1 OFFICIAL PROCEEDINGS DUNN COUNTY BOARD OF COUNTY COMMISSIONERS July 15, 2015 MEMBERS PRESENT: Commissioners Pelton, Dukart, Scott, Kleemann and Hauck OTHERS PRESENT: Tracey Dolezal, Pat Merriman Darrin Schaeffer, Fil Askerland Kent Wilkerson, Mike Zimmerman and Del Olson The meeting was called to order by Chairman Hauck at 9:00 a.m. Additions to the agenda: New England Detention Center Bids for lighting on the North end of the Courthouse Frank Saetz appeared to discuss his concern with water backing up onto his property adjacent to the New Hradec Road. Following discussion the consensus of the Commission was to lower the culvert on Mr. Saetz approach to help divert the water in the right of way to run through the culvert. Engineer Darrin Schaeffer, Bartlett and West appeared to report on the projects his firm is working on. Wannemacher Road Phase 1: Cement treated subgrade being finished this week and the gravel surfacing should be finished by the end of next week. Discussed Martin Construction s request for a contract extension on the Wannemacher Phase 1 project due to the changes in the scope of the project. Motion by Commissioner Dukart, 2 nd by Commissioner Kleemann, to grant a formal contract extension to Martin Construction until August 15 th with a final completion of October 1, All members voted aye, and the motion carried. Discussed the safety concern on 104 th between 16 th and 19 h Ave SW. Engineer Schaeffer presented preliminary data outlining the sight distance and safety concerns. Engineer Schaeffer will work on some preliminary options for the Commission s consideration. Fil Askerlund, Epic Engineering, appeared to report on the South Heart project and presented Knife River Construction s pay estimate # 2 in the amount of $1,717, Motion by Commissioner Dukart, 2 nd by Commissioner Scott, to approve pay estimate #2. Upon roll call vote, all Commissioners voted aye, and the motion carried. Mr. Askerlund stated that Phase 3 right-of-way acquisition and final plans are near completion. Justin Hyndman, KLJ, appeared to update the Commission on the Stream Restoration project. Walk through and weed inspection will be July 16 th at 8:00 a.m.
2 Curt Glascoe, Technical Support Representative for Local Technical Assistance Program (LTAP) appeared to introduce himself and to report on the many LTAP programs and services available to counties. Mr. Glascoe thanked Dunn County for hosting some of the LTAP training events. Greg McCormick and Darwin Engzminger representing Northern Improvement appeared to request the County s approval to accommodate movement of their equipment between work areas on the SW Water Pipeline Project. Motion by Commissioner Kleemann, 2 nd by Commissioner Pelton, to approve Northern Improvement s plan for the SW Water Project. All voted aye, and the motion carried. Sandy Rohde, Code Administrator, appeared and presented the applications that were approved at the July 14 th Planning and Zoning hearing. Motion by Commissioner Scott and 2 nd by Commissioner Kleemann, to approve the following applications. 1. Tressia Contreras, Gordon Schoonover & Jason Schoonover of Tempe AZ, representing Bakken Aggregates filed a Conditional Use Permit for a 18.1 Acre Scoria Pit located in the NE4 of section The property is zoned Rural Preservation and owned by James and Linda Wallace. 2. Jeff Schmidt of Killdeer, ND filed a Conditional Use Permit for a Temporary Water Depot with up to 10 Frac Tanks from 3 dams and holding pond. The property is located in the NE corner of the NE4, section , zoned Rural Preservation and owned by Jeff & Shelley Schmidt. 3. Patrick Coyle & Christ Marshall of Tulsa OK, representing WPX Energy Williston, LLC filed a Conditional Use Permit for an Industrial Support Office. The property is located on Lot 2 Blk 1 Killdeer Industrial Park lying in the NW4 of section The property is zoned Rural Development and owned by WPX Energy Williston, LLC. 4. Warren Smith of Halliday ND, filed a Conditional Use Permit for a Temporary Water Depot piped to well sites with the possibility of 10 Frac tanks in the future located in the NE4SE4 of section The property is zoned Rural Preservation and owned by Warren Smith. 5. Shirley Kleemann of Killdeer, ND filed a Conditional Use Permit for a Temporary Water Depot that will be piped to well sites. The Water Deport is located in the SE4SE4 of section The property is zoned Rural Preservation and owned by Shirley Kleeman. 6. Mark Knight of Webster SD, representing Foothill Contracting, Inc. filed a Conditional Use Permit for a 7 acre borrow pit located in the SW4 of section The property is zoned Rural Preservation and owned by Anton Stroh. 7. Mark Knight of Webster SD, representing Foothill Contracting, Inc. filed a Conditional Use Permit for 6-7 acre borrow pit located in the NW4 of section The property is zoned Rural Preservation and owned by Dean Dvorak. 8. Mark Knight of Webster SD, representing Foothill Contracting, Inc. filed a Conditional Use Permit for Equipment and Material Storage located in the NW4 of section The property is zoned Rural Preservation and owned by Dean Dvorak. 9. Mark Knight of Webster SD, representing Foothill Contracting, Inc. filed a Conditional Use Permit for Equipment and Material Storage located in the SE4 of section The property is zoned Rural Preservation and owned by Willard and Irene Kovaloff

Motion by Commissioner Scott, 2 nd by Commissioner Pelton, to approve the following application: Brent LaPierre and Jason Vohs of Williston ND, representing Source Solution, LLC filed a Conditional Use Permit for a Water Depot with up to 10 Frac Tanks located in the SW4 of section The property is zoned Rural Preservation and owned by Greg Tabor. Upon roll call vote, Commissioners Scott, Pelton, Dukart and Hauck voted aye, Commissioner Kleemann abstained. The motion carried. Sheriff Clay Coker appeared to report on the Sheriff s Department. Discussed the old Dunn County Rod and Gun Club shooting range located in section and the possibility for it to be used by law enforcement as a county firing range. Motion by Commissioner Pelton, 2 nd by Commissioner Dukart, to have the States Attorney continue to pursue a lease or purchase of the Property. All members voted aye, and the motion carried. Becky Buchmann, County Extension Agent, appeared to report on the Extension Service. Fifty-five 4-H static projects and twenty-eight animals are registered for this year s fair. Jeremy Wood, Northern Plains Engineering appeared to report on the projects his firm is Working on. Kisse Bridge is expected to be bid in November with 2016 construction. 97 th Ave from ND 200 to 7 th Street: A bid opening has been scheduled for August 5 th. Construction is expected in Gas Plant and Tank Battery Road Bids will be held until August 5 th as there are outstanding easement issues which are expected to be resolved soon. Emanuel Stroh and Doug Wilder appeared to discuss the water leak to the Manning Waterworks system on the SW corner of the courthouse property. The water leak resulted in a loss of approximated 800,000 gallons of water. The leak was found where the water ties into the courthouse. Mr. Stroh requested that the county assist by covering some of the cost of the repair and water loss. The water loss cost is $4670 with $1400 cost of repairs, for a total cost of $6070. Motion by Commissioner Dukart. 2 nd by Commissioner Scott, to pay $3070 to Manning Waterworks for water loss and repairs. Upon roll call vote, all members voted aye. and the motion carried. Mr. Howard Johnson appeared to request his assessments to be lowered further on his Werner property. No action was taken at this time. HR Director, Denise Giffin submitted a request for out of state travel and registration to attend the 2016 SHRM Conference in Washington DC. There are significant cost savings
4 for early registration. Motion by Commissioner Dukart, 2 nd by Commissioner Scott, to approve the registration fee of $995. Upon roll call vote Commissioners Scott, Pelton, Dukart and Hauck voted aye. Commissioner Kleemann voted nay. The motion carried. Auditor/Tax Director Dolezal reported on the progress of the Tax Director s office and recommended the appointment of Bonnie Bell as Tax Director effective July20 th, Motion by Commissioner Scott, 2 nd by Commissioner Kleemann, to appoint Bonnie Bell as Tax Director. All members voted aye and the motion carried. Commissioner Scott reported that the New England Women s Correctional Center is requesting an old pickup that they can use for maintenance. Motion by Commissioner Dukart, 2 nd by Commissioner Pelton, to provide the Correctional Center with a retired County pickup as soon as one becomes available. All members voted aye, and the motion carried. Commissioner Dukart reported on the educational seminars that he attended at the National Association of Counties Conference. Auditor Dolezal presented bids from Denny s Electric and Electric Sales & Service for lighting for the north end of the courthouse and parking area. Motion by Commissioner Pelton, 2 nd by Commissioner Kleemann, to approve the $3550 low bid from Electric Sales & Service. Upon roll call vote, all members voted aye, and the motion carried. The Commission discussed the Industrial & Special Waste landfill committee. Several names were presented as possible committee members. Commissioner s Scott and Pelton will work on organizing the committee. Road Superintendent, Mike Zimmerman and Del Olson, appeared to report on the Road Department. Motion by Commissioner Pelton, 2 nd by Commissioner Dukart, to remove from the table discussion on the Werner property assessments. It was noted that there was a 2011 sale for $1350 for two lots in Werner. Motion by Commissioner Scott, 2 nd by Commissioner Dukart, to accept the proposed Werner property values as recommended by the Tax Director. Upon roll call vote Commissioners Scott, Pelton, Dukart and Hauck voted aye. Commissioner Dukart voted nay. The motion carried. Motion by Commissioner Kleemann, 2 nd by Commissioner Scott, to approve Oneok s utility permit. All members voted aye, and the motion carried.
5 Mickey Wetsch, Kathleen Stroh and Toody Haugen appeared to express their views against the High Plains Community Center. Commissioner Hauck reported that he and Commissioner Pelton met with members of the Fair Board to discuss options going forward. The Fair Board would like to see the HPCC continue with the use as was intended. The county is in need of office space for Social Services, Public Health, JDA and Extension Services. There will be another meeting scheduled with the Fair Board.
