1 OFFICIAL PROCEEDINGS DUNN COUNTY BOARD OF COUNTY COMMISSIONERS August 16, 2017 Minutes MEMBERS PRESENT: Commissioners Hauck, Scott, Pelton and Dukart OTHERS PRESENT: Auditor Dolezal, States Attorney Merriman, Road Superintendent Zimmerman, Mike Buresh, Gary Schmidt, Jeremy Wood and Darin Schaeffer. Chairman Hauck called the meeting to order at 9:01 a.m. Additions to the agenda: Burned houses in Manning Fair Board request for one mill. Wayne Craig of Pro-Tec, Gary Schmidt and Mike Buresh appeared to discuss options of moving the current courthouse generator to the weed shop for the Emergency Operations Center or to the road shop in Halliday. The generator that currently backs up both the weed shop and the road shop does not have enough capacity for both buildings. Motion by Commissioner Dukart, seconded by Commissioner Pelton, to accept the proposal from Pro -Tec to wire the weed/road shop generator exclusively to the road building. Upon roll call vote, all members voted aye, and the motion carried. Wayne will assess the electrical updates necessary at the Halliday shop before making a decision on moving the courthouse generator. Motion by Commissioner Dukart, seconded by Commissioner Scott, to table discussion on the generator options for the weed building and Halliday shop. The motion carried. Darin Schaeffer, Bartlett and West appeared to update the Commission on the status of 2 nd Street NW and the Eckelberg Road projects. Jeremy Wood, Northern Plains Engineering appeared to report on the construction projects his firm is working on. Road Superintendent Zimmerman and Del Olson appeared to report on the Road Department. Motion by Commissioner Pelton, seconded by Commissioner Scott, to approve the utility permits. Alll members voted aye, and the motion carried. Nicole Bement and Sheldon Portwine, XTO appeared to request a section line encroachment

2 located between section and section Motion by Commissioner Dukart, seconded by Commissioner Scott, to approve with stipulation that XTO follow up with the old well site encroachment. All voted aye, and the motion carried. Carie Boster, JDA Director appeared and presented the name of Shasta Patterson to serve out David Walth s term on the JDA Board. Motion by Commissioner Pelton, seconded by Commissioner Scott, to appoint Shasta Patterson to the JDA Board. All members voted aye, and the motion carried. Sandy Rohde, Code Administrator and Joel Quanbeck, KLJ Planner, appeared to present the draft text amendment for special waste landfills, as recommended by the Planning and Zoning Commission. Mr. Quanbeck presented an overview of the text amendment for the Commission s consideration. The Commission discussed the following items in the text amendment: 1. Double soil borings 2. Engage expert consulting firm to assist site and application review process foot ownership/lease/setback from landfill facility 4. Landfill operations/material transport 5. Cover material 6. Financial assurances 7. Interstate commerce Motion by Commissioner Dukart, seconded by Commissioner Pelton, to table until the September 6 th commission meeting. The motion carried. Melissa Pavlicek, Social Services Director appeared to report on Social Services and presented her proposed 2018 budget. Janet Wanek, Extension Service, appeared to report on the Extension Services and presented the proposed 2018 budget. Ms. Wanek reported that forty-five youth participated in Achievement Days. Denise Brew, Emergency Manager appeared to discuss discontinuing the total burn ban. Denise recommended that the ban now follow the fire index with the exception of no garbage pits and large control burns allowed. Motion by Commissioner Dukart, seconded by Commissioner Pelton to implement the burn ban as recommended by the Emergency Manger. All members voted aye, and the motion carried. Motion by Commissioner Pelton, seconded by Commissioner Scott, to approve the following Emergency Declaration for the July 20 th storm that caused extensive damage in the county:

3 Emergency Declaration Whereas, the county of Dunn suffered damages to trees, homes, farmsteads, fence lines, businesses, including McKenzie Electric Rural Electric Coop which sustained 1.1 million dollars in damages; and other public infrastructure caused by winds associated with a severe thunderstorm occurring on July 20, 2017, and Whereas, the impact of these damages threaten the health, well-being, and public safety of the citizens of Dunn County, and Whereas, the cost of cleanup, repair and replacement of such damaged facilities is in excess of available county resources. NOW, THREFORE BE IT RESOLVED that the Board of County Commissioners declare an emergency and order the activation and utilization of the Dunn County Emergency Operations Plan, its procedures, attachments and appendices to monitor the situation, develop a detailed damage assessment, alleviate hardship, and initiate appropriate relief actions and mitigation measures by departments and agencies of county government to limit the hardships and impact of this emergency upon the citizens of the County of Dunn. All members voted aye, and the motion carried. Pat Merriman, States Attorney reported on his 2018 proposed budget. States Attorney Merriman informed the Commission that he will be conducting a two day class in Williston for crime scene control with eight different agencies participating. At 12:14 p.m. the Commission recessed for lunch and reconvened at 1:10 p.m. with Commissioners Pelton, Dukart and Hauck present. Commissioner Scott left the meeting to attend a Statewide Interoperable Radio Network [SIRN] meeting in Dickinson. Dessie Calihou, Human Resources appeared to report on the HR, Risk Management and Wellness 2018 proposed budgets. Tracey Dolezal, Auditor reported on her department s 2018 proposed budget. Denise Brew reported on the Emergency Management 2018 proposed budget. Sheriff Clay Coker appeared to report on the Sheriff Departments 2018 proposed budget. Discussed truck weight enforcement on county roads. Motion by Commissioner Dukart, seconded by Commissioner Pelton, to add one FTE to the 2018 Sheriff s budget to allow for additional personnel for truck weight enforcement. Upon roll call vote, Commissioners Pelton, Dukart and Hauck voted aye, and the motion carried.

4 Sandy Rohde, Code Administrator appeared to discuss the 2018 proposed Planning and 911 budgets. Commissioner Pelton will discuss the Planning and Zoning contract for legal counsel with Attorney Ari Johnson. Discussed the 911 Coordinator position. Motion by Commissioner Pelton, seconded by Commissioner Dukart, to approve $500 per month for the 911 Coordinator in the 2018 proposed budget. Lisa Guenther, Clerk of Court and Recorder appeared to report on her 2018 proposed budgets. Lisa recently completed and received certification for a two year program in court management. By consensus the Commission agreed to a $3000 per year adjustment to her salary and expressed compliments for her taking the initiative to obtain the certification. The Commission thanked the department heads for the good job in putting together their respective 2018 budgets. Discussed whether the commission would consider hosting a regional public information meeting at the HPCC on topic of zoning for medical marijuana growers. Motion by Commissioner Dukart, seconded by Commissioner Pelton to host a regional public information meeting. All members voted aye, and the motion carried. Commissioner Scott had indicated that she will work with Administrator Rohde and Vision West to plan the meeting. Discussed the need for cleanup of the burn site in Manning. Commissioners Hauck and Scott will conference call with the owner. Commissioner Dukart reported that WDEA looking at drafting a revamp of the oil gross production tax and trying to keep impact grants in western ND. AE2S doing a study and WDEA is requesting matching funds from members to help cover the cost of the study. WDEA is asking for $7500 from McKenzie and Dunn Counties. Motion by Commissioner Pelton, seconded by Commissioner Dukart, to pay $7500 for the study. Upon roll call vote, all members voted aye, and the motion carried. Auditor Dolezal presented a letter from the Dunn County Fair Board s requesting the continuation of one mill in the 2018 budget. By consensus the Commission agreed not to hold a special ground breaking event for the courthouse project on September 6 th.
