKortoff reported on the Economic Development Advisory Committee minutes of May 8, 2013 MOTION 148 /13 Moved by Councillor Ryan and seconded by Councillor Plante and resolved that the minutes of the Economic Development Advisory Committee meeting held May 8, 2013 be received as information. 4. CAO Report Barry Romanko presented his report, a copy of which is attached to and forms part of these minutes. 5 May 8 attended Okanagan Similkameen Healthy Living Coalition Walked at Move for Health Day with Mayor Wells Attended opening and unveiling of name of new Desert Sun Marina. Thanked Phil Armstrong, Planning Technician for all his work. Business Plan updates presented by Department heads Splash Park equipment has been purchased. Fundraising continues for installation of equipment. Call out to trades to volunteer their time. Councillor Ryan: Attended IH Healthy Living Fair. Contacts with dieticians about healthy foods for public gatherings Attended marina dedication Okanagan International Choir - wonderful performance and was well-attended Hoped everyone voted Spent holiday weekend with family Councillor McKortoff: Attended Festival of the Holy Spirit procession, dinner and show sponsored by Portuguese Society of Osoyoos. Great community spirit. Canada Business Walks take place May 27, 28 and 29. EDAC, Council, Chamber of Commerce and DO Board members will visit businesses, find out how the business is doing, what can be done to assist the business. Accessorize Fashion Show funds to Desert Sun Counselling Centre on May 29 th. Bring a purse as a donation and purchase a new one for $10. Paraiso Events and Signature Moments are new to Osoyoos Councillor Rhodes: Last week held special open meeting for directors to report on projects in their departments. Thanked CAO Romanko and all directors for providing their reports. Shop local benefits asked merchants to do their part as well. Artificial increase in cost of fuel over long weekend. Average cost on Saturday of long weekend New Brunswick $123.9, Ontario $125.7, Manitoba $128.8, Alberta $123.9, Osoyoos $141.9 per litre. 6.
